On the heels of a gainful first contract victory against with Covanta on the US east coast, a branch of the ICEM affiliate Utility Workers Union of America (UWUA) mounted another mobilisation in the US Midwest to stave off unneeded concessions, winning another excellent collective agreement.

This one was with DTE Energy, the electric and gas provider that formerly was known as Detroit Edison. Some 4,000 UWUA Local 223 are now voting on a three-year labour agreement that will give them 3% annual salary increases, plus a US$750 contract signing bonus.

UWUA President Mike Langford, at 1 June Local 223 meeting. At left, Executive Vice President Steven VanSlotten and Local 223 President Rich Hawkins. At right, Local 223 President Jim Harrison
The proposed agreement, negotiated in contentious bargaining that went right up to the 6 June expiry of a prior three-year agreement, came primarily because of workers’ anger in being presented with concessionary proposals by a company posting rich (US$230 million) net profits in first quarter 2010, and then handsomely rewarding its top executives.

DTE Energy had proposed huge increases to the portion of worker-paid health care coverage, elimination or cuts to retiree health care, and the stripping of job security provisions. On 1 June in a fiery, over-full mass union meeting that needed the police of Livonia, Michigan, for crowd control, Local 223 members voted 97% to give strike authorization to the bargaining committee.

Workers were angry that they contributed US$100 million in continuous improvements at Edison and MichCon. At the mass meeting, UWUA President Mike Langford said, “The national union will not allow this to happen. We won’t let DTE line the pockets of executives while it empties the wallets of our workers.”

Local 223 members turned out in force on 1 June to resist DTE Energy’s takeaways

Bargaining resumed the next day and by the time weekend (4-6 June) talks concluded, the company had moved from its entire slate of concessions. “We’re proud that we were able to work together to achieve an outcome that values our employees, serves our customers and supports Michigan’s economic recovery,” appropriately stated the company in a joint news release.

UWUA Local 223 represents electric line workers, skilled trades-persons, technical staff, power plant operators, electric and gas service and distribution workers, and customer service, office, and clerical staff. Local 223 members also serve as first responders in times of crisis and in times of life and death situations in Detroit and surrounding communities.

UK’s Unite the Union held its first Policy Conference 31 May to 3 June at the Manchester Central Convention Complex with 700 delegates present. Entitled “Working for Working People,” the biannual event was the first jointly held conference since the 1 May 2007 merger between the Transport and General Workers Union and Amicus that created Unite.

Central themes of the four-day conference included winning back the British Labour Party for working people, keeping a sturdy manufacturing base in the UK, stopping erosion of public services and public sector workers against Tory assaults, and addressing the bullying affront by British Airways against the union’s cabin crew members.

The conference also took up several intentional topics, including support for Canadian strikers of the United Steelworkers (USW) at mining company Vale, strong condemnation of Israel’s aggressive policies against Palestinians, support to Latin American unions resisting capitalist demands, and, closer to home, a hearing over the lack of rights for Unite’s Moroccan members working in Gibraltar.

Tony Woodley, USW’s Gerald Fernandez, Canadian Vale striker Bob Belowos, United Executive Council Chair Tony Woodhouse, and Derek Simpson

Some 180 policy issues were tabled.

The biggest debate occurred on 2 June over whether or not Britain ought to scrub its £76 billion Trident nuclear weapon system when its service life ends in 2024. The debate centered on peace and disarmament versus jobs and workers’ livelihoods, with discussion on how cancelling the programme can liberate monies for public services, such as health, education, and social services. After a fierce debate, Unite’s Executive Council recommendation for peace and disarmament won out.

On 2 June, UK’s Trades Union Congress (TUC) Secretary General Brendan Barber spoke. He said that manufacturing must become the centerpiece of a new economy. “Whether it’s high-speed trains or electric vehicles, whether it’s wind turbines or more efficient airplane engines, we have the skills, the experience, and the expertise to build them here.”

