Making available a significant number of key statistics, including the ICEM’s own, as well as a wide range of “best practice examples,” the ICEM issued a new comprehensive presentation on “CAL and the ICEM CAL campaign.” Slide by slide, this education tool provides information on the ICEM’s national and international CAL work, highlighting, among many other items, what unions around the world are doing in their daily struggles against precarious work. The presentation can be found <a href="/sites/default/files/migration/icem/2010CAL.ppt" type="internal">here</a>. 
 
The statistics indicate that the phenomenon of short-term, contract, agency and other precarious work is still growing in almost every part of the world. On the other hand, there also is progress being made. In a lot of countries, for example, laws have been changed for the better. In other cases, unions managed to gain improvements for precarious workers through successful collective bargaining. Trade unions are also increasingly looking towards their own structures and strategies, aiming to better protect and defend often non-affiliated CAL workers.

New CAL Facts and Figures Overview 

Strike actions in April and a flurry of trade union activities over the past two weeks have succeeded in bringing formal recognition to the ICEM affiliate, Metallurgical, Mining, and Chemical Industry Workers’ Trade Union of Georgia, at the Zestafoni Ferroalloys Plant and the Georgian Manganese mines, some 40 kilometres from Zestafoni in Chiatura. 
 
That was reinforced on 13 May after the union, backed by the Georgian Trade Unions Confederation (GTUC), and top managers met for a second conciliation commission session and made headway towards resolving a host of demands put forward by workers. 
 
Miners and metalworkers were buoyed massively when, ten days after a three-day strike ended on 25 April that got management’s rapt attention, ICEM General Secretary Manfred Warda and Chemicals and Rubber Officer Kemal Özkan travelled to western Georgian to meet with workers.

Bringing pledges of solidarity from the ICEM and the International Metalworkers’ Federation (IMF), Warda told Georgian workers they were not alone. And speaking before regional news media and to workers directly, Warda assured all that the combined strength of the two federations was ready and willing to take this fight beyond central Asia if that was needed. 
 
The message underscored a resolve borne through several months of struggle, culminating in a series of April incidents, including grievous intimidation tricks (see prior ICEM report <a href="/en/78-ICEM-InBrief/3731-Miners-Metalworkers-Not-Intimidated-by-Georgian-Manganese-Managers" type="internal">here</a>) by management that served only to bring more staff into the Metallurgical, Mining, and Chemical Workers’ fold. 
 
Initially in the 13 May negotiations, managers and their attorneys sought involvement of an existing but dying “yellow” union in the talks. But the seven union members of the joint, bilateral commission threatened to walk out and begin renewed strike actions. The union and GTUC representatives then showed managers a large number of power-of-attorney statements by workers that expressed their allegiance to the Metallurgical, Mining, and Chemical Workers’ Union.

Recognition was achieved. The numerous petitions that workers demand to improve their working lives were then open for discussion. Foremost among them were wages. In the hours leading up to the talks, the ICEM and IMF scrambled to gather and succeeded in delivering wage rates from associated ferroalloy plants in Ukraine, owned by the metals arm of PrivatBank. 
 
Miners at the Georgian Manganese complex are paid an average monthly wage of GEL (lari) 450, or US$238, €192. Metalworkers at the ferroalloy plant in Zestafoni earn a monthly average of GEL 562, or US$298, €240. With both sides having already agreed to 1 May as the effective date for salary adjustments, management proposed a 15% increase for shift workers and 8% for day workers. 
 
This is unsatisfactory to the union side of the commission. But they are confident that further negotiations on 17-18 May, and again on 20 May, will bring long overdue percentage increases higher. The union did get a commitment at the 13 May set of talks that the enterprises will begin to comply with Georgia labour law regarding sick leave payments, including retroactive compensation for those workers who have been denied such pay. 
 
“It is a big step forward,” said Gocha Aleksandria, Vice President of the GTUC, who is a member of the 14-member conciliation commission. “The administration now accepts our union, but the hardest part is still ahead. We intend to achieve the obvious, meaningful, and tangible results for our members and that is permanent labour contracts that address all issues.”

Some of those issues include raising the number of yearly paid leave days from 30 (metal) and 32 (mining) to 35; creation of a joint contributory pension fund to supplement a miserly state pension; better safety and health conditions; and an upgrade to medical facilities. 
 
