	A 90-day strike planned by ICEM affiliate Oilfields Workers’ Trade Union (OWTU) of Trinidad and Tobago against state oil company Petrotrin did not go ahead as scheduled on 18 February. OWTU and Petrotrin, in marathon talks mediated by Labour Minister Errol McLeod on 17 February, agreed to a three-year deal for 5,000 oilworkers that covers the years 2008-10.

	The agreement not only grants fair wage and allowance adjustments, but OWTU made great strides contract-wise for temporary workers, and fulfilled job safety issues by getting Petrotrin to agree to fill all job vacancies within three months.

	The settlement averted a fuel disruption on the twin-island nation during Carnival and OWTU’s filing of strike notice had set off panic buying at the fuel pumps over the past two weeks.

	The deal includes a 9% wage increase following consolidation of all cost-of-living increases, and it will be allotted with 1% in the first year, 2% the second year, and 6% for 2010. The strike notice came about after Petrotrin refused to move above 5%.

	OWTU represents five bargaining units at the company, and it also won a 10% increase on all allowances, which include working heights, shift work, and excessive heat allowance. OWTU saw to it that full-time jobs will go to temporary workers, and that payment of all severance and gratuity to temporary workers over the age of 55 will be made.

	Earlier this week, the chairman of Petrotrin said the package will cost the company TT$271 million and that was far less than losses that would have accrued because of a strike. “It was best for the company in coming to a settlement immediately because we really don’t want a strike at this point in time.”

	OWTU General President Ancel Roget left the Ministry of Labour following the 17-hour talks early on 18 February and was greeted by jubilant union members. At a car park near the ministry in San Fernando, Roget told them it was their “militancy and commitment” that forced the deal. “You made us crack the 5% cap,” he said. “We secured a good settlement. We have gone where others said we could not go.”

OWTU Reaches Excellent Terms with Petrotrin in Trinidad and Tobago

	Some 25 trade union representatives from Indian states Maharashtra, Gujarat and Karnataka met at an ICEM workshop entitled “International Labour Standards and Social Dialoguein Indian Chemical Industry,” which took place on 15-16 February in Mumbai. The participants represented different chemical companies, including BASF (Mangalore and Thurbe plants), Rhodia, Reliance, 20-Microns, Shankar Packaging, FAG Bearing, NRC, Calchem, BEC Chemical and Danashmand and the ICEM workshop brought together different unions and national centers.

	Since 1990s, India has seen phenomenal economic progress with average 8% yearly GDP growth. This has made India 12th in the global chemical world and third-ranking in Asia. The chemical sector makes up 7% of India’s GDP and 14% of total exports. The country also has emerging multinationals such as Reliance, Tata, Gujarat Chemicals, Biocon and Ranbaxyies.

	The Indian trade union movement, including chemical industry unions, face serious challenges such as declining union membership, shifts to unorganized and informal sectors, union multiplicity, low union density and weak finances. Indian union leaders inside the chemical industry say low wages and very long working hours are major problems.

	Contract and Agency Labour was defined as another major matter because chemical companies are using this social dumping practice widely. Workers employed in such regressive contracts generally get paid much less than workers directly employed with the primary employer.

	The meeting analyzed recent trends in the chemical industry through ICEM’s viewpoint via its Director of Industry and Corporate Affairs, Kemal Özkan, who provided wide information on employment characteristics in the sector. International labour instruments were also on the programme within the context of ICEM’s Multinational Companies and Social Dialogue Project, coordinated by Yoon Hyowon.

	Ghosalkar Ravindra Govind, President of ICEM affiliate Chemical Mazdoor Federation (CMFI), stressed the importance of international cooperation for developing union work in India’s chemical industry. “At a time when our chemical industry grows, we must take all efforts to advance our members through the global support of ICEM,” said the CMFI President.

	The participants discussed a road map for the future with special attention of enhancing union visibility, organizing contract and agency workers; enhancing union and social networking; establishing social dialogue mechanisms at various levels, and escalating campaigns for ratification and proper implementation of core labour standards.

