<ol type="A"><li>The Finance Committee shall be composed of six (6) members of the Executive Committee plus the President, the Vice President<em> </em>and the General Secretary.</li><li>The Finance Committee members shall designate in writing to the General Secretary their substitutes within 60 days after the conclusion of the Congress. The substitutes are to be confirmed by the Executive Committee. If a Finance Committee member is unable to attend a meeting, the officially designated substitute shall attend the meeting.</li><li>Two members of the Auditing Committee shall attend the Finance Committee meetings as observers.</li><li>The Finance Committee shall discuss and make recommendations to the Executive Committee on the following: <ol type="i"><li>Long-term financial planning.</li><li>Analysis of IMF income needs.</li><li>Review annual budgets.</li><li>Establish terms of reference for collective bargaining negotiations with staff in Geneva.</li></ol></li><li>The Finance Committee shall meet as often as needed, but at least once a year.</li></ol>

5.     The Finance Committee

<ol type="A"><li>The Congress shall elect from among its ranks twenty five members, of whom a minimum of six are to be women, who, together with the President of the Federation, shall constitute the Executive Committee, for the purpose of assisting the Federation's Secretariat in its work and making decisions between meetings of the Congress. <br /><br /><br />Seats shall be distributed as follows: <br />Africa: 4  representatives, including at least 1 woman; <br />Asia &amp; the Pacific: 4 representatives, including at least 1 woman; <br />Latin America &amp; Caribbean: 4  representatives, including at least 1 woman; <br />North America: 4  representatives, including at least 1 woman; <br />Western Europe: 6  representatives, including at least 1 woman; and <br />Central &amp; Eastern Europe: 3 representatives, including at least 1 woman. <br />However, should vacancies on the Executive Committee occur between Congresses, the Central Committee retains its authority to elect new members.</li><li>If an Executive Committee member is unable to attend a meeting, the substitute designated by the Executive Committee member shall attend the meeting. The Executive Committee members shall designate in writing to the General Secretary their substitutes within 60 days after the conclusion of the Congress.  The substitutes are to be confirmed by the Executive Committee.</li><li>The Executive Committee shall determine its own rules. In doing so, the Executive Committee may hold its meetings and conduct its business by utilising new technologies.</li><li>The Executive Committee has the authority to establish special committees for specific work on areas of important concern.</li><li>The Vice President shall  conduct proceedings in the President's absence.</li><li>Presidents of Industrial and Organisational Departments shall participate in Executive Committee meetings as observers.</li><li>The Executive Committee shall appoint a certified public accountant to audit the books and accounts of the Federation.</li><li>The Executive Committee shall meet at least twice a year and, subject to the requirement to act consistently with the decisions of Congress and the Central Committee, is responsible for all policies and activities between meetings of the Central Committee.</li><li>The General Secretary and the Assistant General Secretaries shall take part in meetings in a consultative capacity.</li><li>The salaries of the General Secretary, the Assistant General Secretaries, the Department Heads and the Representatives of the Regional &amp; Project Offices, as well as their conditions of employment shall be determined by the Executive Committee as proposed by the President.</li></ol>

4.     The Executive Committee

<ol type="A"><li><div>The Central Committee is composed of the delegates of affiliated organisations which have fulfilled their obligations to the IMF.</div></li><li><div>The President, the Vice President, the General Secretary and the Assistant General Secretaries of the Federation shall be present at all Central Committee meetings.</div></li><li><div>The Central Committee shall hold an ordinary meeting at least every other year and is responsible for policies and activities of the Federation between Congresses.</div></li><li><div>The President and the General Secretary are authorised, with the approval of the majority of the Executive Committee members, to convene special meetings of the Central Committee.</div></li><li><div>The Central Committee has the authority to elect the President, the General Secretary, the Vice President or Assistant General Secretaries of the Federation in case of a vacancy between Congresses.  The Central Committee has also the authority to replace Executive Committee members in case of vacancies between Congresses. The same applies to the Auditing Committee.</div></li><li><div>The Central Committee has the authority to elect the Presidents of Industrial and Organisational Departments.</div></li><li><div>The Central Committee shall determine its agenda and programme.</div></li><li><div>The Central Committee is entitled to raise subscriptions between the Congresses (see Article 8.6.).</div></li><li><div>The Central Committee approves the annual accounts reviewed by the Auditing Committee (see Article 3.6.C.) and discharges the General Secretary and the Executive Committee of any further responsibility.</div></li><li><div>To ensure orderly preparation for the work of Congresses, the Central Committee is empowered to set up<strong> </strong>such<strong><em> </em></strong>committees<strong> </strong>as Rules, Resolutions and Credentials.  In the composition of these committees, fair representation of gender<em>, </em>membership and the various continents in the Federation shall be taken into account.  Final confirmation rests with Congress.</div></li><li><div>The Central Committee shall determine guidelines for establishing and for the operation of regional groupings and regional offices for the IMF.</div></li><li><div>The travelling and delegation expenses of delegates to the Central Committee are to be borne by the respective organisations. Any affiliated organisation requiring financial assistance for its participation should in advance make arrangements with the General Secretary.</div></li><li><div>The Central Committee defines the duties and powers of World Councils and working groups.</div></li><li><div>For voting in the Central Committee, Article 3.2. I. and J. of the Rules apply.</div></li></ol>

