The European Metalworkers&rsquo; Federation (EMF) and Areva, the Paris-based nuclear power and nuclear service provider, signed a protocol agreement on 1 April intended to facilitate career enhancement and employee competencies within the 13 European countries that Areva operates in. 
 
Entitled &ldquo;Memorandum of Agreement on Professions and Competences Forecast,&rdquo; the protocol framework is the second that EMF and Areva have adopted, the first being a 2006 Equal Opportunities pact that a European Commission (EC) project now oversees. 
 
The new agreement is intended to forecast and manage career development of Areva staff by providing training, work-life balance, mobility, transfer of knowledge throughout the company, as well as giving a positive work environment across a person&rsquo;s entire employment career with Areva.

The three-year agreement will be tracked under a separate EC project called Forecasting and Anticipating Competencies in Europe through Social Dialogue (FACES). The protocol calls for an annual appraisal that will &ldquo;articulate the positioning of the employee in such a way that their qualifications and their payment is in relation to their level of competencies and performance.&rdquo; 
 
The agreement states that such assessments will not conflict with existing national collective bargaining agreements. 
 
It commits the company to develop a training policy in step with the needs of workers &ldquo;to both preserve and renew competencies in order to have the best possible career evolution.&rdquo; Each of Areva&rsquo;s 35,000 workers in Europe will have access to 30 hours of training per annum, which can be allotted over three years. 
 
The agreement&rsquo;s overall monitoring device is a committee of Areva management and the European Works Council Select Committee, which will evaluate and present the results yearly to the EMF. 
 
Areva is a ten-year-old company that was formed through a three-way merger between CEA-Industrie, COGEMA, and Framatome to combine the French Government's interests in several nuclear power and information technology businesses. CEA-Industrie, (Commissariat &agrave; l'&Eacute;nergie Atomique or French Atomic Energy Commission) owns about 80% of Areva. The company globally operates in 43 countries and employs 48,000 staff. 
 
Areva designs and builds nuclear reactors and components for nuclear power plants, and it also supplies nuclear fuel, engineering, maintenance, and inspection of nuclear facilities.

Mobilisation in the Netherlands toward strike action won 330,000 metalworkers a 25-month labour agreement in the small metals and electric-technical sector. The pay package of 4.45% exceeds Dutch inflation and is expected to set the pace for national contracts in the coming weeks in automotive and the big metals sectors. 
 
FNV Bondgenoten, CNV Vakmensen, and De Unie reached a tentative agreement with the Metaal &amp; Techniek industry asssociation, representing 30,000 employers, late on 6 April, which now prevents another two weeks of scheduled mobilisation that could have led to industrial actions. A prior agreement in the sector covering metal fabrication, installation, as well as plumbing, heating, and electrical installation expired 1 April.&nbsp;

&ldquo;The employers didn&rsquo;t want a fight and we were quickly mobilising toward strike action,&rdquo; said Jan Berghuis, head of the sector for FNV Bondgenoten, who called the pact &ldquo;trendsetting.&rdquo; 
 
&ldquo;With inflation expected to be less than 2%, this is a very good result and it will likely prove very important in the big metal and automotive sectors.&rdquo; 
 
Some 150,000 metalworkers in basic steel and other heavy metal production resume talks through their unions on 19 April. The agreement in that sector expires 1 May. The automotive sector, where 90,000 workers are employed, has a social agreement expiring on 1 June. 
 
The accord in light metals and electric-technical provides exceptional training opportunities and investment of such for workers, a key part of the deal. Berghuis also said the unions won language regarding the use of short-term contract labour that specifies this work can only go to labour-hire firms that have collective agreements with the unions. 
 
The 4.45% pay increase will come in four steps over the next 18 months. Berghuis said the only disappointment came in not securing a higher wage or a stipend for young workers. But young workers brought into the sector during the financial crisis will benefit by the 4.45%. 
 
The three unions and Metaal &amp; Techniek industry had been at a bargaining stalemate since late February, and only a week ago mobilisation meetings and union activity indicated there could be a rare Dutch strike in this sector. But a compromise on wages, extending the agreement into a second year, the unions gaining the necessary continuing education and training criteria, and workable language on contract labour means the agreement will be recommended for ratification by all three unions.

