With Singapore&rsquo;s Retirement and Re-Employment Act (RRA) set to take effect on 1 January 2012, two of ICEM&rsquo;s affiliated unions in the city-state have successfully entered into Memorandums of Agreement with employers and employer organisations stating that salary decreases will not happen once companies are mandated to offer jobs to workers when they reach age 62. 
 
The United Workers of Petroleum Industry (UWPI) and the Singapore Shell Employees&rsquo; Union (SSEU) announced last week that the agreements go beyond what will be required in the new law by guaranteeing that salaries and bonus payments will be maintained for workers between the ages of 62 and 65. 
 
The RRA amends a 1999 law that mandates retirement at age 62. The new Act requires employers to offer re-employment to a worker who reaches age 62 after January 2012, but a provision allows bosses to make &ldquo;reasonable&rdquo; adjustments in salaries, employment terms, and job assignments.

Last week, the UWPI got 13 employers to agree to the memorandum stating no lowering of salaries or elimination of bonus payments for oil or petrochemical workers choosing to continue to work after age 62. SSEU reached a similar deal with the Royal Dutch Shell subsidiary in Singapore two months ago. UWPI must now convince 13 other companies to do the same, and the precedent created by the Shell memorandum and last week&rsquo;s deal is expected to convince most to sign such accords with UWPI. 
 
Employers in Singapore, many of whom have begun offering re-employment ahead of the new law, have argued that pay cuts for older workers are necessary because seniority-based salary schemes inflate payrolls. Last week&rsquo;s signing was praised as a &ldquo;win-win&rdquo; result by one governmental minister who said the companies benefit from the loyalty and experience of the older workers. 
 
About half of Singapore&rsquo;s 5,000 oil and petrochemical workers are now covered by the no-cut agreements. The RAA, passed by Singapore&rsquo;s Parliament on 11 January 2011, is aimed at giving more financial security to older citizens, and these labour agreements recently signed in the ICEM sectors now go further to fulfil this.

Singapore’s Oil, Chemical Unions Blocking Pay Cuts after Age 62

The Action Plan of the ICEM World Conference for the Chemical Industries held in October 2010 in Istanbul, Turkey, defined developing and improving company and sector global and regional network activities as a key priority. 
 
The Conference then endorsed the Secretariat to organize the first meeting of the ICEM Global Pharmaceutical Unions&rsquo; Network in consultation with the unions in the sector. As a result of this, around fifty representatives of ICEM affiliates in the pharmaceutical sector from Belgium, Brazil, France, Germany, Hungary, India, Indonesia, Japan, Norway, Romania, Slovenia, South Africa, Spain, Turkey and USA met on 28 October in Geneva to discuss current developments in the industry and possible actions in the future.

The meeting received a detailed report from Kemal &Ouml;zkan, ICEM Director of Industry and Corporate Affairs, on the global pharmaceutical industry, including an economic and social overview; and impacts of changing health care systems. The report showed that although patent expirations and limits on drug spending can hamper growth of drug sales in developed countries, global pharmaceutical sales are in a growth trend. A substantial rise comes from emerging markets, and the great majority of the expansion is driven by growth in China, the world&rsquo;s third-largest market in the sector. 
 
The participants shared their experiences from respective countries. &ldquo;Due to low birth rate and an ageing population, the costs of the social security system including pension, health care and welfare have been rapidly increasing, which led to a need for reform of tax and social security systems&rdquo; reported Naramato Masafumi, President of Karoken, Council of Chemical Workers&rsquo; Union of Japan, who spoke on behalf of Japanese unions.&rdquo; 
 
&ldquo;Moreover, currently Japan has many problems affecting the socio-economy such as deflation, highly appreciated yen, increased non-regular employees, and the recovery from the devastating Great Earthquake and Tsunami,&rdquo; said Naramato. In his report Ghosalkar Ravindra Govind, President of ICEM&rsquo;s India affiliate Chemical Mazdoor Federation (HMS), underlined considerable changes in his country.

&ldquo;My country accounts for a relatively large share of the world&rsquo;s disease burden. And while India&rsquo;s burgeoning middle class has greater access to excellent healthcare, the vast majority of citizens still have limited access to basic care,&rdquo; Ghosalkar stated. Other participants gave similar reports about their individual countries and companies. 
 
