After seven-and-a-half to eight days trapped deep inside a coal mine, Chinese rescue teams freed some 120 workers today, 5 April, from a massive state-owned colliery still under construction. The Wangjialing mine in northern Shanxi Province was flooded by 140,000 cubic metres of water on 28 March when workmen, one kilometre underground, inadvertently broke through a wall into an adjacent and abandoned shaft filled with water. 
 
There were hopes that some of the remaining 30 of 153 workers trapped might also be alive. “It is a miracle. This has been worth all (our rescue) efforts, not to have slept for several days,” said one medical worker today to the news agency China Nouvelle. 
 
Chinese authorities began sending divers and other rescuers into the mine on Saturday, 3 April, after drilling and laying pipes were done to pump water out. Workers were stranded for over a week in some nine different mine shafts. Some 100 rescue workers descended into the mine late last evening, 4 April, and returned in the early hours of today with the first nine survivors.

By mid-afternoon in Shanxi Province, or 06h00 GMT, another 111 construction workers had been pulled from pits. 
 
The State Administration of Work Safety (SAWS) last week blamed lax safety and a haste to finish construction on the 180-square-kilometre mine as cause, but ineffective mapping of either waterlogged old shafts or an underground river no doubt also contributed. 
 
Workers reported persistent water leaks in the days leading up to the flood and brought that to the attention of construction supervisors. But the warnings went unheeded. Workers had also seen their eight-hour workdays increase to 16 in efforts to finish mine construction so mechanical digging could begin. Reportedly, several construction managers fled the area immediately after the flooding began, and they are now wanted by Chinese authorities. 
 
SAWS stated on its website: “This incident once again exposes lapses in responsibility and management of safety and failure to take safety checks and measures seriously.” 
 
The eight-day ordeal, which saw some 3,000 recovery and medical personnel present, got wide attention both inside China and worldwide. Chinese Vice Premier Zhang Dejiang appeared at the site on the third day of rescue operations (30 March) and later in the week sided with angry relatives of workers who demanded local officials release a list of those missing.

Huajin Coking Coal Ltd., jointly owned by the China National Coal Group and the Shanxi Coking Coal Co. Ltd., was started in 2006 as a US$287.5 million project, with an expected production of six million tonnes annually. The mine is estimated to have 2.3 billion tonnes of coal reserves, including 1.04 billion tonnes of proven reserves. 
 
Construction started on the Wangjialing project near the city of Hejin in Xiangning County in April 2007 and was originally scheduled to be completed by March 2010. 
 
But delays pushed that deadline back to October 2010, and it is now certain that the rush to finish later this year jeopardized construction safety. 
 
The Wangjialing mine tragedy will inevitably result in some deaths, but it was not the only China coal mine last week that experienced death. In nearby Henan province on 31 March, 19 miners were killed and 24 are still missing after a methane gas explosion inside an illegal Guomin Mining colliery near Luoyang City, Yichuan County. The mine had been ordered closed by provincial safety authorities on 1 May 2009, after huge gas outbursts were reported. Managers of the privately-owned company had gone missing following the explosion. 
 
And a day earlier, on 30 March, ten workers became trapped and died at the Shajihai Coal Mine in the far western autonomous region of Xinjiang Uighur when a shaft collapsed. 
 
On 1 April, nine miners perished from a fire inside the Quanzigou Coal Mine near Hancheng City, Shaanxi Province. In the northeastern province of Heilongjiang on 1 April, a flood inside shafts trapped five miners and they are presumed dead. And carbon monoxide from self-made explosives claimed four lives in the autonomous region of Guangxi Zhuang in southeastern China.

Miraculous Rescue for Majority of 153 Workers Trapped in Chinese Coal Mine

With the support of the International Trade Union Confederation (ITUC), trade unions in Iraq have come together to create a campaign and a website, calling for international solidarity and pressure on the government of Iraq to enact fair labour legislation. Seven years after the fall of Saddam Hussein’s regime, workers in Iraq are still without legislative protection of their fundamental rights at work. 
 
The ICEM strongly supports the campaign, and urges all trade unions from all corners of the world to offer similar support by logging onto the website <a href="http://www.iraqitradeunions.org/cgi-bin/campaign1.cgi">here</a> and join the campaign. Many in the Iraqi government now perceive trade unions as government tools. However, momentum is building behind the campaign for free and independent trade unions, and fair and just labour laws. Important political figures inside Iraq are now pledging their support. These include former President Jalal Talabani, 85 members of Parliament, the Oil Minister, and many community and business leaders.