Dutch Unions Agree to ‘Trendsetting’ Terms in Light Metals, Electric Sector

ICEM-affiliated Sintravidricol of Colombia won a much-heralded victory in December 2007, achieving recognition and a collective agreement at three metal-moulding plants owned by US-based multinational Ross International. The victory followed a 23-day strike, and a three-year struggle that garnered international support through the ICEM. 
 
The agreement made all 240 workers at the three plants full-time employees, whereas the majority were previously on fixed-term contracts. 
 
That four-year agreement is now seven months from expiration, and Sintravidricol&rsquo;s Section Presidents for La Estrella and Sabaneta, Brahyan Sanchez Henao and Heriberto Giraldo Hernandez, are calling for the company to come to the table and discuss a new agreement for all employees of the group.
The union seeks improvements on paid leave for union activity, and greater stability and formalisation of employment to stop the increasing use of outsourcing at the plants. Sintravidricol formally submitted their list of demands on 5 April to the company.

Outsourced employees at two of the three worksites, Andes International Tooling Limited and Andes Cast Metals Foundry Limited, were successfully&nbsp;brought into Sintravidricol in 2007&nbsp;through a campaign supported by the ICEM and the United Steelworkers (USW) and its Flint/Glass Section, after those plants were opened in 2004. Workers at Moldes Medellin Ltd. had organised with Sintravidricol previously. 
 
During the bitter dispute of 2007 which culminated in the first agreement, the company signed two parallel agreements with non-unionised staff. A central goal of this negotiating round will be to scrap those divisive agreements and reach a settlement to cover all staff. Sintravidricol bargaining representatives will be seeking improved guarantees on development of mature industrial relations at the three plants.

Colombian Glass Workers Seek to Build on Gains Made in 2007

Today, 15 March, the International Federation of Chemical, Energy, Mine, and General Workers&rsquo; Union (ICEM), the International Metalworkers&rsquo; Federation (IMF) and their Norwegian affiliated trade unions, Fellesforbundet and IndustriEnergi (IE) signed a Global Framework Agreement (GFA) with Norsk Hydro ASA in Oslo. 
 
The agreement covers provisions of freedom of association and collective bargaining rights, discrimination, forced labour, child labour, health and safety, wages, working conditions, employment conditions, skills training, HIV/AIDS, and environmental conditions, referencing the standards established by the core labour conventions of the International Labour Organisation (ILO).

Norske Hydro was established more than 100 years ago and today is a leading global supplier of aluminum products and energy solutions. The Hydro companies have a total of 23,000 workers in more than 40 countries worldwide. The production facilities are mainly located in Europe, North America, Australia, and Qatar. 
 
In addition to the agreement, the parties agreed to establish a working group on the US legislation and US practices related to freedom of association and collective bargaining rights. The conclusions of this group&rsquo;s work will provide a basis for revision of the GFA in 2012.

ICEM, IMF, Norwegian Unions Sign Global Social Accord with Norsk Hydro

ICEM&rsquo;s affiliated mining union Sintracarb&oacute;n is calling for pressure to be increased local management of food multination Aramark, to follow their legal requirement and enter into bargaining with the newly formed union. 
 
The 90 workers at Aramark formed a branch of the national Colombian union of food workers, SINAILTRAINAL on 21 February, elected the leadership, and drafted and approved the list of demands which was presented to management the following day, 22 February. 
 
Colombian labour law requires the employer to respond and enter bargaining with the nascent union within five days. This step has not been taken by local Aramark management. 
 
The absence of any mechanism for industrial relations at the contractor had lead workers to frustration on salary, and shift scheduling especially. 
 
Sintracarb&oacute;n has escalated its campaign to organise outsourced workers at Cerrej&oacute;n over the last two years, following a congress vote to change the organisation&rsquo;s statutes and allow inclusion of outsourced workers.

New SASK/FNV-sponsored HIV/AIDS Project 
 
Agreement was reached with the Solidarity Support Organisations SASK (the Trade Union Solidarity Centre of Finland) and FNV-Mondiaal of the Netherlands for a new HIV/AIDS project running for three years from 2010 to 2012. 
 
The project will allow the ICEM and its affiliates in sub-Saharan Africa to build on the experience of five years HIV/AIDS project work and intensify activities in a number of countries, as well as continue regional and sub-regional work in Africa. 
 
