The ICEM Contract and Agency Labour (CAL) Campaign has released a new country report focusing on CAL use in the Netherlands. The report, which was developed with the assistance of FNV Bondgenoten, highlights the fact that 1.9 million people in the Netherlands work for temporary employment agencies, are employed by fixed-term or on-call contracts, or are bogusly referred to as self-employed.

The Netherlands was deeply affected by the global economic crisis, and the economy shrunk by 4% in 2009. In 2010, the country has seen a weak recovery, with many of the jobs that are being created, for example in the chemical industry, are precarious jobs. 
 
As is the case in many countries, CAL workers in the Netherlands receive lower wages, fewer benefits, and have less social security than permanent, directly-employed workers. In the Netherlands, companies may only hire a worker on three fixed-term contracts of up to one year each before the worker must be offered a permanent position. This regulation is often circumvented by allowing a one month period of unemployment before rehiring the worker on a further fixed-term contract.

The report details how Dutch trade unions have been active in challenging CAL, particularly the abuse common to workers hired through temporary employment agencies. This year alone, 12 new collective agreements have been negotiated by the national labour centre FNV, which include provisions that temporary workers may only be deployed in busy times and to cover for absences of other workers in case of illness, and that if they work longer than nine months in one year, they should be awarded permanency. There were also 34 new agreements signed which state that only certified employment agencies can be used. 
 
Dutch unions have also been active in bargaining for improvements for CAL workers at the sectoral level, and this year new collective agreements were signed with the two employers&rsquo; organizations representing temp agencies in the Netherlands: the ABU (ABU (Algemene Bond Uitzendondernemingen) and the NBBU (Nederlandse Bond van Bemiddelings-en Uitzendondernemingen). The most significant improvement in both collective agreements is that the training possibilities of people working through temp agencies have been expanded. Under the ABU collective agreement, workers are entitled to the same wages as employees of the hiring company after 26 weeks of employment. In the NBBU, the agreement states that workers receive equal pay for equal work from day one. 
 
A new foundation (the SNCU) was also established to monitor compliance with these collective agreements. The foundation - a partnership between employer and employee organisations in the temporary work sector &ndash; has the power to decertify temporary employment agencies which fail to respect the terms of the relevant labour agreement. 
 
The report also details the heroic efforts of CAL cleaners, who joined forces this year to assert their rights. Many cleaners in the Netherlands, including those contracted to work for companies such as Shell and Akzo Nobel, went on strike and organised protests for nine weeks. Their efforts ultimately resulted in a new collective agreement that provides better wages and more educational opportunities.

ICEM CAL Campaign Releases Country Report on the Netherlands

The cement workers&rsquo; union, Sintraincehsa, an affiliate of the Building and Wood Workers&rsquo; International (BWI), wrote to the chief labour inspector of the Ministry of Labour in Honduras, Selvin Ram&oacute;n Mart&iacute;nez, on 21 January to decry the union-busting tactics of local management. The union accused&nbsp;French-based Lafarge of&nbsp;breach of&nbsp;the collective agreement, national and international labour legislation, and the Global Framework Agreement signed by ICEM, BWI, and Lafarge. 
 
Local management of Lafarge Cementos in the city of Comayagua have arbitrarily begun&nbsp;alcohol and drug testing on employees as a means to sack union leaders. The tests are not observed by a third party and were initiated without consultation with the union.

Sintraincehsa requests that inspectors from the Ministry of Labour&nbsp;oversee the testing. The union asked&nbsp;management in June 2010&nbsp;to work together with it&nbsp;in cases where workers were found to be breaking rules on alcohol and drugs. The union wants&nbsp;to&nbsp;rehabilitate and educate those failing drug or alcohol tests. 
 
However, since December 2010, management has increased its unilateral testing, without agreement or dialogue with the union. Sintraincehsa says that this is the latest tactic in the company&rsquo;s union-busting campaign, which has seen membership of the union decrease five-fold in recent years. Local management continues to outsource jobs, with 23 sub-contracting firms&nbsp;now operating on site, jobs Sintraincehsa says should be held by direct and permanently employed workers of Lafarge Cementos. 
 
Sintraincehsa and&nbsp;Lafarge Cementos&nbsp;have had a collective agreement in place since March 2005.

