Swiss union UNIA is mobilising its forces in defence of 560 jobs at Swissmetal, as the company moves dangerously close to bankruptcy. Some 150 Swissmetal staff in Dornach in north-western Switzerland assembled in the factory car park on 21 July in a sombre demonstration, demanding that production continues after the two-week scheduled holiday break. Resumption of all work activities should occur 8 August. 
 
Workers at the plant are refusing to halt production, in the knowledge that it would result in mass redundancies. UNIA and local staff have proposed a raft of alternative measures to improve efficiency, which would ensure profitability for Swissmetal. 
 
Pending a solution, local management must not issue redundancies or dismantle production equipment, as operations may still be purchased by another company. One prospective buyer is France-based Le Bronze Industriel.

Other union demands include for management to provide fully transparent financial documentation of the company, and a joint review of union proposals on efficiency improvements. A period of consultation has been extended to 19 August. 
 
UNIA is calling on the Canton of Soleure to mobilise its powers to safeguard the jobs. It is the same Canton where pulp and paper multinational Sappi last spring announced closure of its Biberist graphic papers mill, in a brutal loss of 341 jobs. Despite UNIA and Sappi European Works Council (EWC) efforts to find a buyer for the Sappi mill, the South African company recently said those efforts have failed and the mill would close. 
 
Swissmetal manufactures high-quality copper products, mainly used in the electronics, telecommunications, aviation, petroleum, and automotive industries. Based in Dornach, ten kilometres south of Basel, the company&rsquo;s other foundry in Switzerland is in Reconvilier, where another 560 jobs are at risk.

UNIA Continues Fight to Keep Swissmetal Jobs

A major textile brand has come out against the sandblasting of jeans and said that it will not, has not, and now will join a global front led by the Clean Clothes Campaign (CCC) and the International Textile, Garment and Leather Workers&rsquo; Federation (ITGLWF) to stop the practice by suppliers and retailers in giving jeans a trendy, faded look. 
 
Italian-based Gianni Versace fashion house responded to a cyber campaign by change.org and announced on 20 July that it is in agreement with CCC and ITGLWF &ldquo;that it is appropriate to take a proactive stance, and stand against the practice of sandblasting. 
 
&ldquo;Versace has specifically asked every supplier (and will ask any new supplier as a condition to work with Versace) to certify that they are not using sandblasting.&rdquo; The apparel marketer said any supplier using sandblasting in production &ldquo;will be considered in breach of contract and dismissed accordingly.&rdquo;

Sandblasting releases silica dust which, when inhaled, causes infection and scarring in the lungs. Continued exposure can cause silicosis. Textile and clothing manufacturing in developing countries is notorious for long working hours, cramped and unventilated work spaces, and lack of safety or health protection. High pressure blasting of sand severely compounds health risks on workers. 
 
Versace now joins some ten other retailers in action to totally eliminate the practice throughout the world. The others include Hennes &amp; Mauritz (H&amp;M), Levi Strauss, Karen Millen, Espirit, Aurora Fashions, Bestseller, Inditex, New Look, Carrefour, and C&amp;A. 
 
The ITGLWF welcomed the news from Versace last month. Spokeswoman Laura Carter, quoted in the Independent newspaper of the UK, said the company&rsquo;s decision sends a huge message to the influential fashion names of Italy. The ITGLWF hopes more companies will join the campaign and ban the practice at a scheduled meeting next month. 
 
CCC said the decision by the Milan-based brand came after a long a campaign. &quot;After many months of silence, Versace now say they agree that the sandblasting operators who make the finishings on the jeans run unacceptable health risks. Previously they had refused to join the call.&rdquo;

A three-day strike last week by a branch of Indonesia trade union Federasi Serikat Pekerja Pulp Dan Kertas (FSP2KI), ICEM&rsquo;s pulp, paper, and packaging affiliate, was suspended today in hopes that talks at the regional Parliament can bring a 2011 wage accord. Those talks should have happened late last week when union leaders and government officials entered the struck PT Tanjung Enim Lestari pulp mill to negotiate, but mill managers disappeared and made themselves unavailable. 
 
Today&rsquo;s talks will be mediated by the provincial Manpower Ministry and came about through global pressure on Marubeni Corp. and the fact that FSB2KI&rsquo;s branch union at the mill, SPPTTEL, had conducted such a thorough strike last week. If talks fail, SPPTTEL has promised another three days of strike action next week, 10-12 August. 
 