Hashmeya Muhsin
Hashmeya Muhsin, President of the GFIW-affiliated General Union of Electricity Workers and Technicians, and a member of the ICEM Executive Committee, is a key figure in the campaign. She recently told the ITUC in an interview that international solidarity and pressure are crucial in pushing the government to enact fair labour legislation. 
 
The key parliamentary drafting committee has consulted with the campaign's coordinating group, the National Labour Campaign Committee (NLCC), and MPs are petitioning for proposed legislation to be debated in Parliament. 
 
Despite the right to organize being clearly guaranteed in the new constitution, Iraq’s government falls back on the blatant anti-union decree of the Saddam era. The current campaign calls for the abolition of Saddam’s Law 150 of 1987, and Order 8750 of August 2005 by the occupation forces, which effectively froze all trade union assets and financial accounts, making it impossible for unions to function. 
 
Saddam’s Law 150 bans all public sector employees from organising or striking. Some 90% of all Iraqi enterprises are considered part of the public sector, including oil, gas, electricity, textiles, and most other manufacturing sectors.

While several versions of a new labour code have been drafted, with the aid of the ILO, political opposition and a gridlocked Parliament has blocked progress. When the campaign is successful in abolishing the draconian anti-union measures of Saddam and the occupation forces, only then can elections to union office be held, free and without government interference. Free trade unions in Iraq will enhance nation-building and contribute greatly to establishing democratic institutions. 
 
Current evidence of the urgent need for new labour legislation is the government interference in the Iraqi Teachers’ Union (ITU). The government committee entrusted with overseeing the leadership elections of the union is attempting to install its preferred candidates into leadership positions. 
 
The ICEM calls on all its trade union affiliates to join this campaign. Now is the time to raise the profile that Iraqi trade unions have been working towards since 2003 – labour statutes that comply with international labour standards, and strong trade unions that can enforce those statutes and protect global standards.

Campaign for Effective Iraqi Labour Laws Takes Shape

The ILO is urging the Mexican government to resolve its dispute with the National Miners' and Metalworkers' Union of Mexico (SNTMMSRM) and considers the government has acted in a way that is incompatible with ILO Convention No. 87 on Freedom of Association. 
 
The ILO released on 26 March the interim recommendations of its Committee of Freedom of Association to the Mexican government in response to a complaint on interference in union autonomy lodged by the SNTMMSRM and the International Metalworkers' Federation (IMF) in March 2006, ILO Case No. 2478.

The complaint documents how Napoleón Gómez Urrutia, the democratically elected general secretary of SNTMMSRM, was forcefully removed from his position after speaking out against the Mexican government and mining company in response to a tragic mine accident in Pasta de Conchos that left 65 miners dead, many of them members of the union. The complaint also documents how the government illegally intervened in independent union activities, forced the dismissal of union leadership, seized union assets, and made government appointments to union elected positions. 
 
In subsequent submissions on Case No. 2478, the union and IMF has also documented ongoing interference and acts of violence by Grupo México and the Mexican government, including using the national army and federal police to break strikes, kill workers, and arrest union leaders fighting for safer working conditions in Grupo México-owned mines. 
 
In its recommendations to the ILO Governing Body, the Committee on Freedom of Association states that it “considers that the labour authorities engaged in conduct that is incompatible with Article 3 of Convention No. 87, which established the right of workers to elect their representatives in full freedom.” 
“The Committee deplores the excessive length of the judicial procedures relating to various aspects of the case and the grave prejudice that this has caused to the complainant union” and “urges for a rapid conclusion of the judicial procedures.”

The committee requests addition information from the government on several points and in particular on the question of the death of worker Reynaldo Hernández González, the use of force by public security forces at the Cananea mine, continuing arrest warrants, freezing of union accounts, threats and acts of violence, including the death and injury of trade unionists. 
 
The Committee calls on all the parties concerned to continue to make efforts within the existing round of negotiations to resolve the collective dispute to which this case results.

ILO Backs Los Mineros, Cites Mexican Government with Convention 87 Interference

Representatives of the Australian Manufacturing Workers’ Union (AMWU) say it has not been uncommon for Alcan, the steel and aluminum subsidiary of Rio Tinto, to lose alumina hydrate into coastal waters while loading ships in the Northern Territory. 
 