The participants also largely discussed the current status of restructuring in the industry with mergers and acquisitions, and delocalization and closures of production and research facilities by multinational corporations. 
 
The biggest sale of a private company was Japanese Takeda&rsquo;s acquisition of Swiss pharmaceutical company Nycomed. As an immediate effect of the meeting, representatives of Takeda from Japan, Indonesia and Germany, in a side event, came together to establish a continuous cooperation and networking with each other. 
 
The participants were also shocked to hear the recent announcement of Swiss-based company Novartis with two thousand job losses and two factory closures in Switzerland and Italy, which resulted in an immediate solidarity message to employees and unions there. Fran&ccedil;oise Pierre of FCE-CFDT from France, secretary of the EWC of Sanofi Aventis, reported on a difficult situation at her company where management has announced more restructuring in research and development. 
 
In the conclusions, the ICEM General Secretary Manfred Warda mentioned that the network will continue to exchange information and company-level networking drives will be strengthened. It was also agreed to provide immediate solidarity with the unions facing challenges of restructuring. The network elected a representative of the Japanese unions as chairman, while the next meeting is scheduled for the second part of 2012 in Japan.

ICEM Affiliates in Pharmaceutical Sector Strengthen Networking

The ILO Tripartite Meeting on Promoting Social Dialogue on Restructuring and its Effects on Employment in the Chemical and Pharmaceutical Industries, held from 24-27 October, ended with key conclusions. The purpose of the meeting was to examine best practices of social dialogue, which can facilitate a constructive and conducive atmosphere during restructurings, including mergers and acquisitions. 
 
It was also to adopt conclusions that include proposals for action by governments, employers, and workers&rsquo; organizations, and the ILO. 
 
The meeting was composed of interested governments, 15 employer representatives, and 15 workers&rsquo; representatives appointed by the Governing Body based on nominations submitted by the ILO Director-General after consultations with the respective groups.

In addition, representatives of intergovernmental organizations and observers representing certain NGOs also attended the meeting. Coordinated by the ICEM, in cooperation with International Trade Union Confederation (ITUC) and ILO ACTRAV, the workers&rsquo; group elected Tomas Nieber, Chairman of the ICEM Chemical Sector and Head of Department Economic and Industrial Policy for Germany&rsquo;s IGBCE as chairperson, while Alfons de Potter, Vice-President of Belgian CSC Construction, Energy and Industry was selected spokesperson and Linda McCulloch, National Officer of UK&rsquo;s Unite the Union was selected vice-chairperson. ICEM&rsquo;s Kemal &Ouml;zkan was secretary for the group. 
 
The meeting handled eight discussion points: employment changes in both qualitative and quantitative terms occurring in restructuring processes; ILO&rsquo;s Global Jobs Pact implementations; skills and qualifications, as well as vocational training and education programmes that are conducive to sustainable development; making the industries more attractive to young workers and women, and provide better opportunities for long-term career development; challenges and opportunities by contract and agency labour; best practices of social dialogue in facilitating a constructive and conducive atmosphere for better industrial relations during restructuring; role of social dialogue in improving sustainability of small and medium-sized enterprises, contributing to promoting decent work; and possible activities the ILO should take to promote social dialogue and good employer&ndash;employee relations.

Following long deliberations, a <a href="/wp-content/migration/icem/TMCPI-conclusions-2011-En.pdf">set of conclusions</a> were unanimously adopted at the plenary session. It was agreed that &ldquo;social dialogue between worker representatives and employers is a valuable means to manage the process of restructuring in the chemical and pharmaceutical industries, thereby contributing to equitable outcomes for all concerned parties whether at global, regional, national or the enterprise levels.&rdquo; 
 
The groups also underlined that &ldquo;restructuring in the chemical and pharmaceutical sectors should not affect the principles and rights at work as defined by the 1998 ILO Declaration.&rdquo; 
 
An important step forward was achieved on Contract and Agency Labour. The conclusions state: &ldquo;Where the use of contract and agency labour becomes necessary, chemical and pharmaceutical firms should at all times ensure that national occupational safety and health laws, regulations and good practice are applied to this category of workers in accordance with the ILO&rsquo;s fundamental principles and rights at work and relevant international labour standards. Contract and agency workers should enjoy the same fundamental rights at work as the firm&rsquo;s directly recruited workers.&rdquo; 
 