All 1,000 workers at the pulp mill, located near Muaraenim in southern Sumatra Island, began strike action on 27 July in response to repressive and rude bargaining table behaviour by managers of PT Tanjung Enim Lestari, a subsidiary of the Japanese holding company Marubeni. When local government officials attempted to mediate the dispute with local managers on 29 July, they found they had left the mill and could not be contacted.

Last week the ICEM put out a solidarity appeal for support to the FSP2KI branch union, SPPTTEL, as well as information on registering protests with local managers. The ICEM continues to seek support and further pressure on local managers. During wage talks in late June and again in mid-July &ndash; with government officials participating &ndash; PT Tanjung Enim Lestari managers offered only token salary increases for 2011, citing profit losses. In the July talks, the union pointed to increased production, rising market pulp prices, consistent profits from 2007 to 2010, and asked to see the employer&rsquo;s most recent balance sheet. 
 
With that, managers became indignant and threatened worker layoffs and terminating bargaining committee members if the team persisted with their demands. They also promised any strike would be met by police force. Although a police presence was nearby last week, the strike was peaceful and void of conflict. Strikers wore red and white ribbons, while a number of South Sumatra supporters and KSP2KI members from other pulp and paper mills have joined the strike wearing black ribbons. 
 
SPPTTEL is insisting on a total halt to the bargaining table threats and intimidation, and an across-the-board monthly increase of IDR 632,000, or US$74. PT Tanjung Enim Lestari has offered IDR 210,000, or US$24. The average median salary in the pulp mill is IDR 2 million, or US$235-per-month. 
 
The ICEM will monitor today&rsquo;s dialogue at the provincial seat in Muaraenim and, if necessary, continue to press Maurabeni for accountability. The mill has capacity to produce 450,000 metric tonnes of market pulp annually and is Indonesia&rsquo;s third largest pulp mill.

Paperworkers Strike Indonesian Pulp Mill; Pressure Brings Marubeni to Table

The ten-day strike by union members of Sindicato No. 1 Escondida of Chile&rsquo;s Federation of Miners (FMC) at the world&rsquo;s largest copper mine has galvanized mining unions in the South American country. In unprecedented solidarity, mineworkers&rsquo; unions of the private-sector FMC and at state-run Codelco, the Federation of Workers of Cobre (FTC), are uniting to proclaim a larger portion of the world&rsquo;s copper profits must remain in national hands. 
 
That message was made clear last Thursday, 28 July, when leaders of both federations met in Antofagasta in northern Region II to discuss how companies circumvent labour laws and collective agreement conventions at the expense of mineworkers, and how natural resources are exploited to the detriment of Chile&rsquo;s national character. Outside the trade union meeting, rank-and-file workers marched and demanded re-nationalisation of copper mining.

That may seem improbable, but one thing is not: soaring pricing on copper concentrates and copper cathodes and the ever-growing profit margins of multinationals that mine and trade the red metal worldwide has created a &ldquo;Together We Can&rdquo; mentality. Chile&rsquo;s mineworkers are now saying that unified industrial action can affect the country&rsquo;s future for the better. 
 
Consider that on a single day &ndash; 30 July &ndash; 10% of the world&rsquo;s copper production stopped when 1,500 FMC miners at Do&ntilde;a In&eacute;s Collahuasi (AngloAmerican and Xstrata) joined 2,400 miners of FMC Sindicato No. 1 at Minera Escondida Ltd. (BHP Billiton and Rio Tinto). Although grievances reflected separate sets of negligent circumstances at the two mining complexes, the unity of purpose was evident. 
 
The bosses have declared both strikes illegal because the walkouts occurred during running collective agreements. But when companies abrogate terms of those contracts &ndash; or refuse dialogue on health and safety or other concerns &ndash; what choice is there? Sindicato No. 1 has taken Escondida Ltd&rsquo;s breaches to labour court to disprove the illegality of its strike.

FMC President Cristi&aacute;n Arancibia said that workers are hearing a national calling, that unions of his federation feel a responsibility to the people and communities of mining regions. He said agreement has been reached with the FTC that mineworkers will not be &ldquo;accomplices to Chile&rsquo;s resources sold away for foreign investment.&rdquo; That includes FMC recognition that Codelco is chipping away at FTC&rsquo;s membership in order to partially privatise the world&rsquo;s largest copper company. 
 
The FTC&rsquo;s Cristian Cuevas, in turn, demanded that Escondida Ltd. stop persecuting workers by failing to fulfil the terms of the 2009-2013 collective agreement and disrespecting international labour conventions. He also warned that if BHP Billiton sacked striking Sindicato No. 1 members and replaces them with scabs, the wrath of all Chilean mineworkers will be heard. 
 