3.     The Central Committee

<ol type="A"><li><div>The highest authority of the Federation is the Congress.</div></li><li><div>The Congress takes place as often as seems advisable, but at least every four years, and is convened by the General Secretary on the decision of the Central Committee.</div></li><li><div>The place, date, and agenda are determined by the Central Committee.</div></li><li><div>Notification of the convening of Congress must be given to affiliates at least four months beforehand.</div></li><li><div>The Congress is composed of representatives of the national organisations affiliated with the Federation.</div></li><li><div>Each affiliated organisation shall determine the number of representatives at the Congress and shall bear their expenses. Affiliated organisations requiring financial assistance to secure participation should make arrangements with the General Secretary well in advance of Congress.</div></li><li><div>A delegate may also represent several of the organisations of his or her country. </div></li><li><div>Such authority shall be in writing to the General Secretary signed by the Principal Officer of the affiliate delegating the representation.</div></li><li><div>Each affiliated organisation, which has fulfilled its financial obligations to the IMF, has the right to vote at the Congress.</div></li><li><div>For the first 200,000 members, affiliates have voting rights according to their membership.  For membership above 200,000, voting rights are in proportion with the subscriptions ratio paid under Article 7.</div></li><li><div>The Congress shall review reports, motions and resolutions offered by affiliates and the Executive Committee.</div></li><li><div>All reports and motions for the Congress must be received by the General Secretary three months before the opening of Congress<em>.</em></div></li><li><div>The General Secretary must notify all affiliated organisations of the Federation of the motions, allowing enough time for them to be brought to the notice of their members before the Congress meets.</div></li><li><div>Reports, motions and resolutions of the Congress are to be adopted by a simple majority of the eligible votes, while alterations of the Rules must require a two-thirds majority of the eligible votes.</div></li><li><div>Each regular Congress shall elect by simple majority of eligible votes<em> </em>the President of the Federation who holds an elected position within his or her organisation.</div></li><li><div>Each regular Congress shall also elect by simple majority of eligible votes the General Secretary of the Federation.</div></li><li><div>Each regular Congress shall also elect by simple majority of eligible votes the Vice President of the Federation who holds an elected position within his or her organisation.</div></li><li><div>Each regular Congress shall also elect with simple majority of eligible votes one or more Assistant General Secretaries of the Federation.</div></li><li><div>Each regular Congress shall also elect by simple majority of eligible votes<em> </em>the Executive Committee members.</div></li><li><div>Each regular Congress shall also elect by simple majority of eligible votes<em> </em>the Auditing Committee members.</div></li><li><div>The Congress determines its own standing orders.</div></li></ol>

