	Warning strikes in German metalworking, engineering and electronic sectors will broaden beginning today with the break-down last week of third round bargaining between IG Metall and employers’ associations in several states.  Upon expiration of a labour peace accord on 28 April, 2,500 German metalworkers began the warning strikes at select locations, taking creative and imaginative actions.

	Talks for 3.6 million German workers represented by IG Metall began in several states in late winter. Bargaining was stalemated in the last state talks, on 26 April, after employers put forth a less than satisfactory salary offer. They also refused to agree to union demands assuring full work guarantees for apprentices once their training tenures are over and more job rights for contract and agency workers.

	The offer put forward by employers’ association Gesamtmetall through its state chapters on 24 April was termed “a provocation” by IG Metall, thus causing mobilisation over the weekend when the peace accord expired. The proposal saw employers offering a 3% increase over 14 months, of through June 2013. The union is seeking a 6.5% pay rise over 12 months.

	The union’s goal is based on a run-up in productivity development, as well as projected inflation in 2012 and 2013. Guaranteed opportunity for apprentices and contract workers is also based on the fact that Germany currently experiences a shortage of skilled workers.

	The 6.5% wage proposal is indicative of German industrial workers being the driving force in a nation that is Europe’s biggest industrial power and strongest economy, with high pay and workers’ savings being the wellspring of that strength.

	Last weekend’s warning strikes began on 28 April in the eastern city of Zwickau in Saxony state, where hundreds of young metalworkers conducted a motorcycle parade. Other demonstrations over the weekend occurred in Bavaria, Berlin, NorthRhine-Westphalia, and Nordenham in northern Germany, where workers from several plants held a protest and mass breakfast early on Sunday morning.

	In Ingolstadt in Bavaria, some 80 apprentices gathered the night before and flashed a light-projector against the wall of a factory expressing their demand for job guarantees. Workers from a TDK factory in Munich held a torchlight parade that same night, and autoworkers from a Daimler Mercedes-Benz plant in Rasiah, Baden-Württemberg state, protested on Sunday.

	The actions continued on 30 April with loud protests in cities and streets near a Daimler Mercedes-Benz factory in Wöerth-am-Main in Rheinland-Pfalz, at a MAN diesel plant in Augsburg, in Baden-Württemberg in Bavaria, where lead talks will resume on 8 May.

	Yesterday on May Day in Hamburg, IG Metall President Berthold Huber pledged that the union will not be deterred from its agenda, and will bring the dispute into June if employers do not adhere to union demands. If upcoming talks do not produced the desired results, IG Metall is planning continuous strike actions commencing on 16 May.

	Besides a number of further warning actions today, mass demonstrations tomorrow, 3 May, are set at an Audi factory on Neckarsulm and a Porsche plant in Stuttgart. Some 900,000 of the 3.6 million workers affected are employed by Germany’s primary auto-makers.

German Warning Strikes Begin in Metals, Electronics Sectors

	The ICEM’s Turkish affiliate Lastik-İş, the Petroleum, Chemical and Rubber Industry Workers’ Union, achieved a ground-breaking, sector-wide collective agreement in the country’s tyre industry on 17 April, just prior to announcing that it would strike.

	With collective bargaining beginning on 10 January, negotiations covered over 4,000 rubber workers, including staff employed at multinationals such as Bridgestone, Goodyear and Pirelli at four plants in Izmit and Adapazari.

	The new agreement brought new awareness inside Turkey’s industrial relations with a first-ever company-financed pension scheme achieved in this round of collective bargaining. The companies will contribute an equivalent of 3% of workers’ salaries to the scheme, while wages will increase 11.5% in the first year of a two-year contract.

	With this, employers have agreed to increase salaries by 14.5% in total to meet the pension plan. The union had demanded 16% at the beginning of the negotiations, while employers had offered only 3.4%.

	Lastik-İş managed to preserve and enhance the purchasing power of its members, and made no compromises in inserting language on provisions related to flexible employment inside the tyre plants. The union also did not retreat in the face of consistent demands from employers for lower wages for new hires.

	According to the agreement, temporary workers will be able to join the union and be granted a 20% salary increase, which never has happened in the history of tyre negotiations.         

	The agreement was unanimously endorsed by the union’s rank-and-file membership through mass meetings after negotiations concluded. “Over 63 years of experience and self-confidence, Turkish tyre workers and their union have managed to continue to develop remarkable advances and to preserve trade union rights,” said Lastik-İş President Abdullah Karacan.