Even prior to the first commission negotiations, on 7 May, management reacted to workers’ militancy and ICEM’s mission statement of that week by agreeing to permanent work contracts, as well as reinstatement of two union leaders who were discharged for strike activities. (At the 13 May session, management agreed to pay the two their full April salaries.) 
 
Another accomplishment in the recent bargaining is that union leaders will bring their demands directly to Georgian shareholders of the enterprises. The complex ownership of the ferroalloy plant and manganese mines has stock ownership by privately-held Stemcor Holdings of the UK, with shares also traded publicly on the Georgian bourse with Georgia entrepreneurs and the Ukrainian oligarch Gennadiy Boholyubov and his manganese empire that is tied to PrivatBank holding vast sums. 
 
For now, the 3,600 miners and 2,200 metalworkers have a free and democratic union they can call their own – the Metallurgical, Mining, and Chemical Industry Workers’ Trade Union of Imereti Region. But as Aleksandria states, the journey now begins in earnest: erstwhile dialogue to gain the wage levels, benefits and work conditions that they justly deserve.

Recognition Realised for Georgian Miners, Metalworkers at Manganese Operations

The ICEM Executive Committee, meeting in Geneva on 26-27 May 2010, is deeply disturbed by the extraordinary high number of workplace deaths and injuries in recent months, particularly in mining and both upstream and downstream oil and gas industries. This deterioration in safety and health conditions is attributable, the Executive Committee believes, to the rush to maximize profits by corporations in the wake of the financial crisis, and a general disregard to follow best practices in safety and health by these same corporations and, in some cases, governments. 
 
The ICEM points to the 17 May mine explosion in Zonguldak province, Turkey, which killed 30 workers as just one example. The Karadon mine is state-owned, but private contractors without trade union representation and with limited experience on safety matters operate this mine. The ICEM also points to the tragic explosion in May of the Raspadskaya mine in the Kemerovo region of the Russian Federation. Ninety miners perished and although cause of the methane gas explosion remains unknown, the ICEM deplores the coal-mining pay structure in Russia in which monthly salaries are kept extremely low and workers are expected to supplement their pay by reaching high production quotas. 
 
As well, the ICEM condemns Massey Energy in the United States, a company that has viciously avoided union representation while challenging all US federal mine safety citations given the company. Such appeals serve to delay corrective measures needed in Massey’s mine. The 5 April explosion inside Massey’s Upper Big Branch mine in the state of West Virginia, killing 29 miners, was compounded and made worse by the callousness and arrogance of the company’s CEO in the aftermath of the explosion. 
 
In South Africa, where overall, mine safety is improving due to the militancy of the National Union of Mineworkers, the ICEM notes three miners were needlessly killed at AngloGold Ashanti in late April, bringing to over 30 the official death toll thus far in the country’s mining industry. The ICEM also cites a recent roof collapse inside the Barapukuria Coal Mine Company in Dinajpur, Bangladesh, which killed and maimed several workers. An improper support system was the cause. Major mining accidents dating back to 2009 have also occurred in Poland, the Ukraine, and India. Also, the ICEM takes notice of continued deaths inside China’s vast coal-mining industry and the fact that the death rate increased by 14% in the first quarter of 2010 over the same period in 2009. ICEM strongly believes this increase is due to negligence in safety in pursuit of greater production. 
 
In the oil and gas industries, the same is true. While much is made of the environmental destruction along the United States Gulf coast brought about by the oil rig explosion in the Gulf of Mexico, which indeed merits attention and the wrath against BP, who is the overall responsible operator, and its contractors, Transocean and Halliburton. Little is made of the fact that 11 offshore workers died and 15 others were severely injured. 
 
In the downstream oil sector as well, a rash of fires and explosions recently in the USA and elsewhere proves that the industry is neglecting correct process safety principles and procedures. 
 
The ICEM calls on the upstream, midstream, and downstream sectors of the oil, gas, and petrochemical industries to engage the legitimate trade union representatives in correcting systematic deficiencies in safety procedures and methods to minimize this industry’s inherent risks. 
 
