ICEM Chemical Industries Sector Chair Tomas Nieber opened the Chemicals Sector Conference in Istanbul last week by calling for more regulatory standards as a result of the global financial crisis. Nieber, the head of German affiliate IGBCE&rsquo;s Economic Department who was re-elected chair of the sector that covers both chemicals and pharmaceutical, said with the sector showing a modest recovery in 2010, politicians and governments must not revert to past policies that caused the crisis. 
 
A record 250 delegates from 40 countries attended the ICEM&rsquo;s quadrennial chemicals conference in Istanbul on 27-28 October, a conference splendidly organised by Petrol-İş, the petroleum, chemicals, and rubber union of Turkey.

Nieber said 34 million jobs were lost worldwide due to the financial crisis, and he cited a number of challenges facing the sector, including the rising price of fuels and the need to maintain sustainable policies for the two industries. He also said since the sector has been marked by &ldquo;internationalization&rdquo; with increased cross-border investments and mergers, there must be more coordination regarding currency exchange rates. 
 
&ldquo;As trade unions, we must demand more regulations,&rdquo; Nieber said. 
 
Petrol-İş President Mustafa &Ouml;ztaşkin welcomed delegates to Turkey, but told global chemical and pharmaceutical trade union leaders that his country has implemented policies neutralizing unions. &ldquo;International conventions related to trade union rights and freedoms are routinely violated,&rdquo; he said, &ldquo;and the national legislation which regulates trade union activity retains its repressive and prohibitive essence.&rdquo;

&Ouml;ztaşkin said recent constitutional modifications that have been accepted by referendum actually are regressive in many ways toward trade union rights. He said Turkey ranks among the top ten worldwide in chemicals production, but he said privatization has decreased employment by 60-70% over the years, with non-union and precarious labour the norm. He also said it has become common for trade unions in Turkey to be the chief advocates for developing social responsibility standards, waste management, health and safety standards, and clean technologies. 
 
The conference included no less than six panel discussions over the two days, including one on Industrial Relations, Social Dialogue, and Social Responsibility. That panel saw Lutz Mugl, General Secretary of the International Chemical Employers&rsquo; Labour Relations Committee, Rhodia Chemistry President Bernard Chambon, and Umicore Human Resources and Development Director Mark Dolfyn participate and review practices, as well as ICEM Chemicals Industry Kemal &Ouml;zkan and Hubertus Schmoldt, former President of IGBCE and President of EMCEF.

The conference concluded with development of an 11-point action plan for the next four-year period. Highlights include support and coordination for organising workers of multinational companies; development of decent work practices in collective agreements, as well as equal pay and same terms and conditions of work; use of social dialogue with employers&rsquo; organizations; health, safety, and sustainability practices through union participation; a emphasis on women and young workers in the chemicals and pharmaceutical industries; and support for a new global trade union structure with two other Global Union Federations.

The Chemicals Conference also endorsed a resolution supporting French, Romanian, and other European trade union federations engaged in strikes against austerity measures. That resolution was first adopted by the ICEM Presidium, which met on 26 October at the same venue in Istanbul. ICEM Chemicals Conference Concludes with Record Turnout

On 29 September, ten million bitter people demonstrated across Europe. They protested government imposed austerity measures brought on by a financial crisis not their fault, or the fault of those now feeling the pain from crisis-caused social cuts. 
 
In the weeks since, that bitterness and anger has not gone away. In fact, it is manifesting itself day by day through differing circumstances in different countries. What the angst and anger have in common from one country to another is the feeling that those that caused the pain do not share in it now. 
 
Perhaps nowhere is the anger more pronounced than in France, where last week&rsquo;s strikes at refineries, pipelines, shipping, and transportation centres were compared to strikes in 2006. The country could be literally shut down this week if the strikes &ndash; focused on President Nicolas Sarkozy&rsquo;s pension reforms &ndash; continue. Prior 24-hour strikes were extended to continuous strikes last week, and another mass day of action is set for tomorrow, 19 September.

The CFDT said 3.5 million workers taken to the streets by mid-week last. Although Sarkozy has pushed through portions of pension reform, he still seeks legislation to increase the minimum pension age from 60 to 62 and increase the age for a full retirement package from 65 to 67. As the strikes grew throughout last week, a poll showed 69% of French citizens support the strikes. 
 
In Romania on 13 October, Finance Ministry workers stopped work in a spontaneous strike and occupied the Finance Ministry overnight. They were joined by public-sector workers from the Work, Heath, and Post Office, all protesting elimination of bonus payments from July, totaling between &euro;100-150 per month. That accounts for up to 60% of public-sector salaries. 
 
Continual protests in the Central European nation have now had an effect. Late in the week, the finance minister agreed to restore the bonuses for August and September. And a pension reform bill that would have lifted the retirement age for both men and women was sent back to Parliament for amendments because of &ldquo;people mobilisation&rdquo; and pressure from trade unions. The protests could become even bigger this week, since the menace behind Romania&rsquo;s austerity cuts &ndash; the International Monetary Fund &ndash; is scheduled for an evaluation visit on 22 October. 
 