Woodley and Simpson
Barber lashed out at the consequences hoisted on British society by financiers. “It is just plain wrong that our schools, hospitals, and local councils should pay the price for a crisis inspired by the free-market dogma, created in the City of London, and caused by the richest minority of the richest minority.”

Unite’s Joint General Secretary Tony Woodley had harsh words for the Labour Party. “It is a scandal that at the end of 13 years of Labour government, the right to strike is hanging by a thread. (It is) at the mercy of employers who would rather sue than settle, and Tory judges who … think strikes are OK as long as they don’t inconvenience the bosses.

“So I want to make one thing clear to all Labour leadership contenders. Our vote should only go to the candidate who pledges – unequivocally, no mealy-mouthed phrases, to do what Labor was set up to do – create a level playing field at work, and scrap the anti-union laws.”

Unite Delegates Voting on a Policy Measure

Speaking on the conference’s final day, 3 June, Joint General Secretary Derek Simpson – who will retire at year’s end – addressed Unite’s merger coordination with the United Steelworkers of North America, called Workers Uniting. He said it was the UK’s failure to implement social partnership models, common throughout Europe, which has left the markets to rule in the UK – as well as in the US.

“If you need to fight the employer on a multi-national field,” said Simpson, “you need a multi-national union and the USW feels the same way.”

While Simpson will retire this year, Woodley will follow him to retirement in the next calendar year. Unite branches are conducting nominations and five candidates announced their intent to succeed Woodley, with elections to start in October of this year.

The European Works Council (EWC) of Rio Tinto last week condemned the global minerals and metal producer for its unwarranted lockout of 780 Canadian members of Syndicat des Métallos d’Alma, an affiliate of the United Steelworkers (USW) in Alma, Québec.

The intervention made by Rio’s EWC Secretary Véronique Roche from Paris comes at a time when the USW along with the ICEM and the International Metalworkers’ Federation (IMF) are ramping up a campaign. Actions have been launched to bring attention and pressure on the multinational in support of aluminium smelter workers of Rio Tinto subsidiary Alcan, who were unjustly locked off their jobs on 1 January in the Saguenay-lac-Saint-Jean region of Québec.

A mass protest of Canadian and global trade unionists will take place in Alma – some 380 kilometres north of Alcan’s headquarters in Montréal – on 31 March. That will come a day after the ICEM North America Region holds its committee meeting in the region as a show of support for the victimised members of Syndicat des Métallos d’Alma, USW Local 9490.

photo: lapresse.ca
An initial thrust 11 days ago by ICEM and IMF global affiliates in the form of protest letters to Rio Tinto’s President and CEO Tom Albanese saw a company response a day into the action: the company turned off its fax machines to avoid a deluge of written protests.

The EWC intervention, however, is sure to resonate. Roche said the EWC has found that Rio Tinto Alcan management failed to even consider proposals made by the union, a “destructive and socially irresponsible position.”

The 2 February letter added to Albanese: “Please know that our European forum will stand alongside the United Steelworkers in all organised efforts in Europe and elsewhere, and we will participate in actions deemed necessary by the USW to repel this anti-social attack.”

The EWC then demanded that Rio Tinto end the lockout and order local management back to the bargaining table to negotiate a fair, equitable and acceptable labour agreement with workers that does not decimate the economic well-being of the community. (The full letter can be read here.)

The chief issue behind the lockout is Rio Tinto Alcan’s desire to have unlimited outsourcing rights, something that would eventually half the wage base of the Saguenay-lac-Saint-Jean region. Since Rio Tinto purchased Alcan in 2007 for US$39 billion, Alma management has replaced each worker taking retirement, or in other reductions in force, by outsourcing to sub-contractors who use low-wage staff without full social benefits.

Syndicat des Métallos d’Alma tried to set a floor on full-time, direct employees in collective negotiations. Alcan refused and immediately locked out the unionised workforce on expiration of a prior five-year agreement. There is mounting proof that Rio Tinto Alcan is partially operating the 438,000-tonne facility with the use of scabs during the lockout, a prohibition under provincial Québec labour statute and something the USW is pursuing through the legal system.