<ol><li>In order to achieve these objectives, the IMF works to build a strong international trade union movement capable of effectively representing and promoting workers' interests, in the face of an ever-expanding global economy -- a global economy that has yet to embrace, let alone recognise, adopt and enforce workers' rights.</li><li>The IMF affirms<em> </em>that only through trade unions and the practice of collective bargaining the goals of attaining social security and constant progress for workers can be achieved. The IMF therefore fights for all workers in their desire for freedom of association to form their own trade unions, the right to collective bargaining, the right to enter into collective agreements and the right to strike to achieve their demands.</li><li>The IMF also supports all its affiliated unions, particularly in developing countries, in their efforts to achieve higher living standards for workers and to promote democratic, economic and social development.</li><li>The IMF also fights for all other related internationally recognised labour standards, such as the right to a livable wage, safe and healthy working conditions, prohibitions against discrimination, and prohibitions against child labour or compulsory forced labour.</li><li>The IMF stands ready to make common cause with other independent, autonomous, and democratic trade union organisations, notably the International Trade Union Confederation and other Global Union Federations in pursuing international trade union objectives. It seeks to work with non-governmental organisations which share a commitment to promote trade union and other human rights.</li><li>Specific IMF activities which support these objectives include: <ol type="A"><li>Supporting the organisational efforts of metalworkers everywhere, particularly in developing countries and in all countries where freedom of association and the existence of free trade unions are threatened.</li><li>Actively voicing metalworkers' positions on potential international trade union, political, social, and economic issues concerning metalworkers throughout the world. Such participation includes appearances and submissions with respect to relevant international forums such as the World Trade Organisation, Organisation for Economic Co-operation and Development, International Trade Union Confederations, etc.</li><li>Serving as a catalyst, depository and exchange of information and material for affiliates needed in accomplishing these objectives.</li><li>Providing moral and practical support and leading in the development of creative and innovative strategies to assist in economic, political and social conflicts.</li></ol></li></ol>

<p>Given the enormous challenges working people face in today's globalised economy, organising remains a basic task for all trade unions and organising drives should be carried out by IMF affiliates themselves.</p><p>The shift from secure to insecure forms of employment, the attacks on trade union rights and the fragmentation of collective bargaining systems has seriously eroded our capacity to organise and effectively represent the interests of workers.  In addition to that the structural change in employment, in particular in the developed countries has resulted in a decline in the proportion of blue-collar workers who are traditionally well organized and an increase in the proportion of highly educated and non-manual workers.  The trade unions have found it more difficult to organise these workers.</p><p>To win and defend metalworkers' rights, we need strong, national unions in all countries. Therefore, one of the key objectives of the IMF is to encourage workers to build independent, democratic and representative national unions that are autonomous from employers, political parties and governments. This includes overcoming weaknesses in existing unions and, where required, building new unions capable of tackling the challenges of today.</p><p>However, it is not only a question of what unions do. In some countries, such as Belarus, Colombia, Thailand and the Philippines, governments and companies actively work to eliminate trade union structures, murder and intimidate activists or alternatively to fragment union structures and encourage enterprise level unionism, which seriously undermines the possibility for trade union strength.  All workers, regardless of their status, must have the right to organize.  The IMF and its affiliates must fight for legislation that allows workers to make their own decisions regarding their representative structures, and will pressure companies to always respect workers' decisions instead of hiding behind national laws when these do not conform to internationally recognized labour rights.</p><p><strong>IMF affiliates will:</strong></p><ul><li>Prioritise organising as a key means of building union strength at the national level;</li><li>Utilise organising strategies at the sectoral level and in key TNCs;</li><li>Provide practical solidarity support to unions attempting to organise workers anywhere, particularly along the supply chain of TNCs, and including in the affiliate's home country; </li><li>Fight to remove legal barriers which prevent precarious workers from joining national unions;</li><li>Step-up organising of non-manual workers, who account for a growing part of the workforce, to build greater solidarity and bargaining strength; and </li><li>Push for the elimination of legal restrictions on the right to organise for non-manual workers. </li></ul><p><strong>To assist affiliates in organising, the IMF will:</strong></p><ul><li>Support unions in developing their own organising campaigns and strategies, particularly for organising women, migrants, youth, and workers in precarious employment;</li><li>Strengthen its efforts to raise awareness about organising non-manual workers' in all regions, promote the exchange of information and experiences on organising tools and policies, and address topics of special relevance to non-manual workers; </li><li>Identify and develop union organising opportunities with affiliates, especially where TNC investments create new or growing concentrations of workers. The IMF Executive Committee, informed by the Regions, will prioritise the countries which should be the focus of this work. This will include countries such as China where the IMF currently has no affiliates;</li><li>Utilise IFAs or other means to develop cross-border organising campaigns;</li><li>Co-ordinate organising activities:</li><li>throughout supply chains by targetting contractors and workers in different forms of precarious employment;</li><li>in EPZs, where workers' rights are ignored and exploited; and</li><li>wherever multi-company, or multi-plant organising campaigns could be co-ordinated;</li><li>Provide forums for the exchange of information and experiences;</li><li>Provide training on issues relevant for organising and keeping members; and</li><li>Support national efforts to bring about changes in legislation to protect the right to organise and bargaining collectively by working together with other GUFs, the ITUC, the TUAC, and the ILO.</li></ul><p><strong>IMF will provide assistance to trade unions that:</strong></p><ul><li>are committed to activities leading to self-reliance;</li><li>have established their own priorities and identified their needs;</li><li>are working in accordance with the IMF Action Programme;</li><li>are building union structures that respond to workers' needs locally and internationally and that include women at all levels;</li><li>are able to organise activities or are prepared to closely co-operate with the appropriate IMF regional office;</li><li>are building union structures that are democratic, and independent of political parties and employers;</li><li>are ready to co-operate with other IMF affiliates at local, national and international level; and</li><li>are confronting and fighting repressive governments.</li></ul>

