Legitimate strike action by five bargaining units comprising 600 cement workers in total, members of the ICEM affiliate Oilfields Workers’ Trade Union (OWTU) of Trinidad and Tobago, turned into a company lockout early this week as Trinidad Cement Ltd. (TCL) seeks to gain individual work agreements to break the strike.

The OWTU began a 90-day strike action on 27 February at the company’s two cement and ready-mix bag plants at Claxton Bay and Mayo, but the company countered that on Monday, 5 March, by issuing intent to lockout notice. That means both TCL and TCL Packaging, part of the Caribbean cement company’s TCL Group, can now try to coerce staff into signing yellow-dogs contracts.

The OWTU is confident cement workers will continue to man the barriers and also has expressed a desire to return to the conciliation process. The two sides, negotiating a 2009-2011 contract, are split on the wage issue, with OWTU seeking 16% while TCL is offering only 7%. The OWTU signed a contract for a total of 9% in wage increases over a similar period recently for 5,000 oil workers employed by state-held Petrotrin. (See ICEM report here.)

The cement strike sent shock waves through the twin-island nation’s construction industry after management announced cement inventories would only last one week. TCL immediately began importing cement and ready-mix from its Caribbean Cement subsidiary in Jamaica and its Arawak Cement in Barbados.

The strike became tense on the evening of 28 February and morning on 29 February when police drew guns and swung batons at strikers as forces left the factory Claxton Bay. The OWTU filed a formal complaint with the police over certain officers’ use of force in confronting the strikers.

Since that incident, calm has been maintained at picket lines, and the OWTU has kept a vigilant strike camp near TCL’s plant in Claxton Bay. OWTU and TCL held conciliation meetings between 9 February and 23 February, but strike notice was then given when the company refused to increase its wage offer.

Trinidad Cement Declares Lockout to Coerce Individual Labour Agreements

Some 100,000 union workers in South Africa will march today, 7 March, for two causes – an outright ban on labour brokers and scrapping the planed e-tolling, or pay-to-drive on Gauteng freeways. Some 32 manifestations will occur today across the country today in actions sponsored by the Congress of South African Trade Unions (COSATU).

The strike is against a government recommendation that failed to get consensus in year-long discussions before the national Economic Development and Labour Council (NEDLAC) that would allow employers to use workers provided by labour brokers for up to six months.

COSATU is also protesting turning the country’s first motorways into toll roads, something that clearly turns public services into commodities. “These roads are national assets for the use of the people of South Africa,” said COSATU General Secretary Zwelinzima Vavi, “not a commodity which can be used to make profits at our great expense.”

	Zwelinzima Vavi

COSATU is intent at ending the practice of labour brokering, which it compares to human trafficking. Statistics now show that one-third of all South African workers are temporary employees without social benefits. COSATU wants the responsibility of labour brokers to be limited to matching employees for employers, and that responsibility must end at the door to the workplace.

COSATU believes precarious workers can easily be intimidated into not joining a union and Vavi said that’s why the organisation’s Central Executive Committee is insisting “that every effort is made to mobilise workers employed by labour brokers to join actions on 7 March.”

In Johannesburg, Vavi, who will stand for re-election at COSATU come the union confederation’s congress in September, will lead marchers starting at the Library Gardens to the Gauteng premier’s office, and then past the offices of the Chamber of Mines and the Steel and Engineering Industries Federation. Multiple marches will be held in various cities in the Western Cape, KwaZulu-Natal and other provinces.

South African Workers March Today to Ban Labour Brokers

With 95% approval yesterday, Local 27 members of the Canadian Auto Workers (CAW) ratified a closure agreement with Electro-Motive Diesel (EMD), part of Caterpillar Inc.’s Progress Rail Services, in London, Ontario. The sizeable financial settlement ends a morbid chapter of labour relations abuse by a company, and leaves an economic wound befitting the worst corporate ill-will that can be served up.

The loss of 465 union jobs is tragedy in London, Ontario. EMD proposed in collective negotiations that CAW members reduce their wages from C$35-per-hour to C$16-18, and give up a 50% equivalent of all benefits. When workers said no, on 1 January Caterpillar and EMD locked workers off their jobs at a rail locomotive assembly plant.