Cement Giant Lafarge in Breach of GFA in Honduras

Some 1,600 American trade union and environmental leaders met in Washington, D.C., last week in a historic, three-day BlueGreen Alliance conference that concluded on 10 February with visits to US legislators urging a green industrial future for America. 
 
The BlueGreen Alliance Foundation, formed in 2006 between the United Steelworkers (USW) and the Sierra Club, has now grown to include eight US unions, several environmental organisations, and a handful of trade groups. 
 
The 2011 &ldquo;Good Jobs, Green Jobs National Conference&rdquo; featured US Environmental Protection Agency (EPA) Administrator Lisa Jackson as keynote speaker, and consisted of many workshops, including one entitled &ldquo;11 Workers Killed and the Worst Environmental Disaster Ever; How Do We Respond to the Deepwater Horizon Explosion?&rdquo;

A familiar chord throughout the conference was how to compete against trading nations such as China and Germany that have developed better industrial policies concerning green technologies. Participants took that question, demanding legislative solutions, to lawmakers on Capitol Hill in Washington. 
 
USW President Leo Gerard opened the conference by urging delegates to push leaders of both US political parties to act in the long-term interests of the US. Another pair of themes weaved throughout the conference is that clean energy does create jobs, and good jobs and achievement of a safe environment are mutually inclusive. 
 
BlueGreen Alliance Executive Director Dave Foster said the participants at last week&rsquo;s conference, who represent 8.5 million American workers, &ldquo;are willing to answer President Obama's call to out-build, out-educate, and out-innovate to win the future. 
 
&ldquo;Congress,&rdquo; he added, &ldquo;must (now) get moving on critical policies that build a healthy and prosperous America.&rdquo;

USW-led BlueGreen Alliance Champions Job Growth in America

A group of union leaders from the energy sectors of Mexico, Canada, and the US, including several ICEM affiliates, met in Los Angeles, US, on 28-29 January and debated topics such as North American energy integration, energy policies and privatization, natural gas policies, and petroleum extraction &ndash; particularly offshore &ndash; and refining. 
 
The conference, hosted by ICEM affiliate Utility Workers Union of America (UWUA), also took up solidarity with the independent trade union movement of Mexico. 
 
Some of the conclusions drawn are that Canada and Mexico have become energy colonies of the US; privatization and deregulation have caused occupational health and safety to suffer; liberalisation of markets has basically seen environmental protection largely forgotten; and good jobs mean liveable, safe, secure, and unionized jobs. Anything less is unsustainable.

Conference participants also concluded that decent jobs are being lost while privatized oil and gas companies exploit and export wealth. Delegates also rejected the notion that new electrical capacity must be private and deregulated, and identified this area as the next round of attacks to come. 
 
The conference also said indigenous peoples' rights are being trampled on or bought off, and countries face greater handicaps in assuring that their energy resources help their own citizens.

The Tri-Nation Energy Workers&rsquo; Network in Los Angeles consisted of Canadian unions Communications, Energy, Paperworkers (CEP) Union, the Power Workers Union (PWU), Canadian Office &amp; Professional Employees&rsquo; Union (COPE 378), and the Canadian Union of Public Employees (CUPE); US unions included the UWUA, United Steelworkers (USW), and the International Longshore &amp; Warehouse Union (UWUA). 
 
And the Mexican unions included the Authentic Workers&rsquo; Front (FAT), the National Miners&rsquo; and Metalworkers&rsquo; Union (SNTMMSRM), the National Union of Technical and Professional Petroleum Workers (UNTyPP), the Mexican Union of Electrical Workers (SME), and SUTIN, a nuclear workers&rsquo; union, and CNEE, an energy union.

Tri-Nation Energy Workers’ Network Convenes in Los Angeles, US

In Spain early this month, national union federations DGB of Germany and CC.OO and UGT of Spain were full social partners at the 23rd Spanish-German Summit. In common, they took the opportunity to issue a strong statement that government measures stemming from the economic crisis have benefited markets, but done nothing for social cohesion. 
 
The national trade union centers also took issue with German Chancellor Andrea Merkel&rsquo;s economic proposition heading into the summit to restrict wage growth by linking salaries to productivity and inflation. Leaders of the three federations &ndash; Michael Sommer of DGB, Ignacio Fern&aacute;ndez Toxo of CC.OO, and C&aacute;ndido M&eacute;ndez of UGT &ndash; were part of a tripartite event at the summit that also included CEOs from Telef&oacute;nica, Deutsche Telekom, Iberdrola, Siemens, Acciona, and other corporations.