In the Slovak Republic on 12 October, thousands of trade unions marched in Bratislava and assembled in the city&rsquo;s SNP Square, protesting the government&rsquo;s harsh reductions in the 2011 budget. The measures include cutting one-seventh of the entire state budget, including cutting the pay of all public-sector workers by 10%. The Confederation of Trade Unions (KOZ) said the average family of four throughout the country will see a reduction in income of &euro;400 a year, and instead calls for higher taxation on dividend earnings and granting relief measures to ordinary citizens. 
 
In the Czech Republic, trade unions are on strike alert today, anticipating the worst scenario on how a 10% pay cut in across the public sector will be implemented. A poll in the Czech Republic revealed that 58% of people polled believe the austerity measures will result in slower economic recovery. On 21 September, 40,000 Czech public-sector workers took to the streets because of the pay cuts. 
 
In Athens, Greece, protesters that are owed up to two year&rsquo;s back pay barricaded themselves inside the Acropolis and had to be removed by police force. Other tense confrontations appear to be hotting up for Slovenia, Portugal, and the UK. 
 
Instead of pension reform, wage cuts, and budget curtailments, trade unions see jobs and economic growth as the catapult to recovery. Unions bear witness that most victims of austerity cuts are workers and the working poor, victims of an economic crisis set off by bankers and traders and aided then by the same neo-liberal governmental policies that now call out for social cuts.

Deep Anger to Austerity Continues Across Europe

As the world rejoiced last week on the release of 33 trapped miners in Chile, questions arise over a chain of events at Campa&ntilde;ia Minera San Esteban Primera&rsquo;s San Jos&eacute; copper mine leading up to the massive 5 August roof collapse and rock slide that entombed miners for a record 69 days. 
 
While Chile President Sebasti&aacute;n Pi&ntilde;era basks in the global spotlight of a heroic rescue marshaled by the world&rsquo;s very best mine engineering and technical expertise, answers to those questions likely will remain hazy. Pi&ntilde;era has pledged there will be no impunity for mine owners and has commissioned an enquiry that will report findings by 22 November. 
 
But the very make-up of that commission explains just one of the structural deficiencies inherent in Chilean mine safety: no trade union representatives will be involved. Chile&rsquo;s mining unions say the government for decades has been unwilling to engage in tri-partite dialogue to improve mine safety, telling workers&rsquo; representatives their job is to negotiate over economic issues, not to participate on health and safety matters.

The unions say government officials and mine industrial representatives have consistently refused initiatives to discuss ratification of ILO Convention 176, the Safety and Health in Mines Convention, because it would dislodge strict industry-government control. One trade union leader told the ICEM that with vast private-sector investment already in Chile&rsquo;s mining industry, he has witnessed a steady stream of World Trade Organisation (WTO) people, but never a representative from the ILO. 
 
The facts behind San Esteban&rsquo;s shoddy safety record must come to light to accurately illuminate the structural barriers blocking safe mine practices in Chile. As early as 2004, the single entity trade union at San Jos&eacute;, Union No. 2 of Compania Minera San Esteban, presented legal challenges in courtrooms to close the mine because of unsafe conditions. Those went unheeded. 
 
In January 2007, following a rock slide that killed a worker, the National Service of Geology and Mining (SERNAGEOMIN) did order closure of the mine, but a replacement supervisor for the agency ordered it re-opened several months later. Reportedly, the order to reopen came because of political pressure. 
 
The re-opening was conditional, with the two owners promising to construct a second escape route, improve ventilation, and make other capital improvements inside a mine prone to rock falls after blasting. None of the promises were carried out and no inspections were made. 
 
Six months before 5 August, San Esteban&rsquo;s safety consultant resigned when he couldn&rsquo;t deal with the multitude of safety infractions. He spoke of roof meshing not in place, roof bolts being shorter and interspaced further than standard requirements, and huge rocks not cleared following blasting. In short, all the prerequisites contained in ILO Convention 176 &ndash; a second exit route, regular inspections, trade union consultation, regulatory bodies with the authority to shut and keep shut unsafe mines, workers&rsquo; rights to refuse unsafe work &ndash; were missing in the San Jos&eacute; mine, and no doubt in countless other Chilean mines.

What is for certain is Pi&ntilde;era, Mining Minister Laurence Golborne, and others, including leaders of state-run copper company Codelco, did assemble a world-class operation that successfully rescued the 33 San Jos&eacute; miners. Chile is a world-class minerals producer. But there is little question that procedural safety processes at the country&rsquo;s mine sites are far from world class.

In the aftermath of the recue, scores of ICEM affiliates issued public statements. The National Union of Mineworkers (NUM) congratulated the Chileans &ldquo;on the successful rescue operation&rdquo; and said that since expert technical aid came from South Africa, South African miners should expect more at home in terms of fewer mine deaths. 
 