Thirty-four days later Caterpillar/EMD announced it would close the operation, move production to a start-up plant in the low-wage – US$12-16-an-hour – city of Muncie, Indiana, six hours to the south of London, where Caterpillar had already assembled a virulently anti-union management team.

	Ken Lewenza

Angry Canadians could only beg the answer to the question: What are our federal and provincial governments doing on such brazen desecration of our manufacturing base. Caterpillar had bought the London plant in third quarter 2010 and it came with a bed of government tax breaks. Eighteen months later, the plant is shuttered and Canadian-made machinery and technical know-how is now leaving the country.

CAW President Ken Lewenza said Canada is in desperate need of a manufacturing jobs strategy. He stated that the free movement of global capital from country to country must be stopped because it is undercutting workers’ wages.

“We have to continue the fight,” Lewenza said. “Because too many workers are losing their jobs, both union and non-union, because of dead-beat employers – in everything from manufacturing plants to call centres.”

Severance packages exceeded what were required by law, partly driven by public indignation of Caterpillar’s conduct and mostly by CAW’s resolve to get the best possible close-out deals for workers. EMD workers will get three weeks’ pay for each year of service and a C$1,500 lump sum payment. (See the CAW closure agreement here.)

For one-third of the workforce, that means severance payments of 60 weeks’ pay or more, while many will average 20-25 weeks. Workers will gain a measure of extended health care coverage, their pension fund will be fully funded, and EMD agreed to settle all claims and grievances with CAW Local 27. That will amount to a C$350,000 payment to the union within 30 days of yesterday.

Province of Ontario law says that workers with five years of work service must get one week’s pay for each year worked, with a cap of 26 weeks. In a company statement on the closure and severance agreement, Caterpillar/EMD boasted that 75 workers, who would not receive pay-outs under the Ontario minimum, will do so now in the negotiated agreement.

That hollow boast fades in juxtaposition to the wider swath of economic carnage Caterpillar has left on southwestern Ontario. Besides the 670 union, clerical and management direct jobs lost, CAW expects the plant closure to impact another 2,100 peripheral jobs.

(See previous ICEM 2012 reports on Caterpillar in London, Ontario, here, here and here.)

A deadly coal mine tragedy and two near misses occurred in Ukraine’s eastern coalfields over the past three weeks. The worse came on 6 February when a methane gas explosion rocked the Pivnichna coal mine near the city of Dzerzhynsk.

One 54-year-old pitman died instantly and seven others died from severe burns in the days to follow in the Donetsk burn centre. The Coal Mining Industry Workers’ Union of Ukraine (PRUPA) was taking stock of the gas blast and welcomed a Donetsk regional prosecutor’s criminal investigation of the tragedy.

The mine, operated with 136 workers at the time of the explosion, is owned by the state-owned Dzerzhynskruhillia company. In August 2010, a methane explosion killed two workers at Pivnichna and trapped several more.

Another mine accident happened a week earlier at a different eastern colliery. This occurred at the Rumaniantseve mine in Horlicka, Donetsk, and it trapped four miners. PRUPA said sound communication was made early with the trapped miners and rescue followed.

The other near miss came on 2 February at the Kalinin mine of the Donetsk Coal Energy Co. when a fire torched wooden carriages inside the mine. Seventy-three miners were working inside at the time, and the fire immediately trapped 22 of them. They were eventually all rescued from depths of 1,000 metres.

Ukraine’s government has officially put the number of miners killed on the job in 2011 at 161.

Somyot Pruksakasemsuk was once again denied bail on 20 February by the Thai Criminal Court and is still incarcerated at the Bangkok Remand Prison. Somyot, a long-time labour activist in Thailand, was arrested on 30 April 2011 for his activities as a journalist in the run-up to the Thai elections last July.

He is charged with violating Section 112, or the lèse majesté law, a charge of defaming, insulting and threatening the King, Queen and heir apparent. Somyot is also alleged to have resisted arrest. He denies all charges.

