A historical achievement happened in Indonesia on 28 October when the country&rsquo;s Parliament passed the Social Security Providers Bill (BPJS), thus clearing the way for long-awaited pension, medical, job-related accident, unemployment and other benefits to millions of ordinary Indonesians. 
 
The House of Representatives gave approval to the new law a plenary session when the six-party ruling coalition, which had worked to delay the legislation, was pressured by a mass rally outside Parliament to reach terms with the Indonesian Democratic Party of Struggle (PDI-P).

25,000 Manifested 28 October at Indonesia&rsquo;s Parliament
That rally, organized by the trade union/civil society coalition, Action Committee for National Social Security (KAJS), saw 25,000 Indonesians engage in a boisterous sit-in, demanding once and for all passage of the populist bill. BPJS means that the government must now implement compulsory social services mandated by the National Security System Law of 2004. 
 
Labour leaders, however, realize that the BPJS time frame for full implementation of the different social components leaves much room for politicians to maneuver, especially with federal elections coming in 2014. BPBJS I, or the scheme for heath care for all citizens, must come into effect by January 2014, while BPJS II &ndash; social benefits related to occupational accidents, pensions, old-age benefits, and death benefit schemes &ndash; must be implemented by July 2015.

&ldquo;Yes, it was a momentous day,&rdquo; said ICEM Indonesian Affiliates&rsquo; Union Chairman D. Patombong Sjaiful, the leader of FSP-KEP, the Chemical, Energy, Mines, Oil &amp; Gas General Workers&rsquo; Union of confederation KSPI. 
 
&ldquo;But now it becomes a process to guard the intent of this new law and not let it get sidetracked by the political system.&rdquo; 
 
Said Iqbal, the KAJS General Secretary and President of the Federation of Indonesian Metal Workers&rsquo; Unions (FSPMI), agreed, stating that the process must be closely monitored in formulating and calculating sufficient costs for the different benefits.

&ldquo;This marks a fundamental change in Indonesian social security,&rdquo; he said. &ldquo;Now we are assured there will be a minimum level of pension benefits for all, that discrimination against the poor regarding health care will end, and that all working people will have some level of social benefits. 
 
&ldquo;We must now be vigilant that government and employers adequately fund these programmes.&rdquo; 
 
Said Iqbal led the KAJS coalition that included some 69 organisations, included 40 trade unions. The coalition, including farm organizations, fishery groups, and many more, included three of the country&rsquo;s main national labour centres, KSPI, KSBSI, and KSPSI. The coalition is expected now to be transformed into &ldquo;BPJS Watch.&rdquo; 
 
The new BPJS law re-makes the four state-owned insurance companies (PT Askes, PT Jamsostek, PT Taspen, and PT Asabari) into two non-profit public companies under the auspices of the President&rsquo;s office. PT Askes will function for the health care scheme, while PT Jamsostek will administer occupational accidents, pensions, old-age risks, and death benefits.

Vigilance Now Needed to Implement Indonesia’s Social Security Law

If last week&rsquo;s G20 summit in Cannes, France, accomplished anything, it accomplished this: it put the urgent need for a financial transaction tax (FTT) firmly on the global economic agenda. Even though G20 world leaders and economic ministers failed to come to consensus on a FTT, the debate was there and it promises to grow. 
 
The FTT was formally made to the G20 through French President Nicolas Sarkozy, who commissioned a report by US philanthropist Bill Gates at the summit that specifies certain tax proposals on financial services that should be considered by G20 nations to aid development in poorer nations. 
 
Sarkozy has become a keen supporter of a European Commission (EC) proposal for a FTT. France was joined by Germany and Spain in supporting enactment within the Eurozone, but UK Prime Minister David Cameron and Chancellor George Osborne stand as barriers. 
 
In Cannes, Argentina, Brazil, South Africa all said the time was right that nations must consider a FTT. Russia and China are opposed. The US, where Treasury Secretary Tim Geithner has long held the view that a FTT is unworkable, is still fundamentally opposed.

But either through the occupy movements or other political tailwinds, there was some indication at Cannes that President Barack Obama might be slightly drawing back from the US&rsquo;s longstanding opposition. Certainly it will take far more heat at home for Obama to endorse a FTT and reject Geither&rsquo;s Wall Street belief that a tax on bond or derivative trading, or stock or currency trades, is not practical. 
 
But the mainstream is beginning to believe various forms of FTTs have merit and provide workable solutions to the world&rsquo;s economic woes. Gates of Microsoft fame said in Cannes a financial tax levy is &ldquo;clearly technically feasible.&rdquo; He also proposed that G20 nations impose legally-binding transparency measures on oil and mining extraction companies, as well as reducing fees on remittances sent home by migrant workers. 
 
At the European level, a FTT could net some &euro;57 billion per year. Considering that in a four-year span from 2007 to August 2011, public aid and guarantees to the financial sector amounted to &euro;4.6 trillion, or 37% of total EU Gross Domestic Product, the political timing for a tiny tax on financial transactions would seem correct. And consider again that during the financial crisis, EU banks have raised as much additional capital as they have written down in lost asset values. 
 