Lastik-İş Makes Great Strides in Turkish Rubber Talks with Multinationals

	Marking 28 April, the World Day for Safety and Health at Work, the Committee on Workers’ Capital (CWC) launched a briefing paper on workers’ safety and the role of responsible investing in ensuring labourrights. The report shows how investors can hold companies accountable for failure to protect their workforce from work-related accidents or diseases, and how workers’ capital especially through trade union pension funds can seriously effect change in corporate governance.

	Collaborators in the project included ICEM, the International Textile, Garment and Leather Workers Federation (ITGLWF), the Building and Wood Workers International (BWI), and ICEM affiliates the United Steelworkers (USW), and the National Union of Mineworkers of South Africa (NUM).

	The CWC is a joint initiative of the ITUC, Global Union Federations (GUFs), and the Trade Union Advisory Committee to the OECD (TUAC). Established in November 1999, following a meeting of international trade union leaders in Stockholm, Sweden, the CWC examines ways for workers to leverage their retirement savings on companies so that they respect human and labour rights.

	The paper includes case studies from the Massey Energy Upper Big Branch mine disaster of April 2010 that killed 29 non-union members in the state of West Virginia, and from USW oil workers at the Tesoro Refinery in Anacortes, Washington, and from the 2010 Deepwater Horizon oil spill in the Gulf of Mexico.

	The paper also includes a clear framework on how pension trustees can use their pension fund investments to address the issues of Occupational Health and Safety and labour rights.

Workers’ Capital Committee Launches Report - Investing in Decent Work, Safe and Healthy Workplaces

	On 24 April, the federal tribunal cancelled the only remaining warrant for the arrest of the leader of the Mexican Miners' Union (SNTMMSRM), Napoleón Gómez Urrutia, regarding US$55 million of union funds.

	On Tuesday 24 April, the First Unitary Criminal Court of Mexico City notified the union that the federal justice system had cancelled the preventive measure.

	Napoleón Gómez's lawyer, Marco Del Toro, said: "All the arrest warrants issued as part of this unprecedented campaign of political persecution have fallen one by one. We are very happy with today's ruling. It is a lesson to those in Mexico who think they can still conduct this kind of immoral persecution, which is alien to our legal system."

	"Once again, it has been shown that the political persecution against the miners' union and its leader is completely and absolutely illegal. Once again, the truth has been established. Napoleón Gómez Urrutia has never committed any kind of crime," said the union, in a press release.

	Andrew Vickers, Chair of the ICEM Mining Sector, described the decision as “further vindication of the magnificent struggle being played out by Napoleón, the USW, and Los Mineros. I find it truly amazing, although not terribly surprising, that governments can impose sanctions on countries and regimes such as Syria, Libya, Zimbabwe, Burma and Fiji, yet with Mexico and the Calderon regime, countries like the US and Australia fete them.”

	Gómez Urrutia has been in exile in Canada for six years, during which time he has worked constantly to establish his innocence and provide leadership for the miners' union.

Napoleón Gómez Nearly Home: Mexican Court Voids Warrant

	A two-day strike by ICEM Indonesian affiliate KSP2KI at one of the world’s largest paper mills this week produced sizeable salary increases for over 13,000 workers. With strike support from nearly all workers at Asia Pulp and Paper’s (APP) PT Pindo Deli’s twin mills in Karawang, West Java, the union achieved substantially more than the minimum government-mandated increase that APP was at first willing to distribute.

	The two-year accord becomes retroactive to 1 April and grants workers, in some cases, a doubling of that provincial government minimum. KSP2KI, or  Federasi Serikat Pekerja Pulp Dan Kertas, the Pulp and Paper Union of Indonesia, announced a three-day strike on 7 May but by yesterday, management had resumed talks and agreed to across-the-board increases.

	Last month, managers of the 900,000-metric-tonnes-per-year paperboard, writing papers and tissue mills had unilaterally decided on the minimum increase while still in bargaining. The strike and yesterday’s bargaining lifted the wage increase from 9.14% to 18% for most workers, with increases to 14.14% and 11.14% in other job classifications.

	That translates to an average IDR (Indonesia Rupiah) monthly increase of 139,363 (US$15.12). The minimum monthly pay at PT Pindo Deli in Karawang had been IDR 1,450,000 (US$157), so the pay grid for most workers will climb to above US$180-per-month.