But on 13 April, something more grievous occurred. While loading a ship near Alcan’s bauxite Gove refinery in Nhulunbuy, workers were ordered by a manager to dump a ship-loading conveyer containing 80 tonnes of alumina into Melville Bay after the load became contaminated with water. The AMWU-represented workers protested the decision, but the manager called the lead supervisor who ordered it dumped into the harbour. 
 
The incident went unreported for two weeks until a whistle-blower informed the news media. Alcan management then responded by saying the 80-tonne figure was wrong – that it was only 30 tonnes. 
 
Rio Tinto Alcan could face a maximum A$1 million fined by the Northern Territory Environmental Ministry if the company is found to have illegally dumped harmful substances. Alumina hydrate contains caustic soda, which can cause severe burns. 
 
AMWU members working at Alcan at Gove say it is common for two percent of loads to be lost due to wind or negligence. The AMWU is standing behind Gove workers as they provide evidence to the territory’s Environment Department. A union representative said it was the company’s inaction over a number of years that caused workers to go to the media over the April incident.

AMWU Members Say Rio Tinto’s Alcan Alumina Spills Not Uncommon

Following the start up seminar of the ICEM Contract and Agency Labour (CAL) project in Dakar, Senegal, in March 2009, the Industrial Workers' Union of Senegal (SUTIDS), conscious of the issue and consequences on workers and their organisation, started a media campaign through the major outlet channels of the country. 
 
The union did this through the two biggest television channels of Senegal and the West African region. 
 
Statements made by the general secretary of SUTIDS, those of the ICEM/CAL Project Coordinator for Sub-Saharan Africa, and a representative of the Minister of Labour were broadcast and commented on in most of the languages in Senegal (Ouolof, French, Toucouleur, Sérère and English).

The conclusions of the seminar were also sent to the Office of the President of the Republic, the Prime Minister’s Office, the National Assembly, the Senate, the National Labour Advisory Commission, the Ministry of Labour, and the ILO. 
 
When the General Secretary of SUTIDS met the Prime Minister of Senegal, he had the opportunity to raise the issue of outsourcing and interim employment, making the country’s leader aware of the sensitive nature of the issue. The Prime Minister requested to see all of the reports of the ICEM/CAL seminar held in March 2009. 
 
SUTIDS therefore organised a media and advocacy campaign among the highest state authorities of Senegal. 
 
These actions contributed to the adoption and promulgation by the President of the Republic of Senegal of Law No. 2009- 1412 on Private Recruitment Agencies and Casual Employment.

Origins of a New CAL Law: ICEM Work in Senegal 

In occupational health and safety, accidents are best described as the results of failures in those systems that ought to keep workers safe. These can include choices of materials, tools, equipment, processes; the design of specific tasks or the work process; level and competence of supervisory control; workplace environment including noise, dust, fumes, heat, cold, and conditions of floors, surfaces, lighting; and the characteristics of workers themselves, including experience, skills, training, and other human factors. 
 
When one or more of these systems fails, an accident can occur. Was an inappropriate tool provided? Was the task poorly designed to begin with? Were supervisors absent or negligent? Was the workplace environment inhospitable? Did the workers have the appropriate skills and capabilities to do the work safely? Systems failures that expose workers to hazards must be corrected at the source, with personal protective equipment used only where elimination at the source is not possible or practical. 
 
Unions demand three fundamental rights for workplace health and safety: the right to know about the hazards of the work; the right to participate in health and safety systems, and the right to refuse unsafe work.

The systems above are far more likely to be weak or absent entirely for Contract and Agency Labour (CAL) workers. The hazards they face are less likely to be corrected at the source, and more likely to be dealt with by providing personal protective equipment - if even this is provided. Finally, contract and agency workers are in a weak position to demand any of their three basic occupational health and safety rights, without the risk of losing their job. 
 
The vulnerability of CAL workers is reflected in accident statistics. Last year in Belgium, agency workers were twice as likely as permanent workers to suffer a workplace accident. The ICEM’s Peruvian mining affiliate, FNTMMSP, reported that 49 miners died in the first nine months of 2009, 37 of whom were working for subcontracting companies. In Turkey, thousands of young migrants who work in jeans factories are likely to develop silicosis, following exposure to high levels of silica during the denim sandblasting process. Forty-four workers have already died this year and 550 have so far been diagnosed with the disease. 
 