A 40-day strike in the US state of Massachusetts has ended. Ninety brave members of the ICEM-affiliated Teamsters Union (IBT) backed Saint-Gobain’s CertainTeed subsidiary away from severe cuts to their health care plan, and ratified a five-year labour agreement by a 69-0 vote on 29 January.

The workers, who make asphalt roofing shingles, gypsum wallboard and fiberglass products at a plant outside Boston in Norwood, Massachusetts, returned to their jobs on 31 January with their heads held high, their pride intact, and most importantly their premium benefits package unsevered.

CertainTeed management came at the members of IBT Local 25 late last year with a proposal to abandon the union’s Health and Welfare Fund and replace it with an inferior company-managed plan. Such a plan would have left the workers with far fewer health care benefits, leaving them largely unprotected from illness or injury.

Workers took strike action on 19 December and when the company refused to move from its regressive proposals in US federal mediation on 13 January, Norwood Teamsters expanded their strike. Besides working with the ICEM and French union CFDT to take the dispute directly to executives of Saint-Gobain in Paris, they began handbilling other non-Teamster and non-represented CertainTeed and Saint-Gobain plants in the US.

“Our members would not accept the company plan and made that loud and clear to us,” said Local 25 Business Representative George Slicis. “We were on the picket line for 40 days, 24/7, through the holidays and in bad weather, and we were not going back unless the Teamster health care plan went back with us.”

The 69-0 vote last Sunday made that an affirmative. In bargaining again supervised by the Federal Mediation and Conciliation Service (FMCS) on 26 January, CertainTeed backed off the takeaways. Although there will be a very slight increase in workers’ out-of-pocket costs for continuation of the premium health coverage of US$6-per-week, that will be more than offset with the union negotiating a US$500 bonus each in years one through four of the labour agreement.

In addition, starting in year two, or late in 2012, and continuing in 2013, 2014 and 2015, workers will receive a 2% wage increase. Local 25 also won company-paid increases to the New England Teamsters Pension Fund of 10% in years one and two, and 6% each in the remaining years.

The ICEM congratulates Local 25 members at CertainTeed for their resolve in maintaining their earned benefits package and also commends Jean-Francois Renucci of CFDT, who took the case to preserve the US workers’ health and welfare insurance to top Saint-Gobain leaders.

A joint Executive Committee meeting of three European trade union federations on 31 January put the final touches on statutes, a political programme, and nominated candidates for leadership in what is to become a united eight-million-member industrial workers’ federation. The meeting, held near Mechelen, Belgium, was attended by 150 national union leaders from 25 nations.

The European Mine, Chemical and Energy Workers’ Federation (EMCEF), European Metalworkers’ Federation (EMF) and the European Trade Union Federation for textiles, Clothing, Leather and Footwear (ETUF-TCL) are now geared to formally merge on 16 May 2012 in Brussels, with dissolution Congresses coming a day earlier.

The joint Executive decreed that the new federation will strive to become a fighting force for a dynamic economic framework that allows industry to thrive as the motor for jobs and sustainable growth across Europe. The three current federations vowed that “social progress and the European social model cannot be sacrificed at the altar of ultra-liberal dogma.”

Although the new grouping has yet to formally adopt a name, its temporary moniker is the European Industrial Workers’ Federation (EIWF).

Michael Vassiliadis, President of Germany’s IGBCE, was nominated to serve as President, while current EMF General Secretary Ulrich Eckelmann was nominated to be General Secretary. Anders Ferbe of IF Metall, Sweden, Renzo Ambrosetti, UNIA, Switzerland, and Valeria Fedeli, CGIL FILCTEM, Italy, were nominated as Vice Presidents, while Sylvain Lefebvre, EMCEF, Bart Samyn, EMF, and Luc Triangle, ETUF-TCL, were nominated as Deputy General Secretaries.