	The ICEM commends the KSP2KI – a union with 7,650 members at the twin Karawang mills – for the well-organised strike action and subsequent result, and encourages all workers at Karawang, including workers of outsource companies operating inside the mills, to take up union membership.

	APP is part of Indonesian Sinar Mas Group and operates some ten paper machines and 14 paper-coating machines in the Karawang No. 1 and No. 2 mills in West Java. It also operates wholly-owned or majority-controlled pulp and paper mills – some nine in total – in other parts of Indonesia.

Short Strike Wins Big Pay Gains at APP Paper Mills in Karawang, Indonesia

	Mining conglomerate Rio Tinto is destroying the community of Alma, Québec, by the continued lockout of 780 workers, members of the United Steelworkers (USW). The lockout since 30 December 2011 is an economic move in order to increase profits at an aluminium smelter of subsidiary Alcan in Alma.

	Tomorrow in London, protests will occur outside and in the Annual General Meeting of Rio Tinto by USW Canadian members and their ally in the UK, Unite the Union. The protest will be supported by three Global Union Federations, the ICEM, the International Metalworkers’ Federation (IMF), and the International Transport Workers’ Federation (ITF).

	Shamefully, the International Olympic Committee (IOC) has contracted with Rio Tinto to produce gold, silver, and bronze medals for this summer’s Olympics and Paralympics Games in London. Active protests are currently underway against IOC, stating that the Games are tainted and achievements of the world’s best athletes are flawed by a company with a long track record of economic and environmental destruction on the communities where it operates. 	At tomorrow's protest, Unite will distribute replica Olympic medals to be passed out to the public at the shareholders' venue, the Queen Elizabeth II conference centre. Unite also has arranged for union-friendly Members of Parliament to submit an Early Day Motion in the UK Parliament.

	Rio Tinto has posted profits of US$20 billion over the past two years and despite the fact that the Alcan aluminium smelter in Alma is one of the most efficient and profitable in the world, it has used a lockout to reap even more profit. Alcan management of late has refused to engage the USW in meaningful negotiations to end the lock-out, predicated on the company’s desire to force mass outsourcing by eliminating and full and direct employment

	Alcan seeks to replace each retiring worker with a subcontract worker that will see 50% less than the current average union wage of C$34-an-hour. USW negotiators in early April submitted a proposal in bargaining to end the lockout, but Alcan management walked from the table still seeking the unlimited right to subcontract.

	Alcan has continued to receive special assistance from the province of Québec in a generous agreement whereby Hydro-Québec buys back unused electricity from the company while the lockout is ongoing.

	The lockout by Rio Tinto Alcan in Alma has triggered a global campaign against Rio Tinto that took on further dimensions early this week at a special Mines and Metals Networking meeting in Sydney, Australia, as well as at the 17-19 April ICEM World Mining Conference, also in Sydney. Trade unionists resolved to build a long-term global campaign against the world’s second largest resource company.

Global Unions, USW Bring Rio Tinto Alcan Canadian Dispute to Shareholders

	The ICEM-affiliated Pragatisheel Cement Shramik Sangh (PCSS) conducted a two-week tour of activities in Switzerland that concluded this week, educating trade union colleagues on the grave violations of work rights abuses by Holcim Cement of contract workers in India’s Chhattisgarh region.

	Causing a stir in the Swiss media, the PCSS together with Swiss union UNIA and Swiss-based human rights organisation <a href="http://www.multiwatch.ch/">MultiWatch</a>, solidarity organisation <a href="http://www.solifonds.ch/node/121">Solifonds</a>, the ICEM and Building and Woodworkers’ International (BWI) raised increasing awareness through various channels.

	The details of the case are shocking and include the worst examples of workers’ rights violations around the world, especially in terms of the global trend of outsourcing and engaging precarious employment relationships, which capital sees as a tool to lessen its responsibilities to workers.

	Holcim invested in the Indian cement industry in 2005 when the Indian government opened up the country’s resources to outside investment. Holcim’s two subsidiaries, ACC Jamul and Ambuja Cement, had a long history of abusing worker rights, and Holcim has thus far refused to reverse these practices. Instead, the Swiss-based company has overseen an increasing proportion of contract workers that now comprises 80% of the company’s total workforce.