At the meeting&rsquo;s end, ICEM General Secretary Manfred Warda said that workers, employers, and governments worked in a constructive manner with a view to securing employment issues in the chemical and pharmaceutical industries. &ldquo;These conclusions are an important guidance tool for all of us,&rdquo; said Warda. &ldquo;It is now time to make proper follow-up activities for making sure these they have practical applications.&rdquo;

Conclusions Adopted at ILO Tripartite Chemicals, Pharmaceutical Meeting

The International Federation of Chemical, Energy, Mine and &amp; General Workers&rsquo; Unions (ICEM) condemns the cold-blooded assassination of a Colombian contract worker who was working with affiliate Uni&oacute;n Sindical Obrera (USO) to bring trade union rights to temporary workers at Ecopetrol&rsquo;s Barrancabermeja refining and petrochemicals complex in Santander department. 
 
Isidro Rivera Barrera, 45, was repairing a washing machine in front of his home at 16h on 26 September in Barrancabermeja when a gunman jumped off a motorcycle and shot him three times at point-blank range. The assassin and accomplice then escaped on the high-powered motorcycle. 
 
&ldquo;This cowardly act again reminds us that Colombia is a deadly country for those exercising freedom of association and free speech rights,&rdquo; said ICEM General Secretary Manfred Warda. &ldquo;We reiterate our trade union affiliate USO&rsquo;s call that Colombia&rsquo;s public prosecution office uses all means to apprehend and prosecute the criminals and masterminds behind this heinous crime.&rdquo; 
 
The ICEM also called on Ecopetrol, its major contractor at Barrancabermeja, Foster Wheeler AG, and all other sub-contractors to ensure the security of all oil industry workers in the city. The ICEM further called on 90% state-owned Ecopetrol and its contractors to create workplace climates where freedom of association and rights to join unions and bargain collectively are considered common civil liberties. 
 
Isidro Rivera was shot twice in the shoulder and once in the throat. He died within minutes of the shooting, slumped across the chair he was working on and in front of neighbours who came running after hearing the shots. Isidro Rivera was a recognised union member by Ecopetrol who was attempting to spread the trade union message to contract workers inside Colombia&rsquo;s biggest downstream oil and petrochemical facilities. He is survived by three children.

Contract Workers’ Leader at Ecopetrol in Colombia Assassinated

The three-month-long wage dispute between a branch of ICEM Indonesia affiliate Federasi Serikat Pekerja Pulp Dan Kertas (FSP2KI) and managers of a pulp mill on Sumatra Island owned by the Japanese Marubeni Group was resolved recently. Along with settlement, the Human Resource director that exhibited rude and coercive behaviour toward the union&rsquo;s bargaining committee in July was sacked. 
 
SPPTTEL, the branch union of FSP2KI at the PT Tanjung Enim Lestari pulp mill near Muaraenim, and Marubeni were able to reach a 2011 wage accord with help from the provincial Manpower Ministry office. The two sides reached a compromise on wages, but it was the company&rsquo;s dismissal of Eko Ganefianto that perhaps is the biggest triumph for paperworkers of SPPTEL. 
 
In collective negotiations, this boss threatened worker layoffs and termination of all bargaining committee members when the union put forward its wage demands. Ganefianto also threatened to call out police to forcefully break any strike that SPPTTEL called. 
 
Mostly due to the manager&rsquo;s words and tone, SPPTTEL did strike for three days in late July (see <a href="/en/19-Pulp-Paper/4573-Paperworkers-Strike-Indonesian-Pulp-Mill-Pressure-Brings-Marubeni-to-Table ">prior ICEM report</a>). Although a police presence was nearby, the walkout by 1,000 paperworkers was peaceful. 
 
In pursuant bargaining, the union retreated from monthly wage demands of IDR 632,000 (US$74) and the company moved upward considerably. The agreement reached just over two weeks ago calls for a monthly increase of IDR 240,000 (US$27) per month. The average median salary at Marubeni&rsquo;s pulp mill is IDR 2 million, or US$235-per-month. 
 
