Thanks to dogged persistence by ICEM affiliate Communications, Energy, Paperworkers (CEP) Union of Canada, the fate of the 133,000 barrel-per-day oil refinery Shell refinery in Montr&eacute;al is still open and subject to sale. Last week, following a second court injunction prohibiting dismantling of the refinery until 10 September, Shell announced it again would negotiate with the Delek Group of Israel over purchase of the refinery. 
 
At stake are the jobs of 500 workers represented by the CEP. In January 2010, Shell announced plans to radically restructure its global downstream operations, including closure of the Montr&eacute;al East refinery by 1 June. 
 
The Anglo-Dutch multinational said it would continue operating part of the site as a terminal and distribution centre for scores of Shell retail outlets scattered across Qu&eacute;bec and Canada&rsquo;s Maritime Provinces. Such continuance, however, would require only 30 workers.

The CEP and its Montr&eacute;al branch union, Local 121, has battled relentlessly to find a buyer, as well as to press provincial and federal authorities to keep the refinery operating. Shell rejected bids by potential operators last spring and union members believe Shell wants the refinery shut, with imported petroleum products distributed through the terminal. 
 
On 8 July, a Qu&eacute;bec Superior Court granted the union a ten-day injunction preventing any cannibalizing of the refinery. &ldquo;We believe that maintaining the equipment in good condition until we get satisfactory answers to our questions about offers to but the facility&rdquo; is in everybody&rsquo;s best interests, said Local 121 President Jean-Claude Rocheleau. 
 
On 16 July, that injunction was extended into September. Meanwhile, last week on 20 July, Shell stated at a federal parliamentary hearing of the House of Commons that it re-open talks with Delek, a holding company in which its wholly-owned subsidiary, US Holdings Inc., operates a crude pipeline, refinery, and hundreds of gasoline retail outlets in the southern US. 
 
Delek had been an earlier bidder for the refinery, but Shell rejected the bid as too low. The ICEM remains hopeful that CEP will succeed in achieving sale of the refinery, preserving jobs for the union&rsquo;s energy workers. Shell operates two smaller Canadian refineries, in Sarnia, Ontario, and in Edmonton, Alberta.

CEP Fights to Keep Shell’s Montréal Oil Refinery Operating

In the rush to get copper production from the Cananea mine back on world markets, is Grupo M&eacute;xico disregarding the safety and health of contract workers? So it seems by an apparent undocumented rash of on-the-job accidents and injuries in the short six weeks since federal police opened the mine in Sonora State for the company. 
 
Following a 16 July accident in which a sub-contract worker was hospitalised after a five-metre fall, military police secured the perimeter of the hospital, not allowing anybody to enter. When leaders of Section 65 of the Mexican National Miners&rsquo; and Metalworkers&rsquo; Union (SNTMMSRM) tried to lend assistance to the injured worker, they were turned away by &ldquo;a violent and arrogant grenadier,&rdquo; according to a report. 
 
Workers of Los Mineros at Cananea claim there have been 20 such accidents with injuries since mine rehabilitation began following the military takeover on 6 June. But this cannot be confirmed because safety reporting, if it exists, is never verified. This non-transparency at a major copper recovery project is a pox on Grupo M&eacute;xico and a pox on federal Labour and Interior Ministries, and on the State of Sonora, the latter governmental agencies that have all taken up reconciliation roles.

The pitiful irony is that Grupo M&eacute;xico and federal police used brute force to reopen the Cananea mine on 6 June, crushing a strike that began over health and safety in 2007. Now they are at breakneck pace, using disposable contract workers, to re-start Cananea at a time &ndash; during first quarter 2010 &ndash; that world copper supply fell short of refined usage. 
 
In a media interview in late June, Grupo M&eacute;xico&rsquo;s Isaac Lopez Arzola, the director-general of Southern Copper&rsquo;s Mexicana de Cobre S.A., which functions as the company&rsquo;s copper operating and servicing subsidiary, said 700 workers are now employed at the mine, all non-direct to Grupo M&eacute;xico and Southern Copper, and the responsibility of individual contractors. That number is expected to climb to 1,700. 
 