The ICEM specifically recalls at this time recent and horrific accidents such as the tragic refinery explosion of the Tesoro company at its Anacortes, state of Washington, refinery that killed seven dedicated union members in April 2010, as well as the death of a contract employee in the state of Texas, and very recent fires at ExxonMobil’s refinery in the state of Louisiana and a Valero refinery in the state of Tennessee, both seriously injuring workers. The ICEM grieves the death of a Petrobras worker at an onshore oil field in the state of Bahia in May. 
 
The ICEM also recognizes that there have been further workplace deaths in other sectors, many brought on by the expanded utilization of contract workers by companies attempting to decrease direct employment. 
Therefore, the ICEM firstly endorses the hour-long strike actions planned by affiliate Genel Maden-Is of Turkey in the Zonguldak region in the aftermath of the Karadon explosion that will take place on 26 May in protest of the government’s general disregard for adherence of global safety standards. 
 
The ICEM also reiterates its campaign for ratification of ILO Convention 176, the Safety and Health in Mines Convention, and pledges to intensify efforts to directly engage governments of resource-rich nations that have not ratified this Convention into doing so. Further, as an integral component of Convention 176, the ICEM insists that trade unions be fully involved in all design, safety methodology, and implementation of safety equipment, as well as fully involved in investigatory work following accidents or malfunctions. 
 
The ICEM pledges it will alert affiliates when there is incidence of mass deaths inside any work facility that is caused by negligence or faulty safety systems. It is the expectation that trade union affiliates will bring attention to these horrific acts to their own governments and inside their own enterprises in order that a new safety consciousness is raised. 
 
It is also the ICEM’s expectation that the ILO take immediate action in regard to implementation of ILO Convention 176, focusing on stricter methane gas controls and ventilation systems. ICEM also expects that the ILO will investigate causes of recent negligence in mine safety accidents, namely pay systems that reward maximum productivity to the detriment of safety, and mining enterprises that rely on temporary or short-term contract workers. 
 
The ICEM also calls for ratification and strict adherence to ILO Convention 155, the Occupational Safety and Health Convention; Convention 174, the Prevention of Major Industrial Accidents Convention; Convention 162, the Asbestos Convention; Convention 148, the Working Environment (Air Pollution, Noise, Ventilation); Convention 136, the Benzene Convention; Convention 170, the Chemicals Convention; Convention 115, the Radiation Protection Convention; Convention 139, the Occupational Cancer Convention; Convention 183, the Maternity Protection Convention; as well as attention to the ILO Guidelines on Health and Safety Management Systems. 
 
Finally, the ICEM calls on other Global Union Federations to join its campaign for better safety and health conditions throughout all industries.

Executive Committee Resolution on Safety in ICEM Sectors

The ICEM Executive Committee, on the second day of its annual deliberations 27 May, denounced Iraq’s government for continued failure to enact a draft labour law, as well as numerous and current prohibitions against trade union activities. 
 
The resolution noted continued adherence to a Saddam Hussein decree that bans trade unions in the public sector, which includes the oil, gas, and electric power industries, and continued imposition of Decree 8750, imposed by the occupation forces in August 2005. That draconian decree, equally restriction on trade union rights as the Saddam one, grants government the power to take over unions at will and forbids trade unions from holding any assets or collecting subscriptions from workers. 
 
The resolution also addresses the forced removals of trade union leaders from their work in the oil, gas, and related sectors, and condemns the most recent imposition by the government in restricting trade unionists from travelling outside the country. In that, the Supreme Ministerial Committee on Supervising the Implementation of the Governing Council Resolution No. 3-2005 must issue approval to those trade unionists seeking to travel or those invited outside of Iraq.

“The ICEM Executive Committee condemns all of these Iraqi government acts against trade unions,” states the resolution. “We salute the bravery of our Iraqi brothers and sisters who continue to organise, represent and protect workers despite these attacks and a background of continued and escalating violence in the society at large. 
 
“We are appalled that seven years after the fall of Saddam Hussein’s regime, workers in Iraq are still without legislative protection of their fundamental rights at work.”

The resolution notes the fact that trade unions inside Iraq have mounted a campaign for a globally-recognised labour law, complete with a website (found <a href="http://www.iraqitradeunions.org/cgi-bin/campaign1.cgi">here</a>) and encourages all trade unionists everywhere to visit the site and register your support for a fair and just labour law inside Iraq. The ICEM strongly supports the campaign and the website.