Special emphasis in the project will be on the training of peer educators/lay counsellors from affiliates to advocate voluntary counselling and testing and counsel on treatment and care, as well as on the conclusion of HIV/AIDS workplace policies and HIV/AIDS clauses in collective bargaining agreements. 
 
The project will be coordinated from the ICEM Johannesburg Project Office with a consultant based in Geneva.

Sponsors Continue ICEM HIV/AIDS Projects 
 
Several other HIV/AIDS projects will continue in 2010. The Women&rsquo;s Department of ICEM&rsquo;s German affiliate, IGBCE, is sponsoring the successful campaigning and advocacy project in Tanzania, in cooperation with ICEM affiliates TAMICO and TUICO. The Humanity Fund of ICEM Canadian affiliate, the Communications, Energy, and Paperworkers (CEP) Union, is supporting the second phase of the HIV/AIDS programme in Trinidad and Tobago in cooperation with ICEM-affiliated Oilfield Workers&rsquo; Trade Union (OWTU). Negotiations are underway to extend the very successful HIV/AIDS project in India, which was sponsored by the German pharmaceutical company Boehringer Ingelheim, and to initiate a new project in Jordan with support from the Norwegian affiliate Industri-Energi (IE). 
 
The HIV/AIDS project sponsored by the Danish Solidarity Support Organisation, LO/FTF Council, in cooperation with the Ethiopian affiliate, the National Industrial Federation of Energy, Chemical, and Mine Trade Unions (NIFECM), will be running until the end of 2011.

A Successful Year in Nigeria 
 
The HIV/AIDS project in Nigeria, jointly sponsored by the Humanity Fund of the Canadian CEP Union, the ICEM HIV/AIDS project, and Nigerian affiliates NUPENG and PENGASSAN, has been particularly successful. 
 
Almost 8,000 workers and members of the community were mobilised for awareness meetings in a six-month period in 2009. Well over 2,000 agreed to be tested. This number would have been much higher if counsellors had not been limited in the number of people they can counsel in a day. The project also demonstrated how far good cooperation with the business sector can go, since the Nigeria Business Coalition against AIDS (NIBUCCA) provided mobile testing units. 
 
Training of project staff was facilitated by USAID and training of union officials and members was sponsored by SMARTWork, which also provided funding for a project office and for the salaries of three staff members.

HIV/AIDS Events in 2010 
 
Important HIV/AIDS events will take place in 2010. The 18th International AIDS Conference, a major biannual event, will take place in Vienna, Austria, from 18 to 23 July. The theme of the Conference is &ldquo;Right Here, Right Now,&rdquo; and the conference will emphasise the importance of protecting and promoting human rights as a prerequisite to a successful response to HIV and AIDS. 
 
The G8/G20 Meeting in Huntsville, Canada, just outside of Toronto will test the commitment of the world&rsquo;s leaders to universal access to HIV prevention, treatment, care, and support which, they had pledged to achieve by this year. 
 
At the 99th Session of the International Labour Conference in June in Geneva, the second reading and likely adoption of a new ILO instrument on HIV/AIDS and the world of work will take place. 
 
For the Global Fund, 2010 is a key year with the 3rd Replenishment Meeting taking place in the Netherlands in March. The meeting will determine the amount of funding governments will pledge for the years 2011 to 2013.

US Commits US$1.05 Billion to Global Fund 
 
US President Barack Obama signed a spending bill for the 2010 fiscal year that includes a US$1.05 billion appropriation for the Global Fund to Fight AIDS, Tuberculosis and Malaria. This is the largest sum ever committed by one country to the Global Fund in a single year. 
 
With this amount, the Global Fund is closer to meeting the demand for financing Round 9 grants worth US$2.4 billion over two years.

Asia Close to Winning AIDS Treatment Battle 
 
The departing head of the UNAIDS Programme in the Asia-Pacific Region, Prasada Rao, said that the region is within three years of winning the battle against the AIDS pandemic. Increased treatment coverage and prevention programmes are turning the tide against AIDS. 
 
In Thailand and Cambodia, treatment coverage has reached almost 90%. In India, 50% get treatment, but in China and Burma the number stands at only 30 to 35%. This puts the region on track to achieve the Millennium Development Goal of halting and reversing the epidemic by 2015. 
 