&ldquo;Over 90 mine workers have died from January to date and the mining industry in South Africa continues to move snail-paced in safety terms and continues to fool itself and those who believe there is significant improvement&rdquo; inside the country&rsquo;s mines, read the statement.

The Construction, Forestry, Mining, and Energy Union (CFMEU) of Australia said that in August, it &ldquo;set about the task of raising funds to help (the 33 miners) and their families. These are people who have nothing and work under some of the most draconian conditions in the world. (CFMEU&rsquo;s) campaign raised 20 million pesos, about A$40,000, and is still growing.

The United Mine Workers of America (UMWA) said, &ldquo;&hellip; while we celebrate, we must also look at this event as a learning opportunity for those who regulate mining at home and abroad. Every mine in the world, regardless of location and engineering challenges, must operate in an environment that puts the safety of miners above every other consideration. 
 
&ldquo;Even the most stringent mine safety laws are only effective when regulators have the will and the means to rigorously enforce them. As we rejoice in the rescue of our Chilean brothers, let us also learn from the mistakes that put their lives at enormous risk.&rdquo;

In Germany, the IGBCE stated that this misfortunate must draw on lessons to support Chilean miners in their fight for safe work conditions. The ICEM rightfully uses this mine disaster to call on governments all over the world to ratify and adhere to the safety standards contained in the ILO Convention.

And Los Mineros, the Mexican National Miners&rsquo; and Metalworkers&rsquo; Union (SNTMMSRM), contrasted the all-out effort to rescue the Chilean miners with its own government&rsquo;s refusal to search or to conduct any kind of inquiry into the February 2006 mine disaster that killed 65 miners. 
 
The 33 miners in Chile are now safe and together with their families. But exactly how they came to be at death&rsquo;s door, and whether or not the Chilean government will make corrective structural changes in mine safety, remains an open question.

Chile’s Rescue Illuminates Country’s Mine Safety Shortfalls

IGBCE Women Sponsor Successful VCT campaign in Tanzania 
 
The second leg of the campaign for voluntary counselling and testing took place in Mwasa, the second largest town in Tanzania, in August. The campaign was sponsored with donations from the women unionists of the German ICEM affiliate, IGBCE. The African Medical Research Foundation (AMREF) gave technical assistance.

A total of 875 people were tested, among them 800 workers, members of the ICEM affiliates TUICO and TAMICO in Tanzania. Four percent tested positive, with a marked difference between men (3.1 percent) and women (6.9 percent). All who tested positive were referred to the government hospital in Mwasa. 
 
A dancing troupe of people living with HIV and AIDS provided entertainment, and members of the group also gave testimonies to encourage workers and members of the public to get tested.

Female Condoms Missing During World Cup 
 
Female condoms have been widely celebrated as an answer to putting reproductive health and HIV protection in the hands of women. Yet, the South African government fell far short of its promise of distributing 7.5 million female condoms during the World Cup games in June, with only one million finding their way into the hands of consumers. On the other hand, male condoms were available in high numbers - 565 million - though even these were 20% fewer than expected. 
 
Many women&rsquo;s organisations, who had pressed for the condoms, expressed disappointment that the female versions were largely missing in action, thus offering women less choice of how to protect themselves. Tian Johnson of Thohoyandou Victim Empowerment Trust is frustrated at the situation, referring to messages communicated by the organisation to 2010 visitors, &ldquo;Coming to South Africa soon? Bring your own condoms; we certainly don&rsquo;t have enough to share!&rdquo;

World AIDS Day 2010: Universal Access and Human RIghts 
 
First observed in 1988, World AIDS Day (WAD) on 1 December has served to raise awareness about the epidemic, focus attention on issues that are key to a successful response, and to inspire positive action. The WAD theme for 2009-2010 is &ldquo;Universal Access and Human Rights.&rdquo; 
 
In cooperation with the World AIDS Campaign and other organisations, this year UNAIDS is organising a global &ldquo;Lights for Rights Commemoration&rdquo; in 100 cities. This campaign aims to highlight the linkages between HIV vulnerability and Human Rights around the world, especially of people living with HIV, women and girls, men who have sex with men, sex workers, people who inject drugs, and transgender people. 
 
The &ldquo;Lights for Rights&rdquo; campaign began on 1 December 2009 in the US, when the lights were turned off and later turned back on, illuminating New York City landmarks. The darkness represents how stigma, discrimination, and criminalization forces people to die alone in fear and shame, while switching the lights on symbolizes the human rights of all people, which allows one to walk in the light of information, treatment, care, and health.

Zimbabwe: Patients Forced to Pay for ARVs 
 
Rampant corruption in the provision of life-prolonging antiretroviral (ARV) drugs and other HIV services is threatening Zimbabwe's national AIDS response, according to a recently released report by a local human rights group. 
 
Commissioned by the Zimbabwe Lawyers for Human Rights (ZLHR) in March 2010, the report - Corruption Burns Universal Access to Treatment - found that 73% of HIV-positive respondents had been asked to pay bribes by health workers. Most of those unwilling or unable to pay were turned away or given inadequate services. 
 
