On 6 October, leaders of Indonesian FSP-KEP (SPSI), the Trade Union of Chemical, Energy, and Mine Workers (CEMWU), officially extended a 30-day strike at the world&rsquo;s largest gold and third largest copper mine one more month &ndash; until 15 November &ndash; because of mine management&rsquo;s absence at a provincial forum to address issues in the dispute. 
 
Community leaders also formed a committee and visited different locations of the vast mining complex in order to assess the number of outside workers recruited to break the strike. The committee visits were fired upon, with reports today that one protestor was shot dead. 
 
The Grasberg mine in Papua Province, New Guinea Island, is 91% owned by US-based Freeport-McMoRan. The PT Freeport Indonesia Workers&rsquo; Union of CEMWU is in dispute with its subsidiary, PT Freeport Indonesia, over unwillingness to meet the salary demands of 10,000 miners.

A two-year labour agreement expired on 1 October. The company is offering only an 11% increase in each year of a new two-year agreement, below that recommended by Indonesian government mediation last month. 

Last week, government officials of West Papua Province, leaders of the province&rsquo;s Parliament, the Papua Peoples&rsquo; Council of seven indigenous groups, a human rights committee, and the PT Freeport Indonesia Workers&rsquo; Union of CEMWU waited patiently for mine managers to show up to address issues. None did. 
 
This came a week after the ICEM intervened with Freeport-McMoRan&rsquo;s chairman asking him to personally step in to resolve the dispute, which threatens global copper and gold supplies. The ICEM received a response from a senior vice president of Freeport-McMoRan Copper &amp; Gold stating the executive had full confidence in managers of PT Freeport Indonesia. 
 
The response stated, &ldquo;The union maintains its unrealistic demands for compensation, which are grossly inconsistent with Indonesian wage levels and, substantially in excess of the wages of mining workers in other countries performing similar duties.&rdquo;&nbsp;
Freeport-McMoRan posted a net profit of US$1.37 billion in the second quarter of 2011 and the person ICEM and the CEMWU is trying engage to resolve the dispute, James Moffet, took in a total compensation package in 2010 of US$21.5 million. 
 
The community forum meeting in West Papua took a decision to write PT Freeport Indonesia managers to halt the threats and intimidation of workers in attempting to get them to quit the strike. They also sent a statement to the US embassy in Jakarta encouraging a diplomatic initiative to get Moffet to resolve the bitter strike. 
 
PT Freeport Indonesia managers have broken global labour norms by pressuring strikers to sign statements that they will quit the strike. And they have also removed the job duties of 138 shop stewards, as well as isolating union leaders from workers by posting security guards around them. 
 
The ICEM will continue to support the PT Freeport Indonesia Workers&rsquo; Union of CEMWU in the union&rsquo;s fight for justice, dignity, and a fair 2011-2012 wage package.

Indonesian FSP-KEP (SPSI) Miners Extend Freeport-McMoRan Strike, One Shot Dead

The strike by 32,000 Finnish metalworkers that began on 21 October could end tomorrow following a new proposal presented by National Conciliator Esa Lonka last night, 23 October. ICEM affiliate Ammattiliitto Pro, the trade union of salaried workers in Finland, and Metalliliitto, the country&rsquo;s Metalworkers&rsquo; Union, will consider the proposal later today in separate meetings. 
 
The two unions began a first wave of strike actions last Friday against 45 metal and engineering companies that was to run until 7 November, with a second wave of strikes against another 35 firms to begin on that day.

Lonka&rsquo;s new proposal addresses the unions concerns on a wage package over the next two years, while Finland&rsquo;s government is expected to legislate the other key issue in the dispute &ndash; a three-day annual training and education leave in which employers sought to use its own discretionary control. 
 