However, access in remote areas in China and India, disrupted AIDS programmes in Pakistan and Afghanistan, and sharp rises in prevalence rates in Indonesia&rsquo;s Papua province and neighbouring Papua New Guinea leave millions at risk.

Zambia: HIV Testing Services Missing the Mark 
 
Voluntary counselling and testing (VCT) services form a critical opportunity to provide risk reduction counselling and HIV prevention information. According to a report by Private Sector Partnerships-One, VCT services in Zambia are squandering this opportunity to reach clients with information about how to reduce their HIV risk. 
 
The study found that although condom use was emphasised only one in three clients received counselling on reducing their number of sexual partners and even fewer were advised on how to disclose their HIV test results to partners. The research also found that VCT services were mainly accessed by the most educated segments of the population and were largely failing to reach those who have no or only primary school education. 
 
Zambia has a prevalence rate of 14.3% but the infection rate is as high as 20% in some urban areas.

Travel Restrictions Based on HIV Status Lifted 
 
The UN, UNAIDS and HIV/AIDS organisations all over the world welcomed the elimination of travel restrictions based on the HIV status of a person by the US and the Republic of Korea. The US policy change was announced by President Barack Obama in October 2009 (see <a href="/en/72-HIV-AIDS/3492-ICEM-HIV-AIDS-e-bulletin-No.-50-November-2009">ICEM HIV/AIDS e-bulletin No. 50</a> of November 2009). 
 
Some 57 countries still have some form of restrictions on entry, stay, and residence based on the HIV status of a person. UNAIDS Executive Director Michel Sidib&eacute; called for freedom of movement for people living with HIV in 2010, the year when global leaders have committed to achieve universal access to HIV prevention, treatment, care, and support.

Global Fund Board Addresses Risks of Treatment Disruptions 
 
The Global Fund is taking action to minimise the risk of treatment disruptions arising from interruptions in Global Fund financing and from weaknesses in country-level procurement and supply management systems. 
 
Inadequate stock management and poor state of medical warehouses, non-transparent procurement and late submission of disbursement requests are among the reasons which contribute to the danger of treatment disruptions. 
 
A report of the Portfolio and Implementation Committee to the Global Fund Board contains detailed measures to prevent treatment disruptions, which are a death sentence to people on anti-retroviral drugs.

TAC Receives FES Human Rights Award 
 
On 10 December, Human Rights Day, Germany&rsquo;s Friedrich-Ebert-Stiftung (FES) awarded its Human Rights Prize to the South African Treatment Action Campaign (TAC). TAC has been in the forefront to advocate better HIV/AIDS services and fight for treatment in South Africa.

SWHAP Conference: Business Combating HIV/AIDS 
 
The Swedish Workplace HIV/AIDS Programme (SWHAP) organised a major conference in Stockholm on World AIDS Day, 1 December, on the role of the world of work in combating HIV/AIDS. Close to 100 representatives from business and trade unions in sub-Saharan Africa and from Swedish companies and unions took part in the event. It was co-organised with the ILO. 
 
In this occasion, Atlas Copco South Africa was awarded the SWHAP 2009 Achievement Award for its commitment and support of HIV/AIDS workplace programmes since 2003.

The ICEM&rsquo;s new global Contract and Agency Labour (CAL) Coordinator/Consultant began work in her new duties last week. Ashling Seely comes from the International Textiles, Garment, and Leather Workers Federation (ITGLWF) and will continue working for the ITGLWF part-time as coordinator for the Global Union Federation&rsquo;s Sportswear Project and as Policy Assistant to the General Secretary. 
 
Through her work as the new global Coordinator/Consultant on CAL, it is anticipated that more will be done, including support work to affiliates of ICEM, ITGLWF, and the International Metalworkers&rsquo; Federation (IMF) in their daily struggles and solidarity actions on CAL and precarious work.

Short strikes by copper miners in Chile have ended and new collective agreements are in place with both the state-owned copper company, Codelco, and with Anglo-Swiss multinational Xstrata. Striking mineworkers at Codelco&rsquo;s Chuquicamata complex have settled, however an agreement still needs to be reached for 280 miners at the state-owned firm&rsquo;s Codelco Norte and for 500 miners at El Teniente. 
 