ICEM Executive Condemns Repressive Union Actions by Iraq

The ICEM is coordinating with other Global Union Federations, the International Metalworkers’ Federation, and UNI, as well as with North American affiliates Communications, Energy, Paperworkers (CEP) Union of Canada and the United Steelworkers (USW), and the Solidarity Centre in Mexico, to conduct a teach-in event in Toronto, aimed at raising solidarity with and understanding of the struggle by democratic trade unions in Mexico. The event will be held on 20 June, as part of the Peoples’ Forum events around the G8 and G20 summits. It is an open event. Entitled the “Conference on Building Solidarity with the Democratic Labour Movement in Mexico,” the forum is targeted at making an impact in both Mexico and Canada, following Mexican President Felipe Calderón’s recent visit to the Canadian Parliament, and the continued anti-union strategy of the Mexican government. 
 
The ICEM Executive Committee last week issued a resolution against mining giant Grupo México and the Calderón government following unprovoked violence by federal police against workers in the city of Lázaro Cárdenas in the Michoacán region. This latest attack is an attack on the autonomy of the National Miners’ and Metalworkers’ Union of Mexico (SNTMMSRM), also known as Los Mineros. The violence follows the arrest of Mario García Ortíz, Los Mineros’ special delegate for the State of Michoacán, also the Alternative General Secretary of the union and President of the recent Convention of the union. When a delegation of Section 271 went to the police station to ask the reason for the arrest, they found Ortíz in the process of being released. Without provocation, the police ordered the mineworkers to lie on the street, and then brutally beat the union members. 
 
Mario Ortíz was seriously injured in the attack and hospitalised. Following the attack, the Section 271 members were detained by police, only being released when their 3,000 fellow Section 271 members stopped work at the ArcelorMittal steel facility in protest. 
 
The ICEM’s governing body last week demanded that the Calderón government respect the democratic decision of the recent Los Mineros Congress, which re-elected Napoleón Gómez as General Secretary. Gómez is forced to lead the union from exile in Canada, as the Mexican government and Grupo México continue sham legal processes against him. The treatment of Los Mineros official Juan Linares acts as stark reminder of what Napoleón Gómez risks facing if he returns to his country. Juan Linares was arrested in September 2008 at an airport on his return from Canada, where he was a guest at a Canadian labour conference. 
 
“ICEM affiliates in Canada and the US have put fourth extraordinary efforts assisting our sisters and brothers in Mexico to stand up against a repressive government and some ruthless employers,” stated Joe Drexler, ICEM Director of Industry and Corporate Affairs and Coordinator for the ICEM North American Region.

Mexican union leaders from different sectors will share experiences of repression and their fight for decent work, under the four following agenda items: Legal & Political Framework of the Labour Movement Crisis; The Mexican Labour Movement in Crisis; Organizing Strategies in Response to the Crisis; Solidarity Strategies in Response to the Crisis.

There was positive news at Johnson Controls in the Mexican state of Puebla this weekend, when a long-fought struggle came to fruition. Johnson Controls officially recognizing the SNTMMSRM as the representative trade union of its employees, ending its relationship with a yellow union. 
 
Management was brought to the table just three days after a work stoppage, as the union timed a strike to stop production just before shipments to key customers including Mercedes-Benz, BMW, Chrysler, Nissan, and Volkswagen. Johnson Controls was at risk of large fines if supplier contracts were not met. The settlement also sees 80 contract and agency workers given full employment by the American-based company. The US Solidarity Centre in Mexico reports that international pressure was vitally important in reaching this settlement, serving as a clear indication of the need to continue the overall campaign.

Mexico ‘Teach-In’ Organised to Build Trade Union Solidarity

Errol McLeod, the former head of the Oilfields Workers’ Trade Union (OWTU) of Trinidad and Tobago, was named Minister of Labour on Friday, 28 May, by newly-elected Prime Minister Kamla Persad-Bissessar, the first woman to ever lead the twin island republic in the Caribbean. 
 