	The PCSS represents contract workers at the two plants and Holcim is the largest cement producer in India. Contract workers are protected by Indian law and by a sectoral agreement prohibiting employment in core production work, with all work paid at the same rate that permanent workers receive.

	This stipulation has been flouted at Holcim India, where contract workers work side by side with permanent workers in core production, and they are denied proper protective equipment and paid one-third that of permanent workers. They also do not receive proper benefits and have greatly reduced rights to organise and bargain collectively.

	Contract workers of Holcim India have been punished for attempting to organise into the democratic PCSS union and as well, they have been punished for informing global Holcim management of the abuses. In fact, the majority of the PCSS members at Holcim are now excluded from work in the companies due to their union involvement.

	Global pressure has forced Holcim to pay attention to these violations in India, but when Holcim Executive Paul Hugentobler visited ACC Jamul recently, contract workers were all moved to a different shift and workers’ representatives were banned from taking part in meeting with him. Instead, representatives of the sham company union, OP Banchore, were involved.

	The Supreme Court of Chhattisgarh ruled in favour of the PCSS, instructing the company to award permanent employment contracts to those temporary employees, some of whom have remained on rolling temporary contracts for over 20 years. Holcim India even went so far as to reject India’s court ruling and instead committed large financial resources to extend the legal process.

	The PCSS, supported by ICEM, met last week with the National Contact Point of the OECD in Switzerland as part of the process of the complaint on breaches of the OECD Guidelines for Multinational Enterprises at Holcim India.

	PCSS was welcomed at the ILO on 13 April, where explanations of the violations in India were met with serious concern and proposals for possible action.

	Public events in Zurich, Bern, and Geneva spoiled Holcim’s 100-year anniversary celebrations. A demonstration outside Holcim’s Annual General Shareholders meeting yesterday presented management with a new book documenting the group’s abuses around the world, and a manifesto for which signatures are being collected around the world, already signed by global figures such as Noam Chomsky.

Holcim Cement Tainted in Switzerland by Work Rights Abuses in India

	The four-month dispute by consumer products company Unilever to scrap a final salary pension scheme for 5,200 UK workers ended in march when unions members of two of the three unions involved voted to accept a compromise.

	Members of Unite the Union and the Union of Shop, Distributive and Allied Workers (USDAW) accepted a revised deal that does close off the scheme, but grants important protections regarding indexing of a new career averaging plan, built-in consultations with the unions, and a moratorium on any further changes until the year 2018.

	A ballot by the third union involved, the GMB, is currently underway. Union members of Unite, the largest labour organisation representing Unilever workers at the 12 food and consumer products factories, voted by a two-to-one margin to accept the compromise. In March, USDAW members – in a vote with a low turn-out – rejected the proposal, but the union conducted a second ballot early this month that passed.

	According to Unite National officer Jennie Formby, the company retreated in some of its harshest proposals contained in the new pension scheme, including unilateral ability to implement annual indexing below UK’s Retail Price Index (RPI) and eliminating any consultations with the social partners.

	In the compromise, negotiated with the help of UK’s Advisory, Conciliation, and Mediation Services (ACAS), indexing of the new scheme to take effect 1 July will be at RPI plus one percent and Unilever is obligated to discuss aspects of the new scheme twice annually with the three unions.

	The Anglo-Dutch company’s hard stance in eliminating a final salary pension plan in the UK produced the first strikes ever at Unilever plants there, with workers taking industrial action in December and again in 11 days of rolling strikes in late January.

Unilever Pension Dispute Ends in UK in Brokered Compromise

As we remember those that have died, been injured or suffered ill health as a result of work, we must also commit to making occupational health and safety one of the highest priorities for IndustriALL Global Union.

	Every year, on April 28, the World Day on Safety and Health at Work, workers take a moment to reflect on the devastating toll taken by workplace fatalities, injuries, and occupational diseases.

	IndustriALL Global Union will soon be created, a new organization speaking for some 50 million workers represented by its affiliates. Here are some statistics that should give us all pause. Of IndustriALL's 50 million affiliated workers:

	<li style="text-align: justify">
		An estimated 16,400 will die in 2012 as a result of their work. That's about 45 fatalities per day.</li>
	<li style="text-align: justify">
		About 5,000 IndustriALL members will die this year of cancer, alone.</li>
	<li style="text-align: justify">
		1,570,000 will be diagnosed with a non-fatal occupational disease.</li>
	<li style="text-align: justify">
		An enormous number, millions, impossible to estimate with any accuracy, will be injured on the job.</li>
</ul>

	These numbers, shocking as they are, are certainly gross underestimates.