	There was also wide common understanding among participants that the collective bargaining scale must be taken from plant level to sector level. It was unanimously agreed to continue such strategy meetings on a regular basis.

Chemical Unions in India Escalate Struggle for Decent Work

	From Seoul to Pretoria, Geneva to Mexico City, unions are taking joint action during the week of 19-25 February 19-25 to urge the government of Mexico to stop its attack on independent trade unions and freedom of association.

	International mobilizations kicked off in the main square of Mexico City on 19 February, in remembrance of 65 miners who died in the Pasta de Conchos mine explosion on that date six years ago. On 21 February, actions took place in Mexico, Geneva and London.

	And the United Steelworkers (USW) used the eve of the Week of Action to again condemn the actions of Canadian mining company Excellon for its damaging behaviour in Mexico. Excellon’s only Mexican operation, the Platosa mine, brings problems for workers, landowners, and the environment.

	The Tri-National Solidarity Alliance, which joins unions from Canada, Mexico and the US held a meeting of Solidarity at the headquarters of the Mexican Electricians Union (SME) in Mexico City.  Speakers at the event, including IMF Executive Committee member and exiled leader of the National Union of Miners and Metal Workers of Mexico (SNTMMRM) NapoleónGómez (via video conference), denounced the Mexican government’s attacks on fundamental workers’ rights and called for the implementation of ILO recommendations adopted by the Governing Body in March 2011.

	In Switzerland, a group of 20 ICEM, IMF, UNI and IUF activists held a small action outside of the Permanent Mission of Mexico to the UN in Geneva. Manfred Warda, Jyrki Raina, Philip Jennings, Fernando Lopes, Kemal Özkan met with Mr. Juan José Gómez Camacho, Ambassador to the Mexico mission.

	Discussions between the Norwegian Foreign Ministry and trade union Fellesforbundet are underway ahead of a planned visit to Mexico by the Foreign Ministry later this month. The union has been briefing Norway’s government on the issue of Protection Contracts in Mexico and the ongoing attacks on fundamental worker freedoms.

	Mexico’s Embassy in London met with a delegation from the Trades Union Congress (TUC), and unions Unite and GMB, and Amnesty International and the Southern and Eastern Regional TUC on 21 February. Similar actions are planned for major cities in the US, including Chicago, Tucson, Boston and Denver, and in Korea, Pakistan, South Africa and Canada.

	Unions around the world are also supporting the global action by sending protest letter to the Mexican government in care of their respective embassies and consulates.

Week of Action Again Shines on Mexico’s Trade Union Abuses

	With 95% approval yesterday, Local 27 members of the Canadian Auto Workers (CAW) ratified a closure agreement with Electro-Motive Diesel (EMD), part of Caterpillar Inc.’s Progress Rail Services, in London, Ontario. The sizeable financial settlement ends a morbid chapter of labour relations abuse by a company, and leaves an economic wound befitting the worst corporate ill-will that can be served up.

	The loss of 465 union jobs is tragedy in London, Ontario. EMD proposed in collective negotiations that CAW members reduce their wages from C$35-per-hour to C$16-18, and give up a 50% equivalent of all benefits. When workers said no, on 1 January Caterpillar and EMD locked workers off their jobs at a rail locomotive assembly plant.

	Thirty-four days later Caterpillar/EMD announced it would close the operation, move production to a start-up plant in the low-wage – US$12-16-an-hour – city of Muncie, Indiana, six hours to the south of London, where Caterpillar had already assembled a virulently anti-union management team.

	Angry Canadians could only beg the answer to the question: What are our federal and provincial governments doing on such brazen desecration of our manufacturing base. Caterpillar had bought the London plant in third quarter 2010 and it came with a bed of government tax breaks. Eighteen months later, the plant is shuttered and Canadian-made machinery and technical know-how is now leaving the country.

	CAW President Ken Lewenza said Canada is in desperate need of a manufacturing jobs strategy. He stated that the free movement of global capital from country to country must be stopped because it is undercutting workers’ wages.

	“We have to continue the fight,” Lewenza said. “Because too many workers are losing their jobs, both union and non-union, because of dead-beat employers – in everything from manufacturing plants to call centres.”