&ldquo;It makes sense to have this kind of tax not only to ask the financial sector to give a fair contribution to the common good, but also to use part of this financial transaction tax as a way to support development,&rdquo; said EC President Jose Manuel Barroso. 
 
Besides the obvious is what a FTT could do in developed nations for investment in jobs, to prop up social programmes or to build new infrastructure, there is a reality those same nations are scaling back on foreign aid to poorer nations, either from austerity or rightward political swings. The UN Development Programme says that a currency trading tax of a mere 0.005% would raise US$40 billion per year and it suggests this would go far to help developing nations deal with the effects of climate change. 
 
Growing global momentum for a FTT also comes at the precise time that funding for global health programmes is being reduced. Funding for HIV fell for the first time in 2009 and it fell again in 2010. The Global Fund to Fight AIDS, TB and Malaria missed awarding grants due to a monetary shortfall in this period as well. 
 
The International Trade Union Confederation (ITUC) predicts that adopting a financial transaction tax would help to reduce market volatility, curb speculative activity and provide resources to fight poverty. The ICEM believes that greed and negligence caused the financial collapse, and it is the perpetrators of that greed and neglect that received the bail-outs. Placing a tiny levy on FTTs is a small price to pay for a sustainable and manageable world. 
 
The financial transaction tax, incidentally, also called the &ldquo;Robin Hood&rdquo; or Tobin tax, was the brainchild of US Nobel prize winning economist James Tobin, who in 1972 proposed a small tax on foreign currency transactions to reduce global speculative risks. ‘Robin Hood’ Tax Gains Some Traction at G20 Summit

Canadian-based energy company Pacific Rubiales continues to hit new lows in its illegal efforts to put down ICEM affiliate Uni&oacute;n Sindical Obrera (USO) in the Meta region oil fields of Colombia. On 27 October the ICEM reported on the company signing an accord with company union UTEN on deadline day for a settlement with USO. 
 
Now as the USO activists continue to demonstrate en-masse, the company organises gatherings of its yellow union, complete with armed protection including from a company helicopter. At the same time, the company is financing propaganda campaigns exaggerating the small gatherings. 
 
Evidence is now coming to light of the sinister alliance between the company and local mayor of Puerto Gait&aacute;n, Edgar Humberto Silva. Evidence suggests that dead people were registered to have voted for the company candidate in the mayoral elections, with local indigenous communities harassed and intimidated into voting for Humberto Silva.

Unsurprisingly then, Humberto Silva has done all in his power to allow the Canadian company to continue exploiting the region&rsquo;s rich resources and poor workers. Residents of the local community have occupied the school where voting took place and are demanding a re-run of the election. Company union UTEN organised a celebratory march following the election of Humberto Silva on 2 November. 
 
State oil company Ecopetrol is allied with Pacific Rubiales and other multinationals active in the region, in establishing the yellow union and using numerous tactics to crush USO. Ecopetrol is exercising its influence and financial strength by running tens of court cases against USO leaders, while ignoring court rulings that favour the strikers. Ecopetrol is also using its wholly-owned subsidiaries Comai and Propilco to launch legal cases against union activists. 
 
The 28 October <a href="/wp-content/migration/icem/PacificRubeLet.pdf">joint letter</a> from ICEM, the International Metalworkers&rsquo; Federation (IMF) General Secretaries, and Canadian Communications, Energy, Paperworkers (CEP) Union to Pacific Rubiales Co-Chairmen and Executive Directors Serafino Iacono, and Miguel de la Campa, has not received a response.

In the letter, the three trade union organisations condemn the decision of the company to deceive USO in bargaining and then circumvent the legitimate bargaining partner in signing an accord with UTEN. USO represents over 14,000 actual oil workers in the oil fields of Rubiales and Quifa, while UTEN serves only administrative staff. 
 
The day of the false accord signing, Pacific Rubiales discharged 500 workers, and proceeded to intimidate remaining workers with threats of dismissal for remaining members of USO if they refused to switch allegiance to UTEN. 
 
It must be noted that the Colombian government has allowed Pacific Rubiales to abuse all internationally recognised minimum standards on workers&rsquo; rights with these recent tactics. And especially disappointing is the abrogation of Ministry of Labour arbitration that established a timeline for reaching settlement between USO and Pacific Rubiales. That deadline was 21 October, the same day Pacific Rubialies signed the bogus accord with the yellow union. 
 
The ICEM fully supports the campaign of USO and its permanent assembly, in place since 24 October, and the original list of demands including direct recruitment, salary increases, decent housing and adequate food, health, transport and social investment to communities. 
 
The CEP will facilitate the USO leadership to travel to Canada and meet the company management in early December.

Pacific Rubiales, Yellow Union Rig Local Elections, Indignation Rises

In this issue of the ICEM HIV/AIDS newsletter, we report on World AIDS Day 2011, occurring on 1 December, the Canadian CEP-sponsored HIV and AIDS project in Nigeria and developments at the Global Fund, as well as the HIV and AIDS situation in Argentina, host country of the ICEM World Congress.