Now working as the prison librarian, the Court ruled against bail on the following grounds:
	- The trial is high profile and evokes strong reactions from the public;
	- That Somyot is likely to escape Thailand if he is released; and
	- That Somyot would interfere with the prosecution witnesses if released.
These reasons are not credible to Somyot’s supporters.

	Somyot Pruksakasemsuk

Somyot’s son, Panithan Pruksakasemsuk, conducted a well-publicised 112-hour hunger strike that ended on 16 February, to protest against the order of the Criminal Court to deny his father’s bail. The request for bail has been made seven times and sufficient deposit has been offered. His protest is aimed at demanding the right to temporary release of his father.

Prosecutors have relocated Somyot to various provinces of Thailand for hearings by the prosecutor’s witnesses. This has been described as a form of persecution of Somyot as several witnesses live in or near to Bangkok.

Automotive and supplier sectors in Thailand have been booming. Some say Thailand is on the way to becoming the “Detroit” of Asia. The export oriented industry is overwhelmingly located in the cities of Bangkok, Chonbori, Rayong, Samutprakaran and Pathumthani.

Thailand’s tyre industry is made up of 16 companies, most of them multinationals, and operating in 20 factories employing 30,000 direct employees. Only nine factories are unionized, and those unions come from different sector and regional labour bodies in Thailand.

Some 33 union representatives from factories of French-based Michelin’s two plants, US-based Goodyear, Japanese-based Bridgestone and Yokohama, Taiwan-based Maxxis, and the Thai national company, Siam Rubber, came together in an ICEM workshop held 18-19 February in Bangkok. The meeting’s purpose was to organize a common union view of the tyre industry at both global and regional levels, introduce international labour standard applications, and chart the future union strategies in rubber in Thailand.

“The Thai tyre industry has developed and international’s support of the sector’s unions is a must,” said ICEM Thai Council Chair Prakob Parimon in opening the meeting. Chaiyuth Choosakul, the new President of ICEM affiliated Petroleum and Chemical Workers’ Federation (PCFT) said six out of 18 unions belonging to his federation are active in the tyre industry.

“We need knowledge, experience and support from the outside to better serve our members in the tyre industry,” said Choosakul in his initial remarks.

The workshop examined general trends, and challenges economically and socially that affect labour matters, presentations by ICEM Director of Industry and Corporate Affairs Kemal Özkan. Participants also warmly welcomed the Secretary of the European Works Council from Michelin, Cyrille Poughon, a member of ICEM’s French affiliate FCE-CFDT.

from right to left: FCE-CFDT's Cyrille Poughon, Kemal Ozkan, ICEM Thai Council Chair Prakob Parimon

Poughon provided detailed information on the French union and collective bargaining structures, as well as rubber industry collective agreements with details such as wages, work hours, labour relations in France and in Europe, as well as Michelin’s corporate situation. ICEM’s Asia Multinational Companies and Social Dialogue Project Coordinator Yoon Hyowon addressed international labour standards such ILO Conventions, OECD Guidelines, the UN’s Global Compact, and other instruments.

The participants then extensively discussed their difficulties, challenges, strong points, opportunities and future ideas on cooperation and solidarity. Widespread union de-recognition practices by employers in the sector was specifically mentioned. Differences in wages and social payments between different tyre companies, even among subsidiaries of the same companies, were noted as important challenges to overcome.

At the meeting’s conclusion, delegates unanimously agreed to form a national tyre union network for defending the interests and rights of employees in the sector. The participants further agreed that regular network activities must materialize in the near future. Continuation of ICEM’s leading role was underlined. Participants from Michelin asked French union representatives to assist them in upcoming negotiations to break the negative attitude of local management by intervening with senior management.

“The ICEM is proud to take the lead in a workers’ voice in the start-up of the Thai tyre network,” said Özkan. “Following the initiative to form a national network in India last December, ICEM will follow the same decisiveness in Thailand to ensure that effective union networking occurs in the tyre sector.”