Unions and decent work make work safer. Insecure contract and agency labour can and does injure workers.

Job Vulnerability Puts Health of Temp Workers at Risk

As part of a SASK of Finland sponsored Sub-Sahara Africa project on Contract and Agency Labour (CAL), the ICEM held a regional meeting on precarious work 2-3 November in Togo for trade unionists from nine different African countries attended. The main aim of the conference was to assess and discuss how the ICEM’s campaign has had an impact on solving some of the problems faced by millions of non-regular workers in the region. 
 
The region is no exception to the rule: CAL workers face many difficulties. Many of them are women and young workers. Typically, agency, temporary, and outsourced workers lose out in various areas, including salary levels, health and safety protections, as well as not receiving ordinary job benefits, vocational training, and job protection, and trade union rights.

Especially in mining, with examples cited from Guinea, Namibia, Senegal, Sierra Leon, South Africa, and Togo, CAL problems appear to be chronic and shocking. But unionists also talked about CAL difficulties in other ICEM industrial sectors, including oil and gas, cement, and chemicals. There was a clear link for participants between the increased CAL problems and escalating investment on the continent by Chinese companies. 
 
The meeting also heard about a variety of success stories that have countered the worst abuses of precarious work. For example, several unions had organised previously unorganised CAL workers. Examples given – Guinea, Mauritius, Senegal, and Sierra Leone – were inspiring, with citations noted that workers of a few hundred at a time had been organised into trade unions. 
 
Sutids from Senegal is just one union that has managed to change hundreds of workers’ individual contracts into one giving permanent employment. This specific campaign topic was adopted by the union as part of the “ICEM national seminar project plan.” 
 
In Nigeria, ICEM oil and gas affiliates, NUPENG and PENGASSAN, report they now represent up to 60% of all CAL workers, admitting, however, that basic work conditions for these workers are still much lower than those of directly and permanently employed workers.

Actions by the ICEM Sub-Saharan Africa affiliates have not been limited to organising and collective bargaining. Several unions in Africa have also engaged their governments, seeking law changes. In South Africa, where the issue is a top political priority (see Ban on Labour Brokers, click <a href="/en/78-ICEM-InBrief/3289-ICEM’s-Contract-Labour-Forum-in-Guinea-Forces-Expulsion-of-Russian-Mine-Boss" type="internal">here</a>), labour brokers were said to receive 50-to-60% of the fees they charge companies for their own “service fees,” thus taking much directly from the pockets of agency workers themselves. 
 
Reportedly, for a number of labour brokers, having an office means having a laptop and an automobile. In Namibia, the law already bans labour brokers and, in Sierra Leone, the government agreed to review the country’s labour laws after a campaign by the United Mineworkers’ Union (UMU). That review looked specifically at ending CAL abuses there, another result of a national plan adopted at an ICEM-CAL seminar. 
 
In Guinea, the government decided to start a process to review all mining contracts in the country after the ICEM-CAL seminar there last spring. Guinea’s Labour Minister has also started the process of preventing sham subcontracting companies from operating in the country, which in some cases are owned by managers of primary employers, including human resources managers. A recent victory (see Guinea Forces Expulsion of Russian Mine Boss, click here) came despite the country being at high risk due to the current political situation.

Regretfully, good laws are often not respected, with Nigeria and Senegal serving as examples. This has led the ICEM CAL Campaign to emphasize – quite successfully in Mozambique – to trade unions that they engage governments to embark on labour inspections. Cooperation between the unions and the labour inspectorate was a main topic at the national CAL seminar in Mozambique. 
 
Unions are also examining their internal rules and structures, in efforts to attract more precarious workers into their ranks. In Mauritius, for example, Sindicatravayer offers membership to CAL workers for a symbolic 1 rupee (instead of 50). The union extended existing collective agreements to also cover contract and agency workers. The union furthermore won, in certain sectors, an extra payment of one day’s salary per month for temporary workers. That money goes into a fund, making sure that also CAL workers at the end of their contract get a dismissal fee. Sutids from Senegal helps precarious workers with easier access to medical care and legal assistance. 
 
There has been much progress in ICEM’s Sub-Sahara Africa Region, but the many problems still outweigh these important steps forward. Sadly, the progress itself is also precarious in some cases. 
 