World AIDS Day 2011 
 
World AIDS Day this year is about &ldquo;Getting to Zero&rdquo;: Zero New HIV Infections, Zero Discrimination, and Zero AIDS Related Deaths. 
 
ICEM affiliates are urged to join national campaigns to underline the role of unions and interventions at the workplace to get to Zero.

Backed by the UN, the &ldquo;Getting to Zero&rdquo; campaign runs until 2015 and builds on last year&rsquo;s successful World AIDS Day &ldquo;Light for Rights&rdquo; initiative encompassing a range of vital issues identified by key affected populations. 
 
World AIDS Day has been celebrated since 1988 and on 1 December each year around the world. It has become one of the most recognised health days and a key opportunity to raise awareness, commemorate those who have passed on. and celebrate successes such as increased access to treatment and prevention services. 
 
This year&rsquo;s slogan underlines that getting to Zero is a must. Only one third of the 15 million people living with HIV in need of life long treatment are receiving it. New infections continue to outpace the number of people starting treatment, while the previous upward trend in resources suffered a serious downturn this year. &rdquo;Zero New HIV Infections&rdquo; and &ldquo;Zero Discrimination&rdquo; are equally as likely to spark high impact events from small scale community vigils to nation wide events. In the words of the World AIDS Campaign (WAC), for 1 December 2011 right up until 2015, it is envisioned that different regions and groups will each year chose one or all of the Zeros that best addresses their situation.

Nigeria: Success of CEP-sponsored HIV and AIDS Project 
 
The second phase of the HIV and AIDS project in cooperation with ICEM affiliates NUPENG and PENGASSAN, and sponsored by the Humanity Fund of the Communications, Energy, Paperworkers (CEP) Union of Canada, has been a big success. 
 
Prior to the second phase, some 210 peer educators had been trained. Prevention campaigns were mounted in 40 workplaces across the country. Some 20,000 individuals were reached with awareness and prevention messages. Voluntary counselling and testing was carried out at 20 sites with close to 10,000 individuals tested.

Specifically in 2011, two training workshops were organised with a total of 33 participants (11 men and 22 women). Eleven advocacy meeting were held and six VCT campaigns were organised. 
 
With the advocacy campaigns, which target union branches and worksite where VCT campaigns are to be organised, a total of 388 (261 men and 127 women) were reached. 
 
During the six VCT campaigns in 2011, which last for three to four days each, close to 11,000 people were reached with awareness, prevention, and behaviour change messages. Out of these, a total of 2,302 people (21%) were tested and counselled (1,986 men and 316 women). Some 10,000 leaflets and 10,000 handbills were also produced.

News from the Global Fund 
 
The Board of the Global Fund has decided to extend the deadline for submission of Round 11 applications from 15 December 2011 to &ldquo;at least&rdquo; 1 March 2012. The decision appears to be primarily motivated by a substantial reduction in the amount of funding that the Global Fund estimates will be available for Round 11. This was initially estimated at US$1.5 billion. However, given the current global economic insecurity, the forecast of funding available for Round 11 has been lowered to &ldquo;not more than&rdquo; US$800 million and that even this amount might not be available until the fourth quarter of 2013. 
 
The Fund also appears likely to take this opportunity to implement some of the changes to the applications process recommended by the High-Level Independent Review Panel on Fiduciary Controls and Oversight Mechanisms of the Global Fund to Fight AIDS, Tuberculosis and Malaria (see article in the October e-bulletin). At a special meeting on 26 September, the Board formally adopted the report of the High-Level Panel and its recommendations. 
 
The Global Fund Board has formed a working group to examine options for changes to the application, renewal and approval processes for new and existing investments. Ghana: Homophobia Prevents Counselling and Treatment 
 
Condemnation of homosexuality by political and religious leaders in Ghana has led to a climate of fear, preventing men who have sex with men (MSM) from accessing vital health services. 
 
NGOs are alarmed at the threats of arrest and report a steady decline of participation in safe sex education and support programmes. At one site, regular peer HIV education programmes had to be stopped as nobody turned up anymore for fear of arrest. In another region, the distribution of condoms and safe sex information to MSMs was also abandoned.

An estimated 25% of Ghanaian MSMs are HIV positive. According to the WHO, since the beginning of the epidemic, MSM have been disproportionately affected by HIV. Male-to-male sexual relations are a crime in Ghana. Considered a misdemeanour, it carries a sentence of up to six months in prison.

Zimbabwe: HIV Survey Reveals Women most Affected 
 
Women and girls account for 62% of the 1.2 million people living with HIV and AIDS in Zimbabwe, a recent survey revealed. The survey also showed that only 20% of the adult population knew their HIV status. 
 
Socio-economic, cultural and religious factors increase women&rsquo;s vulnerability to HIV. Stigma and discrimination associated with an HIV positive status and fear of violence from partners deterred women from acting on prevention and treatment. 
 
