The Communications, Energy, Paperworkers (CEP) Union of Canada held its Eighth Bi-annual Women&rsquo;s Conference from 8-10 November in Ottawa. Entitled &ldquo;Breaking Down Barriers&hellip;Building Equality,&rdquo; the conference was attended by a record number of women from the 150,000-member union &ndash; 250 &ndash; making it the union&rsquo;s largest women&rsquo;s conference ever. 
 
The conference was organized mostly with workshops, with one on the opening day dealing with the new harassment policy of the Canadian union. Three other workshops were held over the ensuing days, including &ldquo;Confronting Harassment and Bullying,&rdquo; &ldquo;The Economic Crisis: We&rsquo;re Not Taking This Sitting Down,&rdquo; and &ldquo;Finding Our Voices.&rdquo;

Lara Acheson, a rank-and-file CEP member from the telecommunications sector, serves as chairperson of CEP&rsquo;s National Women&rsquo;s Committee. 
The conference paid special remembrance to what has become known in Canada as the Montr&eacute;al Massacre. Twenty years ago, on 6 December 1989, 14 women were shot dead at &Eacute;cole Polytechnique de Montr&eacute;al by a deranged man who stormed into a classroom, separated men and women, and shot dead the women in anti-feminist lunacy. Because of that, Canada designates 6 December as &ldquo;National Day of Remembrance and Action on Violence Against Women,&rdquo; and that theme was carried out in CEP women&rsquo;s workshops last week.

The harassment workshops emphasized that there would continue to be zero tolerance for harassment on the job and in the union. The economic crisis workshop detailed the effects that the crisis was having on women. And in the &ldquo;Finding Our Voices&rdquo; workshop, CEP women were empowered to begin standing up and speaking, and begin to be heard. 
 
The Canadian crisis in the pulp and paper industry was one recurring theme at the conference, specifically on the toll such economic depravation is taking on women in communities. CEP women developed a set of demands for the Canadian government to counteract the adverse economic consequences, such as affordable childcare and reform of the employment insurance scheme.

CEP Women Turn Out in Record Numbers at Canadian Conference

Newton B. Jones, the President of ICEM North American affiliate, the International Brotherhood of Boilermakers (IBB), was elected chairman of the Materials Sector at the ICEM&rsquo;s World Conference for Materials, held 3-4 November in Izmir, Turkey. 
 
The conference was attended ay 118 delegates from 31 countries, and was aptly hosted by ICEM Turkish affiliates &Ccedil;imse-İş and Kristal-İş. Alan Black of ICEM UK affiliate GMB was elected vice chairman. Jones is leader of the 100,000-member Boilermakers, North America&rsquo;s leading cement and building materials manufacturing union, with members in other sectors as well. Black&nbsp;replaces Michael Decayeux of F&eacute;d&eacute;chimie-CGT FO, who retired after a long service career in the French and global trade union movement. 
 
The Materials Conference produced two resolutions, and saw lively discussions come out of a panel debate. That panel, entitled &ldquo;Industrial Relations and Social Dialogue in the Turkish Materials Industries,&rdquo; featured employers&rsquo; representatives from Turkey&rsquo;s cement, glass, and ceramics associations. 
 
The panel saw keen perspectives from Metin Bozkurt of &Ccedil;imse-İş and M&uuml;n&uuml;r Dinler of Kristal-İş. 
 
In cement industry, M&uuml;rsel &Ouml;zt&uuml;rk of the Cement Employers&rsquo; Association of Turkey (CEIS), together with the trade union panelists, discussed some positive developments through social dialogue to avert job dismissals during the financial crisis. In ceramics, both the employers&rsquo; representative, Bekir Uzun, and the trade unionists expressed the hardships and challenges faced during the crisis.

In Turkey&rsquo;s glass sector, despite problems of union recognition in the past, the importance of mature and institutional labour relations was stressed. Hakan Yilirimoğlu represented the glass employers. 
 