The findings were based on interviews with 1,024 people living with HIV in the provinces of Masvingo, Harare, Bulawayo, and Manicaland. Most of the respondents lived in urban areas and 89% had a family income of less than US$100 a month. 
 
HIV patients were often asked to pay for services that were supposed to be free. About a third of the respondents who were asked for bribes refused to pay them, mainly because of poverty; as a consequence, 63% were denied the service and had to pay for drugs or diagnostic tests in the private sector, or on the black market, or go without.

Kenya: Minister Condemned for Promoting Gay Inclusion 
 
A Kenyan minister who expressed her opinion in support for HIV and Aids mitigation programmes for gays and lesbians has come under sharp criticism from church and Muslim leaders who said her remarks were &ldquo;satanic&rdquo; and contrary to &ldquo;African culture.&rdquo; 
 
Esther Murugi, the special programmes minister in the Kenyan government, while addressing a Gays and Commercial Sex Workers HIV and Aids Symposium held at the Kenya Coastal City of Mombasa, challenged the government, in which she serves to help the lesbian, gay, bisexual, transgender, and inter-sex (LGBTI) community efforts in war against the scourge. 
 
The seminar, titled &ldquo;Most &ndash; At-Risk Populations (MARPs),&rdquo; was targeted at Men having Sex with Men (MSM), sex workers, and Injecting Drug Users (IDUs), believed to be at the greatest risk of HIV infection. 
 
Politicians attacked the minister over her remarks and called on Kenyan President Mwai Kibaki to dismiss her for advocating for the recognition of gays and lesbians. The symposium was partly sponsored by the National Aids Control Council (NACC) which is the government national agency that designs and implements policies on the fight against HIV and AIDS.

Global Fund: Donor Governments Pledge Record Amounts 
 
Donors are expected to give the Global Fund about US$11.7 billion over the three-year period, 2011-2013. This is 20% more than was pledged three years ago for the 2008-2010 period; but it is still less than the Global Fund says that it needs. 
 
More than 40 countries, together with the European Commission, faith-based organizations, private foundations and corporations attended a pledging session in New York on 5 October chaired by UN Secretary-General Ban Ki-Moon. 
 
The Fund says that its total needs over the three years 2011-13 will be between US$13 billion and US$20 billion. Over the past few months, donor government studied the Fund's needs and effectiveness and deliberated over how much each would commit to for the three years in question. They then came to New York to announce their decisions. 
 
The four countries that pledged the most for 2011-13 are the US, US$4 billion, 40% more than its pledge for the previous three years; France, US$1.48 billion, a 20% increase over the previous three years; Germany, US$822 million, no change; and Japan, US$800 million, a 28% increase. The three countries that pledged the largest percentage of their Gross National Income (GNI) are Norway and France (0.018% each) and Canada (0.013%).

AngloAmerican&rsquo;s Campaign against HIV/AIDS 
 
AngloAmerican is the largest private sector employer in South Africa and the effects of the HIV/AIDS pandemic have ravaged its business. However, over the years the situation has become more manageable. By its own estimates, approximately 12,000 of its 71,000-workforce in South Africa are HIV-positive. 
 
The group&rsquo;s medical consultant, Dr Brian Brink, who is also the Global Fund Board member for the private sector, says that the big turning point came when treatment became available and effective. In negotiations with the union, the company agreed to pay for antiretroviral treatment (ART), but the real obstacle to getting things done was the stigma, fear, and distrust surrounding the disease. Agreement with the union also included guarantees that the jobs of HIV-positive workers were safe. 
 
From the economic point of view, giving out ART free of charge also makes sense. The fully-accounted cost for treatment is US$126 per HIV-positive worker per month. Against this, the total savings from reduced absenteeism and declining health care costs, as well as reduced staff turnover and benefits payments are US$219.

News from the Swedish Workplace HIV/AIDS Programme 
 
The Swedish Workplace HIV/AIDS Programme (SWHAP) is a joint initiative by the International Council of Swedish Industry (NIR) and the Swedish Industrial and Metalworkers&rsquo; Union (IF Metall), an affiliate of the ICEM. 
 
In the latest newsletter of SWHAP, there is a report on the Swedish programme&rsquo;s Sub-regional Conference in Zimbabwe related to the development of its South Africa Peer Educators Network and new HIV/AIDS workplace programmes in cooperation with unions and Swedish companies in Southern and East Africa. The SWHAP programme in Namibia has commenced with the adoption of workplace policies by Auto Sueco, Atlas Copco, and ABB, and the training of peer educators.

The International Transport Workers&rsquo; Federation (ITF), <a href="http://www.itfglobal.org">www.itfglobal.org</a>, reports in its latest HIV/AIDS update No. 93 of 1 October on its HIV/AIDS capacity-building workshop for the Asian region and the publication of a new seafarers directory that includes information on practising safer sex and advocacy of condom use. 
 
