ICEM energy and mining affiliates in West Africa set ambitious priorities and work commitments in Dakar, Senegal, on 7-8 April. In workshops sponsored by the Friedrich-Ebert Foundation (FES) of Germany, unions of the region focused on specific growth strategies, the increasing threat of use of casual labour by multinational enterprises, and the necessity of West African nations to ratify ILO Convention 176, the Health and Safety in Mines Convention. 
 
Representatives from 13 trade unions in 11 countries participated in the two-day forum. The workshops were unique in that individual unions stepped forward and pledged to lead cross-union efforts in specific areas. 
 
&quot;The entire resolve coming from the workshops underpins the commitment by ICEM West African affiliates to build strong and democratic unions in which to challenge multinational companies,&quot; said ICEM Sub-Saharan Representative Fabian Nkomo. &quot;We have committed to challenge the exploitation of workers that leaves both communities and countries very poor.

&quot;It is a commitment to help democratic countries improve the lives of ordinary people, but also a challenge to non-democratic governments to democratise,&quot; added Nkomo. &quot;In short, it is a call for better lives for all citizens in West African countries.&quot; 
 
All ICEM trade union affiliates of the region will consolidate their three- and four-year plans on growth strategies with each other. Those plans will center on leadership accountability to trade union members, and ownership of trade union structures by rank-and-file members. 
 
With West Africa fast becoming a hub of upstream oil and gas production, the Nigerian trade unions, NUPENG and PENGASSAN, took on responsibility to lead a campaign against casualisation, or the growing use of Contract and Agency Labour (CAL). The two unions will lead a mobilisation to build formidable trade unions in oil- and gas-producing nations of West Africa.

The Ghana Mine Workers' Union (GMWU) will lead the push for adoption of ILO Convention 176 in West African nations, as well as to develop and mobilise a cross-region campaign toward that end. 
 
A further commitment was made by participating trade unions to propose a Social Charter to the Economic Community of West African States (ECOWAS). That charter will specifically include adherence to all core ILO labour standards. ICEM Sub-Saharan African CAL Coordinator Joseph Toe and Ayikoue Teve of CSTT in Togo will head that effort. 
 
Finally, West African trade unions promised to spread training and education activities throughout their unions, and not to limit such opportunities only to individual leaders. 
 
The ICEM is grateful to FES for sponsoring the workshops; a forum that ICEM believes can be a turning point in trade union development in West Africa.

West African ICEM Unions Formulate Specific Goals in FES Workshops

Negotiations to end a national dispute across Sweden's pulp and paper sector failed last night, 18 April, at midnight when ICEM affiliate Svenska Pappers and the employers' Forest Industry Association (SFIF) adjourned bargaining. 
 
The two sides are to try again today, 19 April, at 18h00. 
 
The union held true to its promise to strike six pulp and paper mills on 16 April. Those six mills, employing 3,000 of Sweden's 18,000 paperworkers, are now facing ongoing strikes. 
 
They include: Billerud Skarblacka; Holmen Braviken; the Holmen Iggesund mill in Korsnas; Stora Enso&rsquo;s Skoghall Mill; SCA Packaging in Munksund; and Sodra Cell's Varo pulp mill.

On 15 April, two days following a marathon bargaining session also failed, the Swedish Paperworkers' Union (Svenska Pappers) announced that workers at six more mills would strike at 18h00 on Monday, 26 April, if no agreement is made. 
 
Those mills include: Smurfit-Kappa's mill at Pitea, the SCA Obbola mill, Stora Enso's Fors mill, the Korsnas Frovi mill, Billerud's Gruvon mill, and Sodra's Monsteras pulp mill. Those six mills employ 2,800 Pappers members. 
 
The central issues are pay and ensuring that Swedish paperworkers receive a 2010 salary increase backdated to 1 April, the date of a prior three-year contract expiration; items related to a pension scheme; an adequate increase for the lowest paid workers in the industry; and an assurance on union consultation when temporary workers or labour agencies are used for employment.

Swedish Paper Strike Continues

Some 70 protestors from the UK, Netherlands, and Belgium demonstrated with locked-out members of the US International Longshore and Warehouse Union (ILWU) in London last week. The venue was the Annual General Meeting (AGM) of Rio Tinto, the global mining company that maliciously, on 31 January, locked 560 members of ILWU Local 30 off their jobs in Boron, California, before reaching impasse in collective bargaining. 
 