Compared to a global investment strategy totaling US$2.8 billion, Grupo M&eacute;xico is spending only US$114 million to bring Cananea into production, rushing to get it done by first quarter 2011 to meet continued high copper prices. In turn, Southern Copper will double its global copper output over the next few years, making it the world&rsquo;s third largest copper producer. 
 
With copper prices doubling in early 2010 over copper pricing in early 2009, and considering that every 1% jump in the copper price equates to an estimated 1.3% rise in Grupo M&eacute;xico&rsquo;s equity value, should the company concern itself with safety, or the injuries of non-direct workers? 
 
Apparently not, except to surround them with militia so their stories cannot be heard.

Grupo México’s Infamous Safety Legacy Lives on at Cananea

The first phase of the project was sponsored by LO/TCO Biståndsnämnd, Sweden, and FNV Mondiaal, Netherlands, and ran from 2005 to 2008, with an additional project year in 2009. After a thorough internal assessment in 2008, a new project was approved, running from 2010 to 2012, sponsored by SASK of Finland and FNV Mondiaal. ICEM affiliates in these countries gave strong support and contributed financially to the project.Throughout the project periods, national HIV/AIDS coordinators were trained in regional workshops. At national level, activities started off with peer education and awareness and prevention campaigns. Increasingly, however, VCT campaigns were organised and thousands of workers, their families and members of the community queued up to know their status.Some progress has also been made on the adoption of workplace policies and the insertion of HIV/AIDS clauses in collective bargaining agreements. Despite a sometimes adverse relationship over conventional bargaining issues, companies must be seen as partners in the fight against the epidemic since an effective HIV/AIDS policy cannot be implemented without the participation of employers.HIV/AIDS workplace policies should also draw on the resources of companies for skills training, awareness and prevention campaigns and for VCT and ART services. Cost-benefit analyses have shown that even small expenses by companies for HIV/AIDS activities result in reduced costs for medical schemes, higher productivity, and reduced expenditure for training. Unions must continue to convince employers that it makes business sense to invest in the fight against HIV/AIDS.At the heart of the ongoing HIV/AIDS project are annually-approved national HIV/AIDS programmes that run in each of the 11 project countries. These &ldquo;projects-within-a-project&rdquo; are applied for by the national coordinators to the Sub-Saharan HIV/AIDS project coordinator, who discusses, approves and monitors all these individual national plans for action.Women issues in relation to HIV and AIDS also received a boost with two women-only sub-regional workshops in 2010 and 2011. Women&rsquo;s empowerment in taking control of their reproductive rights and dealing with issues such as violence at home and sexual harassment at the workplace were at the heart of these workshops. The use of female condoms was also promoted. The sub-regional workshops in turn led to women activities organised at national level. Several of these were not only relevant with respect to HIV/AIDS, but also strengthened unions by integrating more women in their union work and by recruiting more female members.Fighting HIV and AIDS is a national policy matter. All target countries have national policies to fight the pandemic and a National AIDS Commission, which coordinates the efforts of all stakeholders. It is important that trade union activities fit into this general framework. For this to happen, unions must be recognised as partners in national policy implementation and, subsequently, they have to actively seek contacts with national HIV/AIDS bodies.As part of the fight against the pandemic, trade unions should also seek the participation of NGOs in their activities and build alliances with them. NGOs often have more expertise and experience