The August Newsletter of PSUFASA (Public Sector Unions Fighting AIDS in Southern Africa) reports on the projects activities in Zimbabwe. The project, which is supported by the UK Department for International Development, is in its last year of the three-year project cycle. The project is coordinated by Tsitsi Mariwo from the PSI Southern Africa office in Johannesburg.

Five Years Ago: ICEM&rsquo;s HIV/AIDS e-Bulletin was Born 
 
The first issue of the ICEM HIV/AIDS e-bulletin was published in October 2005. In future issues, we will refer to an article from the same month five years ago and reflect on developments. 
 
In October 2005, we reported on the Global Fund replenishment meeting in London in September 2005. Governments then pledged US$3.7 billion, which was short of expectations as the total needs of the Fund had been estimated at US$7 billion. As the article on the replenishment meeting in New York above shows, the amounts pledged have trebled but so have the needs to cover all approved grants and sustain service delivery. 
 
In the October 2005 issue we wrote: &ldquo;The relatively low level of support raises questions about the G8 commitment (at the Gleneagles Summit in July 2005) to place on antiretroviral treatment by 2010 all HIV patients who need it.&rdquo; 
 
That sadly has become true. As the year 2010 comes close to ending, various estimates say that only half of the HIV positive population who needs treatment still has not access to it.

At a press conference on 8 January in Mexico City, during an ICEM North American Regional Coordinating Committee meeting there, Canadian and US ICEM leaders denounced the Mexican government of Felipe Calder&oacute;n Hinojosa&rsquo;s anti-union conduct in dissolving the Mexican Electrical Workers&rsquo; Union (SME) and its continuing persecution of the National Miners&rsquo; and Metalworkers&rsquo; Union (SNTMMSRM, or Los Mineros) and its General Secretary Napole&oacute;n G&oacute;mez Urrutia. 
 
The regional forum, led by ICEM North American Vice Presidents Ken Neumann of the United Steelworkers (USW) and Dave Coles of the Communications, Energy, Paperworkers (CEP) Union of Canada, stressed that the repressive tactics heaped upon trade unions by the Calder&oacute;n government is an affront to human rights and that these actions will receive world-wide attention.

The North American ICEM leaders also said the anti-union policies subject millions of Mexican workers to poverty. They also called attention to Mexican trade union leaders like Los Mineros&rsquo;s Juan Linares Mont&uacute;far who have been jailed for their legitimate union activities. The press conference was attended by members of Los Mineros, by several ICEM North American delegates, and by ICEM&rsquo;s Director of Industry and Corporate Affairs Joe Drexler. 
 
Napole&oacute;n G&oacute;mez himself has escaped jail in Mexico by fleeing to Canada, with the Mexican government now seeking his extradition.

Neumann, the USW&rsquo;s National Director for Canada, said that there is evidence that the charges against Napole&oacute;n G&oacute;mez are unfounded and purely an invention by the Mexican government in sync with the mining company, Grupo M&eacute;xico. &ldquo;Mexico is a NAFTA partner with Canada and the United States and we will not sit back and allow these repressions to occur,&rdquo; said Neumann. 
 
On 10 October 2009, the Calder&oacute;n government swept in with federal agents and armed police to shut down the country&rsquo;s second largest utility, the Mexico City regional Luz y Fuerza del Centro (LyFC), or Central Light and Power. Calder&oacute;n used an executive decree to merge the electric power distributor with the Federal Electricity Commission and to disband the 95-year-old and 60,000-member SME. 
 
The North American ICEM representatives condemned the government for not proceeding through legal channels if it suspected there were misdeeds inside the utility.

ICEM North Americans Use Mexican City Press to Condemn Calderón’s Labour Policies

On 14 December 2009, the Supreme Court of Namibia struck down a two-year-old government law that banned labour hire agencies. In a unanimous, five-judge decision, the court said that government must first try to regulate irregular work imposed by labour hire firms before imposing a ban on them. 
 
The court&rsquo;s decision also cited the law as unconstitutional because it fails to protect the right to practice &ldquo;occupation, trade or business.&rdquo; In 20-year-old Namibia, images of an entrenched contract labour system through apartheid are recent, and this labour issue has both the emotions and the memories to make it a leading story in all of Africa. 
 
The Supreme Court itself called it &ldquo;an emotive and politically charged&rdquo; issue, and both opponents and proponents of agency labour expressed sharp differences on the court&rsquo;s ruling. 
 
The decision was the second time within a year that the High Court in Namibia has taken up the case. It had earlier upheld the ban on labour hire agencies, contained inside Section 128 of the 2007 Labour Act. But Namibia&rsquo;s largest temporary employment agency, Africa Personnel Services (APS), appealed the constitutionality of this section of the labour code on the eve of it taking effect. The 14 December ruling overturns the High Court&rsquo;s earlier decision, and now places responsibility on the government and civil society to implement stringent regulatory measures on the operations of labour agencies. 
The head of the Namibia Employers&rsquo; Federation, Tim Parkhouse, heralded the court&rsquo;s decision, calling it an investment attraction.