Metalliliitto&rsquo;s 38-member Union Council will consider the proposal at 16h today in Helsinki, while Ammattiliitto Pro&rsquo;s Executive Committee will meet at 17h to take up the government conciliator&rsquo;s proposal. If both bodies accept, the 32,000 workers &ndash; 25,000 metalworkers and 7,000 represented by Ammattiliitto Pro &ndash; will be back to work tomorrow, 25 October. 
 
The major discord was over a 4.3% wage increase for two years, an amount Finnish social partners agreed to on 13 October. Metal and technical employers, under the auspices of the Federation of Finnish Technology Industries, or Teknologiateollisuus, sought to structure that pay rise whereby many metalworkers and white-collar workers would not get the full amount. The new proposal given by Lonka last night, 23 October, proposes that it be granted across the board to all 200,000 workers in the country&rsquo;s metal and engineering sector.

Conciliator’s New Proposal Expected to End Short Finnish Metalworkers Strike

With the United Steelworkers (USW) currently voting local-by-local on adoption of a US National Oil Bargaining Policy, one thing is certain when talks with oil refiners get underway early in 2012: union-initiated process safety improvements will lead the agenda. 
 
Some 300 local USW leaders convened in Dallas, Texas, in late September and adopted a bargaining policy. That policy is now up for ratification by USW branch unions representing oil workers and once 75% of local unions agree, the agenda will be tabled when bargaining begins early in 2012. A current three-year labour agreement between USW and a majority of US downstream oil and petrochemical employers expires 1 February 2012.

USW Vice President Gary Beevers, who heads the sector, said achieving process safety will be the main issue in this round of talks. &ldquo;We must have meaningful and enforceable safety provisions if we are going to save lives, and we are prepared to strike, if necessary, to get that,&rdquo; said Beevers, an ICEM Executive Committee member. 
 
Process safety refers to a safe and functioning engineering and management controls system that prevents explosions, fires, and toxic releases caused by the highly hazardous chemicals used in refining. USW will strive to get a union-trained safety specialist in each of the 69 refineries where it represents workers as part of that process safety system. 
 
The USW reports that during the term of the current labour agreement, up through early September 2011, there were 131 reported fires in US refineries, about one per week. The USW lost seven union members, including some who were Local 12-591 leaders, in the deadly 2 April 2010 explosion at Tesoro Corp.&rsquo;s Anacortes, Washington, refinery. 
 
The Tesoro explosion was caused by a heat exchanger in a naphtha unit that blew apart due to cracks in a welded area, an obvious flaw in process safety. The Washington State Department of Labour and Industry determined that the Texas-based company failed to test equipment for cracks and fined Tesoro US$2.39 million, a fine the company appealed. 
 
The USW represents 30,000 workers at a total of 168 production, refining, marketing, transportation, and pipeline installations, and its membership in the US&rsquo;s 69 oil and petrochemical refineries gives it representation covering 64% of all workers in the US downstream sector. 
 
Oil bargaining in the US is termed pattern bargaining in which USW selects a lead company to negotiate with and then those terms are presented and expected to be accepted by other companies. Traditionally, the USW and its predecessor unions have selected Royal Dutch Shell as the lead company.

Safety Central Issue in Upcoming US Downstream Oil Talks

Over 200 Global Mining and Maritime trade unions representing millions of workers around the world met in Durban, South Africa at the fourth International Mining and Maritime Conference. The conference has previously been held in Australia and the USA and was being held for the first time in Africa. The conference was hosted by the South African Trade Unions participating in the initiative. These Trade Unions are NUM, SATAWU, and CEPPWAWU. Most of the National Unions participating in the Mining and Maritime initiative are affiliates of the ICEM and participate in their individual capacities. The Mining and Maritime initiative is an independent loose alliance of national trade unions across the globe in the Mining and Maritime value chain, committed to global solidarity across the value chain of the Mining and Maritime industries. 
 
Intensive deliberations were held over three days of the conference on a wide range of issues across the mining and maritime value chain. A declaration was adopted at the end of the conference that commits the initiative to a plan of action in the next three years before the next conference.