as they concentrate on one issue. Of utmost importance is the involvement of organisations of People Living with HIV/AIDS to reduce stigma and to demonstrate that HIV and AIDS should be treated like any other condition or disease.From its adoption by the International Labour Conference of the ILO in June 2010, ILO Recommendation 200 concerning HIV and AIDS and the World of Work, was promoted at in regional and national ICEM HIV/AIDS events. This is the first international human rights instrument to focus on HIV and AIDS and the world of work. All workers are protected by the new labour standard, including those in informal economies. As Recommendation 200 becomes more widely known and accepted, it has the potential to develop into a tool for unions to use.The Global Action Plan for the implementation of R200, as adopted by the ILO Governing Body in March 2011, seeks three outcomes for the period 2011 to 2015: reduction of stigma and discrimination, increased access to services, and scaled-up action by world of work actors.In our work, we also made a link to the broader ILO Decent Work Agenda, which is central in efforts to reduce poverty and to make occupational health and safety an integral part of the Decent Work Agenda. Important in this, as far as HIV/AIDS is concerned, is often not so much the job itself, but the conditions around it that can lead to behaviour that puts workers and their dependents at risk of acquiring HIV, such as working and living conditions of workers in remote mining areas, which contribute to an increasing infection rate.At global level, good cooperation was established with ILO/AIDS. Technical cooperation was not only extended by the ILO Head Office in Geneva but also by country offices where activities were organised. Special mention must be made of the cooperation with the ILO Delhi office, which greatly contributed to the success of the HIV/AIDS project in India, and of the collaboration with the ILO Pretoria office, which gave a boost to work on the ILO Decent Work Agenda and Recommendation 200.Work was initiated with the Global Fund to Fight AIDS, Tuberculosis and Malaria, the World Bank (WB AIDS Campaign Team for Africa) and the World Bank&rsquo;s International Finance Corporation (IFC against AIDS) with the objective to promote the concept of public/private partnership and co-investment with the involvement of unions. The dictum has been that the private sector is business and organised labour, i.e. trade unions. When skills training, knowledge transfer and other assistance are extended to management, it should also be offered to unions. No HIV and AIDS interventions at the workplace are effective if workers and their representatives are not included. Unfortunately, these organisations have not been responsive to such legitimate demands.An HIV/AIDS e-bulletin has been published monthly since October 2005. A dedicated HIV/AIDS website provided access to useful materials and links to other websites. Materials have included a leaflet, a manual for collective bargaining on HIV and AIDS issues, and a guide for resources and finance for HIV/AIDS activities. Very important for union work at the national level, a model union policy and a workplace policy on HIV/AIDS were developed.Another element of the work at global level has been the successful acquisition of additional funding to expand the project beyond Africa. Corporate partnership and solidarity contributions from affiliates made it possible to run HIV/AIDS projects in India, Trinidad &amp; Tobago, Mongolia, and Colombia. Supplementary funding was also obtained for Sub-Saharan Africa, mainly earmarked for VCT campaigns in Tanzania and Nigeria. The Danish LO/FTF supported a three-year project (2009-2011) in the mining sector in Ethiopia.While a lot has been achieved in the past years, much more still needs to be done. It was therefore decided to seek a continuation of the HIV/AIDS project and look at developing a new project proposal for sub-Saharan African IndustriALL affiliates for the years 2013-2015. Discussions are ongoing with the donor community on this.