In the statement, the federations said compliance with &ldquo;the agenda established at the G20 in London for new regulation of the international financial system&rdquo; must be a priority. They also gave full support to the European Trade Union Confederation&rsquo;s (ETUC) rejection of European Commission proposals for financial governance, and bluntly said, &ldquo;Today&rsquo;s European governments aim to lay the burden of the crisis on workers and pensions.&rdquo; 
 
Citing social inequality as a trigger to the economic collapse, the statement said structural reform and fiscal consolidation concerning pensions overhaul, welfare cut-backs, and weakening of collective bargaining laws &ldquo;will not lead to the recovery of the European economies. Quite the opposite. This erroneous conception is holding back a solution to the crisis and promoting social injustice.&rdquo; 
 
The statement also hit out at judgments from the European Court of Justice that wrongly regularize social and wage dumping, including the Vikking, Lava, R&uuml;ffert, and Luxembourg cases. 
 
The DGB, CC.OO, and UGT also said it agrees with analysts who say &ldquo;Europe is losing its values and its soul,&rdquo; and used as case example Tunisia and the fact that European governments held back until the very end condemnation of dictator Ben Ali and support for a people&rsquo;s democratic movement.

DGB, CC.OO, UGT Forge Common Ground on Euro Jobs, Economy

A national settlement was signed on 11 February in Delhi bringing significant wage improvements to 125,000 workers in the Indian cement industry. Workers will receive an increase of up to 3,500 Indian Rupees (US$77) per month. 
 
The ICEM-affiliated Indian National Cement Workers&rsquo; Federation (INCWF) led the negotiations under President Sanjeeva Reddy. There was good cooperation with all other Cement Workers' Federations in the talks with the Cement Manufacturers' Association, representing 23 major employers in the sector. The INCWF is also affiliated to the Building and Wood Workers&rsquo; International (BWI).

Negotiations were chaired by Chief Labour Commissioner N. K. Prasad. The settlement is valid for a period of four years from 1 April 2010. Continuous negotiations have been occurring since then when the INCWF submitted its demands for an agreement, following the termination of the previous settlement of April 2005. The repeated failures of the parties to reach agreement led them to request arbitration by the Chief Labour Commissioner. 
 
The new agreement includes improved allowances for education of workers&rsquo; children and for travel. The raise is equal across all grades of the pay scale. Arrears will be paid in April and August this year. 
 
The INCWF and other trade union signatories to the agreement have distributed it widely and hope that it will serve as a model for workers in cement companies outside of the Cement Manufacturers' Association, of which there are 18.

Finally, Excellent Wage Gains Won by Indian Cement Workers

Effective 1 March, some 200 transport workers at the Tkibuli-Mindeli coal mines in Imerti region, Georgia, will receive between 20-40% salary increases, depending on job classification, thanks to a 1-2 February strike by 600 members of the Metallurgical, Mining, and Chemical Workers&rsquo; Trade Union. 
 
That strike, on the heels of a methane gas explosion that killed one miner and seriously injuring four others, proved highly successful at 1,050-worker Saknakhshiri, or Geo-Coal, with management immediately agreeing to recognise the ICEM affiliate. Saknakhshiri is owned by Georgian Investment Group (GIG), a diverse conglomerate controlled by Georgian politician Davit Bezhuashvili. 
 
The 20-40% salary hikes for mine transport workers was agreed to in initial bargaining on 7 February. On 20 February, the union and management, together with the President of the Georgian Trade Unions Confederation (GTUC), Irakli Petriasvili, will resume talks on behalf of 650 underground miners over safety, pay, and other work terms.

Following the methane gas explosion on 21 January &ndash; the third such deadly blast in less than a year at Tkibuli-Mindeli &ndash; workers and their new union demanded modern mine safety equipment to replace Soviet-era equipment in place, and demanded improved work and pay conditions. 
 
The situation was exasperated days after the blast when police arrested two low-level managers as scapegoats for last month&rsquo;s deadly accident. In support of the two and as protest to the overall work and safety conditions, miners staged a two-hour warning strike on 31 January and then began an open-ended strike on 1 February. The strike ended the very next day when management recognised the union and agreed to begin immediate talks with a series of set deadlines leading to a collective agreement no later than 20 March. 
 