Unlike previous conferences, the Durban conference reflected the influence and articulation of African Trade Union issues and agenda and this was extensively covered in the Declaration. Noteworthy in the declaration was the establishment of a truest fund to support the SATAWU initiative to recognize, albeit posthumously, Akhona Geveza, a victim of sexual assault and murder in the workplace, while on a Maritime scholarship in Australia 
 
The ICEM President, Senzeni Zokwana opened the conference and ICEM General Secretary, Manfred Warda, was one of the key note speakers at the conference. Both leaders gave the assurance of the ICEM&rsquo;s support for the initiative&rsquo;s solidarity campaigns and programmes. 
 
The ICEM&rsquo;s Mining Officer, Glen Mpufane gave a presentation on the State of the Current Global Extractive Resources Industries, which was well received by the conference delegates. The Chairperson of the Initiative, Mick Doleman, recognized the presentation as an invaluable resource material for the Mining and Maritime. 
 
Conference delegates declared continued support for the global campaign for Los Mineros in Mexico, development of a global network of unions at mining multinational Vale, and to reenergise the Rio Tinto global network. The declaration prioritised the fight for women&rsquo;s rights and participation. Specific support was pledged to the International Longshore and Warehouse Union (ILWU) Local 21 in their fight for good jobs at EGT Development&rsquo;s grain terminal in the Port of Longview, Washington, USA. EGT Development is a joint venture of Japan-based Itochu Corp, South Korea&rsquo;s STX Pan Ocean and Bunge North America. The ILWU President Robert McEllrath surrendered himself on 26 September to authorities, as police abuse their powers to harass the Longview strikers. McEllrath was arrested on the same day as another ICEM North American trade union leader, Dave Coles of the CEP in Canada was arrested on Parliament Hill, Ottawa during a protest against the Keystone XL pipeline.

Mining and Maritime: Durban, South Africa 5-7 October 2011

Former ICEM Sub-Sahara Africa Regional Organisation (SSARO) Chairman Rayford Mbulu was named on 1 October to be Deputy Minister for Labour, Sport, Youth and Gender in Zambia. He enters the new government of Michael Sata and the Patriotic Front Party (PF), which won Zambian elections on 23 September. 
 
Mbulu takes the government posting along with the head of the reconstituted Labour Ministry, Fackson Shamenda, former President of the Zambia Congress of Trade Unions (ZCTU) and once the African Regional Secretary of Global Union Federation Uni.

Rayford Mbulu
Mbulu is past President of the Mineworkers&rsquo; Union of Zambia (MUZ), a position he was elected to in 2005 after serving as MUZ Deputy General Secretary in 2004. He left the MUZ late last year after challenging for the presidency of ZCTU. On the day of the election, he was disqualified by the Labour Minister under the previous Movement for Multiparty Democracy Party after his mining employer, state-owned Zambia Consolidated Copper Mines (ZCCM), terminated his employment. 
 
Mbulu worked for many years at ZCCM&rsquo;s Nkana Division. He served as ICEM&rsquo;s SSARO Chairman from 2007 until his resignation in March 2011. Mbulu also becomes a Member of Zambia&rsquo;s Parliament from the Kalululushi constituency in the Copperbelt. 
 
On his swearing-in, Labour, Sports, Culture and Gender Minister Shamenda said the PF leadership would work to raise the minimum wage, reduce casualisation of employment, and strive to get better working conditions for all Zambians. President Sata reduced the number of government ministries from 23 to 19, combining some ministries including Sports, Culture and Gender with Labour.

Press Advisory - Press Conference, Grasberg Mine Strike

A historical achievement happened in Indonesia late on Friday night, 28 October, when the country&rsquo;s Parliament passed the Social Security Providers Bill (BPJS), thus clearing the way for long-awaited pension, medical, job-related accident, unemployment and other benefits to millions of ordinary Indonesians. 
 