IndustriALL Global Union to be New Force

	The abuse of basic labour rights in Iraq, and the bravery of Iraqi workers to continue to organise under extreme pressure of aggressive employers supported by viciously anti-trade union legislation from the Saddam era is continuing. A raft of recent attacks on trade union activity of oil workers is attracting wide condemnation from international trade unions, and includes fines, forced demotions, and relocation of union officials.

	The Court of Appeal has ruled against Ibrahim Radi, vice-president of the Iraqi Federation of Oil Unions (IFOU), confirming a fine of 34 million Iraqi dinars (US$30,000), an amount far beyond the trade union leader&rsquo;s ability to pay. In case of non-payment, Radi will face jail, and also the possible dismissal from his job. Hassan Jumaa Awad Al Assadi, President of IFOU calls for solidarity and assistance from trade union comrades abroad.

	IFOU President Hassan Jumaa has himself recently been disciplined for trade union activity, being arbitrarily demoted three years seniority including a substantial drop in salary.

	In May 2011 ICEM reported on the Sadrist-controlled Ministry of Labour controlling trade union elections, appointing a &ldquo;Ministerial Preparatory Committee&rdquo; (MPC), consisting of un-elected, politically bias officials, mostly from the Sadrist Party. MPC officials distributed union membership cards, arbitrarily choosing members favourable to their faction. Union offices were taken over with support from police and military personnel, and the union elections were held inside the Sadrist Party offices. Following international outcry, those election results were voided, but today the Ministry of Labour recognised the 2011 election results and asked the same preparatory committee to oversee a new round of worker elections on 2 June. The elections stand to appoint worker representatives at all levels, and will be marred with fraud and misconduct.

	A LabourStart campaign will be launched in the coming days gathering online messages to the Iraqi authorities. Join the campaign which also calls for justice in a number of further cases, connected to a peaceful protest of workers at the Maysan Oil Company for which they are charged and disciplined for &ldquo;inciting unrest&rdquo;.

Iraqi Oil Workers Union under Government Attack

<img alt="" src="" style="width: 100px;height: 39px" width="390" />The Colombian subsidiary of US-based glass company Ross International, Moldes Medellin, is attempting to dismiss the majority of its employees at the Sabaneta and Estrella Antioquia plants, despite social bargaining agreements protecting the workers&rsquo; rights to their jobs.The workers are members of ICEM-affiliated Sintravidricol and the union is leading the campaign against the dismissals. So far 20 employees have been forced out either through unilateral decisions of management or under the pretence of a &ldquo;voluntary agreement&rdquo; which has no other possible alternative than the worker losing their job.The fear now is that Moldes Medellin will cut its workforce by half, condemning 60 workers and their families to unemployment. Management is accused of targeting the unionised workers in the cuts, punishing the exercising of freedom to organise.<img alt="" height="174" src="" width="232" />If the mass dismissal is not stopped, Moldes Medellin will effectively crush the Sintravidricol plant-level unions. The agreement made all 240 workers at the three plants full-time employees, whereas the majority were previously on fixed-term contracts.Those hard-won advances are now at serious risk.

Support Colombian Glass Workers Facing Mass Dismissal

The National Union of Metalworkers of South Africa (NUMSA) voiced fierce opposition to government&rsquo;s decision to bail out the authoritarian and illegitimate Swaziland rule of King Mswati III. On 3 August, South African Finance Minister Pravin Gordhan announced a R2.4 billion (US$354 million, &euro;259 million) loan to the repressive regime to offset revenue shortfalls from the Southern African Customs Union (SACU).
&ldquo;This decision by the South African government to give King Mswati&rsquo;s regime a financial bail-out is a direct assault on our solidarity efforts to free and liberate the people of Swaziland from this hyena&rsquo;s tyranny,&rdquo; said NUMSA in a statement, making direct reference to Mozambique&rsquo;s 1987 Nkomati Accord with South Africa&rsquo;s apartheid regime.
Then, African National Congress (ANC) President Oliver Tambo said &ldquo;our brothers and sisters in Mozambique have hugged and kissed the most hated hyena in the world.&rdquo;
The South African loan to Mswati&rsquo;s absolute monarchy comes when all political parties have been banned, trade unionists are jailed, and a bureaucracy surrounding Mswati that has proven corrupt and ineffectual in tending to the needs of the impoverished country of 1.2 million. The Congress of South African Trade Unions (COSATU) and the South African Communist Party also oppose the loan.