The union also won payment for the three days of strike action, and partial payment on salaries for the post-fasting Ramadan days of Eid ul-Fitr.

Indonesia Pulp Dispute Settled; Human Resource Director Sacked

The European Mine, Chemicals, Energy Federation (EMCEF), the European Chemical Employers&rsquo; Group (ECEG), and the European Chemical Industry Council (Cefic) signed on 6 September a declaration to jointly encourage policymakers to implement the recommendations by the High Level Group on the Competitiveness of the European Chemical Industry. 
 
The agreement was signed at the European Commission headquarters in Brussels with Employment, Social Affairs and Inclusion Commissioner L&aacute;szl&oacute; Andor participating. 
 
The three-pillared blueprint, entitled &ldquo;Framework conditions for a sustainable chemical industry in Europe,&rdquo; centers on positive environmental, economic, and social principles. Under the environmental principal, the three social partners share the view that the voluntary Responsible Care programme offers the best possibilities to make continual improvements in safety, health and the environment.

The social component specifies good working conditions, life-long learning, and improving employability through skill development, retention and re-employment. The social partners also emphasize opportunities here for young people, and they say this social framework serves so far as the main contribution to the Agenda for New Skills and Jobs under the Euro 2020 strategy. 
 
The economic pillar is built around competitiveness and innovation, and striving to maintain Europe&rsquo;s strong position in global chemicals. The declaration states that the High Level Group&rsquo;s recommendations do &ldquo;form a strategic agenda for areas such as innovation, intellectual property, regulation, energy and climate change, logistics and trade policy.&rdquo; 
 
EMCEF General Secretary Michael Wolters said the declaration &ldquo;highlights the urgent need to see sustainability as a way to safeguard and expand high-skilled, high value-added jobs in Europe through a comprehensive EU industrial policy.&rdquo;

Europe’s Chemical Social Partners Sign Sustainability Pact

On 14 September 14, the ICEM held an education and awareness-raising event on ILO Convention 176, the Health and Safety in Mines Convention, at XIX World Congress on Safety and Health at Work (WCSHW), an important global occupational health and safety gathering. It took place at the Hali&ccedil; Congress Center in Istanbul. 
 
The ICEM forum had the presence of two of the leaders of ICEM-affiliated mining unions, which indicated the commitment from them to get Turkey to ratify and implement the standards contained in Convention 176. Nurettin Ak&ccedil;ul, President of T&uuml;rkiye Maden-İş, the Mine Workers&rsquo; Union of Turkey, and President Ey&uuml;p Alabaş of Genel Maden-İş, the General Mine Workers&rsquo; Union of Turkey, participated and expressed the necessity of improved mine safety through adoption of global standards. 
 
ICEM Industry and Corporate Affairs Director Kemal &Ouml;zkan introduced the panellists. He noted that the ICEM has made mine safety a top priority, and will vigilantly work to get more countries to ratify ILO Convention 176. 
 
The first panellist was Dr. Fikret Sazak, Director of Education Department for Maden-İş. He reviewed the deplorable occupational health and safety conditions in Turkey's mining sector, as well as generally.

Neo-liberal policies of deregulation, privatization, and globalization are devastating the sector, he said. There is a large informal sector within the Turkish economy. Even within the formal sector, there is high unemployment, low union density, and therefore a big problem with contract labour, flexible labour arrangements, and other forms of precarious work. 
 
Turkish mines are poorly regulated, and there are not enough government inspectors to adequately enforce even those regulations that do exist. 
 
Sazak concluded that the solution lies in enacting effective and enforceable occupational health and safety laws, much more education and training, and worker participation through joint Health and Safety Committees. ILO Convention 176 sets out a minimum standard for all of these things, therefore it should be a high priority for the government of Turkey to ratify it. This will not happen without strong unions. 
 
ICEM Mining Officer Glen Mpufane entitled his presentation &ldquo;First Aid Needed for Safety and Health in the Mining Industry.&rdquo; He focused on various incentive systems used to compensate miners &ndash; both workers and managers. This creates a race to the bottom where all standards are sacrificed to the altar of profit. 
 