A number of other presentations were made throughout the two-day event, including global sector reviews of cement, glass, and ceramics by Phee Jungsun, ICEM&rsquo;s Materials Officer, and on the ICEM&rsquo;s leading role among Global Union Federations regarding sustainable development by Brian Kohler, the Health, Safety, and Sustainability Officer. 
 
A further presentation was given by Warren Fairley of the IBB in the US. He stated how many employers have used the economic crisis as a pretext for facility closures, job cuts, and general cost cutting. He said an important lesson his union learned is to demand accurate financial information from companies seeking relief.

Another presentation was made by Rashid Arin, President of the Malaysian Cement Industry Employees&rsquo; Union (CIEU). He spoke on the large number of irregular workers in that sector in his country, and the fact that they are deprived of social benefits and medical care. Hwan-seop Shin of the Korea Chemical and Textile Workers&rsquo; Federation (KCTF) stressed that Asian unions need structural changes from company-based and plant-level trade unions to industry-wide unions. 
 
The resolutions included one giving full support to 29 members of Teamsters Local 455 in the US states of New Mexico and Colorado, who were locked off their jobs at an open pit mine on 7 October. The company involved, Harborlite, a wholly-owned subsidiary of Imerys World Minerals, mines perlite, a substance used in building materials, insulation, and filler uses.

dealt with the global economic crisis, as well as reiterating ICEM&rsquo;s commitment to its Contract and Agency Labour Campaign, achievement of Global Framework Agreements, and growing trade union bargaining power and strength through organising in the Materials Sector. It serves as the sector&rsquo;s four-year work plan. 
 
The ICEM highly appreciates the support given by the IBB, which enabled many delegates from across the world to attend the quadrennial World Conference for the Materials Sector in Izmir.

Leader of North American Boilermakers’ Union to Head ICEM’s Materials Sector

Ugandan trade unions have brought to light de-humanising work conditions imposed by foreign investors in some of the country&rsquo;s workplaces. In a meeting with President Yoweri Museveni in Entebbe on 1 September, leaders of the Central Organisation of Free Trade Unions (COFTU) said abuse of workers and mistreatment is increasingly on the rise in private businesses controlled by outside investors. 
 
Although COFTU did not name employers, the worst of the abusive practices were by small businesses. Dr Sam Lyomoki, COTFU&rsquo;s General Secretary and a member of the Uganda Parliament, presented a petition to the President that outlined general shortcomings in pay and work conditions, as well as failure by some employers to remit income tax and social security deductions to the government. 
 
But the biggest shock came when labour leaders told of denigrating practices imposed by bosses on workers. Specific incidents were cited. One involved a small-business owner who forced an employee to mop an office floor with her tongue. Another boss in a food and detergent manufacturing plant locked a female worker in a toilet in retaliation for her using the toilet before a scheduled break. 
 
Reports said Museveni was visibly shaken upon hearing such accounts. He ordered the Labour Ministry to immediately investigate the abuses. He also told the trade union federation that he would support establishment of labour institutes within the country that would monitor employer misconduct, as well as safeguard workers&rsquo; health and safety.

Degrading Work Abuses Brought Forward in Uganda

Women of Steel, the women&rsquo;s organization of ICEM North American affiliate United Steelworkers (USW), has called on the US government to take stronger action against the Honduran military, following the 28 June coup of democratically-elected President Manuel Zelaya. 
 
The union&rsquo;s women&rsquo;s group pointed to at least 19 cases of rape by police officers since the coup began, and cited a report by Feministas de Honduras en Resistencia that said police are using rape and other forms of sexual assault against women leaders of the resistance to blunt a return to democracy. 
 
In a 31 August letter to US Secretary of State Hillary Clinton, Women of Steel Director Ann Flener said, &ldquo;We call upon you and President Obama to denounce the repression and basic human rights violations being carried out by the current illegitimate government and to take all necessary steps to restore President Zelaya, including the withdrawal of the US Ambassador to Honduras; the end of all economic assistance to the coup regime, including monies granted by the Millennium Challenge Corp., and to freeze all assets of the coup leaders. 
 