<div>Swaziland had gone to the European Union, the African Development Bank, and the World Bank for loans but turned down Africa&rsquo;s last absolute monarchy. The International Monetary Fund (IMF) has refused to extend credit for what it calls blatant irresponsibility in handling budgetary processes.</div>
The first instalment of South Africa&rsquo;s loan is to be paid out late this month, the second in October and the final in February 2012. South Africa is to recoup payment over five years through Swaziland&rsquo;s share of SACU revenue sharing. 
Although there are some conditional requirements to the loan, none are readily transparent. Vague &ldquo;confidence-building measures&rdquo; by the Swazi regime, adherence to fiscal and technical reforms by the IMF (reforms that failed in past loans), and capacity-building support by the South African government are listed as those conditions.
COSATU was point-blank in its assessment of South Africa&rsquo;s loan: &ldquo;So long as there are no strict conditions to compel the regime to concede democratic reforms and to share the country&rsquo;s wealth among the people, the loan will simply be used to perpetuate the status quo. Mswati&rsquo;s lavish lifestyle and the royal family&rsquo;s extravagance, impunity and lack of accountability will continue unabated, while the conditions of misery for the majority get even worse.&rdquo;
NUMSA said the loan essentially squanders the &ldquo;hard-earned money generated through taxes&rdquo; of South Africans while continuing Mswati&rsquo;s &ldquo;order to unleash state terror and starve the people of Swaziland.&rdquo;

NUMSA Opposed to South Africa’s Non-Transparent Swaziland Loan

Further industrial actions in Queenland&rsquo;s rich coal fields happened over the weekend and early last week as three Australian unions &ndash; joined together as the Single Bargaining Unit (SBU) &ndash; continue months-long efforts to gain a fair collective agreement with the world&rsquo;s number one exporter of metallurgical coal, the BHP Billiton-Mitsubishi Alliance (BMA).
Mineworkers led by the Construction, Forestry, Mining and Energy Union (CFMEU), and the Australia Manufacturing Workers&rsquo; Union (AMWU) and Communications, Electrical and Plumbing Union (CEPU), this weekend took 12-hour work stoppages at BMA&rsquo;s Gregory Crinum and Blackwater mines in the Bowen Basin, while similar rolling 12-hour strikes occurred from 7-9 August at the Goonyella Riverside, Saraji, Peak Downs, and Norwich Park mine sites.
The protected actions are in preparation for SBU-BMA talks this week, 18-19 August. Some 4,000 miners have been stymied by the coal-producing enterprise belonging to the two multinationals since December 2010 over a fair collective agreement. Despite BMA publicly boasting of high miners&rsquo; salaries and its own pay offer in these drawn-out talks, the dispute has little to do with money but rather work conditions and quality-of-life issues. The SBU is resisting unwanted extensions on work rosters, which will negatively affect family life, and they oppose BMA&rsquo;s desire to gain flexibility over contracting out, an obvious job security threat. BMA wants to move from a five-day weekly roster to a seven-day one, and seeks greater rule over operators&rsquo; jobs.
Since industrial action began following a 2 June ballot that saw a 92% support, the strength of miners of the three unions has only grown. That was visible at a mass picket at the Saraji mine that was set up on 6 August.
BMA is a ten-year joint venture that extracts 58 million tonnes annually of coking coal from the Bowen Basin and exports it from its wholly-owned Hay Point terminal on Australia&rsquo;s east coast.

Union members of US affiliated Teamsters Union (IBT) used a broadening corporate campaign to win reprieve over job losses at a BMW auto-parts warehouse in California. IBT Local 495 and North American bosses of German auto-maker BMW agreed on 9 August to a six-month extension of a collective agreement that was to expire 31 August.
BMW North America had given notice in June that it would terminate the agreement at a parts distribution warehouse in Ontario, California, then and outsource the 68 Teamster jobs to a third party logistics company. The IBT nationally then ramped up a pressure campaign on both sides of the Atlantic (see prior <a href="/en/78-ICEM-InBrief/4570-US-Teamsters-Ardently-Resist-BMW-s-Auto-Parts-Outsourcing">ICEM news article</a> here) and there is little question that adverse publicity on the luxury auto producer caused management to re-consider.
<div>Last week, just as dockworkers belonging to unions affiliated with the International Transport Workers&rsquo; Federation (ITF) organised informational pickets at nine ports in 10 countries on behalf of the California warehouse workers, BMW North America sat down with Local 495 in Southern California and agreed to extend the contract for six months to allow the two sides to work out a mutually acceptable solution that addresses long-term employment for Teamster members.</div>