<p>In countries where national unions are vulnerable or enterprise unions predominate, the IMF will work with affiliates to promote national unity and strengthened national structures.  This includes developing strategies to prevent workers' organisations from being played off against one another or becoming dependent on management. Using tools such as Country Councils, the IMF will work to avoid competition and encourage co-operation and solidarity between workers. </p><p>Given that strong national unions are often born out of different historical backgrounds, it is necessary to seek unity of action even when unification into a single national union is not realistic. The IMF will focus its attention on ensuring that the unions we support have the capacity to organise, bargain and prioritise work on a national level, and that different unions within a country work in concert in the interests of all metalworkers.</p><p>In countries where labour legislation does not permit national unions, the IMF will work with national centres, other global unions, and the ITUC to assist workers and their unions in overturning laws that prevent workers from forming national unions.</p><p><strong>To assist affiliates in achieving unity at the national level, the IMF will:</strong></p><ul><li>Utilise IMF Country Council structures to build greater unity and solidarity in action; and</li><li>Focus its union building activities in countries where affiliates are predominantly enterprise-level unions in TNC's on the strengthening of national structures, and on building unity among unions by encouraging changes in union structures.</li></ul><p><strong>IMF affiliates will:</strong></p><ul><li>Work with other affiliates at the national level to build common positions and platforms on issues affecting metalworkers, particularly collective bargaining.</li></ul>

<p>KOREA: The IMF Shipbuilding Action Group (AG) meeting took place on 13-14 December 2010 in Seoul, hosted by IMF affiliate, the  Korean Metal Workers' Federation (KMWU). 22 participants and 2 guest speakers from Denmark, Finland, Germany, India, Japan, Republic of Korea, USA, and France held an active discussion of the agenda as follows:</p><ul><li>Trade union structures in the shipbuilding industry in Korea;<br />East Asian shipbuilding performances and China's impact in the global market;</li><li>Challenges to make the shipbuilding/breaking industry "Greener";</li><li>Health &amp; safety in the shipbuilding/breaking industry;</li><li>Developing future activities/programs in the IMF Shipbuilding/breaking sector.<br /></li></ul><p>After the global financial crisis, economic performance and employment in the shipbuilding industry has been heavily damaged, and the industry needs to achieve a fair, level playing field in order to create a sustainable industrial base. The meeting mainly focused and shared opinions on:</p><ul><li>Achieving a fair and level playing field in global shipbuilding sector;</li><li>Market factors and monitoring;</li><li>Promoting Green technology and creating sustainable jobs;</li><li>Impact on environment and health: Life cycle from shipbuilding to shipbreaking.</li></ul><p>Many fatal accidents still occur in this sector all over the world, especially in Turkey (both in the shipbuilding and shipbreaking industry) and in the South Asian region (in shipbreaking). The Action Group confirmed that the IMF will continue to promote occupational health and safety (OHS) and organizing activities in the region. All the participants of the meeting agreed to hold an event/seminar promoting OHS and green jobs in the sector at the World Congress on Safety and Health at Work which will take place on September 11-15, 2011 in Istanbul, Turkey, together with  the next IMF Shipbuilding/breaking meeting.</p><p>To make IMF shipbuilding/breaking sectoral activities more effective and stronger, in 2011 the IMF will conduct a research covering OHS working conditions, union structure, the global market, green jobs &amp; technology, union policies and more.</p><p>On December 15, the Action Group visited DSME (Daewoo Shipbuilding and Maritime Engineering), one of the biggest shipyards in Korea, and met with union leaders to learn about the emerging issues of sub-contract workers in the yard.</p>

IMF shipbuilding/breaking sector will take action to promote OHS and green jobs in the shipbuilding/breaking industry next year in Istanbul, Turkey. The IMF shipbuilding Action Group also decided to have a deeper discussion to achieve a level playing field for sustainable jobs.