Meanwhile, mineworkers at Xstrata&rsquo;s Altonorte copper smelter agreed to contract terms, following one week of industrial action that ended on 4 January. 
 
Some 5,600 miners at Chuquicamata, located in Chile&rsquo;s northern region, ended two days of strike action on 5 January after accepting a pay rise of 4% and a bonus totaling US$24,280. Codelco&rsquo;s Chuquicamata workers also won a US$6,000 interest-free loan. Miners voted by 2,610 to 1,203 to accept the deal.

The Chuquicamata produces around four percent of the world&rsquo;s total copper supply. The vast complex includes the Chuquicamata and Mina Sur mines, and the short strike boosted global prices to a 16-month high. Union leaders had been seeking a 7.5% salary increase and a US$28,000 bonus, claiming the cost of living in the remote region is higher than anywhere in Chile. 
 
It was the first strike at these Codelco mines since 1996. The new collective agreement will last 38 months and took effect on 1 January. 
 
The settlement at Xstrata&rsquo;s Altonorte smelter, also in Chile&rsquo;s northern Region II, includes a two percent increase to base wages, a bonus of US$5,000, and an annual production bonus of US$1,500. The new collective agreement will be in effect for a three-year period, backdated to 18 December 2009. Miners of Labour Union No. 1 at Altonorte began their strike action on 28 December.

Altonorte employs 660 workers and treats raw copper and other mining by-products to obtain copper anodes. The site has the capacity to produce 290,000 tonnes per year of copper in anode form. Xstrata is the fourth largest copper producer in the world. 
 
End-of-year negotiations at both Codelco and Xstrata coincided with a big jump in global copper prices, bringing pricing levels to 130 percent of what they were in early 2009. Codelco resumes bargaining with miners at El Teniente in March. 
 
Chile, the world&rsquo;s largest copper producer, reached an output of 5.3 million tonnes in 2008, and it is estimated that the 2009 figure will be similar. This equals roughly one-third of total global production.

In Hobart, Tasmania, the Construction, Forestry, Mining, And Energy Union (CFMEU) and Belgian-based lead and zinc producer Nyrstar NV agreed to a 14-day cooling down period last week following escalated industrial tensions that included the threat of a lock-out under Australian&rsquo;s Fair Act by the company. 
 
Nyrstar operates a 300-worker zinc smelter in Hobart and exports some 250,000 tonnes of zinc cathode annually from Tasmania. The two parties resume negotiations under the supervision of Fair Work Australia, the government&rsquo;s new labour dispute agency.

The dispute flared in mid-December when some workers opted to take lawful industrial actions, including work bans and other stoppages. Strikes occurred on December 19 and December 24. Nyrstar immediately responded by issuing letters to strikers stating they would face a 16-day lockout, while another letter to those not striking stated that implementation of partial work bans will be construed as refusal to do any work, thus staff will not be paid at all. 
 
The central issue in the Nyrstar Australian dispute is the company insistence to continue a performance-based pay system, while the CFMEU and another workplace representative is seeking renewal of an enterprise agreement that contains automatic and set pay increases. The current operating enterprise contract expired three years ago, with no accord reached in that time period. 
 
Nyrstar was formerly a joint venture between Belgian metals and chemicals company Umicore and Australian mining and development company Zinifex Ltd. It was spun off into a separate company in late 2007 and wholly owns GM-Metal of France and 25% of Thailand&rsquo;s Padaeng Industry Public Company Ltd. Zinifex remains Nyrstar&rsquo;s primary source for raw zinc, while Umicore is a main buyer of Nyrstar&rsquo;s processed zinc. Globally, Nyrstar also processes some copper, gold, indium, and refined silver.

12 December: A mass &quot;civil society&quot; demonstration demanding action on greenhouse gases took place today. Tens of thousands of demonstrators took part in mostly peaceful fashion, although there are reports of several hundred arrests, and some police brutality. The Copenhagen negotiations are troubled. The US negotiators in particular are so far reluctant to agree to anything substantive on targets and financing. China is unwilling to accept external verification of its progress, which is a US demand. Developing countries are anxious to defend the principles in the Kyoto Protocol and secure funding for mitigation and adaptation. Targets, and even a baseline year, remain far from agreement.