McLeod, also a former ICEM Executive Committee member, will head a Cabinet ministry entitled Labour, Small, and Macro Enterprise Development. He retired as President of OWTU a year ago after 21 years as leader of one of the world’s most militant trade unions. 
 
The newly-founded Movement for Social Justice (MSJ) political party, which counted McLeod as a candidate for elections to Parliament a week ago, is part of a multi-party coalition called the People’s Partnership that elected Persad-Bissessar and won 29 of 41 seats in Parliament on 24 May.

Those elections proved a crushing defeat to former Prime Minister Patrick Manning and his People’s National Movement party. 
 
McLeod came on the political scene as a strong and charismatic leader of workers in the early 1980s when he founded the Committee for Labour Solidarity in Trinidad and Tobago. Even prior, his confident demeanor and apt leadership were apparent in the 1960s when he first worked at the former Texaco refinery in Pointe-à-Pierre. That complex is now part of state-owned Petrotrin and sits at the vanguard of workers’ militancy in Trinidad and Tobago. 
 
McLeod’s fearless, honest, and tactful leadership over 30 years won working class gains for tens of thousands not just in his home country, but all across the Caribbean and the Commonwealth nations. 
 
“The entire family of ICEM trade unions extends its hearty congratulations to Errol,” stated ICEM General Secretary Manfred Warda. “His great number of achievements on behalf of workers bodes well for all citizens of Trinidad and Tobago and we truly look forward to working again with him.”

Errol McLeod Named Labour Minister in Trinidad and Tobago

The Workers’ Network of Bayer meeting, held 6-7 May at the Hotel Terras Altas in Itapecerica da Serra, São Paulo, was supported by the Friedrich Ebert Foundation (FES) of Germany and was attended by workers, members of factory committees, and managers from Bayer plants in Brazil and Argentina. This eighth meeting was also attended by representatives by CNQ/CUT, the National Confederation of Chemical Industry, the Social Observatory Institute, CUT’s Multi Action on Multinationals Project from the Brazilian national labour centre’s International Relations Secretariat. 
 
The participation of comrades from the pharmacists' union in Argentina stimulated the discussion on the regional expansion of the network and also allowed a better understanding of the reality of Bayer employees in that country. The Argentine trade unionists spoke on collective agreements, benefits, restructuring and acquisitions in the region, and on relations between business, workers, and unions. 
 
According to CNQ International Relations Secretary Antenor Nakamura, the network must engage in regional expansion, but in order to do that it has to consider the differences in trade union structures in the region. According to Eder Correa, manager of labor relations at Bayer in Brazil, the company acknowledges the Brazilian network, but emphasized that the Brazilian structure cannot interfere in Bayer’s positions in other countries. "We can’t guarantee recognition of the network in other regions, but we can make a strategic disclosure of the dialogue practices," he said. 
The impact of nanotechnology for workers was another topic discussed during this eighth meeting. The coordinator of the research institute Renanossoma, Dr. Paulo Martins, introduced the theme and spoke about the lack of regulation for products made with nano particles and the lack of research investment and that impact on processes.

"Nanotechnology allows the creation of new products, but we still do not know if they are safe. The social, environmental, and ethical concerns should be taken into consideration," he stated. 
 
During the two-day meeting, workers and Bayer managers covered topics such as fundamental rights at work, moral harassment in the corporate world, control system of working hours, incorporation of benefits, dissemination of social dialogue in all areas of the company, newsletters, and the functioning and structure of the network. The next meeting of workers network at Bayer will be held in April 2011. 
 
At the social dialogue forum, Bayer representatives were present during the whole meeting and discussed all themes proposed by workers. They presented an overview of the business in the country and its prospects for the future. The President of Bayer Brazil, Dr. Horstfried Laepple, stressed the importance of transparency in dialogue with workers, unions, and factory committees. In his institutional presentation, Laepple spoke about the positive results of the company in 2009 in Brazil, with R$3.8 billion in sales, about the possibility of business expansion, and also the positive projections for 2010. That includes investment of R$180 million in technology upgrades and amplification of plants. 
 
The company also presented the project Hamonia, a people management tool that uses the methodology of skills. The tool has recently been installed in its plant in Belford Roxo, in order to align human resource practices between the two businesses in that plant and set career tracks, as well as giving more transparency to the criteria for evaluation, promotion, and remuneration. The theme of "Jobs and Wages," discussed by the Bayer Workers’ Network until 2008, was one of the instigators to this project. 
 