Although Zimbabwe has managed a steady decline of the HIV prevalence rate from a peak in 2003 of 32% to the current 14.2%, the relative prevalence rate of women has gone up.

HIV and AIDS in Argentina 
 
According to UNAIDS, the Joint United Nations Programme on HIV/AIDS, Argentina has an HIV prevalence rate of 0.5% in the age group 15 to 49 years. While this is a relatively low rate, it has gone up steadily over the years. The number of people living with HIV is 110,000 of whom 36,000, or one-third, are women. Deaths due to AIDS stood at 2,900 in 2009, the latest available figure. 
 
The Ministry of Health leads the national AIDS response and the national strategic planning process. The response is mainly focused on the provision of antiretroviral treatment. In 2007, there was a review of the National Strategic Planning on HIV and AIDS with more broad-based participation of civil society and consideration of most-at-risk groups and a clearer gender perspective. 
 
The Global Fund had approved two HIV/AIDS grants in Round 1 for a total of US$25 million. These grants have been implemented and no further grants were extended.

The International Transport Workers&rsquo; Federation (ITF &ndash; <a href="http://www.itfglobal.org">www.itfglobal.org</a>), in its latest HIV/AIDS Update 114 of 15 October, reports on the launch of its 2011 World AIDS Day campaign &ndash; Getting to Zero. As in the past, the ITF has prepared campaign material for its affiliates. The ITS documentary on HIV and AIDS in the transport sector, called &ldquo;Being Positive,&rdquo; received an award at the Delhi Development Film Festival. 
 
The September Newsletter of the Swedish Workplace HIV and AIDS Programme (SWHAP), jointly run by the International Council of Swedish Industry (NIR) and the Swedish Industrial and Metalworkers&rsquo; Union (IF Metall), reports on its annual Southern Africa Regional Conference which was attended by 87 participants representing 31 companies from eight countries. Articles on community outreach, VCT campaigns and peer education can also be found in the newsletter.

Five Years Ago: From the November 2006 Issue (No. 13) 
 
The first issue of the ICEM HIV/AIDS e-bulletin was published in October 2005. In current issues, we refer to an article from the same month five years ago and reflect on developments. 
 
In the HIV/AIDS e-bulletin of November 2006, we reported on the preparations for World AIDS Day, on a meeting of the Global Union AIDS Programme in Nairobi and on the Round 6 grant approval of the Global Fund. Then, the Board approved 85 grants with a cost of US$846 million over the first two years and US$2.52 billion over the full five-year grant period. For comparison, Round 10 grants, approved in December 2010, come at a cost of US$1.73 billion for the first two years and US$ 4.72 billion over five years. At that time, UNITAID also became operational as a drug purchasing facility for the treatment of AIDS, tuberculosis and malaria. It was established during the UN General Assembly Special Session; its secretariat is hosted by the WHO. UNITAID generates money through an airline ticket levy first introduced by France on 1 July 2006. Founding members of the initiative were Brazil, Chile, France, Great Britain, and Norway, with the Clinton Foundation facilitating bulk purchase of drugs at lowest prices. UNITAID is now supported by 29 countries and the Bill &amp; Melinda Gates Foundation. Ninety-four countries receive UNITAID funding.

ICEM HIV/AIDS e-bulletin - No. 74, November 2011

The International Federation of Chemical, Energy, Mine &amp; General Workers&rsquo; Unions (ICEM) disagrees with a decree issued by the Government of Northern Cyprus last night that effectively blocks a legitimate strike in the electricity sector by EL-SEN, ICEM&rsquo;s affiliated Turkish Electricity Authority of Cyprus Workers&rsquo; Trade Union. 

EL-SEN launched the indefinite strike on the morning of 19 January over the government&rsquo;s draft bill to privatize the Turkish Electricity Authority (KIB-TEK). According to Article 16 of Collective Agreements and Strikes of Northern Cyprus, the government can suspend any strike for a 60-day period if it deems that the strike endangers the &ldquo;essential works&rdquo; of the country. After such suspension, the strike can continue but the government then has the option to postpone it again since the law allows the government to declare the strike illegal twice in a year. 

The ICEM considers the Northern Cypriot law as running opposite to norms contained in internationally recognized standards regarding the right to strike. 

&ldquo;We are very familiar with such anti-worker, anti-trade union practices in Turkey and now the same holds true in Northern Cyprus,&rdquo; said ICEM General Secretary Manfred Warda. &ldquo;Postponing a strike is in effect to ban one.&rdquo; 

Although EL-SEN abided by last night&rsquo;s decree issued by the Northern Cypriot Council of Ministers, the union and its members will stay off their jobs as democratic right of civil disobedience. The ICEM communicated its support of that decision to EL-SEN President Tuluy Kalyoncu today. A similar strike by the telecommunications union TEL-SEN that began at the same time on 19 January continues. 