The ten-day strike by FMC Sindicato No. 1 at Escondida is portrayed as a difference in a one-off production bonus between the union and management. In fact, it is over dramatic reductions in agreed-upon production bonuses that were reduced three-fold this past spring while multinationals, BHP Billiton (57.5%) and Rio Tinto (30%), were reaping huge profits from a mining enterprise that accounts for 7% of the world&rsquo;s copper supply. 
 
At Collahuasi, the 24-hour walkout on 30 July &ndash; only eight months after a bitter 33-day strike &ndash; was over the company negotiating individually with workers outside the collective agreement. It was also brought about by an unresolved health issue from that November-December 2010 strike. The mine is located 4,000 metres high in the Atacama Desert of the Andes where oxygen levels are low and worker body stress is high. Anglo American and Xstrata have a US$750 million expansion underway that will nearly double production. The new open-cast mining area is at even higher altitudes, up to 5,000 metres. The FMC affiliate, Sindicato de los Trabajadores de Collahuasi, seeks dialogue to address the obvious and adverse health affects.

‘Together We Can’ …. Chile’s Copper Miners Unite for National Gain

In a landmark ruling issued 25 July by the full bench of Australia&rsquo;s Federal Court, the Construction, Forestry, Mining and Energy Union (CFMEU) successfully short-circuited Rio Tinto&rsquo;s 2008 decision to unilaterally put into effect a non-union collective agreement. The ruling voids Rio Tinto&rsquo;s sham five-year agreement with ten new hires in July 2008 that was intended to cover thousands of iron ore miners in West Australia, both signed under bygone individual work agreements under the John Howard government and future employees. 
 
The practice was done to avoid law changes then coming under Fair Work Australia. 
 
The 20-page ruling likely will serve as a precedent and a key portal for CFMEU to recruit miners in the mostly non-union Pilbara mining areas and then enter into legitimately negotiated enterprise labour agreements. Besides Rio Tinto, BHP Billiton also implemented long-term phoney collective agreements as a means to escape the CFMEU once the Fair Work Act took effect.

&ldquo;Rio and other employers that went down that path were, obviously, looking to shield themselves from the new legislation which brought fairness into the workplace, particularly around bargaining,&rdquo; said CFMEU West Australia Mining and Energy Secretary Gary Wood. 
 
The CFMEU challenged the validity of Rio Tinto&rsquo;s 2008 non-union contract last year, but Justice Robert Buchanan ruled in August 2010 that it was valid. On CFMEU appeal, however, the full bench of Justices Peter Gray, Bruce Lander, and Anna Katzmann overturned Buchanan&rsquo;s decision, determining that the contract was not an &ldquo;employee collective agreement&rdquo; as defined by the new legislation. 
 
The case centered on Rio&rsquo;s subsidiary Pilbara Iron Company Pty. Ltd. and a so-called Pilbara Iron Employee Agreement that was intended to last until 2013. The CFMEU argued that the company could not properly describe employees scheduled to work under the agreement when it was signed on 28 July 2008.

Australia’s CFMEU Wins Major Bargaining Ruling Against Rio Tinto

The ArcelorMittal Health and Safety Committee, created in June 2008 in a common effort by the company and unions to improve safety in ArcelorMittal, issued its first report of activities on 15 August called &ldquo;Together for Safety.&rdquo; The number of fatalities has declined since 2008, but remains unacceptably high in the company. 
 
In 2008, ArcelorMittal management and unions signed an agreement to create a Joint Health and Safety Committee to address the high number of fatalities in the company&rsquo;s units. The Committee is composed of representatives of the IMF, the European Metalworkers&rsquo; Federation, the United Steelworkers (USW), CNM-CUT, a mining area representative, and company Health and Safety representatives. 
 
On 15 August, the Joint Global Health and Safety Committee launched its first report, concluding it has had a positive impact on the number of fatalities, which it ascribes to good workplace cooperation between trade unions and management. 
 
Since its inception, the Committee has created local health and safety committees and made site visits in priority company sites in Kazakhstan, Brazil, Mexico, Czech Republic, Romania, South Africa, USA, Argentina, and Ukraine. During these visits, local union members and management met with committee members to review the local safety situation and develop a health and safety action plan. The committee has then arranged follow-up visits. 
 