Workers began joining the Metallurgical, Mining, and Chemical Workers&rsquo; Trade Union after a 27 August 2010 gas blast that killed four and severely injuring six others. On 3 March 2010, another gas explosion filled four and severely burned one other miner. 
 
The Tkibuli-Mindeli coal deposits are the second major set of Georgian workplaces that the Metallurgical, Mining, and Chemical Workers&rsquo; Trade Union has organised using direct action in recent months. Last spring, the union staged strike actions at the Zestafoni Ferroalloys plant and Georgian Manganese mines, winning work rights for 5,800 miners and metalworkers.

Two-Day Strike Wins Georgian Miners, Metalworkers 20-40% Pay Hike

Copper mining unions at Chuquicamata in Chile&rsquo;s northern Region II are poised to take job action against state-owned Codelco if certain terms and benefits aren&rsquo;t met. Codelco&rsquo;s largest copper mine is undergoing a restructuring that includes a drop in production, retirement severances in order to thin job ranks, and then a multi-year US$2 billion investment to develop and extract copper from underground deposits. 
 
Miners of four local branches of Sindicato Minera Codelco Norte are upset that Codelco has reneged on certain conditions regarding retirement severance benefits. They are also upset that Codelco has refused to negotiate a social plan for job growth at the new underground project, called Chuquicamata Subterr&aacute;nea, a nine-year copper and molybdenum project that will extend Chuquicamata&rsquo;s life span 42 years. 
 
Codelco announced last year that it was cutting production by one-third over the next three years to prepare for the project. In December, senior managers of the national company clashed with supervisors when they pressured bosses to meet retirement quotas in order to set examples at both the Chuquicamata and Radomiro Tomic open-pit operations.

Now, Codelco has agitated 800 copper workers by reneging on severance entitlements and refusing &ndash; as is the practice in Chile &ndash; to engage legitimate trade unions in meaningfully talks on business development. 
Refusal is common as well regarding trade union engagement over health and safety matters. At a smelting plant that is part of the Chuquicamata mine complex, a worker died following a traumatic injury near a refining furnace. The death occurred on 11 January, 13 days after the accident occurred. In October 2010, a contract worker was killed in a pit when a ten ton rock fell on him. And in December, another contract worker suffered serious spinal injuries while working near a crusher. 
 
Codelco has split apart Chuquicamata and Radomiro Tomic by dissolving its Codelco Norte division and making each mining operation a separate division. The strategy distinctly indicates a move toward privatising. 
Codelco is the world&rsquo;s biggest copper producer and Chuquicamata is the world&rsquo;s second largest copper mine, behind Chile&rsquo;s Escondida mine, owned by BHP Billiton (57.5%) and Rio Tinto (30%). In January 2010, Chuquicamata mining unions staged a two-day strike that won workers sizeable pay gains.

Another methane gas blast inside a Colombian coal mine killed five workers, and seriously injured one. This time it occurred on 1 February at the semi-legal La Escondida colliery in Cunduinamarca department, in a community called Sutatausa, 100 kilometres north of Bogot&aacute;. 
 
Last time was only a fortnight ago when 25 miners died 600 metres inside the La Preciosa Ltda. coal mine in Norte de Santander department. That 26 January tragedy now stands as Colombia&rsquo;s second worst mine disaster in less than a year, behind the San Fernando mine blast on 16 June 2010, where 73 perished in North-West Colombia state. 
 
Following the recent mine deaths, both Colombian President Juan Manuel Santos and Mines and Energy Minister Carlos Rodado Noreiga admitted the country&rsquo;s Institute of Geology and Mining (Ingeominas) is ill-equipped to handle mine safety and compliance in the nation&rsquo;s burgeoning mining industry.

Ingeominas has 17 mine inspectors to handle some 6,000 mines that are currently licensed. Roughly 19% are coal operations, with the vast majority of them underground mines operated by small- and medium-sized businesses. The ICEM reminds that Colombia has many illegally operating mines, with estimates that of every 100 mining enterprises, 51 are operated illegally. 
 
The Escondida mine is in an area called Pe&ntilde;as de Boquer&oacute;n in the central department of Cunduinamarca and was operating under a temporary permit granted by Ingeominas. A day before the tragedy, miners had complained that the ventilation system was not operating adequately and gas levels were rising. 
 