	Severance packages exceeded what were required by law, partly driven by public indignation of Caterpillar’s conduct and mostly by CAW’s resolve to get the best possible close-out deals for workers. EMD workers will get three weeks’ pay for each year of service and a C$1,500 lump sum payment. 	For one-third of the workforce, that means severance payments of 60 weeks’ pay or more, while many will average 20-25 weeks. Workers will gain a measure of extended health care coverage, their pension fund will be fully funded, and EMD agreed to settle all claims and grievances with CAW Local 27. That will amount to a C$350,000 payment to the union within 30 days of yesterday.

	Province of Ontario law says that workers with five years of work service must get one week’s pay for each year worked, with a cap of 26 weeks. In a company statement on the closure and severance agreement, Caterpillar/EMD boasted that 75 workers, who would not receive pay-outs under the Ontario minimum, will do so now in the negotiated agreement.

	That hollow boast fades in juxtaposition to the wider swath of economic carnage Caterpillar has left on southwestern Ontario. Besides the 670 union, clerical and management direct jobs lost, CAW expects the plant closure to impact another 2,100 peripheral jobs.

CAW Reaches Severance Terms with Caterpillar’s Electro-Motive Diesel

	In calling attention to jobs creation as equivalent economic growth, working people across Europe today led by the European Trade Union Confederation (ETUC) are in a Day of Action in opposition to the European Council’s adoption of a budget discipline treaty.

	The decentralised mobilisations are occurring in scores of cities and worksites with a common theme pointed at EU governments and decision-makers: “Enough is enough! There are alternatives to austerity. Employment and social justice are the number one priorities.”

	Today’s ETUC Day of Action is taking the form of demonstrations, work stoppages and information postings inside workplaces and government institutions stating that the European summit’s Treaty on Stability, Co-ordination and Governance is a straightjacket that will plunge the Eurozone into free-fall recession.

	The actions include two demonstrations in Brussels, site of the European Council’s 1-2 March summit where the misguided treaty will intrinsically slash wages and social protections, restrict collective bargaining, and provide even more neo-liberal policies, hardly the remedies for economic growth to assure a sustainable future.

	Union leaders, led by ETUC General Secretary Bernadette Ségol, meet with Council President Herman Van Rompuy and European Parliament President Martin Schulz at the European Council Building, while a mass rally takes place outside. Meanwhile, members of all Belgian trade unions will protest today outside the Belgian National Bank.

	A sampling of other actions today includes a mass demonstration organised by the Romanian national trade union centres between 14h and 16h at Victoria Square in Bucharest. In Rome, Italian labour federations CGIL, CISL and UIL will demonstrate at Pantheon Place at 16h, while Hungarian trade unions will hold a press conference and manifestation.

	In Greece, trade unions will take a three-hour work stoppage from 12h to 5h, while even in Georgia trade unions will protest Trade Union Action Day with a rally at Parliament in Tbilisi against their government’s one-sided labour code and the economic harm it brings.

	“In mobilising on the same day everywhere in Europe for the first time,” said Ségol, “European trade unions are reacting with anger and exasperation.”

	In the UK, British trade unions used the day to gear up their defence of the National Health Service (NHS), which will happen across the UK massively on 7 March. Both the ETUC and Trades Union Congress (TUC) denounced austerity measures that always “fall hardest on the shoulders of the weakest” when public services are cut.

Europe’s Unions Protest ‘Straitjacket’ Treaty

	The third phase of the Royal Commission of Inquiry’s investigation of the Pike River mine explosions of November 2010 that killed 29 concluded in mid-February in Greymouth, New Zealand, and several experts testified to the inherent weak safety mechanisms in place by Pike River Coal Ltd.

	The latest set of hearings also reveal a company that was 18 months behind on orders to deliver  premium metallurgical coal, and in the words of a technical services manager who resigned just days before the first explosion, “There was no way the company would delay coal production” because of safety concerns.