The committee concludes that it has had a positive impact on the number of accidents in the workplace, especially fatalities, and helped reduce risk faced by workers. It has also helped to improve communication and cooperation between unions and management, locally and globally. 
 
The committee, however, also notes an increase in the number of fatalities in the last year &ndash; from 36 in 2009 to 41 in 2010, which is considered to be unacceptably high by both unions and management. 
 
There remain issues of dispute between unions and management. The company has publicised a set of &ldquo;Golden Rules&rdquo; for safety and associated actions, including penalties for violations, while unions fear that this violations policy will impede safety by dissuading workers to report about minor accidents and near misses, thereby creating a lazy safety management culture. 
 
There is also joint criticism of inconsistent responses to requests for health and safety training, and a deficient dialogue on the subject at some business units and work sites. 
 
The parties remain committed to the committee&rsquo;s work, and see the joint report and accompanying union and management statements as evidence for a working dialogue and commitment to building a positive workplace culture. 
 
The report, &ldquo;Together for Safety,&rdquo; has been issued in English, and will be published also in French, Spanish, German, and Portuguese.

Common Efforts Input to Workers’ Safety at ArcelorMittal

Multi-stakeholder negotiations in Indonesia, bringing together major sportswear brands, key manufacturers and five unions &ndash; including ITGLWF affiliates SPN and Garteks &ndash; have cumulated in the signing of a protocol to protect trade union rights. 
 
The negotiations began in November 2009 following a major Play Fair campaign and a commitment by major sportswear brands to engage country-by-country with trade unions in order to agree concrete steps to bring about improvements to working conditions in the industry. 
 
The protocol, signed on 7 June, addresses the fact that unions in Indonesia&rsquo;s garment and footwear sectors are frequently denied the time and space they need to carry out their duties. The protocol outlaws all forms of anti-union discrimination and requires that a CBA, where none exist, be negotiated within six months. The agreement provides for the release of union officials from work duties in order to carry out their union activities; requires provision of adequate office, meeting and notice board space; gives unions the freedom to distribute information without interference; and commits signatory factories to facilitate a check-off system for collecting union dues. 
 
Initial signatories comprised multinational brands adidas, Nike and Puma, their key suppliers, and five Indonesian unions including SPN and Garteks. Playfair 2012 launched an action, exactly one year before the London 2012 Olympics, to encourage additional brands to commit to the protocol. The action was well supported and since then Pentland &ndash; owners of the Speedo brand, Asics, and New Balance have agreed to sign the protocol. 
 
Although implementation is in the embryonic stages, some steps have been taken to socialise the protocol. adidas have held workshops for their 58 Indonesian suppliers to inform them about the protocol and encourage them to agree to its provisions, and Nike have promised that all of their suppliers will know about the protocol by the end of October. ITGLWF affiliate Garteks report that the protocol has opened the door for them to negotiate a CBA and they have also seen their membership increase in that factory. 
The ITGLWF is urging all garment and footwear brands sourcing from Indonesia to sign the protocol.

Multi-Stakeholder Negotiations Lead to Garment Framework Agreement

Oil industry multinationals employ over 12,500 workers in the Meta Region of Colombia, mostly by outsourcing work to contractors. These precariously employed workers are subject to poverty wages, exhausting working hours including working 49 days consecutively, and other sub-standard working conditions, all in clear violation of Colombian law and international minimum standards. 
 
Colombian Senator Robledo has described the workstations of the Puerto Gait&aacute;n oil fields as more like concentration camps, with overcrowded tents, water shortages, malnutrition, unhygienic sanitation, and degrading treatment. Oil contractor Pacific Rubiales conducts a public disinformation campaign in which it describes trade union USO as &ldquo;armed criminals, forcing work stoppages&rdquo;. 
 
The fight back against this untenable situation began on 19 July with mass demonstrations and work stoppages in the Puerto Gait&aacute;n and Campo Rubiales installations. Protestors were met with violent police brutality. Key support and action has been supplied by ICEM affiliate Uni&oacute;n Sindical Obrera (USO), which traditionally has organised employees of Ecopetrol, Colombia&rsquo;s listed state-owned oil company. Along with Ecopetrol, the contractors employing the Meta region oil workers are providing services for Canadian-based Pacific Rubiales, and CEPCOLSA, a subsidiary of Spanish-based CEPSA. 
 