Workers in Mauritius are facing a different, new “precarious” problem after the country’s government, in February 2009, decided to change the labour law, turning virtually every worker into a “contractual.” This new law removes obligations to pay dismissal fees. At the same time, it also makes it possible to dismiss any worker at any time without good reason. 
 
Many participants in the ICEM-SASK seminar in Togo reported on the fact that the more successful CAL activities in their respective countries took off after, and as a result of, ICEM project seminars in the different countries.

The person most responsible for that has been ICEM’s project coordinator, Joseph Toe. He, while organising the CAL seminars for the ICEM affiliates, almost invariably manages to get the respective country’s Minister of Labour, or a high-ranking representative from that office, at CAL conferences. 
 
This was also the case at the most recent 2-3 November regional seminar, which was opened by Togo’s Labour Minister, Mr. Broohm Octave Nicoue. The fact that Toe has succeeded in such organizing has improved access on the political level, and coupled with this high-level political participation, is the reason behind a number of the successes in the region.

Action on CAL Evident as ICEM African Affiliates Tackle Irregular Work

In the US, the ICEM intervened on behalf of the affiliated Teamsters Union in a strike that started on 3 November and ended 14 November against specialty chemicals manufacturer Rhodia. General Secretary Manfred Warda contacted the Paris-based company directly in efforts to bring the two sides together. 
 
The plant is in Baton Rouge, Louisiana, and it is part of Rhodia’s Eco Services division, producing sulfuric acid and organic chemicals. The 135 members of Teamsters Local 5 went on strike following rejection of a company proposal given 1 November, but accepted a new three-year agreement with modifications on 13 November after managers and the bargaining committee reached agreement that day.

Teamsters Local 5 Members Last Week on Strike, a Strike that Ended on 13 November 
The strike was primarily over rising health care costs and co-payments that Teamster members were asked to make. The negotiated settlement includes wage increases in each of the three years. It also includes positive modifications for workers to an on-call procedure, or provisions for calling staff to work during their off hours. That was a further cause in the ten-day strike.  
 
The ICEM has a constructive Global Framework Agreement with Rhodia. The difficult American issue of private and for-profit health care delivery systems is generally the leading cause of US labour-management disputes.

ICEM Affiliates: Implementation of 2010 Programmes in Full Swing 
 
Midterm reports from ICEM affiliates in sub-Saharan Africa show that the implementation of activities through the ICEM HIV/AIDS project, which is sponsored by the solidarity support organisations SASK of Finland and the Dutch FNV Mondiaal, is according to plan. 
 
In Côte d’Ivoire, workplace activities on awareness and prevention and advocacy for early testing reached 170 workers in three different companies. In Mauritius, initial training of women delegates and workers provided the basis for awareness campaigns at worksites through which, so far, 375 workers have been reached. A locally produced DVD multiplied the effect of these campaigns. Twenty-one women unionists were trained as peer educators in Nigeria. Some 1,450 workers and community members were mobilised in one VCT campaign alone. Affiliates in Tanzania organised two workshops in preparation for a massive VCT campaign in the mining area around Mwasa in August, which is sponsored by the women’s structure of the German ICEM affiliate, IGBCE. In Ghana and Uganda training workshops were organised for shop stewards and negotiators on building capacity for bargaining on HIV/AIDS issues.

Labour’s Role at the International AIDS Conference 
 
Trade unions and the ILO played an important role at the 18th International AIDS Conference (IAC), which was held in Vienna, Austria, in July. Some 25,000 scientists, health professionals, representatives of governments, and AIDS activists met for this Conference which takes place every two years. 
 
During the Labour Forum, organised by the Global Union AIDS Programme (GUAP) and the ÖGB, the Austrian trade union centre, labour’s participants were prepared for their different roles and interventions during the Conference. 
 
ILO/AIDS organised a tripartite Workplace Forum during which Jan Eastman, GUAP Chairperson also spoke. The ILO launched the implementation phase of the newly adopted Recommendation concerning HIV and AIDS and the world of work. Numerous other events included trade union speakers and displays gave examples of union HIV/AIDS materials. 
 
Medical advances in treatment have made great progress since the HI virus was discovered almost 30 years ago. Early treatment can effectively reduce the viral load (see also article below). A precondition for this is early testing. 
 
Behaviour change has also contributed to a reduction in new infections. South African Vice President Kgalema Motlanthe underlined that a change of policies has led to a decline in infections. He, like many others, pleaded that world leaders renew their commitment to universal access for HIV/AIDS treatment, especially in view of the fact that funds have fallen flat during the economic recession.