	The manager, Pieter Van Rooyen, testified that workers had given him notice of inadequate methane drainage pipes, requesting that drilling cease until rectified. Despite passing that on in writing to senior operational managers, nothing was done. Van Rooyen said the decision to begin hydro-mining deep within the shaft without constructing a second exit – and in areas of high methane gas build-up – was strictly for “cash-flow purposes.”

	An electrical engineer who investigated New Zealand’s worst mining accident in 100 years said the faulty Pike River electrical systems multiplied chances for disaster since stray currents in many mechanical instruments produced sparks. Pike River’s main exhaust fan was located underground, an anomaly to modern mining.

	In late October 2010, the company was warned by a regulatory agency that the stability of an expanded roof in an underground area was worrisome, and again nothing was done. A mine safety expert from Australia testified that the blast was caused by a roof collapse deep inside the mine, causing a massive release of gas. When the underground fan failed, the gas could have ignited from a small spark.

	For 16 months now, the bodies of the 29 have remained entombed inside the South Island mine, despite efforts by families to recover their loved ones. In this inquiry round, photos of two miners who were sighted dead near self-rescue units were shown. The photos indicate that the miners might have survived the initial blast on 19 November 2010. In the following days, five more major explosions occurred.

	Pike River Coal Ltd. killed 29 miners, including 26 New Zealanders, a miner from South Africa, one from the UK, and another miner who was an Australian national. The mother of this Australian miner named Josh Ufer is currently speaking out in Australia on the necessity to maintain full trade union involvement in all mine safety matters.

	As the Single Bargaining Unit led by the Construction, Forestry, Mining and Energy Union (CFMEU) wages a battle against BHP Billiton and Mitsubishi to retain union-mandated safety deputies and open cut examiners inside Queensland collieries, Joanne Ufer is versing the dangers inherent in unilateral management control of safety matters in union advertisements.

New Zealand: Pike River Mine Inquiry Hears ‘Disaster Waiting to Happen’

	The 20 February shooting at strikers – mainly women – of the KaoWay Sports Ltd. footwear factory in Bavet, Svey Rieng province, Cambodia, appears to have been committed by the governor of Bavet region, Chhouk Bandith. Three women were shot and seriously wounded after a man dressed in police-style khakis got out of a vehicle and began firing at people.

	The factory produces shoes primarily for the German apparel company Puma. According to ITGLWF  affiliate, the Coalition of Cambodian Apparel Workers’ Democratic Union (C.CAWDU), thousands of the 6,000 employed at the factory engaged in strike action on 17-18 February. When strikes resumed on 20 February, Chhouk Bandith allegedly jumped out of a Lexus 470 with a bodyguard and a policeman after exiting the factory and fired shots from a high-power gun equipped with silencer.

	After firing, he fled in a Toyota Camry and truckloads of police moved in to quell disbelieving and angry strikers. Police have questioned Chhouk Bandith, and C.CAWDU believes he was held for three days, but has since been released.

	The entire incident, occurring about 09h00, was captured by a KaoWay factory security camera. Puma has been conducting its own investigation since the outset, together with an NGO.

	Buot Chinda, 21, was shot through the chest with bullets that narrowly missed her heart and severely punctured her lung. She was near death, but now is in stable but serious condition at a Phnom Penh hospital. The two other women who were shot and injured are Keo Neth, 18, and Nuth Sakhorn, 23.

	A senior ILO official who monitors a programme called Better Factories Cambodia, said in press comments, “It doesn’t look good for Cambodia when this type of violence is concerned.”

	Puma’s shoe workers, employed by Taiwanese-based KaoWay, were striking over better transport and food allowances, and better pay and conditions overall. Due to the industrial action – and Puma’s rapid response to the random violence – the strike has ended and all workers’ demands have been met in full.

	The strike and shootings had a different scenario at a separate Cambodian dispute, this one at Singapore-based Medtecs, a health textiles and apparel maker located in Kampong Siem district, some 125 kilometres from Bavet. While 2,000 strikers pelted the factory with rocks, police at the scene were unarmed and at stand-down because of the KaoWay shootings.

	The Medtecs strike was over the company failing to live up to decisions handed down by a binding Arbitration Council. It has been resolved due to the strike action.