The House of Representatives gave approval to the new law through consensus in a plenary session when the six-party ruling coalition, which had worked to delay the legislation, was pressured by a mass rally outside Parliament to reach terms with the Indonesian Democratic Party of Struggle (PDI-P).

25,000 Manifested 28 October at Indonesian Parliament
That rally, organized by the trade union/civil society coalition, Action Committee for National Social Security (KAJS), saw 25,000 Indonesians engage in a boisterous sit-in demanding once and for all passage of the populist bill. BPJS means that the government must now implement compulsory social services mandated by the National Security System Law of 2004. 
 
Labour leaders, however, realize that the BPJS time frame for full implementation of the different social components leaves too much political maneuvering room, especially with federal elections coming in 2014. BPBJS I, or the scheme for heath care for all citizens, must come into effect by January 2014, while BPJS II &ndash; social benefits related to occupational accidents, pensions, old-age benefits, and death benefit schemes &ndash; must be implemented by July 2015.

&ldquo;Yes, it was a momentous day,&rdquo; said ICEM Indonesian Affiliates&rsquo; Union Chairman D. Patombong Sjaiful, the leader of FSP-KEP, the Chemical, Energy, Mines, Oil &amp; Gas General Workers&rsquo; Union of confederation KSPI. 
 
&ldquo;But now it becomes a process to guard the intent of this new law and not let it get sidetracked by the political system.&rdquo; 
 
Said Iqbal, the KAJS General Secretary and President of the Federation of Indonesian Metal Workers&rsquo; Unions (FSPMI), agreed, stating that the process must be closely monitored on formulating and calculating sufficient costs for the different benefits.

&ldquo;This marks a fundamental change in Indonesian social security,&rdquo; he said. &ldquo;Now we are assured there will be a minimum level of pension benefits for all, that discrimination against the poor regarding health care will end, and that all working people will have some level of social benefits. 
 
&ldquo;We must now be vigilant that government and employers adequately fund these programmes.&rdquo; 
 
Said Iqbal led the KAJS coalition that included some 69 organisations, included 40 trade unions. The coalition, including farm organizations, fishery groups, and many more, included three of the country&rsquo;s main national labour centres, KSPI, KSBSI, and KSPSI. The coalition is expected now to be transformed into &ldquo;BPJS Watch.&rdquo; 
 
The new BPJS law re-makes the four state-owned insurance companies (PT Askes, PT Jamsostek, PT Taspen, and PT Asabari) into two non-profit public companies under the auspices of the President&rsquo;s office. PT Askes will function for the health care scheme, while PT Jamsostek will administer occupational accidents, pensions, old-age risks, and death benefits.

Indonesia Passes Provisions to Implement Social Security Law

Today in Belgrade, the ICEM affiliate Federation of Chemical, Non-Metal, Energy and Mining Trade Union will lead a joint main board meeting with two other Serbian unions on the final stages of a three-way merger. The 40,000-member ICEM affiliate will be joined by the Trade Union of Metalworkers and the Textile, Leather and Shoe Workers&rsquo; Union in an effort to create a single entity with strong growth prospects in the Central European nation. 
 
The new labour organisation is expected to be called the Trade Union of Industry and Energy and an integration Congress will be held in early May 2012. The 2,000-member Metalworkers&rsquo; union was weakened by a split in that organisation in 2010 and the Textile, Leather Union, numbering now only 1,000 dues-paying members, has been plagued by operational difficulties. 
 
Today&rsquo;s meeting is expected to set an agenda in which the two smaller unions will operate as boards of the Chemical, Non-Metal, Energy and Mining Trade Union until next year&rsquo;s merger. Zoran Stojanovic of the ICEM affiliate said the action plan being developed calls for a merged union to actively organise and provide updated services to Serbian industrial workers, particularly in the different energy sectors.

Serbia’s Chemicals, Metal, Textile/Leather Unions Set Agenda for Merger

The North American Cement and Building Materials Union Network (NACBMUN) met at the headquarters of the United Steelworkers (USW) in the US city of Pittsburgh on 20-21 October. This third network meeting was co-chaired by Steve Brady, Chair of the USW Cement Conference, and Jim Pressley, Vice President of the International Brotherhood of Boilermakers (IBB). 
 