The manifestation at the AGM was organised by the International Transport Workers' Federation (ITF), with support from the ICEM and the International Metalworkers' Federation (IMF). Several NGOs, including the London Mining Network, joined the labour rally, bringing with them a host of Rio Tinto's environmental atrocities from Papua New Guinea to Indonesia, to Madagascar, and Mongolia.

Inside the meeting, Rio Tinto CEO Tom Albanese fielded questions regarding the company's conduct for nearly two hours. Local 30 bargaining committee member Dave Irish queried why Rio Tinto was willing to take deep revenue drops through lost production brought on by the lockout, while at the same time imposing economic hardships on 560 working families. 
 
Albanese's answer was polite, but succinct in capturing the general philosophy of corporations everywhere: prioritising profits before people. He said Rio Tinto's rollbacks on working terms and conditions at Boron were necessary in order to bring ILWU Local 30's collective agreement more in line with other company enterprises in North America. 
 
That answer was clear. Despite massive profits driven mainly by iron ore, copper, and coal -- and even by the relatively small Rio Tinto Minerals, which controls a 45% market share of the global borates business -- the London/Melbourne-based mining house subscribes to &quot;the race to the bottom&quot; philosophy of suppressing human and social benefits.

Following the meeting, ILWU Vice President Ray Familathe caught up with Albanese in a corner of the Queen Elizabeth II Convention Centre. He told him the company's strong-arm bargaining methods in California will surely backfire, including galvanizing the global trade union movement to pressure the company in any way possible. 
 
The ILWU has already begun that backlash by vigorously lobbying the US government to delay a land swap between the government and Rio Tinto in the state of Arizona in which the company was to gain valuable copper deposits. 
 
For the ILWU, the European trip also meant a strongly worded resolution in support of Local 30 be the European Works Council of Alcan, a Canadian-based metals producer that Rio Tinto acquired in 2007. That effort was spearheaded by the Metalworkers' affiliate of French CGT. 
 
A day after the London AGM of April 15, the American union also did protest actions against Rio Tinto at British consulate offices in the US cities of Los Angeles, San Francisco, Seattle, Boston, and in Vancouver, Canada.

Perhaps not coincidentally within last week's trade union actions, Rio Tinto Minerals and ILWU Local 30 did return to bargaining on 14-15 April, the first set of talks since the lockout began. It was a fact noted by Albanese from the dais of the AGM, but clearly missing was any willingness by Rio Tinto to budge from its concessionary proposals. In California, the two sides adjourned late on 15 April without making any meaningful progress. 
 
This week, on 22 April, Rio Tinto is scheduled to replicate its AGM in Melbourne and the ILWU will be there. Shareholders will hear Secretary-Treasurer Willie Adams and locked-out Local 30 activist Terri Judd tell of the anguish faced by Mojave Desert, California, families. They will have the support of the Construction, Forestry, Mining, and Energy Union (CFMEU) and the Maritime Union of Australia (MUA). 
 
Again, Albanese will be questioned on why the company he heads needs unprecedented givebacks by workers of their holidays, their seniority rights, their health care protections, and why Rio Tinto needs to infringe on full-time, direct employment in seeking to gain greater latitude to outsource jobs.

 Rio Tinto is a multi-billion dollar global corporation that mines and processes aluminum, coal, copper, diamonds, gold, iron ore and uranium, as well as industrial minerals including borates, titanium dioxide, salt and talc. 
 
 The company is based in London and Melbourne, Australia and traded on the London, Sydney and New York Stock Exchanges. 
 
 Rio Tinto is the 3rd largest mining company in the world, operating in more than 50 countries on six continents, with the majority of production occurring in Australia and North America.

About Rio Tinto&rsquo;s Borate Business 
 
 Rio Tinto&rsquo;s borate mining and processing business is part of its Diamonds &amp; Minerals product group, which reported net earnings of $800 million in 2009. 
 
 The company&rsquo;s borate business consists primarily of its mine &ndash; the largest borate deposit in the world &ndash; and processing plant in Boron, California, USA. Rio Tinto also operates a small borate mine and processing plant in Argentina, as well as plants and/or distribution facilities in Wilmington, California, France, Spain and the Netherlands. 
 
 Rio Tinto supplies nearly half the world&rsquo;s demand for refined borates. Together with Etimine of Turkey, Rio Tinto enjoys a virtual monopoly on the global borate market. 
 
 Borates are industrial minerals with a wide variety of uses, including glass, ceramics, fertilizer, detergents and wood treatments. 
 