&ldquo;As women, we ask you to speak out and stand up against this violence against women &hellip;&rdquo; The letter also asked Secretary of State Clinton to denounce the gender violence in Honduras, similar to her denouncement of violence against women in the Democratic Republic of Congo.

The letter was copied to President Barack Obama, US First Lady Michelle Obama, 17 women members of the US Senate, and several other US government officials. 
 
While the US government has verbally called for the return to power of Zelaya, it has officially refrained from terming the overthrow a coup, which would legally require it to suspend all economic and military aid. The US is Honduras&rsquo;s chief trade partner. 
 
Most European Union governments have withdrawn their ambassadors, and EU countries in total have suspended US$90 million in aid to the Central American country. 
 
On 30 July, Carlos Reyes, General Secretary of International Union of Food and Agricultural Workers&rsquo; (IUF) affiliated STIBYS, was brutally attacked by Honduran police squads while he was peacefully protesting the military coup in the northern city of Tegucigalpa. Reyes, an IUF Executive Committee member, suffered a severely broken arm and other serious injuries.

USW Women call on US Government to Take Definitive Action in Honduras

A summer-long Korean labour dispute that spiraled into a 25 August lockout by Kumho Tire Co. at three manufacturing plants was resolved Saturday, 5 September, when South Korea&rsquo;s second largest tyre maker and the Kumho Tire Workers&rsquo; Union of the Korean Metal Workers&rsquo; Union (KMWU) reached a compromise settlement. 
 
That compromise will preserve 733 of 4,000 jobs that Kumho had proposed be cut. The union, in turn, will extend a 2008 wage freeze through 2009. The Kumho Tire Workers&rsquo; Union also agreed to forego scheduled 2008 bonuses, with talks over 2009 bonus schemes to be held in the first quarter of 2010. 
 
The dispute began in June when management demanded another wage freeze, non-payment of bonuses, a job-sharing plan that would cut work hours, thus reducing salaries between 20-to-30%, and the redundancies, totaling 18% of the entire workforce. The union then began a series of industrial actions, and was prepared to escalate job actions after Kumho reported its restructuring plan to the Ministry of Labour on 24 August.

Instead, the company imposed lockouts at tyre facilities in Gwangju, Gwanngju province, Gokseong, South Jeolla province, and Pyeonggtaek, Gyeonggi province. When Kumho lifted the lockouts some ten days later, workers embarked on sit-in strike actions. Those ended at the weekend with the negotiated compromise. 
 
The union also retreated on a &ldquo;no work/no pay&rdquo; demand by Kumho for the strike days, and salaries will not be paid during periods of strike. The dispute mirrored some of the negative results from the recent Ssangyong Motor struggle. 
 
Kumho Tire is part of the conglomerate Kumho Asiana Group, a holding company that took on massive debt in 2006 with the purchase of Daewoo Engineering &amp; Construction Co. The group&rsquo;s debt-to-equity ratio rose five-fold and Kumho has tried to reduce debt by reducing labour costs. 
 
Kumho Tire has severed its workforce by 130 each year since ill-advised purchase of Daewoo, but last year, in July, a four-day strike by the Kumho Tire Workers&rsquo; Union convinced the company to withdraw 431 announced redundancies. In the past year, however, Kumho opened its second plant in China, a truck and bus tyre facility in the city of Nanjing. 
 
The Tire Workers&rsquo; Union, through the KMWU, is affiliated to the Korean Confederation of Trade Unions (KCTU).

Korean Tyre Dispute at Kumho Ends in Compromise

A record number 364 union and management participants attended a Social Dialogue Conference in Thailand last week, 31 August, sponsored by the ICEM, the Thai Ministry of Labour, FNV Mondiaal of the Netherlands, LO-TCO of Norway, and the Employers&rsquo; Federation of Thailand (ECOT). 
 