EL-SEN and ICEM believe the state-owned utility KIB-TEK is sustainable and can be transformed into a viable public utility with a more efficient management. The ICEM also believes that the Northern Cypriot government must engage more fully with EL-SEN and other stakeholders before pushing forward legislation to privatize KIB-TEK. 

Before the strike, ICEM had sent a letter to Prime Minister Irsen K&uuml;&ccedil;&uuml;k urging the government to withdraw the draft privatization bill. The ICEM sent a second letter today, 20 January, to the Prime Minister protesting the Cabinet of Ministers decree last night.

ICEM Protests Northern Cyprus Strike Ban in Energy Sector

The Asia-Pacific Regional Materials Union Network of the ICEM held its third meeting in Ho Chi Minh City, Vietnam, on 10-11 October. The meeting was attended by 34 trade unionists from 14 unions in the cement, glass, and ceramics industries of Japan, Korea, Thailand, Vietnam, India, and the Philippines. 
 
This meeting agreed to set up a Saint Gobain Network in the Asia-Pacific Region, with affiliates in Korea, Indonesia, Thailand, India, Vietnam, Australia, and New Zealand joining the network. Unions in the region are currently running networks at Lafarge and Holcim in India, Korea, Philippines, Australia, New Zealand, Thailand, Indonesia, and Vietnam.

The meeting was also joined by union leadership from Nippon Sheet Glass (NSG) and Taiheiyo Cement of Japan, who expressed support for networking in their subsidiaries. 
 
The Vietnamese General Confederation of Labour (VGCL) and the Vietnam National Union of Building Workers (VNUBW) hosted this meeting of the Network, supported by the German Friedrich-Ebert Foundation (FES). The meeting also welcomed the ICEM Secretariat and the Japanese Affiliates&rsquo; Federation (ICEM-JAF).

ICEM Materials Industries&rsquo; Officer Phee Jungsun presented major developments and challenges in the global materials industries and profiles on multinational companies. 
 
Participants then gave country reports with pre-arranged survey details on working conditions and occupational safety and health. For the cement unions of Thailand, Indonesia, and Malaysia, performance of union activities is still difficult due to weak labour legislation. It was reported that both Lafarge and Holcim hire an increasing number of contract workers &ndash; averaging about 60% &ndash; with offers of voluntary retirement schemes to reduce permanent workers with long seniority. 
 
The meeting adopted a resolution to support contract workers at Swiss-based Holcim in India, who fight constantly for freedom of association rights. Also, support was extended to workers and unions at Lafarge in India, Malaysia, the Philippines, and Malaysia. The establishment of a Saint Gobain Network on the national and regional level is seen to coordinate with French trade union affiliate CFDT-FCE, which heads the Saint Gobain European Works Council. This Asia-Pacific network will work alongside a newly-planned North America Saint Gobain Network and hopefully build toward creation of a global network. 
 
The meeting also received a detailed report from ICEM-JAF General Secretary Yoshio Sato on the earthquake and tsunami in Japan. Sato thanked all ICEM affiliates who showed solidarity to Japanese unions by sending messages and donations.

ICEM’s Asia-Pacific Materials Sector Network Meeting Held in Vietnam

Members of the International Association of Machinists &amp; Aerospace Workers (IAM) began strike action Honeywell on 10 October at a nuclear parts manufacturing facility in Kansas City, Missouri. The 940 members of IAM Lodge 778 begin their third week today on picket lines at a US government-owned site following a 79% contract rejection on 9 October. 
 
Union members followed that ballot with an 85% strike vote the same day. US federal mediation a week ago failed to resolve differences, but did produce a hand-shake agreement on 18 October in which both sides agreed to refrain from airing the dispute in the local press. Two days later, a manager for Honeywell Federal Manufacturing &amp; Technologies LLC. told a television broadcast that IAM members are overpaid and should be satisfied with the company&rsquo;s &ldquo;last and final&rdquo; offer.

That offer is a six-year proposal that does contain minimal pay gains in each year, but it also creates a two-tier wage scheme. That pay grid would see all employees hired in 2012 receive less hourly pay and come under a slower pay progression. Such a pay schedule would take new hires five years to reach only 90% of what current workers earn. 
 
Honeywell&rsquo;s proposal also attacks workers&rsquo; health care coverage, making it more costly for union members to have adequate health insurance. IAM Lodge 778 has proposed a four-year contract without the concessions. 
 
The union awaits a decision from the US National Labor Relations Board (NLRB) declaring the work stoppage an unfair labour practice strike. In the days prior to the 9 October rejection vote, Honeywell management circumvented the union&rsquo;s bargaining committee by express mailing a letter to all workers, misrepresenting the company&rsquo;s proposal and urging them to accept the offer. 
 
Such bad-faith bargaining runs counter to US labour statute and if the NLRB does issue a complaint, the strike takes on new meaning. Honeywell operates the US government facility called Bannister Federal Complex and produces non-nuclear components for America&rsquo;s nuclear weapons industry. 
 