But the National Union of Namibian Workers (NUNW) reacted angrily to the court&rsquo;s decision, while Minister of Labour and Social Welfare, Immanuel Ngatjizeko, said that although the government must abide by the decision, he pledged the government of President Hifikepunye Pohamba will not allow the labour-hire system to continue in its current form. 
 
Ngatjiseko, in a Windhoek newspaper, said: &ldquo;It is ironic that a provision of the Namibia Constitution that was intended to eradicate apartheid practices that subjected black workers to the injustice and humiliation of job reservation, influx control and the like has now been interpreted to turn a blind eye to commercial arrangements for the rental of human labour in order to avoid the protections afforded to workers by the labour laws.&rdquo; 
 
Ngatjiseko said the current system in Namibia, where labour hire firms are allowed to employ people who then provide these people to clients, is exploitative and reminiscent of the apartheid contract labour system because workers in Namibia with few or no other options for gainful employment fall into the clutches of labour agencies. 
 
The NUNW, linked in history with the ruling South West African People&rsquo;s Organisation (SWAPO) 
political party and a union itself banned in the pre-Namibia days of the 1970s and 1980s because it dared to challenge the apartheid labour system, was more blunt in its assessment of the court&rsquo;s decision. &ldquo;We firmly believe that one cannot regulate slavery and thereby give it a human face,&rdquo; said the federation.

The court&rsquo;s decision last month provoked wide opinions, proving again the intensity of the labour hire issue inside Namibia and in all of Africa. 
 
The New Era, a Windhoek publication, predicted, &ldquo;There is no denying that labour hire is a niece of the contract labour system that we have supposedly got rid, but when weak regulations are approved, the Supreme Court would be left with no choice but to stick to what is lawful on paper.&rdquo; 
 
An editorial in The Namibian, another Windhoek newspaper, stated, &ldquo;The principal of labour hire may be an important one, especially in a country with a very high unemployment rate, but it cannot be allowed to perpetuate exploitation of workers to the benefit of middlemen; to provide ways around employer adherence to the Labour Code; and to shut out unions.&rdquo; 
 
On 5 July 2007, the country&rsquo;s National Assembly passed an amendment to the labour code stating that &ldquo;no person may, for reward, employ any person with a view to making that person available to a third party to perform work for the third party.&rdquo; The law was to take effect on 1 March 2009. But on 27 February, the High Court suspended implementation of the law to hear APS&rsquo;s appeal.

Namibian Supreme Court Strikes Down Labour Hire Bill

The struggle continues for trade union rights for contract workers at Colombia&rsquo;s vast mining complex, Carbones del Cerrej&oacute;n. ICEM mining affiliate Sintracarb&oacute;n has been fighting to organize the contract workers at the mine. 
 
Following the successful organization of mechanics and machinists of the company Chaneme at Cerrej&oacute;n in November (see InBrief No. 144 <a href="/en/78-ICEM-InBrief/">here</a>), the new union Sintrachaneme was formed and recognized by Chaneme. Since, the company has refused to discuss even the slightest improvements to salaries and working conditions with either Sintrachaneme or Sintracarb&oacute;n.

A second union of contract workers under Sintracarb&oacute;n&rsquo;s guidance, Sintrans, representing transport workers of the Sotrans company, has seen that employer refuse to recognise the union or to consider any of the bus drivers&rsquo; demands. In fact, the sacking of union activists among bus drivers has brought fear and reluctance by workers to engage in union activity. 
 
Sintracarb&oacute;n, with the full support of ICEM, is focusing efforts towards the consolidation of Sintrachaneme and pressuring the mechanical maintenance contractor to accept the demands of workers. International support is important in the push for a collective agreement between Chaneme and its 300 staff, an accord that will guarantee the existence of the union. 
 
&ldquo;The Chaneme management, Carbones de Cerrej&oacute;n management, and the Colombian Ministry of Social Protection must all commit to the process,&rdquo; said Sintracarb&oacute;n representative Jaime Deluquez.

Since workers of Chaneme and Sotrans at Cerrej&oacute;n took the step to organize, they have suffered a campaign of harassment and persecution from employers. Sintracarb&oacute;n, consisting of 3,500 direct employed miners at Cerrej&oacute;n, has denounced complicity by their employer of denial of work rights by contractors, saying Carbones del Cerrej&oacute;n has &ldquo;turned a blind eye to the abuses.&rdquo; 
 
Harassment has included workers being visited at home, with threats of dismissal or offers of perks in return for loyalty to the contractors and a turn against the newly-formed unions. 
 
Cerrej&oacute;n management is also criticised by its mining workforce for applying double standards, claiming on the one hand that it respects human and trade union rights with rhetoric that it support the free association into unions of workers of contractors, while working covertly with the contractors and units of government to destroy the trade union organization process. 
 