Shipbuilding workers need a level playing field for sustainable jobs

<p>KOREA: The first round of bargaining between the Korean Metal Workers' Union (KMWU) and Hyundai Motor took place on December 14, after the non-regular workers decided to end their one month sit-in on December 9 and enter negotiations with the company.</p><p>Workers of an in-house subcontractor at the Ulsan factory of Hyundai Motor <a href="../index.cfm?c=24760&amp;l=2">began the sit-in on November 15</a> after the business closure of in-house subcontractor Dongsung Industries, and together with sympathy strike action from precarious workers in other Hyundai plants, raised three main demands in accordance <a href="../index.cfm?c=23679&amp;l=2">with the Supreme Court ruling on July 22</a>: </p><ul><li>That Hyundai Motor implement the Supreme Court ruling and transform the status of indirectly-employed subcontracted workers in the Hyundai plants to permanent, regular, directly-employed status with retroactively-applied backwages </li><li>After regularizing the precarious workers' status, that Hyundai Motor take appropriate measures such as coming to agreement with the union on remedies for trade union members victimized while raising the illegal dispatch issue (withdraw dismissals, forced transfer, pay cuts and to allow deceased union member RYU, Ki-hyeok, to rest in peace), and</li><li>That the Hyundai Motor Company issue a public apology to the precarious workers in Ulsan, Asan and Jeonju plants and to the South Korean people with the promise to stop using illegal precarious employment arrangements.</li></ul><p>The workers had been dismissed due to the subcontractor's notice of closure of business on October 14, and closure of November 12. Hyundai Motor was insisting that the workers would only be rehired by the new subcontracting company if they withdrew their membership from the KMWU.</p><p>The strike is reported to cost Hyundai 315 billion won ($277 million) in lost production causing it to report the worst November sales among Korean automakers.</p><p>KMWU has brought four demands to the negotiating table formed by the strike:</p><ol><li>Withdraw criminal and civil charges against the strikers and resolve the hospital bills of the injured strikers (some 120 people were injured, such as sustaining broken ribs by attacks from thugs),</li><li>Guarantee employment for the subcontracted workers who struck at the Ulsan, Jeonju and Asan plants, </li><li>Guarantee the physical safety of the strike leaders, and</li><li>Agree on a framework to negotiate for the regularization of workers victimized by illegal dispatch work disguised as subcontracting.</li></ol><p>During the first full round of negotiations, the KMWU national leadership, Hyundai branch leadership and the irregular workers branch leadership, along with Hyundai Motor CEO and a representative of all Hyundai subcontractors agreed to a timetable of bargaining once a week, with the next session to take place on December 20, 2010.</p><p>The Korean government has issued arrest warrants for 16 strike leaders from the Ulsan plant and five strike leaders from the Jeonju plant in relation to the strike, and the strike leaders have established a protest tent inside the company grounds near the KMWU branch union office as one precondition to the negotiating table was Hyundai Motor's agreement to guarantee safety of person of the wanted union leaders within the company premises. </p><p>The arrest warrants stem from charges lodged by Hyundai Motor against the striking workers, and it has been reported that the company filed on Monday new charges against strike leaders of the Asan plant industrial actions. </p><p>On December 16, the Seoul High Court had its first hearing into the case on whether illegal dispatch workers must be regarded as a directly employed worker by Hyundai the day after he worked more than two consecutive years at the plant after the case was sent back to the court following the July 2010 Supreme Court ruling in the matter. The KMWU is expecting the High Court to make a final ruling on the case sometime in January.</p><p>In the meantime candlelight vigils and other forms of protest against the company are continuing as the temporary workers continue their struggle for recognition as permanent workers with trade union rights at Hyundai Motor.</p><p>The International Metalworkers' Federation is closely monitoring the situation and is supporting affiliated union actions of solidarity support, such as UAW's protest on December 6 outside the Hyundai-Kia America Technical Center in Detroit.</p>

Ending a one month sit-in strike, subcontracted workers at Hyundai in Korea returned to work and began negotiations with the company. At the heart of the dispute are the workers' demands for full union rights and to be recognized as permanent workers, in line with an earlier Supreme Court decision.