The explosion of mass protests moved the Colombian government, notoriously compliant in the repression of trade unions, to hold a tri-partite forum on 3 August, chaired by Vice-President Angelino Garz&oacute;n. The forum created nine working groups to assess the various issues over 15 days and reach conclusions leading to a settlement of the conflict. Unfortunately and predictably not one recommendation of the 15-day working groups has been enacted. Instead unions have been hit with fierce persecution. Contractors MR, Intricon, and Medell&iacute;n Electricians ended the employment of 70 workers who had been involved in the 19 July mobilisation. Another contractor Duflo SA instructed employees to cancel their union membership, under threat of dismissal. 
 
The failure to implement any of the roundtable recommendations was met with protest from the local Puerto Gait&aacute;n community, who blocked all major roads leading into the municipality on 19 August. The local community&rsquo;s discontent was then compounded when the oil companies began hiring new staff, without employing anybody locally. 
 
The Ministry of Social Protection claims to have made 162 visits to the region, but has never met with USO or with the outsourced workers, and has only met with high level company officials on a handful of occasions. In a clear indication of the government&rsquo;s allegiance, from September the administration of President Santos will deploy a military battalion to be stationed in the community, which will in fact have its military vehicles fuelled by the local multinationals. 
 
Pacific Rubiales posted annual profits of US$218 million in 2010. 
 
During this labour conflict, 4,000 workers joined USO en masse in the Meta region. In the past year, over 16,000 contract workers have joined USO throughout Colombia.

Colombian Oil Workers Fight Back Against Mass Persecution

The initial findings from a global survey of ITGLWF affiliates show that there has been a sharp increase in the use of Contract and Agency Labour in the textile, garment and leather sectors. 
 
In Cambodia, ITGLWF affiliates the Coalition of Cambodian Apparel Workers Democratic Union (C.CAWDU) and the National Independent Federation Textile Union of Cambodia (NIFTUC) believe that contract and agency workers now account for 41-45% of the garment workforce. They also report that workers on short term contracts are more likely to be forced to work overtime whilst also receiving remuneration and benefits of a standard lower than their permanent colleagues.&nbsp; The length of contracts has also changed dramatically in the last 12 months. Previously six-month contracts where the most common contract length for CAL workers however this has now decreased to three months, while some are as short as one month. 
 
In Kenya, there has been an even sharper increase in the use of contract and agency workers. In the last 12 months the Kenyan Shoe and Leather Workers Union (KSLWU) has recorded a 50% increase in the use of CAL.&nbsp; Joseph Bolo, General Secretary of the KSLWU outlines the union&rsquo;s reaction to these increases &ldquo;The footwear sector is now using outsourced firms to provide the bulk of their employees. We are already organising with such employers and have signed recognition agreements with two firms employing about 600 employees.&rdquo; 
 
In Faisalabad, Pakistan, two ITGLWF affiliates have reported a 37% increase in the use of contract labour in the last 12 months whilst in Malawi the Textile Garment Leather and Security Services Workers Union has recorded a 20% increase in the last year, nearly all of whom have been women. 
 
In fact, all respondents to date have indicated that it is women workers who make up the majority of contract workers. They also agree that contract workers are facing even greater levels of exploitation than permanent employees such as forced overtime, non-payment of the minimum wage, and no social security provision amongst other issues. 
 
Unions have also indicated that their ability to organise workers is fundamentally undermined by employers dismissing organised contract workers or failing to renew only the contracts of union members. Added to this the industry standard of intimidation and other forms of repressing freedom of association, unions report they are finding it extremely difficult to organise contract workers. 
 
The ITGLWF is continuing to collect data from affiliates in the Americas, Asia, and Africa on the use of Contract and Agency Labour and will publish the full findings in early 2012.

st1:*{behavior:url(#ieooui) }The Coordinating Committee of ICEM affiliates in Colombia conducted a second educational seminar for trade union officers, 8-12 August, in Girardot Cundinamarca, 100 kilometres south-west of Bogot&aacute;. The educational program aims to develop an improved, stronger leadership of trade unions in the country.</div>
A total of 38 participants to the seminar came from ICEM six affiliates in Colombia, and trade union friends of the ICEM in the South American country. As in previous meetings, representatives of the International Metalworkers&rsquo; Federation (IMF) in Colombia participated, one activist from Sintraindumecol and two from Sintrametal.

The intensive workshop totalled 110 hours, with each participant receiving a diploma as an activist of ICEM Colombia. The participants will continue this training and development in 2012.
The organisers&rsquo; goal is to hold a major conference after 15 years of the programme, bringing together the large number of trade union activists who have been trained and educated by the program. This will represent a significant group of activists who can then influence management and government strategy.