These abuses of the right of association and collective bargaining contravene national law, the Colombian Constitution, and ILO Conventions 87 and 98, ratified by Colombia. 
 
An ICEM Project on Social Dialogue, organized by Colombian Coordinator Carlos Bustos and counting Carbones del Cerrej&oacute;n as a participant, has achieved exemplary results. The multinational companies holding stakes in one of the world&rsquo;s largest open-cast coal mining operations &ndash; Xstrata, AngloAmerican, and BHP Billiton &ndash; must now prove that a commitment to the Social Dialogue Project and to global labour standards is genuine by stepping forward to defend the rights of outsourced workers at its mining operation in La Guajira department in northeastern Colombia.

Union, Contract Workers Continue Fight for Work Rights at Cerrejón in Colombia

A 53-day strike by 1,500 leather workers in Iraq concluded successfully on 7 December 2009, after the state-run Enterprise of Leather Industries and Iraq&rsquo;s Ministry of Industry acceded to demands of workers on safety benefits. The leather workers, part of the Federation of Workers&rsquo; Councils and Unions of Iraq (FWCUI), won added payments totaling 25-30% of salaries for working in hazardous conditions. 
 
The workers&rsquo; committee, led by Sa&rsquo;ad Issa and Munadhil Atiya, displayed persistence and resolve throughout long negotiations with the state, and even after reaching a deal with state administrators in the early days of December, the strike continued for three days until all workers were paid the safety stipend in cash.

The leather workers are employed in two factories in Baghdad and a third in Al Kūfah, some 160 kilometres south of the capital city. They produce shoes, bags, and clothing items such as leather coats. The strike began in mid-October and was brought on by workers having to deal with hazardous chemicals and operate dangerous equipment. 
The leather workers&rsquo; strike served as an inspiration for 4,000 textile workers. Following the early December end of the leather strike, Baghdad-area textile workers embarked on an 18-day strike of their own and won partial safety stipends from a separate state-run enterprise inside the Ministry of Industry. 
 
&ldquo;The strike organizers showed an ability to lead and maintain a determination among the ranks that lasted for more than seven weeks,&rdquo; said FWCUI President Falah Alwan. &ldquo;We learned a valuable lesson in this strike. That lesson is not to respond to hollow promises intended to slow or extinguish the movement of workers.

&ldquo;The victory of the workers in the leather industries is the beginning of a new drive for the workers&rsquo; movement in the public sector and in all sectors.&rdquo; 
 
The strike was marked by continual dialogue with state administrators, but talks that produced only false promises and nothing substantive. Anticipating this, strike leaders engaged fellow workers to conduct constant demonstrations, marches, and public gatherings demanding safer work conditions and safety benefits. 
 
Leather workers also participated in a peaceful 6 October Baghdad manifestation, in which protestors were met by Iraqi armed troops firing rubber bullets. (See InBrief No. 143 <a href="/en/78-ICEM-InBrief/3531-Iraqi-Trade-Unionist-Murdered">here</a>.)&nbsp;In that clash, FWCUI strike leader Munadhil Atiya was beaten and then arrested for his participation. 
 
Nearly 90% of all industry in Iraq is incorporated in state hands and the country still abides by the Saddam-era Decree 150 of 1987 that prohibits independent trade unions in the public sector. Thus the need for persistent and ongoing direct action by workers is in order to gain labour rights from the al-Maliki government. The ICEM commends the leather and textile workers of the FWCUI for their heroic and historic actions in late 2009.

Safety Benefits Won by Iraqi Leather Workers after 53-Day Strike

The 20-million-member International Federation of Chemical, Energy, Mine, and General Workers&rsquo; Unions (ICEM) is demanding that the government of Bosnia-Herzegovina intervene on behalf of 1,250 workers in the northern city of Lukavac. The workers have had their pay slashed and are owed wage arrears by India-based Global Infrastructure Holdings Ltd., a subsidiary of the Ispat Group, owned by the Mittal steel-making family. 
 
The company is the minority owner but manages a coke-chemicals enterprise called Global Ispat Koksana Industtrija Lukavac (GIKIL), which sells to steel mills throughout Central Europe, Turkey, and in India. The local government of the Canton of Tuzla is majority stakeholder. 
 
In a 21 January letter to Bosnia-Herzegovina Prime Minister Mustafa Mujezinovic and to Canton of Tuzla Prime Minister Enes Mujić, ICEM General Secretary Manfred Warda &ndash; together with International Metalworkers&rsquo; Federation (IMF) General Secretary Jyrki Raina &ndash; called on both the federal government and regional government to ensure that restoration of previous pay levels dating to 2003 are restored, that wage arrears are paid, and that the governments be more vigilant on potentially serious health risks existing inside GIKIL. 
 
The ICEM, a Geneva-based global trade federation that numbers 467 affiliated trade unions in 132 countries, is pursuing justice for Lukavac workers on behalf of one of those affiliates, the Independent Trade Union of Chemistry and Non-Metal Workers of Bosnia-Herzegovina. 
 