 Although Rio Tinto often tells reporters that it has lost 25% of its share of the borate market in order to garner sympathy and justify its attack on families in Boron, the company&rsquo;s claim has never been independently substantiated. Rio Tinto does not report publicly on the financial performance of its borate business. Like most companies, Rio Tinto has been temporarily impacted by the economic recession, but the outlook for Rio Tinto&rsquo;s future is bright and already improving. In his &ldquo;State of Business&rdquo; address in August 2009, Rio Tinto Vice President Chris Robison said, &ldquo;the financial position of the company is very strong.&rdquo; Independent experts predict demand for borates will increase significantly in 2010, mainly due to the growth in Chinese manufacturing. China is Rio Tinto&rsquo;s largest destination market. 
 
About the Mine in Boron 
 
 Located in the Mojave Desert, about 100 miles northeast of Los Angeles, the Boron mine is the largest open-pit mine in California. 
 
 The mine has been operating since borates were first discovered in Boron in 1925. The facility was acquired by Rio Tinto in 1967. 
 
 The mine serves Rio Tinto&rsquo;s borate customers in almost 100 countries around the world. 
 
 There are about 570 hourly workers at the mine, many of whom have worked their entire lives at the facility. Some employees have more than 40 years of experience there. 
 
About the Lockout 
 
 On January 31, 2010, Rio Tinto locked out about 570 hourly workers from the Borax mine. 
 
 Employees had refused to accept Rio Tinto&rsquo;s concessionary contract ultimatum. Their demands included allowing the company to convert good jobs into temporary, part-time or outsourced positions. 
 
 Since the lockout, Rio Tinto has replaced its experienced, skilled workforce with workers from its other facilities and with contract workers supplied by Gettier Security, a Wilmington, DE-based company that specializes in providing workers to firms engaged in strikes or lockouts. 
 
 The locked out families are relying on unemployment insurance and other forms of public assistance to help feed their children and pay mortgages.

Facts About Rio Tinto and the Lock Out in Boron, California

Two global trade union federations whose affiliates represent over 45 million workers, together with four Norwegian trade unions, have asked the Council on Ethics of the Government Pension Fund of Norway to divest its holdings in the Mexican mining conglomerate Grupo Mexico because of alleged labor and environmental violations. 
 
The International Federation of Chemical, Energy, Mining and General Workers&rsquo; Unions (ICEM) and the International Metalworkers Federation (IMF) sent a <a href="/wp-content/migration/icem/Ltr_to_Ethical_Council-Mexico.pdf">letter</a> requesting the divestment to the Council on Ethics, which is charged with overseeing responsible investments of the Government Pension Fund, the second largest pension fund in the world. Grupo Mexico is accused of labor rights violations, environmental destruction and shareholder fraud. The letter also requests divestment in Southern Copper, Grupo Mexico&rsquo;s wholly-owned subsidiary.

&ldquo;We are supporting this action on behalf of trade unionists in Mexico to call attention to the extreme abuses of Grupo Mexico and to ask the Council on Ethics to drop Grupo Mexico as an investment in accordance with the Fund&rsquo;s very high standards and Norwegian law,&rdquo; said Fellesforbundet President Arve Bakke. &ldquo;The wealth of future generations in Norway must not be invested in companies which systematically attack labor unions and damage the environment, as Grupo Mexico has done.&rdquo; 
 
Manfred Warda, ICEM General Secretary, stated, &ldquo;We have national mining unions in over 60 countries, and nowhere have we found more despicable behavior than that demonstrated by Grupo Mexico.&rdquo; 
 
The overt attempt by Grupo Mexico to crush the National Union of Mine and Metal Workers of the Mexican Republic (SNTMMSRM or Los Mineros) and gross violations of workers&rsquo; rights to freely associate and collectively bargain as defined by the International Labor Organization are core arguments for divestment set forth in the letter. 
 
&ldquo;The illegal practices of Grupo Mexico, unfortunately supported by a corrupt Mexican government, include seizing the union&rsquo;s assets, attempting to replace the legitimate union with one selected by the company, and launching a protracted campaign of repression against the union&rsquo;s leadership,&rdquo; said IMF General Secretary Jryki Raina, 
 
In August 2007 the government and Grupo Mexico forced workers at eight mines to join a company-sponsored union using &ldquo;elections&rdquo; in which workers had to vote publicly in front of their employer. One union leader has been imprisoned without bond since December 2008. There are also credible allegations that Grupo Mexico is responsible for the violent deaths of two workers on two separate occasions. 
 