The title of the conference was &ldquo;International Labour Standards and the Wisdom of Co-Existence,&rdquo; and central in purpose was to shape a common understanding of ILO core labour standards, as well as building responsible social governance between Thai labour unions and multinational companies. 
 
Over 150 people more than were expected turned out for the conference, held at the Siam City Hotel in Bangkok. Managing directors and human resource executives from 28 companies attended, including representatives from Esso, Linde-TIG Industrial Gases, Goodyear Tire &amp; Rubber Co., and Norske Skog paper company.

ICEM General Secretary Manfred Warda congratulated those present, and expressed hope that a true commitment to a new era of labour-management relations in Thailand was at hand. He also pledged to extend the resources of the Global Union Federation to Thailand in order that the country ratify core labour conventions, namely Conventions 87 and 98, freedom of association and right to collection bargaining, and Convention 111, the Discrimination in Employment and Occupation Convention. 
 
&ldquo;It is imperative that values of mutual faith and cooperation be built between managers of transnational companies and Thai labour unions,&rdquo; said Warda. &ldquo;For this to effectively begin, the Thai government must lead by starting the process toward ratification of ILO core labour standards.&rdquo; 
 
The ICEM organized the conference, jointly with the Thai Ministry of Labour, as a follow-up to a resolution from its 2007 Bangkok Congress. There, delegates recognized a Thai labour-management system structured on authoritarianism and hierarchal in industrial relations.

ECOT General Secretary Siriwan Romchat-thong confirmed in her opening remarks that the employers&rsquo; federation would support ratification of Conventions 87 and 98. A panel discussion composed of labour, management, and governmental leaders showed a consensus toward ratification in the immediate future. 
 
The Thai Permanent Secretary of the Labour Ministry, Somchai Chumrat, stressed the mutual benefit that can be gained through trust between labour and management by dialogue and understanding. &ldquo;Employers cannot live in a vacuum,&rdquo; he said. &ldquo;Managers and workers&rsquo; representatives must sit together to discuss the wisdom of conducting labour relations in peaceful cooperation.&rdquo; 
 
He added that although Thailand recognizes the benefit of foreign investment, senior executives of multinationals must clarify the roles of local managers in Thailand so that they act according to international labour standards and national laws. 
 
Another speaker that echoed the immediate need for a changed culture was Rawai Pupaga, chairman of the ICEM Thai Affiliates Committee and President of Government Pharmaceutical Employees&rsquo; Association (GPOTU). As a first step, he called on Thai workers and managers alike to show respect for workers&rsquo; rights by taking part in World Day for Decent Work activities on 7 October. 
 
Other resource people calling for a different labour-management culture were Tim de Meyer, senior specialist for the ILO on International Labour Standards and Labour Law, and Lae Dilokwidhayarat of Chulalongkorn University. Dilokwidhayarat stressed that the globalisation of capital and freedom of movement demands respect for the concept of decent work, meaning adequate compensation, trade union representation, and stability, security, and protection of workplace rights. 

A side meeting to the Social Dialogue Conference occurred between the ICEM, local executives of Linde and its Thai Industrial Gases subsidiary, and ICEM affiliate TIG Local Union. The Thai subsidiary of Linde has been neglectful over trade union rights at some 20 Thai workplaces, particularly in respect to work rights and full-time opportunities for short-term contract and temporary workers. The meeting did produce an understanding that TIGLU and the company&rsquo;s managing and human resource directors would meet in the near future to discuss problems and strive for a better relationship.

Visit to the Norske Skog Mill in Singburi 

One employer that has practiced exemplary social responsibility in Thailand has been the Norwegian paper company Norske Skog. On 1 September, Warda, Rawai Pupaga, ICEM Thai Project Coordinator Aranya Pakapath, and ICEM&rsquo;s Asia-Pacific Contact Person, Phee Jungsun, visited the factory in Singburi, where workers and local managers, including Managing Director Torpong Thongcharoen, hailed a relationship that can serve as a standard within Thailand. Notably, the collective agreement at Norske Skog in Singburi has strict language regarding the use of contract and agency labour, language that both sides respect and adhere to.