The main activity of the network, created in 2008, is information exchange via a collective bargaining database, which includes full analysis of each collective agreement in the cement and building products sector. The database is updated annually. Six managers from Lafarge, Cemex&rsquo;s St. Mary&rsquo;s Cement, Essroc were invited to receive a report on business trends and human resource issues.

Phee Jungsun, ICEM Materials Industries&rsquo; Officer, presented an industry report and explained the new global labour instruments on protection of trade union rights in supply chains, including the revised OECD Guidelines and the UN Governing Principles on Business and Human Rights. Ongoing labour disputes at Holcim Cement in India and in Guatemala, and a global action plan to combat Holcim&rsquo;s unfair labour practices were reported. 
 
The network extended full solidarity support to contract workers at Holcim&rsquo;s Ambuja Cement in India, who have long been fighting for the right to join a union and to bargain collectively. 
 
The meeting discussed a plan to regularly conduct social dialogue with human resource managers, and participants agreed to extend the dialogue agenda to cover comprehensive subjects including subcontracting and union work along supply chains. A plan on a common organizing drive at unorganized workplaces is set as the main agenda item for a 2012 network meeting, to be held in Canada.

North American Cement, Building Materials Network Meets in Pittsburgh

The ICEM&rsquo;s Brazilian affiliate ABC Chemical Workers&rsquo; Union project called &quot;The Chemical Industry in 2020 &ndash; A New Direction is Possible&quot; launched earlier this year was finalized with an international conference from 26-28 September in Santo Andre with 150 union leaders, government officials, and business and civil society representatives attending. 
 
The project&rsquo;s main goal is to promote sustainable growth in the Brazilian chemical industry through social dialogue and decent work. ICEM&rsquo;s Director of Industry and Corporate Affairs Kemal Ozkan was keynote speaker and the conference fostered many discussions toward achieving 2020 targets by the UN, as well as producing and using chemicals not harmful to human health and to the environment.

The event was also an opportunity to prepare the ABC Chemical Workers&rsquo; Union, together with social partners, for the UN&rsquo;s Conference on Sustainable Development (Rio +20) to be held in June 2012. 
 
With topics covering economic, social, and environmental dimensions, the conference deepened and expanded a series of discussions in three parts with participation of workers, entrepreneurs, public authorities, and others. Another highlight was presenting the ILO report called &quot;Restructuring the Brazilian Chemical Industry and its Impact on Employment and Social Dialogue.&quot; 
 
Paulo Lage, President of ABC Chemical Workers&rsquo; Union, opened the meeting by citing progress made since the first round of discussions in June 2011, especially a joint agenda between the union and the Brazilian Association of Chemical Industry (ABRIQUIM). &quot;Our industry has a terrible trade deficit which directly affects the jobs of workers, and only through debate and dialogue we will have a better world for everyone,&quot; said Lage.

At the conference&rsquo;s opening, Ozkan presented a detailed overview of the world&rsquo;s chemical industry, highlighting the prospects of growth in Asia, particularly China, which today is among the leaders in producing specialty chemicals industry. 
 
Yasuhiko Kamakura, senior ILO specialist for the chemical industry, addressed another important topic &ndash; Social Dialogue in the Chemical Industry. He gave worldwide data on restructuring and the effects of social dialogue, contents of which are contained in the ILO study. He also addressed the trend of mergers in the chemicals industry, saying some four million jobs were lost between between 2000 and 2006 due to corporate integration. 
 
The conference&rsquo;s closing was made by Artur Henrique, the president of Brazilian national labour center, Central &Uacute;nica dos Trabalhadores (CUT) and following, a proposed document was produced to strengthen the Brazilian chemical industry, which will be delivered by the unions and employers to the federal government.