The threat of strikes across Austria’s electric energy sector in mid-February brought a national labour agreement to 21,000 workers. ICEM affiliate PRO-GE and GPA-djp, the Salaried Employees, Print, Journalism, Paper Union reached accord on 12 February after the third round of bargaining last week failed.

In keeping with a decision made in worksite meetings after the second round of talks failed, late in January, the two unions got strike endorsement from the Austrian Federation of Trade Unions (ÖGB) and were to start manifestations today, with warning strikes commencing tomorrow.

	PRO-GE’s Manfred Anderle

Instead, the employers’ association moved a previous 3.6% wage offer to over 4%, with the minimum level of wages in the utility sector lifted to 4.2%. Higher-level wages will be increased by 3.8%, while those of apprentices will be hiked by 4.2%.

The two unions took the stalemate in 2012 wage negotiations to union memberships at the shop-floor level because employers were refusing to come close to wage level increases reached in Austria’s metal sector last October, or to account for a 2011 inflation rate of 3.2% that continues to rise. The unions also cited rising company earnings as reason why electric generating and distribution companies could pay what was achieved in the nation’s metal sector.

In a statement issued yesterday, PRO-GE’s Manfred Anderle and GPA-djp’s Karl Proyer jointly said: “Our great thanks go to all employees and to the shop stewards, who made this possible through their solidarity and readiness for action.”

Strike Threat in Austria Brings National Electric Accord

The European Works Council (EWC) of Rio Tinto last week condemned the global minerals and metal producer for its unwarranted lockout of 780 Canadian members of Syndicat des Métallos d’Alma, an affiliate of the United Steelworkers (USW) in Alma, Québec.

The intervention made by Rio’s EWC Secretary Véronique Roche from Paris comes at a time when the USW along with the ICEM and the International Metalworkers’ Federation (IMF) are ramping up a campaign. Actions have been launched to bring attention and pressure on the multinational in support of aluminium smelter workers of Rio Tinto subsidiary Alcan, who were unjustly locked off their jobs on 1 January in the Saguenay-lac-Saint-Jean region of Québec.

A mass protest of Canadian and global trade unionists will take place in Alma – some 380 kilometres north of Alcan’s headquarters in Montréal – on 31 March. That will come a day after the ICEM North America Region holds its committee meeting in the region as a show of support for the victimised members of Syndicat des Métallos d’Alma, USW Local 9490.

photo: lapresse.ca
An initial thrust 11 days ago by ICEM and IMF global affiliates in the form of protest letters to Rio Tinto’s President and CEO Tom Albanese saw a company response a day into the action: the company turned off its fax machines to avoid a deluge of written protests.

The EWC intervention, however, is sure to resonate. Roche said the EWC has found that Rio Tinto Alcan management failed to even consider proposals made by the union, a “destructive and socially irresponsible position.”

The 2 February letter added to Albanese: “Please know that our European forum will stand alongside the United Steelworkers in all organised efforts in Europe and elsewhere, and we will participate in actions deemed necessary by the USW to repel this anti-social attack.”

The EWC then demanded that Rio Tinto end the lockout and order local management back to the bargaining table to negotiate a fair, equitable and acceptable labour agreement with workers that does not decimate the economic well-being of the community. (The full letter can be read here.)

The chief issue behind the lockout is Rio Tinto Alcan’s desire to have unlimited outsourcing rights, something that would eventually half the wage base of the Saguenay-lac-Saint-Jean region. Since Rio Tinto purchased Alcan in 2007 for US$39 billion, Alma management has replaced each worker taking retirement, or in other reductions in force, by outsourcing to sub-contractors who use low-wage staff without full social benefits.

Syndicat des Métallos d’Alma tried to set a floor on full-time, direct employees in collective negotiations. Alcan refused and immediately locked out the unionised workforce on expiration of a prior five-year agreement. There is mounting proof that Rio Tinto Alcan is partially operating the 438,000-tonne facility with the use of scabs during the lockout, a prohibition under provincial Québec labour statute and something the USW is pursuing through the legal system.