The IAM strike comes a short two months after Honeywell ended a 13-month lockout against members of the United Steelworkers (USW) at a uranium conversion site in Metropolis, Illinois. US Machinists Strike Honeywell Nuclear Parts Plant in Missouri

Broad strike activity accelerated a positive wage agreement in the Austrian metal sector. In the early morning hours today, 18 October, Austrian trade unions PRO-GE and GPA djp, the Salaried Employees, Print, Journalism, Paper Union, emerged from bargaining on behalf on 170,000 metal and industrial workers with positive results. 
The 2011 pay awards will range from 4.2% to 4.4%, with the minimum wage in the sector increasing by &euro;80-per-month, or a sizeable 5.3%. The ICEM commends these wage gains as a sterling European example in creating consumer power to offset the dire financial climate of the Eurozone. PRO-GE and GPA djp are to be congratulated for negotiating &euro;300 million into the Austrian economy in this single set of talks.

This was made possible by strategic and early strikes last week that moved third-round bargaining up to yesterday, and forced the employers&rsquo; hand in raising their wage offers to above 4%. (See <a href="/en/5-Mining-DGOJP/4719-Wage-Shame-Drives-Austrian-Metalworkers-into-Warning-Strikes">ICEM report</a> on Austrian coordinated strikes last week here.) 
&ldquo;We have met our main demands of sustainable wage and salary increases, particularly for the lowest paid workers,&rdquo; said Rainer Wimmer, PRO-GE&rsquo;s chief negotiator. &ldquo;I thank the stewards, members, and supporters who made this deal possible. Without the 800 workplace actions and the pressure generated by the strikes, this would not have been possible.&rdquo; 
Those strikes happened last Thursday and Friday, and were about to carry into Monday, 17 October, except that employers recognised the growing momentum among workers for fair wage gains and they reached settlement on union terms. That recognition came in hastily called exploratory talks held on Sunday, 16 October, that included &Ouml;GB national labour centre President Erich Foglar and the leader of the chief employers&rsquo; association, the Austrian Federal Economic Chamber (WK&Ouml;).

Third-round bargaining was moved up from 20 October to yesterday to avoid further work stoppages, and the two sides reached accord early today after a 14-hour bargaining session. 
The agreement grants a 1 November pay rise of 4.4% to bottom rung workers, 4.3 to mid-level, 4.2% to senior staff, and 4% to top level people. In addition, pay for apprentices increases by 4.3% and all benefit indemnifications increase by the same amount. 
Perhaps the crowning achievement was hiking the minimum wage by 5.3%, or up to &euro;1,584-per-month. The wage agreement positively affects the buying power for 25,000 autoworkers, 16,000 who work in basic steel and iron, 5,000 in non-ferrous metals, 5,000 in utility work, and tens of thousands more in machinery, metal goods, and other industrial production. 
Austria&rsquo;s metal sector agreement now sets a template for 450,000 retail sector workers. Unions representing those workers and retail employers begin talks on 19 October.

Austria Metalworkers Negotiate Exemplary 2011 Wage Terms

In this issue of the ICEM HIV/AIDS newsletter, we report on the ICEM Women&rsquo;s Workshop in West Africa, the selection of the abstract written for ICASA, and the report of the High Level Panel on Global Fund reforms.

Women and HIV and AIDS, Sub-regional Workshop in Accra 
 
The West African Sub-regional Women&rsquo;s Workshop, which was held in Accra, Ghana, brought together 17 women from the Democratic Republic of Congo (DRC), Cote d&rsquo;Ivoire, Ghana, Togo, Nigeria, and Guinea. 
 
The workshop identified specific challenges facing women at the workplace and in communities with respect to HIV and AIDS. It addressed violence arising from HIV status and women&rsquo;s health and HIV and AIDS and dealt with the issue of the use of female condoms. 
 
The workshop started with a presentation by Akua Asumadu, the ILO HIV/AIDS Focal Point in Accra on &ldquo;Gender in the World of Work and mainstreaming gender in workplace response to HIV and AIDS.&rdquo; 
 
The workshop dealt with the issue of the importance of women structures especially in a male dominated industry such as the mining sector. Participants felt strongly that despite existing challenges, women structures play an important role in uplifting women and suggested that women structures should begin to be relevant to women by addressing specific women health and societal issues in order to improve active participation of women. 
 
Dr. Fred Nana Poku from the Ghana AIDS Commission made a presentation on &ldquo;The existing progress in the fight against HIV and AIDS, gender related issues that hinder access to care and the strategies in place to encourage the use of the female condoms.&rdquo; 
 
His presentation was followed by a presentation on the female condoms as a well as a demonstration on its proper use by Paule France Ndessomin, the ICEM HIV and AIDS coordinator. It became clear that the majority of women had never come across a female condom and were ignorant of its existence. The efforts through the ICEM HIV/AIDS project not only familiarise women with female condoms but also demonstrate the potential of their empowerment.