News from Affiliates 
 
National HIV/AIDS activities by ICEM affiliates in sub-Saharan Africa in 2009 are off to a good start. During the first quarter of the year, national coordinators in participating countries submitted proposals for national activities that are supported with small subsidies from the HIV/AIDS project sponsored by the Swedish LO/TCO Secretariat and the Dutch FNV Mondiaal. Below is a description of national HIV/AIDS activities planned in 2009. 
 
In Nigeria, ICEM affiliates NUPENG and PENGASSAN will continue their successful campaign, which was started more than two years ago, to boost the uptake of voluntary and confidential counselling and testing in major worksites. The project is co-sponsored by the Humanity Fund of the ICEM&rsquo;s Canadian affiliate, Communications, Energy, Paperworkers (CEP) Union. Increased attention will also be paid to women to know their status and to access information. 
 
The 18 ICEM affiliates in the Democratic Republic of Congo cooperate on an HIV/AIDS Committee. Focus this year is on the elaboration of a comprehensive HIV/AIDS proposal for third-party funding. VCT campaigns in specific companies are also planned and as a pilot project, a first campaign will be implemented in a large cement factory. 
 
ICEM affiliate Mineworkers&rsquo; Union of Zambia (MUZ) and the NUCIW in Zambia are building on their earlier training activities to organise workshops and meeting for rank-and-file members, and communities, to encourage access to VCT. A gender training workshop and the development of an HIV/AIDS manual are also on their programme. 
 
In Tanzania, TUICO and TAMICO have started preparations for a major VCT campaign sponsored by funds collected by the Women&rsquo;s Department of the ICEM&rsquo;s German affiliate, IGBCE. Two workshops have already been organised for the unions&rsquo; women committees and shop stewards to prepare for the campaign. In an encouraging development, some of the facilitators were unionists who had been trained as peer educators and VCT counsellors earlier. 
 
UMU of Sierra Leone has made good use of the seed money provided by the ICEM HIV/AIDS project. A large number of shop stewards and local union officials have been trained since UMU was included in the HIV/AIDS project in 2007. As HIV/AIDS does not discriminate between formal and informal workers, the informal workers, so-called grass-diggers, have also been included in the activities. 
 
In Ghana, the Ghana Mineworkers&rsquo; Union (GMWU) is focussing on new mines and mines not previously covered, and where awareness and uptake of VCT is low. It is therefore targeting the sites of Newmont and the Ghana Bauxite Company. A training course for women on the issues and challenges they face with respect to HIV/AIDS is also planned. 
 
Women are the target group for an extensive company-based programme in C&ocirc;te d&rsquo;Ivoire. The national coordinator who also organises HIV/AIDS activities in a number of Francophone West African countries, plans to work with women in nine companies organised by the three ICEM affiliates in the country. 
 
Affiliates in Botswana and Uganda are also planning training workshops and campaigns with emphasis on awareness about VCT and counselling. 
 
In 2009, Guinea is a new target country for the HIV/AIDS project (see HIV/AIDS e-bulletin 41, February 2009). During a visit earlier this year, the Coordinator for Francophone West Africa, Charlotte Nguessan, met with ICEM affiliates to assess the needs and help affiliates to set up an HIV/AIDS committee to coordinate the work. She also met with the National AIDS Commission, UNAIDS, and the ILO.

British TUC Launching HIV/AIDS Projects 
 
The UK&rsquo;s Trades Union Congress (TUC) is launching a project designed to build workplace capacity to combat HIV/AIDS in Nigeria in partnership with the Nigeria Labour Congress (NLC). 
 