The signing of a term that will deal with Bayer's commitment to adopt and respect the OECD Guidelines for Multinational Enterprises in the restructuring theme should be discussed by company and workers network in the future.

Bayer Workers’ Network Seeks Regional Expansion Across Latin America

Started in 2009 with the support of the Dutch national labour centre FNV, ICEM’s Organising and Social Dialogue Project continued its seminars in Turkey last month. Regional seminars involving local union officials and militants in April were held in Thrace and Gebze, both areas considered to be emerging industrial zones that surround Istanbul. 
 
There are a number of multinational companies within ICEM sectors in both cities, some of which are organised by ICEM-affiliated trade unions. There are also a number of organsing efforts by the unions. 
 
With the overall objective to build Turkish trade union ability to recruit new members, as well as to discuss the establishment of a base to create a functioning industrial relations system, prioritizing human and trade union rights, and to promote healthy social dialogue, the seminar in Thrace was attended by 64 local trade union leaders, shop stewards, and militants from ICEM-affiliated unions, while those attending in Gebze numbered 68.

The Thrace seminar welcomed several international trade union leaders from the Netherlands, France, Germany, and Spain. Celil Çoban and Mail Ürker of FNV Bondgenoten in the Netherlands, Sylvain Lefebvre and Jacques Caltot of French FCE-CFDT, Michael Wolters of IGBCE of Germany, and Isidor Boix of Spain’s FITEQA-CC.OO exchanged the experiences and trade union knowledge from their countries. 
 
ICEM Health, Safety, Sustainability Officer Brian Kohler also shared his trade union experiences from Canada. During the seminar, a solidarity visit was made by the French delegation to the plant of Zentiva, a part of the multinational Sanofi-Aventis. The Zentiva plant is organised by ICEM Turkish affiliate Petrol-İş. At the time of the visit, there was a collective bargaining conflict. The French delegation met with company managers as well as workers, and it was decided to put the dispute on to the agenda of the European Works Council through the help of FCE-CFDT. 
 
The seminar in Gebze in May hosted international trade union leaders from the Netherlands, Germany, Denmark, and Sweden. Celil Çoban and Mail Ürker of FNV Bondgenoten and Michael Wolters of IGBCE again participated, as did Mats Svensson from Sweden’s IF Metall and Jorgen Juul Rasmussen of Dansk-El Förbund of Denmark.

ICEM Central and Eastern European Coordinator Anatoly Surin shared his trade union experiences from Russia, as well. As a prompt practical result of the seminar, IGBCE’s Wolters visited the plants of two German-based multinationals, Bayer and BASF, where he met with union officials and company managers with a view to enhancing social dialogue at local levels. It was decided to develop this particular agenda in the upcoming period. 
 
Both seminars got presentations from Turkish trade union expert Üzeyir Ataman, Director of Education and Collective Bargaining of Lastik-İş, on union history and the current labour relations situation in Turkey. Later, the seminar focused on Power and Weak Points, Challenges and Opportunities, and Concrete Organising Targets inside Turkey, with contributions and inputs by participants from different towns around both Thrace and Gebze. 
 
“Both seminars in Thrace and Gebze created a good environment for international solidarity after many militants did get together with their comrades from different countries,” said ICEM Rubber and Chemicals Industries Officer Kemal Özkan, coordinator of the two-year project. Özkan also made a presentation on globalisation and labour relations. 
 
The project will continue with similar seminars in the second half of 2010. One such session will occur in September in the city of Bursa, said to be the “Detroit” of Turkey for its auto industry, as well as being known as the capital of the textile and garment industry. The other will be devoted to youth organising in the Eagean region. That will occur in October. The project will close with a conference at the end of October in Ankara.

ICEM’s Turkish FNV Mondiaal Project Continues in Thrace, Gebze

On 5 April, 29 American miners were killed at the Massey Energy Company’s non-union mine of Upper Big Branch in the state of West Virginia. The catastrophe, caused by a methane gas explosion, was the worst mine tragedy to occur in the US in 40 years and it triggered a fierce debate in America over the merits of union mines versus non-union ones regarding safety. 
 