	Drawn from International Labour Organization's Bureau of Labour Statistics and estimates of occupational fatalities and diseases produced in 2008, they rely on nationally accepted statistics reported to the ILO by member countries. In most cases, these are taken from the country's workers' compensation systems, immediately omitting workers whose disease or death was not accepted as "occupational" in origin, or who were not covered by the workers' compensation system. Occupational diseases are chronically under-diagnosed, and occupational injuries are subject to various strategies to suppress reporting or fraudulently misrepresent them.

	In addition, these estimates simply divide world totals by IndustriALL's fraction of the global labour force. In reality, IndustriALL will represent workers in industries with many more hazards than most. It is worth remembering that even in traditionally dangerous workplaces such as coal mines, an estimated five times as many workers die of occupational diseases, than of sudden accidental causes such as fires, explosions, falls, or encounters with machinery.

	IndustriALL clearly has to make occupational health and safety one of its highest priorities.

	There are a large number of global standard-setting agencies and agencies that engage in different aspects of occupational health and safety. The alphabet soup of their acronyms includes ILO, WHO, OHSAS, ISO, GRI, UNEP, GHS, REACH, SAICM. IndustriALL must watch all of these closely and pressure them to do a better job of protecting workers.

	IndustriALL will inherit a substantial number of Global Framework Agreements with trend-setting multinational companies. Occupational health and safety provisions must become more prominent in most of these.

	Global campaigns on specific issues, such as the ongoing campaign to raise the number of ratifications of ILO Convention 176 on Safety and Health in Mines, must continue.

	Occupational health and safety is a complex problem. Interconnected systems must be created to identify and control workplace hazards, and protect workers from them. Central to that effort must be the full participation of workers through their representatives, and on Joint Health and Safety Committees.

	There is no simple, magic solution that can be quickly implemented. Instead, occupational health and safety requires hard work and determined campaigning by union activists. Despite the global race for profits, our health is not for sale."

28 April 2012: A Day of Mourning

	The 20 February shooting at strikers – mainly women – of the KaoWay Sports Ltd. footwear factory in Bavet, Svey Rieng province, Cambodia, appears to have been committed by the governor of Bavet region, Chhouk Bandith. Three women were shot and seriously wounded after a man dressed in police-style khakis got out of a vehicle and began firing at people.

	The factory produces shoes primarily for the German apparel company Puma. According to ITGLWF affiliate, the Coalition of Cambodian Apparel Workers’ Democratic Union (C.CAWDU), thousands of the 6,000 employed at the factory engaged in strike action on 17-18 February. When strikes resumed on 20 February, Chhouk Bandith allegedly jumped out of a Lexus 470 with a bodyguard and a policeman upon exiting the factory and fired shots from a high-power gun equipped with silencer at strikers.

	After firing, he fled in a Toyota Camry and truckloads of police moved in to quell disbelieving and angry strikers. Police have questioned Chhouk Bandith, and C.CAWDU believes he was held for three days, but has since been released.

	The entire incident, occurring about 09h00, was captured by a KaoWay factory security camera. Puma has been conducting its own investigation since the outset, together with an NGO. 

	Buot Chinda, 21, was shot through the chest with bullets that narrowly missed her heart and severely punctured her lung. She was near death, but now is in stable but serious condition at a Phnom Penh hospital. The two other women who were shot and injured are Keo Neth, 18, and Nuth Sakhorn, 23. 

	A senior ILO official, who monitors a programme called Better Factories Cambodia, said in press comments, “It doesn’t look good for Cambodia when this type of violence is concerned.”

	Puma’s shoe workers, employed by Taiwanese-based KaoWay, were striking over better transport and food allowances, and better pay and conditions overall. Due to the industrial action – and Puma’s rapid response to the random violence – the strike has ended and all workers’ demands have been met in full.

	The strike and shootings had a different scenario at a separate Cambodian dispute, this one at Singapore-based Medtecs, a health textiles and apparel maker located in Kampong Siem district, some 125 kilometres from Bavet. While 2,000 strikers pelted the factory with rocks, police at the scene were unarmed and at stand-down because of the KaoWay shootings.

	The Medtecs strike was over the company failing to live up to decisions handed down by a binding Arbitration Council. It has been resolved due to the strike action.