Michael Vassiliadis
The new federation will consist of four policy committees – Collective Bargaining and Social Policy, Company Policy Committee, Industrial Policy Committee, and Social Dialogue Policy Committee. It will also be composed of eight regions: South, Benelux, Central, South-East, Eastern, British, Nordic/Baltic, and South-West.

Trade Union Industrial Federation Takes Shape for Europe

A three-week strike by 4,000 members of the National Union of Metalworkers of South Africa (NUMSA) spilled into the streets of Johannesburg on 15 November, with workers employed at Xstrata’s Boshoek and Wonderkop ferrochrome smelters near Rustenburg took a protest to the Swiss company’s Alloys headquarters. NUMSA members presented a petition to company managers demanding wage parity with workers employed at the Xstrata Lion ferrochrome smelter in Tubatse, Mpumalanga province.

Both operations are undergoing big expansions. Xstrata owns 79.5% of the ferrochrome complexes in South Africa, while publicly-listed Merafe Resources holds a 20.5% stake. Both companies also mine chrome in South Africa.

The strike by NUMSA in the North-West province began on 24 October after conciliation efforts by the country’s Commission for Conciliation, Mediation, and Arbitration (CCMA) failed. NUMSA and Xstrata Alloys met two days earlier, but a revised pay offer by the company fell short and workers rejected it.

NUMSA President Cedric Gina (rear) gets Xstrata's Edwin Hlatshwayo Sign Receipt of Petition
NUMSA is seeking an immediate 10% pay increase for Boshoek and Wonderkop metalworkers and a reduction of job grading systems from eight to five. That would close the wage gap with workers at the Lion smelter and equalize the grading system. Currently, Boshoek and Wonderkop workers earn 14 to 39% less than at Lion, depending on pay grades.

NUMSA is also seeking a housing allowance of R3,500.

The petition handed to Xstrata Alloys management last week states: “(The company) has angered workers and instead of focusing on negotiations, they have decided to apply cheap apartheid-era tactics of bashing members through police intimidation of the strike. NUMSA is very angry that workers who went on a legal and protected strike have been treated like common criminals.”

NUMSA President Cedric Gina and Congress of South African Trade Unions (COSATU) Second Deputy Vice President Zingiswi Losi led the march and handover of the petition. The petition asks the company to respond within 48 hours.

Xstrata is world’s largest producer of metal alloys, which besides ferrochrome includes vanadium and platinum, and accounts for one-third of total global production. The Boshoek smelter is currently seeing an expansion that will lift production to 240,000-tonnes-per-year by the end of next year. A second smelter, meanwhile, is now being constructed at the Lion operation that will see production double from the current 360,000 tonnes when it goes on line in the first half of 2013.

The Xstrata-Merafe joint venture in South Africa will then yield 2.3 million tonnes yearly of ferrochrome, which is used in stainless steel production.

ICEM, IMF and ITGLWF will hold the joint event “Cutting emissions - transforming jobs” at the UN climate change conference in Durban (COP17) to discuss a sustainable foundation for Just Transition and develop a common industrial strategy for the future of industrial workers.

GLOBAL: The 17th conference of the parties (COP17) to the UN framework convention on climate change will be held in Durban, South Africa, from November 28 to December 9, 2011. The international trade union movement led by ITUC will urge the governments to agree on a legally-binding climate regime and a concrete climate finance scheme, including provisions for a Just Transition.

To support ITUC's contribution, ICEM, IMF and ITGLWF will hold a joint event, "Cutting Emissions - Transforming Jobs" on November 30 at 14.30-16.00 in the COP17 World of Work Pavilion, at the Civil Society Space - University of KwaZulu, Howard College Campus, King George Av., Berea, Durban.

The event will promote a common industrial workers' position to ensure the "greening" of existing jobs, the creation of new, sustainable jobs, and a Just Transition, with concrete policies for green technology innovation and a sustainability fund securing the future for both today's and tomorrow's workers.