Surveying recent mining disasters, in Pakistan, New Zealand, the US, China, Russia, Mexico and other countries, Mpufane concluded that the role of trade unions was crucial. The ICEM predecessor, the Miners&rsquo; International Federation (MIF), played a major role in drafting and adopting ILO Convention 176 in 1995, and now the ICEM is the major organization campaigning for country to country ratification. 
 
Brian Kohler, ICEM Officer for Health, Safety and Sustainability, reviewed some of the provisions contained in ILO Convention 176, and the associated Recommendation 183. 
 
The main features include recommendations for a strong national legislative and regulatory framework, including inspection, required accident investigation, and reporting and record-keeping; employers' responsibilities to provide adequate training and supervision; hazard control following the principle of eliminating or controlling the hazard as close to the source of the hazard as possible and relying on personal protective equipment only as a last resort, and a recognition of workers rights to participate in health and safety policy-making at the workplace level and to remove themselves from danger. 
 
Other important provisions include topics such as risk assessment and control, health surveillance, and risk communication. Good engineering design is a starting point for a safe mine, stated Kohler. Effective emergency response procedures and equipment are also necessary. 
 
Kohler concluded by saying when it comes to occupational health and safety, governments and employers have responsibilities &ndash; workers have rights.

ICEM Holds Forum on ILO C. 176 at Safety Congress in Turkey

Movement finally occurred in the ten-and-a-half-month lockout by U.S. Steel Corp. of United Steelworkers (USW) Local 1005 members in Hamilton, Canada, but too little of it by the concession-seeking company by all accounts. The American steelmaker tabled an offer one week ago, but little in it has changed from US Steel&rsquo;s original demands. 
 
The lockout of 900 steelworkers in the province of Ontario began on 7 November 2010 when USW Local 1005 refused to put a concession-laden proposal before proud union members. US Steel is demanding closure of the defined benefit plan to new hires, an end to pension indexing for 9,000 retirees, cuts to cost-of-living adjustments, and elimination of two weeks vacation time.

Negotiations commenced on 13 September for the first time since the lockout began and Hamilton Works managers tabled the offer. The union took it to an information meeting on 21 September, but Local 1005&rsquo;s Executive Committee reviewed it days earlier, and passed a resolution declaring it &ldquo;substantially the same as the offer presented prior to locking the workers out on November 7, 2010, as concerns the demands to give up indexing of pensions and permitting new hires to go into a defined contribution plan instead of being part of the defined benefit plan.&rdquo; 
 
Local 1005&rsquo;s committee also said parts of the new offer actually &ldquo;make it worse,&rdquo; proving &ldquo;that (U.S. Steel) continues to refuse to bargain in good faith.&rdquo; 
 
A major sticking point reportedly is the offer contains call-back language in which the company will only re-start certain operations with a very limited number of workers. The new offer also contains a modest ratification bonus. 
 
USW Local 1005 and U.S. Steel are expected to continue talks under the guidance of provincial mediator Simon Clark.

Talks Begin but Relations Still Frozen in Canadian Steel Lockout of USW Members

United Steelworkers (USW) Local 6166 in Thompson, Manitoba, ratified a three-year labour agreement with the mining company Vale on 15 September, the same day that a prior three-year pact expired. Following a strike authorisation vote by the 1,100-strong unionised workforce a week earlier that passed by 95.3%, the USW bargaining team negotiated excellent gains in wage, pension, cost-of-living, and other payment schemes. 
 
But most importantly the union diminished the harsh effects to workers in expected 2015 closures of a nickel refinery and smelter at Vale&rsquo;s Manitoba Operations. 
 
The new contract contains annual 2.5% wage increases, plus a C$.35-per-hour cost-of-living increase that will lift earnings C$2.72-an-hour over the life of the agreement. USW Local 6166&rsquo;s defined-benefit pension plan also will increase, to C$3,450 monthly for full work service effective this year and to C$3,550 in September 2013. 
 
The union won &ldquo;preferential hiring&rdquo; language for workers that will lose their jobs in 2015 when Vale pares the Thompson workforce by 45% with the refinery and smelter closures. Vale&rsquo;s Thompson operations exceed new federal Canadian sulphur dioxide standards that will come in 2015. The Brazilian company is building a new C$2.8 billion refining complex in Long Harbour, Labrador/Newfoundland, near Vale&rsquo;s Voiseys Bay and Goose Bay mine operations in eastern Canada. 
 