Local Governor Accused in Shooting of Cambodian Footwear Strikers

	Trade unions from around the world agree on plans to establish IndustriALL Global Union in June 2012, a new global union to represent workers in manufacturing, energy, mining, and textile sectors at the global level.

	Meeting at the ILO in Geneva on 29 February, more than 200 trade union leaders from around the world spoke of the serious challenges working people face in the current political and economic climate. Having greater strength and building power across the supply chain at the global level is the motivating force for the creation of the new global union.

	The new organization will bring together affiliates of International Federation of Chemical, Energy, Mine and General Workers’ Unions (ICEM), the International Textile, Garment, Leather Workers’ Federation (ITGLWF), and the International Metalworkers’ Federation (IMF).

	The joint executive committee meeting of the ICEM, ITGLWF and IMF discussed the draft Statutes and Action Plan for the new organization and agreed on the proposed new name IndustriALL and logo.

	The joint meeting noted the proposed candidates for the political leadership of the new organization. The importance of including women in both the political leadership and representative structures of the new global union was argued for and included in the proposed Statutes.

	A founding Congress of the new organization will take place in Copenhagen, 18-20 June 2012. The proposed name, Statutes and Action Plan will be decided on at the founding Congress.

	The ICEM this week protested the unfair dismissal of 14 employees of Molds Medellin in Sabaneta La Estrella, Colombia. The members of Colombian affiliate Sintravidricol were informed on 22 March of the immediate cancelation of their contracts with no prior discussion with union representatives and with no reason given.

	Writing to the new CEO of Ross International, Tom Lusk, ICEM General Secretary Manfred Warda stressed the international attention and expectation on the company’s management following the recent passing of Mr Larry Ross, the company founder.

	Similar damaging downsizing inside Ross International’s operations is affecting ICEM members of the United Steelworkers in the US. Since 2008 the closures of Ross’s Penn Mold facility in Washington, Pennsylvania and the OMCO Mold facility in Winchester, Indiana have ended employment of approximately 150 mould makers. Currently the workforce at Brockway Mold in Brockway, Pennsylvania has been reduced by 50 percent to 44 mould makers with a further 12 slated for layoff.

	Reminding Ross International that their conduct in Colombia was in breach of international labour law, Warda insisted on the company’s respect for the fundamental principle of dialogue with workers, which the unions are sure, could lead to alternative solutions to downsizing and shop closures.

Pressure is building on US-based Freeport-McMoRan as talks again broke down with striking miners at the Sociedad Minera Cerro Verde copper and molybdenum mine in southern Arequipa region. A branch union of the ICEM-affiliated National Miners’ and Metalworkers’ Union (FNTMMSP) of Peru met with management on 20 October in an attempt to end the strike, but once again company negotiators refused to move closer to union demands. 
 
Management originally offered a 2,000-sol (US$735) one-time bonus and a 3% pay rise but the union has demanded an 11% increase to current wages. 
 
Very important to the struggle was a government declaration on 30 September that the strike is legal. This is the first time a strike at the mine has been declared legal in its 40-year history. This judgement means Freeport cannot hire temporary replacement workers, or scabs. The company is however using 600 volunteers and management staff to continue operations. This is illegal and has been confirmed to be so by the government, which has ordered the mine to stop its unsafe use of replacement workers or face a fine of 72,000 soles (US$26,500).

Replacement workers damaged an ore-crushing facility at the mine, causing a three-day total shutdown until repairs could be made. The copper mine has now exhausted its stockpiled ore. No new blasting is being carried out. Pressure is high on management to meet the union demands. 
 
The indefinite strike is respected by all 1,220 FNTMMSP members at the third largest copper mine in Peru. Miners downed tools on 29 September. 
 
Some strikers went on hunger strikes on 17 October, demanding the company and regional authorities respect their demands. Leoncio Amudio, the secretary general of the branch union of FNTMMSP reported that workers marched on 18 October to the Arequipa regional government headquarters. 
 
The Cerro Verde mine produces some 2% of the world's copper mine. Miners of Cerro Verde are unwilling to accept anything less than an 11% pay increase.