International AIDS Conference in Addis Ababa 
 
The 16th International Conference on AIDS and STIs in Africa (ICASA 2011) will be held in Addis Ababa 4-8 December. The theme of the Conference is &ldquo;Own, Scale-up and Sustain.&rdquo; 
 
In the context of the project, sponsored by the Danish LO/FTF and in cooperation with the ICEM affiliate NIFECM, an abstract was written for the Conference proceedings. <a href="/wp-content/migration/icem/ICEM%20Abstract-ICASA2011-a.pdf">The abstract</a>, entitled &ldquo;HIV and the Workplace, Awareness and Prevention in the Mining Sector in Ethiopia, Trade Unions Take their Responsibility,&rdquo; was selected for presentation at an oral abstract session at the Conference. 
 
High Level Panel Recommends Major Changes to the Global Fund 
 
A High Level Panel led by former President Mogae of Botswana and former US Secretary of Health and Human Services Michael Leavitt has recommended in its report, released on 19 September, that the Global Fund make some major changes in its structure and working methods. The Panel was established six months ago by the Board of the Global Fund after widespread media publicity about corruption among some grant implementers. 
 
The Panel was given a broad remit to look into the Global Fund's problems and what should be done about them. Much is riding on the report; several donors have delayed making, or implementing, their funding commitments for 2011 and later until they see how the Panel reports and how the Fund responds. 
 
It would go beyond the scope of this e-bulletin to summarise the 149-page report (which is done in the GFO Issue 158 quoted below). However, some of the major recommendations stand out. 
 
Firstly, the GF Board should specify the maximum available funding for each type of country. It is further recommended that the GF introduces a two-stage grant application process with a relatively brief concept paper first and a full proposal after &ldquo;approval in principle.&rdquo; With respect to staffing, it is recommended that the overall ratio of Country Program Staff (mainly Fund Portfolio Managers) within the Secretariat should increase. 
 
The report was subsequently adopted by the Global Fund Board.

HIV and the Neglect of Older African Adults 
 
While the focus of HIV and AIDS interventions has always been on the 20-40-year-olds most likely to be infected, African democracy institute Idasa warns that health workers and social planners have neglected to take into account the elderly who have contracted the virus &ndash; and their numbers are growing. 
 
Successful ARV treatment is just one factor that has created a new group of HIV and AIDS patients &ndash; the over 50s who face their own distinctive needs and challenges. A IDASA study, HIV and AIDS and the Older Adult, points out that old age could disguise the symptoms of HIV and AIDS, leaving it undetected and untreated as health workers and social services focus their attention on the younger population. This could have serious consequences as older adults may fall through the treatment net. 
 
Greater awareness of the prevalence of HIV and AIDS in the older cohort is urgent. The study suggests that older people may be more sensitive to antiretroviral drug toxicity and therefore the body&rsquo;s reaction to antiretroviral agents may be different in the older person. The authors also warn that older people may be suffering from age-related conditions and using other non-HIV medications, which could introduce complications in the use of antiretrovirals. 
 
The stigma and discrimination experienced by older people suffering from HIV and AIDS is also greater. Furthermore, many of South Africa&rsquo;s older generation have been left to care for AIDS orphans. They have become the sole breadwinners and sources of income in many households. but a growing numbers of these senior citizens are HIV-positive or suffering from AIDS themselves.

Swaziland: HIV Prevalence among Factory Workers 50% 
 
A new study has found that more than half of workers in Swaziland&rsquo;s garment industry are living with HIV, and officials are realizing that the once-hailed promise of manufacturing employment has become a financial and medical nightmare for tens of thousands of Swazi women. 
 
About 30,000 Swazis, mostly women, are employed in garment factories financed by Taiwanese investors and operated by managers from mainland China. The survey also found that most factory workers were well informed about HIV/AIDS, and 90 percent of workers interviewed were aware of the female condom and other methods of preventing HIV. 
 
The prevalence rate for textile industry employees is significantly higher than the 26% rate among sexually active adult Swazis, which is already the highest in the world. Although most of the workers knew how to prevent HIV, their circumstances did not allow them to practice this. Wages for part-time workers can be as low as US$56 a month, and rarely top US$223 a month for factory-floor workers. This forces a lot of factory workers into prostitution where unprotected sex is often demanded.

Nigeria: Changing Attitudes to Contraception 
 
Traditional leaders&rsquo; support has been vital to reproductive health education efforts. Health workers say an apparent rise in contraceptive use in Nigeria stems largely from a willingness by traditional and religious leaders in some regions to use their influence in promoting reproductive health. 
 
In the predominantly Muslim north, where contraceptive use has historically been far lower than the national average, the support of traditional leaders has helped change attitudes in communities where contraception was long regarded as taboo. 
 
Even in rural areas condoms are being used. People now know the negative consequences of not using condoms - HIV and pregnancy. Culturally relevant performances in villages are used to promote messages about family planning, reproductive health and safe sex.

The International Transport Workers&rsquo; Federation (ITF &ndash; <a href="http://www.itfglobal.org">www.itfglobal.org</a>) in its latest HIV/AIDS update 113 of 1 October, reports on its participation in the Inter-Agency Task Team to scale up HIV workplace policies and programmes and to mobilise the private sector. 
 