Despite these attacks, Los Mineros continues to negotiate wage increases across the country that average twice the government-imposed wage cap, which unions believe is a major motivation for Grupo Mexico&rsquo;s attacks. It is especially noteworthy that Los Mineros maintains non-confrontational labor relations with most employers and has some 70 collective bargaining agreements with multinational employers such as Goldcorp, Bombardier and ArcelorMittal.

The company is accused of gross health and safety violations at the Pasta de Conchos mine, where 65 workers died in an explosion in 2006, and the copper mine at Cananea, where workers have been on strike since July 2007. 
 
Studies of Grupo Mexico smelter operations in Mexico illuminate the company&rsquo;s shameful environmental record where abnormal levels of toxic minerals such as lead, zinc, copper, cadmium, mercury, and magnesium were found among the general populations, including high levels of arsenic and cadmium among children. In Peru, Grupo Mexico was forced to pay hundreds of millions of dollars to remediate its contamination of water and air. In Chile the company is accused of developing a mining project on indigenous land without consultation with local natives or assessing environmental damage. 
 
According to sources cited by the trade unions submitting the letter, the cost to shareholders of Grupo Mexico&rsquo;s abysmal labor practices exceeds $3 billion (USD) on top of the hundreds of millions required to remediate the company&rsquo;s environmental destruction in Peru. Grupo Mexico was convicted by a U.S. court in 2009 of defrauding shareholders of a wholly-owned subsidiary. Another subsidiary has been linked to drug trafficking. 
 
Covalence Ethical Quotation System, which tracks the ethical reputation of multinational companies, ranked Grupo Mexico 573rd out of 581 global companies in 2009. 
 
The trade unions and labor federations submitting the request for disinvestment anticipate that the Council on Ethics will thoroughly investigate the information and make an expedient decision to divest. 
 
Los Mineros is affiliated with both the ICEM and IMF. The Norwegian trade unions signing the letter include Fellesforbundet, Handel og Kontor i Norge, Industri Energi and Norsk Arbeidsmandsforbund.

Trade Unions Ask Norwegian Pension Funds to Divest of Grupo Mexico Shares

The 30,000 technical and professional employees of PEMEX, Mexico&rsquo;s large state-owned petroleum company, finally won the right to unionize upon their third attempt. The new union, &ldquo;Uni&oacute;n Nacional de T&eacute;cnicos y Profesionistas Petroleros&rdquo; (UNTyPP), received its registration on 16 December, and its leadership was officially recognized for the period beginning 18 March, 2008 through 17 March, 2012. The first two attempts at unionization (ONTCIP and UNTCIP) were denied registration by the government and the leaders fired. 
 
Following the successful court battle, culminating in registration from the Secretary of Labor and Social Welfare&rsquo;s office for the Registration of Associations (STPS), members of the new union were informed by company management that in order to retain their jobs they were required to sign two documents, one calling for the cancellation of the registration and the other a resignation from the union. 
 
Those who refused, along with organisers of the UNTyPP, were fired and violently removed from their workstations by paramilitaries, including the entire National Executive Committee of the union1. These workers must be immediately reinstated, and their rights respected under both Mexican and International law. PEMEX is also being urged by the international labour movement to accept union calls to come to the bargaining table and establish a working relationship with them. 
 
UNTyPP organisers have faced continued intimidation and threats throughout their campaign for registration. 
 
PEMEX is the 10th largest oil company in the world, and is the sole supplier of all commercial petrol and diesel stations in Mexico. Annual company revenue is US$78 billion.

Mexican PEMEX Workers Win Registration for New Union, Face Continued Repression

Today, International Women&rsquo;s Day, was marked in Geneva with a large demonstration at plaine de Plainpalais, between 12pm and 2pm. The ICEM, along with other Geneva-based Global Union Federations turned out in support. 
 
The manifestation, organized by ICEM&rsquo;s Swiss affiliate UNIA, protested the issues of raising the retirement age of women, fighting for gender equality on wages, the effective application of equality legislation, protesting against the proposed lengthening, in Switzerland, of opening hours of shops, this sector employs more women than men.

On 23 March, 8,000 members of the ICEM affiliate in the UK, GMB, voted for strike action against British Gas by 82%. Upon releasing the ballot results, GMB General Secretary Paul Kenny said, &ldquo;It is now time for them to sit up and take notice. We are giving British Gas a week to give us a constructive response.&rdquo; 
 
Last week, GMB got that constructive response. The electric and gas utility that is owned by Centrica Plc. began positive discussions with the union and as a result, threatened strike action was halted. 
 