The project, which is funded by the Department for International Development (DFID) at a cost of &pound;500,000 over three years, will contribute to a drop in the prevalence of HIV/AIDS, better protection of employment and human rights of workers infected with and affected by HIV and AIDS, and the elimination of discrimination against them in the education and health sectors. 
 
Collective bargaining with employers on effective enforcement of the National Workplace Policy on HIV/AIDS will be an integral part of the project. Emphasis will be on prevention and advocacy for voluntary and confidential counselling and testing by unionists trained by project activities. 
 
In Ghana, the TUC cooperates with the Timber and Woodworkers&rsquo; Union in a one-year project funded by the Bill Morris Testimonial Fund for HIV/AIDS in Africa. The project is aimed at the prevention of HIV infections through behaviour change, the improvement of the quality of life of workers affected by, or infected with, HIV and the facilitation of access to testing and counselling to ensure early diagnosis.

Global Fund Approves RCC Proposals 
 
The Global Fund Board has approved six proposals in Wave 5 of the Rolling Continuation Channel (RCC), representing costs of up to US$322 million over three years. Of the six proposals, two were for HIV. 
 
The RCC is a separate channel of funding set up to allow applicants with strong performing grants to apply for continuing funding for up to an additional six years beyond the original proposal term. Applications are by invitation only. The two HIV proposals which were approved were from Armenia and China.

AIDS: Lessons Learned and Myths Dispelled 
 
In an article in the online edition of Lancet (<a href="http://www.thelancet.com">www.thelancet.com</a>), the authors, among them the head of the Global Fund, Michel Kazatchkine, and former head of UNAIDS, Peter Piot, deal with several myths which have emerged recently with respect to HIV and AIDS. 
 
The call alarming the notion, especially worrying during the time of financial crisis, that too much money is spent on AIDS. The fact is that AIDS remains the leading cause of death in Africa and the sixth highest cause of mortality worldwide. The authors also dispel the myth that HIV prevention is not working and point out that in several countries prevention programmes are effective and that global prevention of mother to child transmission has led to a substantial decrease in the number of children born with HIV. 
 
They also dismiss the myth that one solution, or a so-called silver bullet, will comprehensively prevent HIV transmission and the misconception that heterosexual transmission of HIV is uncommon outside Africa. The authors further argue that investments in AIDS are not being made at the expense of health systems which are chronically under funded. The Global Fund and PEPFAR are now among the biggest investors in health system strengthening.

World Bank&rsquo;s HIV/AIDS Efforts Failing 
 
World Bank programmes aimed at fighting HIV/AIDS, particularly in Africa, are less effective overall than programmes aimed at addressing other health and development issues, according to a report released by the organisation&rsquo;s Independent Evaluation Group on 30 April. 
 
HIV/AIDS programmes in Africa had a 25% success rate, compared with 80% for all World Bank programmes, the report found. The report cited weak monitoring and infrastructure, poor implementation and overly complex programmes as reasons for the unsatisfactory results. Difficulties in coordinating collaboration with donors, NGOs, and government agencies contributed further to the poor results.

HIV/AIDS Funding in Times of Economic Crisis 
 
Life-saving drug treatment for up to 1.7 million people is under threat because of funding pressures triggered by the global financial crisis, according to an analysis released by the World Bank on 24 April. 
 
The report examined the effect of the economic crisis on 69 of the most impoverished countries worldwide and found that 15 are highly exposed to interruption of antiretroviral treatment because of decreases in domestic and foreign funding. As stopping treatment is a death sentence for HIV-positive people, cuts could be made in prevention programmes to be able to continue treatment. This will, however, lead to new surge in infections requiring an ever higher proportion for funding for treatment.

The roll-out of the revised Global Framework Agreement between EDF, French and other national unions, and the ICEM and global federations did not come without workers&rsquo; representatives airing the shortcomings to the electric company&rsquo;s application of its social responsibility principles. In Paris last week, from 12-14 May, EDF senior managers and the trade unions reviewed performance of the agreement through an established joint Consultation Committee for Social Responsibility (CCSR). 
 