UNAIDS: 10 Million Death, 1 Million New Infections Could be averted 
 
The UNAIDS Outlook Report 2010 outlines a radically simplified HIV treatment platform called Treatment 2.0 that could decrease the number of AIDS-related deaths drastically and could also greatly reduce the number of new HIV infections. 
 
Treatment 2.0 is a new approach to simplify the way HIV treatment is currently provided and to scale up access to life saving medicines. Using a combination of efforts it could bring down treatment costs, make treatment regimens simpler and smarter, reduce the burden on health systems, and improve the quality of life for people living with HIV and their families. Modelling suggests that compared with current treatment approaches, Treatment 2.0 could avert an additional ten million deaths by 2025. 
 
In addition, the new approach could also reduce new HIV infections by up to one million annually if countries provide antiretroviral therapy to all people in need, following revised WHO treatment guidelines. Today, only five million of the 15 million people in need are accessing these life-saving medicines. 
 
A supplement to the report also shows that young people are leading the HIV prevention revolution. HIV prevalence among young people has declined by more than 25% in 15 of the 25 countries most affected by AIDS. In eight countries—Côte d’Ivoire, Ethiopia, Kenya, Malawi, Namibia, the United Republic of Tanzania, Zambia, and Zimbabwe—significant HIV prevalence declines have been accompanied by positive changes in sexual behaviour among young people. 
 
For example, in Kenya there was a 60% decline in HIV prevalence between 2000 and 2005. HIV prevalence dropped from 14.2% to 5.4% in urban areas and from 9.2% to 3.6% in rural areas in the same period. Similarly in Ethiopia, there was a 47% reduction in HIV prevalence among pregnant young women in urban areas and a 29% change in rural areas.

Knowing Your HIV Status through Workplace Initiative 
 
A Voluntary Counselling and Testing (VCT) Centre opened at the Primary Health Clinic at Jikwoy in Abuja, Nigeria, on 5 July 2010 under the Building Workplace Capacity to Combat HIV/AIDS in Nigeria Project, funded by the UK Department for International Development (DFID). The new Clinic will cater to the needs of workers willing to know their HIV/AIDS status in the area and is part of the Project launched in July 2009 by the British Trades Union Congress (TUC) in partnership with the Nigeria Labour Congress (NLC). 
 
The workplace initiative in Nigeria implemented by TUC Aid is designed to contribute to a reduction in the prevalence of HIV/AIDS, better protection and promotion of employment and human rights of workers infected with or affected by HIV and AIDS, and to the elimination of stigma and discrimination against them. Six affiliates of the NLC in the Education and Health Sectors are taking part in it. It is hoped that the establishment of the VCT Centre will enable workers and their families to know their status and seek counselling, treatment, and care at an early stage. 
 
In many parts of the world, trade unions combating HIV/AIDS through workplace action have played a decisive role in overcoming the initial reluctance of workers to come forward for testing. The current VCT initiative in Abuja follows the successful completion of a pilot project in 2009 funded by TUC Aid in the Ashanti Region, Ghana, in collaboration with the Timber and Woodworkers' Union (TWU).

Glaxo, Pfizer Joint Venture Opens HIV Pipeline to Generic Companies 
 
ViiV Healthcare, GlaxoSmithKline and Pfizer's joint venture company for AIDS drugs, is opening its entire product line-up to generic drug makers working in the world's poorest countries. 
 
The announcement, on the eve of the International AIDS Conference in Vienna, means generic companies will be able to obtain royalty-free voluntary licences for all current ViiV products, as well as products still in development. 
 
The move would help drive down the cost of second-line treatments for HIV, which will be needed increasingly as more people in poor countries develop resistance to cheaper first-line drugs. 
 
The ViiV offer is open to 69 countries, including all least-developed countries, all low-income countries and the whole of sub-Saharan Africa. ViiV, which was launched last November, pools the two drug makers' HIV/AIDS businesses into a new company, owned 85% by Glaxo and 15% by Pfizer.

South Africa: Counsellors to Give ‘The Prick’ 
 
Lay counsellors in South Africa can now legally perform HIV tests, but delays in paying them and shortages of test kits are threatening a national campaign to scale up voluntary HIV testing and counselling (VCT). 
 