13 December: No formal meetings of the parties were scheduled for today. A limited number of meetings of observers and informal groups occurred. The trade union delegation met in caucus. Union lobbying is making a difference, and many governments seem favourably disposed to accepting some version of &quot;labour's paragraph&quot; in the final text. This may be due, in part, to the economic crisis and the wish of political leaders to be able to say something positive about jobs when spinning the Copenhagen outcome. However, attempts to modify the text or move it from the body of the &quot;Shared Vision&quot; document to the preamble of the final document, may create problems for us. 
As far as the broader progress of the talks is concerned, it is at present difficult to predict the outcome. The outcome may be a bad agreement (neither fair, nor ambitious, nor legally binding) with or without the wording on Jobs and Just Transition that labour wants. 
 
14 December: Today, at what was to be a meeting with the COP15 President, it was instead announced to those present that security issues would trump public participation in the remaining days of the Copenhagen talks. Of some 40,000 registered delegates, only 9,000 &quot;observers&quot; (all NGOs, all labour unions) would be admitted tomorrow and Wednesday; 1,000 &ldquo;observers&rdquo; on Thursday; and 90 &ldquo;observers&rdquo; on Friday. Security issues and problems at the registration desk have created a nightmare for people trying to get into the Bella Center. Fortunately, the next three days feature a number of events at labour's off-site World of Work pavilion, where access will be unaffected by developments at the Bella Center. Events today include: 1.) Trade Unions and Climate Change: the need for Just Transition, presented by the International Trade Union Confederation (ITUC); 2.) Low Carbon Diet: The trade union vision of sustainable food production and the right to food, presented by the International Union for Food and Agricultural Workers (IUF); 3.) 15 December: Reports continue of delegates trying to register standing in the cold for hours, only to be turned away. Keep in mind that the capacity of the Bella Center is only 15,000 according to fire safety regulations, but the secretariat accepted some 40,000 registrations. Today's World of Work events include:

16 December: This morning, an informal meeting of trade unionists affiliated with the ICEM, as well as the IMF, the EMF and EMCEF took place at the headquarters of the Danish union 3F. Thanks must go to Jesper Lund Larsen of 3F for helping ICEM obtain the venue in an over-crowded and chaotic city. 
In the afternoon, the four organisations&rsquo; joint World of Work event, &quot;Cutting Emissions: Transforming Industrial Jobs&quot; took place. It was a huge success, with a standing-room-only crowd, high-profile speakers, and plenty of interest in our message.

17 December: Admission to the Bella Center is all but impossible. &quot;Observer&quot; delegates admitted to the Bella Center today were supposed to be restricted to 1,000, but before this number was reached all new admissions were completely closed except to official government negotiators. A morning meeting of labour delegates took place at the LO-Denmark building, but a snowfall this morning was the final straw that broke the back of Copenhagen's already overstressed public transport system. I was not able to get there in time. Truly, this conference has become a catastrophe for the city of Copenhagen. Reports from those few still inside the Bella Center provided first indications that the entire negotiating work to date was being trashed in favour of a political agreement negotiated between only a few of the major participants. In this scenario, &quot;labour's paragraph&quot; will disappear, at least temporarily. 
 
18 December: Only 90 &quot;observer&quot; delegates, including only 9 trade unionists, were to be admitted to the Bella Center. It is now hopeless for any others to try to interact directly with any of the negotiators. 
The political leaders of the world, unable to reach a consensus on prepared texts, have crafted a face-saving document. In fact, the document was negotiated primarily between the US, China, and some 20 other countries, short-circuiting the UNFCCC process. Now called the Copenhagen Accord, the document itself meets none of the criteria of labour and civil society groups necessary to the final accord, and it contains no references to sustainable jobs, decent work, or Just Transition. However, it does make reference to political will to keep global warming below 2 centigrade degrees global average, with a scientific review following the release of the IPCC's fifth review. It also has some non-specific references to financing and targets. After two weeks of meetings, and months and years of preparatory work, many would describe this weak result as a disgrace. In the interests of fair reporting, some optimists say that at least it creates a political basis for a potential agreement at a later meeting. The work of the Ad-hoc Working Group on Longterm Cooperative Action, where &quot;labour's paragraph&quot; resides, is mandated to continue and may be incorporated in a subsequent, more detailed agreement. Let us hope that the pessimists are wrong and the optimists are right. In either case, we still have much work to do.