A renewed global pact was agreed to in January 2009 for a four-year period. Last week marked the official unveiling and signing of the improved agreement by the social partners, which included the presence of EDF Chairman and CEO Pierre Gadonneix. The meetings also saw the election of a secretary for the workers&rsquo; representatives, selection of a six-member bureau to oversee the agreement, and a thorough review of the 22 articles contained in the social responsibility document. 
 
During the review, the 22 workers&rsquo; representatives from seven countries did produce a declaration of dissatisfaction on recent corporate performance. It was read to Gadonneix during an extensive question and answer session on 13 May. The declaration specifically cited workers taking industrial actions in France over social degradation, and a break-down in social dialogue at EDF&rsquo;s four businesses in Poland which caused workers to stage a manifestation at the French embassy in Warsaw on 5 May.

The declaration also called EDF&rsquo;s restructurings and financial deals expensive, with workers suffering adverse effects. We &ldquo;note a general worsening of the social conditions within all subsidiaries of the group, a worsening in job security due to outsourcing, a worsening of both living and working conditions, and a worsening of social dialogue, particularly when it comes to salary negotiations. We cannot accept that workers pay the price for the strategic choices made by the company.&rdquo; 
 
The workers&rsquo; representatives of the CCSR said it refuses to let the agreement be used as mere &ldquo;social window dressing for EDF&rdquo; and demanded that managers at all levels of the company &ldquo;agree and respect without restrictions&rdquo; the general spirit of all the articles of the global agreement. 
 
Gadonneix responded by saying that he heard the pronouncements of the declaration. He also said he wants the social responsibility agreement to be window dressing for EDF, but that he desires to have &ldquo;substance inside that window.&rdquo; 
 
Workers&rsquo; representatives on the CCSR come from five different unions inside France, three from the UK, and representation from trade unions of Poland, the Slovak Republic, Hungary, Vietnam, and China. 
 
Marc Ferron, representing ICEM French affiliate FCE-CFDT, was re-elected as secretary of the CCSR, and will serve a two-year term leading the global workers&rsquo; representatives to ensure EDF compliance with the agreement. The company is rapidly expanding operations both inside Europe and around the world.

EDF’s New Global Agreement Unveiled, Complete with Company’s Social Errors

A week of industrial actions against AngloGold Ashanti by miners aligned with ICEM affiliate Ghana Mineworkers&rsquo; Union (GMWU) was avoided late last month when the union and company came to a Memorandum of Understanding that settles a three-year dispute over an Employee Share Ownership Plan (ESOP). 
 
The dispute dates back to November 2006, when Ashanti Goldfields fully merged with South Africa-based AngloGold. Then, GMWU proposed an ESOP for Ashanti staff at the Obuasi and Iduapriem gold mines who did not receive a US$1,000 &ldquo;goodwill package&rdquo; at the time of the merger.

AngloGold refused to take up the proposal, resulting in a two-and-a-year stalemate. In October 2008, the two sides resumed talks on the ESOP with GMWU giving the negotiations process six months to produce an ESOP. By 24 April, when Ghana management of the mining house still would not move toward ESOP parity for the Ghana miners with their South Africa counterparts, GMWU issued a press release calling it &ldquo;morally wrong for AngloGold Ashanti to discriminate in its employee relations,&rdquo; and stating a week of protests would result. 
 
But on 28 April, the two sides, meeting in Accra, agreed to an ESOP called for the 5,000 affected miners to receive 20 shares each of AngloGold stock, to be paid across four years in five-share increments. The first such award was made in May 2009. 
 
In a joint statement, GMWU General Secretary Prince William Ankrah and company Vice President for Ghana, Keith Faulkner, said: &ldquo;We are very pleased that this matter has been finalised. We see it as an important further step towards improved cooperation between the company and the union which we are convinced will advance the interests of both the company&rsquo;s employees and its shareholders.&rdquo;