The new contract language will mean workers likely to be furloughed will have preference in employment opportunities at Vale&rsquo;s Canadian operations in Ontario and Labrador/Newfoundland. The company will continue mine and milling processing in Manitoba and also will continue development of new nickel deposits in the western Canadian province. 
 
Other gains in the 2011 to 2014 collective agreement include a transition and retention payment to be paid over the three years. That will total C$10,000 and include a C$4,000 pay-out on 15 October 2011, and C$2,000 pay-outs in each of the next three years. The new agreement also contains an incentive scheme. 
 
&ldquo;Obviously, the gains we have made are bittersweet, given Vale&rsquo;s plans to close our smelter and refinery in 2015, eliminating 500 jobs,&rdquo; said USW Local 6166 President Murray Nychyporuk. The company and union came to terms on 12 September. A senior Vale manager called the negotiations &ldquo;respectful throughout.&rdquo; The agreement stands as the second labour accord between USW Local 6166 and Vale, the first coming in 2008 two years after Vale bought Inco Ltd. operations in Canada and elsewhere.

Canadian Steelworkers, Vale Agree to Terms at Manitoba Nickel Mine

In Namibia recently, a collective agreement signed between ICEM affiliate Mine Workers&rsquo; Union of Namibia (MUN) and Namdeb Diamond Corp., the DeBeers, Namibian state joint mining venture, had the rubber stamp of a High Court order. That unusual attribute came because a month-long strike/lockout of 1,600 miners developed into a highly charged and fractious split between labour and management that had Namibia&rsquo;s top political leaders nervous. 
 
The agreement ending the strike, which began 16 August, and the lockout, beginning 20 August, came 11 days ago and was overseen by the country&rsquo;s Minister of Presidential Affairs. The next day, High Court Judge Dave Smuts made the agreement a court order. 
 
The agreement calls for the two sides to &ldquo;dedicate themselves in good faith to rebuild relationships.&rdquo; It calls for empowering a tripartite commission to investigate and resolve the many issues that surfaced in the hostile dispute, and the accord signed at government house in Windhoek also positively resolves the central issue behind the dispute: housing pay when a mine&rsquo;s resources are spent and workers are transferred.

The dispute started when Namdeb mothballed the remote Bogenfels mine and denied workers their housing and utility allowances in transferring them to new sites. That occurred earlier this year for a small number of the 1,600 union miners, about 125, and the dispute festered with both sides hardening until industrial action started in August. 
 
When MUN decided to conduct a strike vote, Namdeb yelled foul, saying the vote should not be open to all 1,600. That angered MUN which saw it as an overt intervention into the union&rsquo;s affairs. Then during talks to resolve the strike/lockout, the company angered miners with a counter-offer granting the housing and utility allowances, but then demanded that miners pay rent in their new locales 
 
The recent peace agreement restores to the 125 transferred workers their housing and utility entitlements, and they will not have to pay rent at their new worksites. The accord guarantees no regressions to a 2009 Work Conditions Agreement. The Ministry of Labour and Social Welfare, which worked staunchly over the past six weeks to resolve the dispute, will coordinate the reconciliation commission. 
 
MUN called attention during to the strike the inequity in opportunities between Namibian citizens and expatriates. The union also singled out a top boss for unfairly denying Namibians jobs because he insists on using polygraph tests on applicants. And MUN has accused this same boss of safety neglect in implementing cost curtailments. Namdeb&rsquo;s largest operation at Oranjemund has seen two years this year. 
 
Diamond output by Namdeb fell off by 30,000 carats of gems during the dispute. Diamond production accounts for almost 10% of Namibia&rsquo;s GDP and 40% of foreign exchange funds. 
 
Meanwhile, a MUN branch took strike action 23 September against R&ouml;ssing Uranium Ltd., 69% owned by Rio Tinto. The 950 uranium miners of the Arandis branch passed a strike authorisation vote 19 September and this is the second strike in three months against R&ouml;ssing over inequitable bonus pay-outs between managers and workers. With Rio Tinto the lead company, the remainder of R&ouml;ssing is owned by the Namibian government and South Africa&rsquo;s Development Corp.