GMB and management of British Gas issued a joint statement saying a new relationship will be &ldquo;built on trust and the ability to have frank, honest debate.&rdquo; The two sides will use the month of April to engage in substantive negotiations on pay and work conditions. &ldquo;Neither party will be seeking to undermine the other in these talks,&rdquo; read the statement.

As a start, the company has separated a performance management process from arbitrary discipline, something that had been used indiscriminately in recent months to reprimand engineers, service and repair mechanics, and other workers. The union and company also agreed to zero tolerance on bullying, an issue brought forward through a GMB workers&rsquo; survey that revealed overwhelmingly that a &ldquo;bullying management culture&rdquo; had set in. 
 
The two sides agreed also to job times. Kenny said last week&rsquo;s &ldquo;discussions have not been easy, but we do now have a platform on which to build relations. 
 
&ldquo;It is positive that the company respects the position of GMB.&rdquo; 
 
British Gas Managing Director Phil Bentley stated, &ldquo;We remain committed to growth and as British Gas grows we want to create an environment in which our union relationships develop with us. Looking forward, we have the opportunity to work together with GMB to agree a new and exciting future for our engineers.&rdquo; 
 
GMB&rsquo;s 21 national shop stewards at British Gas will meet this week with management to formalise the process forward. A short two months ago, GMB and British Gas were completely polarised, as reflected in <a href="/en/78-ICEM-InBrief/3604-GMB-to-Take-Strike-Ballot-at-British-Gas-This-Week ">this</a> ICEM dispatch then. The ICEM commends our British affiliate, and senior management of the company, in establishing the proper social protocol to resolve outstanding issues.

GMB Lifts Strike Action Against British Gas; Positive Dialogue Takes Hold

With the support of the International Trade Union Confederation (ITUC), trade unions in Iraq have come together to create a campaign and a website, calling for international solidarity and pressure on the government of Iraq to enact fair labour legislation. Seven years after the fall of Saddam Hussein&rsquo;s regime, workers in Iraq are still without legislative protection of their fundamental rights at work. 
 
The ICEM strongly supports the campaign, and urges all trade unions from all corners of the world to offer similar support by logging onto the website <a href="http://www.iraqitradeunions.org/cgi-bin/campaign1.cgi">here</a>&nbsp;and join the campaign. Many in the Iraqi government now perceive trade unions as government tools. However, momentum is building behind the campaign for free and independent trade unions, and fair and just labour laws. Important political figures inside Iraq are now pledging their support. These include former President Jalal Talabani, 85 members of Parliament, the Oil Minister, and many community and business leaders.

Hashmeya Muhsin, President of the GFIW-affiliated General Union of Electricity Workers and Technicians, and a member of the ICEM Executive Committee, is a key figure in the campaign. She recently told the ITUC in an interview that international solidarity and pressure are crucial in pushing the government to enact fair labour legislation. 
 
The key parliamentary drafting committee has consulted with the campaign's coordinating group, the National Labour Campaign Committee (NLCC), and MPs are petitioning for proposed legislation to be debated in Parliament. 
 
Despite the right to organize being clearly guaranteed in the new constitution, Iraq&rsquo;s government falls back on the blatant anti-union decree of the Saddam era. The current campaign calls for the abolition of Saddam&rsquo;s Law 150 of 1987, and Order 8750 of August 2005 by the occupation forces, which effectively froze all trade union assets and financial accounts, making it impossible for unions to function. 
 
Saddam&rsquo;s Law 150 bans all public sector employees from organising or striking. Some 90% of all Iraqi enterprises are considered part of the public sector, including oil, gas, electricity, textiles, and most other manufacturing sectors.

While several versions of a new labour code have been drafted, with the aid of the ILO, political opposition and a gridlocked Parliament has blocked progress. When the campaign is successful in abolishing the draconian anti-union measures of Saddam and the occupation forces, only then can elections to union office be held, free and without government interference. Free trade unions in Iraq will enhance nation-building and contribute greatly to establishing democratic institutions. 
 
Current evidence of the urgent need for new labour legislation is the government interference in the Iraqi Teachers&rsquo; Union (ITU). The government committee entrusted with overseeing the leadership elections of the union is attempting to install its preferred candidates into leadership positions. 
 
The ICEM calls on all its trade union affiliates to join this campaign. Now is the time to raise the profile that Iraqi trade unions have been working towards since 2003 &ndash; labour statutes that comply with international labour standards, and strong trade unions that can enforce those statutes and protect global standards.