&ldquo;We sent a clear message to BMW with our campaign actions that outsourcing these jobs is unacceptable,&rdquo; said Teamsters Joint Council 42 Public Affairs Director Ed Rendon. &ldquo;We won&rsquo;t be happy until we get a full agreement, but we&rsquo;re highly optimistic this will happen and BMW will better run their business with our members&rdquo; maintaining direct employment.</div>
Added IBT Local 495 Secretary-Treasurer Bob Lennox, &ldquo;I am confident that BMW will honor its promises to find a solution to keep their long-time, dedicated workforce and ensure that these jobs remain good, middle-class jobs.&quot;
Teamster members and supporters protested at a 6-7 August weekend event called &ldquo;Bimmerfest&rdquo; in the state of Maryland where BMW enthusiasts annually turn out to celebrate ownership of the German car. Thousands of handbills were distributed and a Teamster-hired airplane flew overhead with a banner emblazoned &ldquo;BMW: the Ultimate Misery,&rdquo; the campaign&rsquo;s slogan.
And on 8 August, Los Angeles Mayor Antonio Villaraigosa sent a letter to BMW North America CEO Jim O&rsquo;Donnell telling him that members of the International Longshore &amp; Warehouse Union (ILWU) were about to picket the Port of Los Angeles, and reminded him that the company received monetary assistance during the 2008-09 financial crisis from the US federal government.
The 68 Ontario warehouse workers themselves had spent their weekends handbilling BMW dealerships in California, Oregon, and Washington state, telling consumers about on BMW&rsquo;s intended social dumping.
The Ontario, California, warehouse is one of six parts depots in the US, supplying and distributing BMW parts to auto dealerships and auto-supply outlets in the western region of the US.

Campaign Action Wins US Teamsters BMW Contract Extension

An unbroken chain of solidarity and staunch resolve by all 157 members of Canadian Auto Workers (CAW) Local 2228 staved off contract concessions in Canada recently. On 8 August, union members ratified a three-year agreement with Sandvik Materials Technology Canada, a subsidiary of Swedish industrial giant Sandvik AB, with an 80.6% vote, ending a successful strike that began on 13 July. 
 
On 9 and 10 August, CAW members returned to their Arnprior, Ontario, factory knowing they bested the company&rsquo;s mid-July &ldquo;last, best offer&rdquo; of pension reductions, cost-of-living (COLA) rollbacks, and contract language deletions. After Sandvik made some modifications in its original proposals in talks on 29 July, changes that CAW members saw as insufficient and which they rejected. The company returned to bargaining in early August with more revisions that essentially left a prior labour agreement intact.

There will be no changes to the roll-in effect of the COLA, no changes to job security, and pension benefits will remain the same. In addition, there were some benefit improvements and strengthened contract language regarding layoffs. A 1% wage increase is also due at the beginning of the third year. 
 
&ldquo;I&rsquo;m humbled by the level of support the membership ha shown in their first-even strike, in the facility&rsquo;s more than 30-year existence,&rdquo; said CAW Eastern Ontario Area Director Harry Ghadban. Local 2228 Unit Chairman Derek Mosley said: &ldquo;We could not have done it without the unwavering support from the membership and the support from the national union. 
 
&ldquo;We are proud of the solidarity of our membership in fighting back concessions and holding tough until a negotiated settlement was reached.&rdquo;

On 26 July, hundreds of CAW members turned out to manifest at Sandvik&rsquo;s Canadian headquarters in Mississauga, Ontario. 
 
And on Local 2228&rsquo;s blog after the 8 August ratification vote, one union member stated: &ldquo;We can all hold our heads high as we return to work knowing we sent a message to management saying we will not accept your final offer, we go back on our terms. I cannot express how proud I am.&rdquo;