The September Newsletter of PSUFASA (Public Sector Unions Fighting AIDS in Southern Africa &ndash; <a href="http://www.psufasa.org">www.psufasa.org</a>) gives guidelines for trade union participation in the proposal process for the Global Fund and reports on meetings of PSI affiliates in Zimbabwe to explore the possibilities to include a workplace component in the country proposal. The newsletter also describes the anti-stigma and discrimination programmes which were launched in several southern African countries.

Five Years Ago: From the October 2006 (Issue No. 13) 
 
The first issue of the ICEM HIV/AIDS e-bulletin was published in October 2005. In current issues, we refer to an article from the same month five years ago and reflect on developments. 
 
In the HIV/AIDS e-bulletin of October 2006, we reported on the 3rd Regional Workshop for national coordinators. It will be recalled that the first cycle of the ICEM HIV/AIDS project, which ran from 2005 to 2006, included a series of regional training workshops for national coordinators. This third workshop focussed on peer education and laid the foundation for successful national activities in the coming years. The fourth and final workshop in that cycle dealt with accessing resources at national level and the writing of project proposals. Without knowledge of funds which may be available at national level and skills to access them, long-term sustainability cannot be achieved. Only a limited number of affiliates, however, succeeded in mobilising additional resources. 
 
In that issue, we also reported on the difficulties the Global Fund to Fight AIDS, Tuberculosis and Malaria had in financing grants for approved Round 6 proposals. Although only 43% of eligible proposals were approved, a funding gap of US$300 million emerged and project funding had to be postponed until additional pledges were received.

Dear Sirs Manfred Warda and Jyrki Raina, 
 
General Prosecutor of the Republic of Kazakhstan considered your appeal regarding strikes of oil and gas companies in Mangistau region. 
 
We draw your attention to the fact that from the very beginning and to the end of the strikes to all participating parties guaranteed rights to freedom of expression, realization of peaceful assemblies, protection of their rights and freedoms, including the courts, have been granted by the Constitution of the Republic of Kazakhstan 
 
The strikers' demands for better working conditions and increased wages with raising coefficients, which, in their opinion, were not taken into account, were the subject of proceedings in court and have been carefully, thoroughly, objectively and impartially investigated by a court with the participation of all stakeholders in the review of claim requirements of the employers to recognize strikes illegal. 
 
Court ensured full competition and equality of parties, right of the strikers (respondent) to be protected, independent election and protection of their position, qualified legal counsel, right to present evidence and participate in their study, to apply with requests and to give verbal and written explanations to the court. 
 
Upon review of the case the strikes at JSC &laquo;Ersay Caspian Contractor&raquo; (court decision of 05.18.2011), a joint-stock company &laquo;Karazhanbasmunay&raquo; (court decision of 20.05.2011), a joint-stock company &laquo;Ozenmunaygas&raquo; (court decision of 05.27.2011) and LLP &quot;Zhondeu &raquo; (court decision of 06.01.2011) have been recognized by the court illegal. 
 
Despite this, the government together with the TU representatives of the companies repeatedly, practically every day, before and after the recognition of the strikes illegal by the court, conducted outreach with the strikers on the unreasonableness of their demands. Their attention was drawn to the fact that in 2009, 2010 and 2011 the salary of the workers in these enterprises increased three times. During this period, their average salary has increased by 100 thousand tenge (or 690 U.S. dollars) and became 340 000 tenge (or 2300 U.S. dollars), which is today one of the highest in Kazakhstan. 
 
As a result of the above outreach large number of strikers returned to their jobs. 
 
Please also be advised that having sufficient legal grounds for dismissal, employment remained even for the organizers and active participants in the strike. The dismissal of some of them took place only after all measures on their return to work have been taken. 
 
Currently, the strike at these companies ceased. 
 
As part of the prosecution of A. Sokolova (Article 164, part 3, art. 334, part 2 of the Criminal Code of the Republic of Kazakhstan), K. Sisenbaev and A. Aminov (Art. 334, part 2 of the Criminal Code of the Republic of Kazakhstan), which were the main organizers of illegal strikes, we state that such persons are granted by the court with all procedural rights provided by law for the protection of the criminal process. 
 
The sentences in respect of such persons entered into force. K. Sisenbaev and A. Aminov fully acknowledged their guilt, and they didn&rsquo;t appeal against sentence in superior court. 
 
In addition, I draw your attention to the fact that the arguments about the frequent beatings and threats against the oil workers and their families were not confirmed. No appeals on such cases to the police of Mangistau region have been reported. 
 
The police of Mangistau region filed a suit on the facts of the murder of J. Turbaev and J. Karabalaeva under Art. 96 of the Criminal Code, under which appointed the judicial examination, interviewed relatives of the victims, residents and employees of nearby objects to the scene. Some other investigative actions aimed at the disclosure are carried out. 
 
The investigation of criminal cases is taken under control of the Prosecutor General&rsquo;s Office.