A 40-day strike in the US state of Massachusetts has ended. Ninety brave members of the ICEM-affiliated Teamsters Union (IBT) backed Saint-Gobain’s CertainTeed subsidiary away from severe cuts to their health care plan, and ratified a five-year labour agreement by a 69-0 vote on 29 January.

The workers, who make asphalt roofing shingles, gypsum wallboard and fiberglass products at a plant outside Boston in Norwood, Massachusetts, returned to their jobs on 31 January with their heads held high, their pride intact, and most importantly their premium benefits package unsevered.

CertainTeed management came at the members of IBT Local 25 late last year with a proposal to abandon the union’s Health and Welfare Fund and replace it with an inferior company-managed plan. Such a plan would have left the workers with far fewer health care benefits, leaving them largely unprotected from illness or injury.

Workers took strike action on 19 December and when the company refused to move from its regressive proposals in US federal mediation on 13 January, Norwood Teamsters expanded their strike. Besides working with the ICEM and French union CFDT to take the dispute directly to executives of Saint-Gobain in Paris, they began handbilling other non-Teamster and non-represented CertainTeed and Saint-Gobain plants in the US.

“Our members would not accept the company plan and made that loud and clear to us,” said Local 25 Business Representative George Slicis. “We were on the picket line for 40 days, 24/7, through the holidays and in bad weather, and we were not going back unless the Teamster health care plan went back with us.”

The 69-0 vote last Sunday made that an affirmative. In bargaining again supervised by the Federal Mediation and Conciliation Service (FMCS) on 26 January, CertainTeed backed off the takeaways. Although there will be a very slight increase in workers’ out-of-pocket costs for continuation of the premium health coverage of US$6-per-week, that will be more than offset with the union negotiating a US$500 bonus each in years one through four of the labour agreement.

In addition, starting in year two, or late in 2012, and continuing in 2013, 2014 and 2015, workers will receive a 2% wage increase. Local 25 also won company-paid increases to the New England Teamsters Pension Fund of 10% in years one and two, and 6% each in the remaining years.

The ICEM congratulates Local 25 members at CertainTeed for their resolve in maintaining their earned benefits package and also commends Jean-Francois Renucci of CFDT, who took the case to preserve the US workers’ health and welfare insurance to top Saint-Gobain leaders.

A joint Executive Committee meeting of three European trade union federations on 31 January put the final touches on statutes, a political programme, and nominated candidates for leadership in what is to become a united eight-million-member industrial workers’ federation. The meeting, held near Mechelen, Belgium, was attended by 150 national union leaders from 25 nations.

The European Mine, Chemical and Energy Workers’ Federation (EMCEF), European Metalworkers’ Federation (EMF) and the European Trade Union Federation for textiles, Clothing, Leather and Footwear (ETUF-TCL) are now geared to formally merge on 16 May 2012 in Brussels, with dissolution Congresses coming a day earlier.

The joint Executive decreed that the new federation will strive to become a fighting force for a dynamic economic framework that allows industry to thrive as the motor for jobs and sustainable growth across Europe. The three current federations vowed that “social progress and the European social model cannot be sacrificed at the altar of ultra-liberal dogma.”

Although the new grouping has yet to formally adopt a name, its temporary moniker is the European Industrial Workers’ Federation (EIWF).

Michael Vassiliadis, President of Germany’s IGBCE, was nominated to serve as President, while current EMF General Secretary Ulrich Eckelmann was nominated to be General Secretary. Anders Ferbe of IF Metall, Sweden, Renzo Ambrosetti, UNIA, Switzerland, and Valeria Fedeli, CGIL FILCTEM, Italy, were nominated as Vice Presidents, while Sylvain Lefebvre, EMCEF, Bart Samyn, EMF, and Luc Triangle, ETUF-TCL, were nominated as Deputy General Secretaries.

The new federation will consist of four policy committees – Collective Bargaining and Social Policy, Company Policy Committee, Industrial Policy Committee, and Social Dialogue Policy Committee. It will also be composed of eight regions: South, Benelux, Central, South-East, Eastern, British, Nordic/Baltic, and South-West.