&ldquo;The ICEM has probed Global Infrastructure Holdings, its parent, the steel-maker Ispat Group, and Pramod Mittal himself.&rdquo; said Warda. &ldquo;What we find is a history of depraved conduct placed on people in many countries and total disregard for global social standards, as well as statutes enshrined in European law.&rdquo; 
 
In Lukavac, workers have carried out lawful strikes twice in six months, laying claims to salaries owed them. Despite all workers taking membership in the union, GIKIL&rsquo;s Indian managing director, Guttupalli Jagannadham, has bypassed the union in slashing pay to 55% of previous earnings. That level is below the minimum wage standard contained in the national collective agreement for chemistry and non-metals, and amounts to just above &euro;200 per month (400 marka), putting it well under the minimum wage threshold for the sector in Bosnia-Herzegovina. 
 
Workers staged a strike from 6 January to 14 January after salaries had not been paid in October, November, and December 2009. During the strike, the October and November pay was made, but December salaries are still in remiss. A mediated agreement that ended a three-day strike in July 2009 called on GIKIL management to honour the collective agreement, and pay all wages due by 31 December 2009. 
 
The ICEM and IMF also stated concern for workers&rsquo; health at GIKIL in the letter to the Bosnia-Herzegovina government. The Independent Trade Union of Chemistry and Non-Metal Workers believes a number of workers have acute cases of cancer due to lack of safeguards around coke ovens. 
 
In the joint letter, the combined 45-million-member ICEM and IMF cautioned the government not to lose oversight over labour-management relations at GIKIL. &ldquo;We think this a mistake, considering the recent history of wage arrears, asset stripping, and general social depravation brought by Global Infrastructure Holdings.&rdquo; 
 
The ICEM cites a number of instances in the near past where Ispat and its Global Steel Holdings and Global Infrastructure Holdings subsidiaries have not met payrolls and displayed other social misconduct following privatizations and restructuring. Those cases have occurred in Nigeria, Libya, Bulgaria, as well as against Indian expatriate staff working abroad. 
 
&ldquo;We take the breach of contract, failure to engage the union in social talks, and wage issues very seriously,&rdquo; said Warda of the conflict in Lukavac. &ldquo;Either the government of Bosnia-Herzegovina corrects the wrongs imposed on workers, or we carry this dispute to different levels.&rdquo;

ICEM, IMF Decry Mittal’s Pay Delinquencies in Bosnia-Herzegovina

Nigerian workers are being victimized, while Mobil Producing Nigeria (MPN) continues to rely on expatriate workers in the Niger Delta, according to ICEM&rsquo;s two oil and gas union affiliates, PENGASSAN and NUPENG. MPN is subsidiary to the world&rsquo;s largest energy company, ExxonMobil. 
 
The two unions combined last week, 3 and 4 February, to shut down the company&rsquo;s worksites and operating facilities in a show of protest over the sacking of casual workers by Mobil&rsquo;s contractors and the company&rsquo;s failure to address those sackings with the unions. 
 
Strikes shut down MPN operations at Onne, Port Harcourt, as well at the Eket jetty and other installations in Akwa Ibom state, and protests were seen at the company&rsquo;s main export terminal, Qua Iboe, also in Akwo Ibom state. A manifestation was also made at MPN headquarters in Lagos.

Since September 2009, up to 100 Nigerian nationals have been discharged by contractors serving under MPN, which is the operating manager of oil and gas facilities along the delta in a joint venture with Nigerian National Petroleum Corp. (NNPC). The casuals were sacked because they responded to a workers&rsquo; collective voice of protest to gain fair and equitable remuneration. 
 
At PENGASSAN and NUPENG&rsquo;s joint National Executive Council meetings in mid-December, union leaders decided to take direct industrial action as reaction to unfair labour practices, illegal separation, and persistent victimization of casual workers employed in the energy sector. 
 
PENGASSAN General Secretary Bayo Olowoshile called last week&rsquo;s actions the first phase of industrial strikes against the US-based company, and promised further actions to intensify this dispute will occur if management does not stop exploitation of casual workers, as mandated under national statute and past conventions with the unions.

&ldquo;PENGASSAN restates that management of Mobil Producing Nigeria engages in medium and long-term casualisation of highly skilled, professional, and experienced nationals in core technical, engineering, administrative, and commercial operations,&rdquo; said Olowoshile, &ldquo;and this amounts to the flagrant contravention of the laws of the Federal Republic of Nigeria.&rdquo; 
 
Olowoshile added, &ldquo;The picketing of Mobil Nigeria last week will continue as long as the management is recalcitrant and until they yield to the demand of the union.&rdquo; 
 
Due to MNP&rsquo;s reluctance to address the issues of its contractors in negotiations with the unions, Nigeria&rsquo;s Ministry of Labour has intervened and the case is heading for arbitration. The ICEM supports the Nigerian unions in their direct action initiatives.