Three weeks after the disaster, non-union miners at Massey’s Montcoal, West Virginia, colliery did what other non-union miners have done in recent times when company negligence has caused a disaster: they called on ICEM affiliate United Mine Workers of America (UMWA) to participate in the investigation. 
 
Under US mine safety law, non-union miners can request the expertise of the UMWA in the event of a disaster, or safety occurrence. That happened at the non-union Crandall Canyon mine in the state of Utah in August 2007, following an explosion that killed six miners, and then days later, three rescue workers. It happened at West Virginia’s Sago Mine a year earlier when 12 miners perished due to an underground explosion.

Then, International Coal Group and its owner, New York investor Wilbur Ross, blocked UMWA safety experts from entering the mine even though miners had designated their participation. The UMWA and the US Mine Safety and Health Administration (MSHA) had to sue International Coal to gain access and uphold the law. 
 
Despite Massey and its CEO Don Blankenship being vehemently anti-union, that recurrence did not happen when UMWA a safety expert showed up at Upper Big Branch on 23 April to investigate. He was allowed on to the property. 
 
On 27 April, a US Senate hearing on the West Virginia tragedy heard testimony that Massey’s Upper Big Branch mine had been cited a total of 515 times for safety violations, and 124 times alone in 2009. The company was hit with fines totaling US$1.24 million, but paid less than US$180,000 because the fines were reduced through continual appeals. And those appeals generally delay the necessary safety corrections. 
 
“It’s very easy to game the system,” said Joe Main, who heads MSHA as an Assistant US Labor Secretary. “It’s a catch me if you can mentality,” added Main, who once served as Health and Safety Director of the UMWA. 
 
UMWA President Cecil Roberts testified, “The miners who work for Massey are scared to death. They’re intimidated. This company is run like its 1921, not the present day.” 
 
A day after the US Senate hearings in the state of Kentucky, two coal miners were killed when an underground roof collapsed. These deaths occurred at the Dotiki mine, owned by Alliance Resource Partners.

US Mine Workers’ Union Designated to Investigate Massey Coal Mine Killings

The ICEM stands in strong support of its trade union affiliate in Zimbabwe, the Associated Mine Workers’ of Zimbabwe (AMWZ), as it starts a continuous strike today, 12 May, against the country’s Chamber of Mines. The strike is over fulfillment of badly needed wage increases, salary adjustments that were negotiated and agreed to in an arbitration award last year but never delivered. 
 
“We find this strike justified because the mining sector in Zimbabwe has fully recovered, yet employers have reneged on agreed upon wage increases,” said ICEM General Secretary Manfred Warda. “We call upon the major mining houses of the world that have enterprises in Zimbabwe to intervene, and correct this injustice so miners can return to work.” 
 
Some 25,000 miners struck about 45 different companies early today, shutting platinum, gold, coal, and other mineral production. This came after the AMWZ issued a 14-day intent-to-strike notice on 22 April, which was not inclusive of holidays or weekends. The Chamber of Mines did petition for a show-cause order from the Labour Ministry, but after two meetings, the Chamber’s offer of a US$9.50-per-month increase was insulting. 
 
An arbitration award from third quarter 2009 should have meant a total salary increase of US$140.00 for the final three months of 2009, but employers refused to honour that award. For most of the 25,000 miners, no increase in wages has come throughout 2009.

The ICEM supports the AMWZ’s current wage demands of US$496 on top of miners’ total salaries, and urges mining houses to swiftly act on this in order to re-start Zimbabwe’s mining enterprises. As well, the ICEM is disturbed to learn that mining companies have neglected to remit contributions to the Mining Industry Pension Fund, monies owed to the National Employment Council for the Mining Industry, and to the AMWZ for subscriptions. This must also be immediately rectified, said Warda. 
 
“Mineworkers have gone too long without salaries, and in some cases, have gone without any pay for months at a time,” added Warda. “In a country such as Zimbabwe, this is unconscionable and senior leaders of global mining houses must step in at once.” 
 
The ICEM will closely monitor the strike and provide solidarity and support to the AMWZ through its President, Tinago Edmund Ruzive, and General Secretary, Joseph Midzi.