The discussions will focus on:

•Post Kyoto framework: Could a second commitment period of the Kyoto Protocol be a solution to avoid a gap in emission reduction commitments and to re-build the legally-binding framework covering all countries in the future negotiation process?
•Building a Foundation-Climate Finance: How should the funding be designed/realized to achieve sustainable jobs and a Just Transition? What are the components of a strong financing scheme e.g. mandatory contributions from governments, the Financial Transaction Tax (FTT), levy on maritime transportation & aviation, or?
•Just Transition: What kinds of programme are needed for industrial workers who are most dramatically affected by the climate change issues? How can both today's and tomorrow's workers benefit from the transformation to a sustainable economy? What support will be needed?
•Developing Industrial Strategy: Industrial strategies which aim towards sustainable production, the transformation and enhancement of existing jobs, and the creation of new, greener jobs are needed at local, national, regional and international levels. How could developed and developing countries be engaged to harmonize/develop respective industrial policies.
•Union’s role for the future: How should unions get involved to transform industry and create new, greener jobs be designed and implemented with the full participation?

The threat of a walkout last week by union members of the Canadian Auto Workers (CAW) served to force German tyre and auto-parts manufacturer Continental AG to back away from a concession-ridden labour contract at a research and development center in Chatham, Ontario.

Members of CAW Local 35 voted by 83% for a three-year renewal agreement at strike deadline 15 November in an accord that preserved full rights for new hires, including inclusion in a defined benefit pension plan, all other post-retirement benefits, and the same level of work benefits as existing staff.

The CAW branch union also won annual wage increases totaling over 9% for the three years, improved retirement incentives, and a signing bonus. The union represents 37 highly skilled workers employed at a research and development for engine management systems.

“We fought hard to preserve the rights of new hires and to prevent the creation of two tiers of workers in this workplace,” said CAW National Representative Richard Laverty. “This small group of workers stood together and pushed back numerous concession demands from this profitable and huge multinational corporation.”

The union agreed to take contract concessions in 2008 during the onset of the financial crisis and subsequent collapse of North American manufacturing segments. This came a year after Continental bought this and other automotive parts operations from Siemens VDO. Then, the Chatham plant made parts for emission control systems but with the sale to Continental, the German company cut the workforce and turned the operation into a R&D centre.

The PT Freeport Indonesia Workers’ Union of the Chemical, Energy, Mine Workers Union (CEMWU), or SP KEP SPSI, resumed wage negotiations this morning with Freeport-McMoRan’s Indonesian subsidiary tomorrow in hopes of getting the 93% owner of the world’s largest recoverable gold and copper deposits to increase its pay offer.

A strike that has crippled all production at the 175,000-ton-per-day mine is now in its ninth week.

From 14-18 November, the union covering 10,000 miners at US-based Freeport-McMoRan’s Grasberg mining complex in Papua province did engage in give-and-take negotiations and although some progress was made on wage differences, the two sides remain far apart.

Earlier, the union had given PT Freeport Indonesia, the Indonesian government, and local government leaders official notification that the strike would be extended another 30 days to 15 December. The ICEM, which has been directly involved in the dispute, responded to the extension by putting a call out to trade unions to assist the union in feeding striking families.

That call can be found in this 10 November ICEM letter and trade unions and others are encouraged to send contributions to the union’s official name in Papua province, the SPSI Freeport Indonesia Dana Perjuangan, at the bank numbers listed in this letter.

The union has been feeding 10,000 workers and their families from five open-air kitchens in southern Papua province near the port city of Timika. The ICEM was informed by the branch’s parent union in Jakarta, as well as by ICEM Indonesian Affiliates’ Chairman D. Patombong Sjaiful, that food staples are running low and a Solidarity Fund is short of money. Several ICEM affiliates immediately responded to the call, and more financial assistance is needed now.