The San Fernando mine blast in June 2010 was Colombia&rsquo;s worst mining accident in 30 years. A preliminary investigation found breach of existing safety regulations, faulty monitoring and detection devices, lack of training and qualification, and unfamiliar explosives used inside the mine. 
 
The list was even more extensive, with all contributing factors listed as preventable. Colombia&rsquo;s underground mine safety regulations fall under the out-dated Decree 1335 of 1987, a regulatory code that is easily breached by small- and medium-size companies. The problem is complicated by the fact that Ingeominas has been too quick to award mining licenses without the proper safety culture or safety equipment. 
 
Colombia has become the world&rsquo;s fifth largest exporter of coal, behind Australia, Russia, South Africa, and Indonesia. There are reported to be 5,800 new mines in various phases of exploration and development and unless the government revamps its internal mine safety structure, and adopts global mine safety standards as outlined in ILO Convention 176, more tragedies are certain to occur.

Colombia’s Second Mine Blast Brings More Alert; 5 More Dead

Warda said the one-hour-and-twenty-minute meeting proved that Camacho had been briefed on the manifestation's purpose. &quot;The only issue he was not familiar with is protection contracts in Mexico,&quot; said Warda. &quot;We had to explain how these contracts infringe on genuine trade union&nbsp;rights.&quot;
A 50,000 strong march in Mexico City on 31 January saw trade unionists protest shoulder to shoulder against the repressive policies of the Calder&oacute;n regime. The National Union of Miners marched with the Electricians Union, Pilots&rsquo;, Teachers&rsquo;, and farmers&rsquo; organisations, calling for social, political, and economic change.

The Calder&oacute;n government must heed the warnings of this global movement, and end abuses of trade union rights in Mexico. 
 
Rallies and meetings with Mexican Ambassadors will be conducted simultaneously in over 30 countries this week, in a coordinated effort by unions affiliated to the ICEM, IMF, UNI, the International Transport Workers&rsquo; Federation, and the ITUC. 
Where demonstrations are not possible, unions are sending written protests and demands to the Mexican government from around the world.

Australia: The global campaign will hold a launch event with the support of Australian trade unions on 15 February. Co-ordinated by the Australian Council of Trade Unions (ACTU), with support from the Construction, Forestry, Mining, and Energy Union (CFMEU), the Australian Manufacturing Workers&rsquo; Union (AMWU), the Maritime Union of Australia (MUA), the Australian Workers&rsquo; Union (AWU), and others, a rally and meeting with the Mexican ambassador is planned for 18 February. At the biennial delegates&rsquo; conference of the AWU tomorrow, IMF General Secretary Jyrki Raina will address the global campaign on Mexico. 
 
Canada: With coordinating support from the Canadian Labour Congress (CLC), the Communications, Energy, Paperworkers (CEP) Union of Canada, the Canadian Auto Workers Union (CAW), Transport Workers&rsquo; Union (TWU), and the United Steelworkers (USW), leading actions will occur in Ottawa, Toronto, Montreal, and Vancouver. These will include a meeting with the Mexican ambassador in Canada, and demonstrations, depending on the local circumstances.

France: Unions in France are organizing for a delegation to visit the Mexican Embassy in Paris. In addition, through their existing relationship with managers, French unions are also contacting French transnationals on situations of companies&rsquo; production plants in Mexico regarding unions, collective bargaining, and wage and working conditions. 
 
Mexico: Unions in Mexico are planning to take action over the entire week, including a press conference in the capital, rallies at embassies of countries where others are taking action, and a march and seminar on 19 February. The Mexican Miners&rsquo; Union is also planning a series of events in Pasta de Conchos, Puebla, and elsewhere where the union has strong presences.

Russia: Unions in Russia were awarded the right to protest at the Mexican Embassy and are preparing a letter to give to the Mexican ambassador and articles and press coverage on the issue.

Turkey: Unions in Turkey will mobilize members to visit the Mexican embassy, present a protest letter, and take picket action in front of the embassy.

US: AFL-CIO and affiliates, including USW are holding events in 14 cities. The ICEM-affiliated United Electrical, Radio, and Machine Workers of America (UE) is organising actions also in many cities.