Before new regulations came into effect in May 2010, only nurses were allowed to administer finger-prick HIV tests, but AIDS activists had long argued that this not only added to an already heavy work load and could also hamstring the VCT campaign aiming to test 15 million South Africans by 2011. 
 
South Africa's public health system is struggling to cope with one of the world's worst HIV epidemics, as well as a shortage of doctors and nurses. The South African Nursing Council estimates that the country has about one registered nurse for every 440 patients. 
 
South Africa's new legislation requires counsellors to undergo three hours of training before being added to a database of healthcare providers allowed to perform "the prick". 
 
Malawi and Zambia, faced with even worse health worker shortages, have put HIV testing in the hands of trained lay counsellors, a strategy known as "task-shifting."

Global Fund: OIG Identifies Shortcomings in Rounds-Based Grant Application Process 
 
The Global Fund's Office of the Inspector General (OIG) released a wide-ranging, 107-page audit report in April 2010, "The OIG Review of the Global Fund Grant Application Process." 
 
The report made six key observations: 1. The way that calls for proposals in the rounds-based channel are structured is inconsistent with the Global Fund principle of supporting country-driven programmes; 2. While a good proposal may be fitted into the Global Fund's proposal form, it is by no means clear that a proposal would be significantly shaped and improved by following the form; 3. There is little scope for the Board to provide assurance on the financial soundness of proposals; 4. After seven years of activity, the Global Fund's relationship with its partners remains poorly defined and even, in some ways, uncomfortable; 5. The present obscurity of the deliberations of the Technical Review Panel (TRP) represents something of a contrast to the rest of the Global Fund's business model; and 6. The current grant application process impairs the ability of the Global Fund Board to set policy and strategy. 
 
The report further comments on the high rejection rate of proposals; the lack of Global Fund presence in-country; the limitations of the screening process; the timing of principal recipient assessments; and the lack of investment in forging and maintaining more effective relations with partners as well as the roles of the Fund's Country Programs staff and the TRP.

Not the Universal Access We Are Campaigning For 
 
Authorities in the Arusha region of Tanzania are investigating the case of a hospital which is alleged to distribute expired medicines to HIV patients. Apparently the anti-retroviral drugs at the faith-based hospital were imported as donations not going through the Medical Supplies Department of the Tanzanian government. 
 
One of the patients who were given expired antiretroviral drugs has started suffering contraindicative complications including rashes, blisters, and periodical fever. There is fear that the expired drugs could be harmful to other patients in the region without them knowing, and officials suspect that other private hospitals could be still issuing them. 
 
The ARVs had an expiry date of December 2009 and were still given out in the first half of 2010.

It also gives a preview of HIV/AIDS workshops to be held at the ITF Congress in Mexico City in August.

A deadly accident killed four maintenance workers at the Carbones del Cerrejón mine complex in La Guajira department, north-eastern Colombia, on Wednesday, 4 August. The ICEM affiliated trade union at the mine, Sintracarbón, represents 3,500 direct employed workers, and has been fighting to organise many of the 4,000 outsourced at Cerrejón, Latin America’s largest coal mine. 
 
As prior ICEM reports indicated, organising efforts were countered with harassment and persecution by contractors, while Carbones del Cerrejón management refused to intervene. 
 
This latest fatal accident underlines the urgent need for free trade unions among all the contractors of Cerrejón in order to end unsafe working conditions. Carbones del Cerrejón, and its owners Xstrata, AngloAmerican, and BHP Billiton, cannot continue to turn a blind eye to anti-union contractors.

Wednesday’s accident occurred at 19h50, when a high platform holding 16 workers collapsed and fell. Contract employees of Conconcreto and Ticom were carrying out repair work in one of two coal storage silos in the massive facility’s crushing plant. 
 
Three workers died at the scene. While 12 of the 16 were injured and taken to hospital, one died en-route. The bodies of the three dead workers could not be recovered until late into the night. 
 
Seven of the hospitalized workers have since been discharged, and the others are all in stable condition. 
 
Sintracarbón, as well as communicating shock and sadness, moved quickly to demand a full inquiry into the accident, with a view to fully understanding its causes, and establishing a strict safety policy throughout the Cerrejón operations. The company has responded, with external investigators due to release findings in two weeks. 
 
Production at Cerrejón reached 30.5 million tonnes in 2009, and is expected to reach 40 million tonnes by 2011.