The union and management also met two weeks ago for four days, from 7-10 November, with management increasing its two-year wage offer to 35% from 30%. The company is offering 24% in 2011 and 11% next year.

Prior to the start of the 15 September strike, Grasberg miners earned a wage of between US$2.13 per hour and US$3.54. The union recently lowered its demands from US$7.50 to US$4 for lower-paid workers in 2011-2012, and proposed a US$3.50 wage increase on 1 October 2012.

There are also a number of other issues still in dispute, including a metal bonus, a production bonus, and housing, education and vacation benefits. The major difference in all these issues is the company’s insistence that they be based on variable costs, while the union wants them set at fixed costs.

The PT Freeport Indonesia Workers’ Union continues to enforce a road blockade at Mile 28 that has hampered Freeport-McMoRan’s ability to produce and caused the company to declare force majeure on 22 October. A ruptured set of pipelines that carry gold and copper concentrate 114 kilometres from Grasberg to Timika, again site of this week bargaining, is now being repaired, with the company using helicopters to ferry construction crews and materials to the damaged portions of the lines.

In late October and early November, police threatened to break the blockade with force. But that threat – which was certain to have been met by resistance and bloodshed – is no longer there and police are no longer present at Mile 28. But rather, strikers and their families are forced onto reduced food rations as union funds have dried up.

The ICEM continues to advocate for the union’s wage and other demands to be met. Miners work 12-hour shifts some 4,200 metres high in the Sudirman Range and most spend another four unpaid hours each day getting to and from the Grasberg site via buses. Workers of the PT Freeport Indonesia Workers’ Union also undergo an excruciating roster schedule in which they work five days on, two days off, followed by six days of work and one day off, and then four days on, three days off.

Indonesian Miners Resume Talks Again Today with Freeport-McMoRan

In calling attention to jobs creation as equivalent economic growth, working people across Europe today led by the European Trade Union Confederation (ETUC) are in a Day of Action in opposition to the European Council’s adoption of a budget discipline treaty.

The decentralised mobilisations are occurring in scores of cities and worksites with a common theme pointed at EU governments and decision-makers: “Enough is enough! There are alternatives to austerity. Employment and social justice are the number one priorities.”

Today’s ETUC Day of Action is taking the form of demonstrations, work stoppages and information postings inside workplaces and government institutions stating that the European summit’s Treaty on Stability, Co-ordination and Governance is a straightjacket that will plunge the Eurozone into free-fall recession.

The actions include two demonstrations in Brussels, site of the European Council’s 1-2 March summit where the misguided treaty will intrinsically slash wages and social protections, restrict collective bargaining, and provide even more neo-liberal policies, hardly the remedies for economic growth to assure a sustainable future.

Union leaders, led by ETUC General Secretary Bernadette Ségol, meet with Council President Herman Van Rompuy and European Parliament President Martin Schulz at the European Council Building, while a mass rally takes place outside. Meanwhile, members of all Belgian trade unions will protest today outside the Belgian National Bank.

A sampling of other actions today includes a mass demonstration organised by the Romanian national trade union centres between 14h and 16h at Victoria Square in Bucharest. In Rome, Italian labour federations CGIL, CISL and UIL will demonstrate at Pantheon Place at 16h, while Hungarian trade unions will hold a press conference and manifestation.

In Greece, trade unions will take a three-hour work stoppage from 12h to 5h, while even in Georgia trade unions will protest Trade Union Action Day with a rally at Parliament in Tbilisi against their government’s one-sided labour code and the economic harm it brings.

“In mobilising on the same day everywhere in Europe for the first time,” said Ségol, “European trade unions are reacting with anger and exasperation.”

In the UK, British trade unions used the day to gear up their defence of the National Health Service (NHS), which will happen across the UK massively on 7 March. Both the ETUC and Trades Union Congress (TUC) denounced austerity measures that always “fall hardest on the shoulders of the weakest” when public services are cut.
