The Thai Industrial Gases Labour Union (TIGLU), part of ICEM affiliate Petroleum and Chemicals Workers&rsquo; Federation of Thailand (PCFT), continues efforts to cement trade union rights for workers who supply industrial gases to the manufacturing and food sectors. The ICEM continues to provide support to what is a courageous and uphill struggle against intransigent employers. 
 
The union is currently engaged on two fronts with multinational companies: German-based Linde and French-based Air Liquide. At both, the union is fighting for reinstatement of workers who have been fired for exhibiting trade union activism. 
 
At Linde, TIGLU is approaching the expiration of a 21-month collective agreement at a plant in Saraburi province. That contract&rsquo;s expiry is in a week&rsquo;s time, on 21 March. Although the two sides are negotiating, proposals by the union relate to information demands, hiring agency workers into full-time jobs, and retuning union activist Wasan Ruengloikham to his rightful job. Linde Thailand seeks to eliminate union involvement clauses that were successfully won in 2008.

TIGLU wants managers to utilise Linde&rsquo;s &ldquo;Golden Rule&rdquo; corporate responsibility language to address the sacking of Wasan Ruengloikham in common dialogue with the union. Ruengloikham was sacked on23 September 2010. 
 
The union is also demanding paternity leave, and full-time employment for agency workers and three-year tank-truck drivers Pornpitsanu Puenpha and Surachai Singpasta. 
 
Upon receiving the union&rsquo;s proposals, managers at the Talan plant submitted their own contract-gutting demands. Linde Thailand seeks to cancel a clause that allows union participation in disciplinary actions, and it seeks to void contract language that allows for company facilitation of six hours per year of education on workers&rsquo; rights for all staff.

At Air Liquide&rsquo;s Nong-kae plant, also in Saraburi province, one month ago five trade union leaders were given the sack over hideous &ldquo;causing disturbance&rdquo; allegations. The matter was due for a hearing at the provincial Labour Ministry on 11 March, at the request of Air Liquide&rsquo;s Nong-kae managers. But just minutes before the session was to begin, management sent a fax stating they would not attend and the five would remain discharged. 
 
The ICEM takes deep exception to this conduct. On 15 February, ICEM General Secretary Manfred Warda personally intervened with local managers, calling them out for violating Air Liquide&rsquo;s global values. Specifically, the ICEM cited Air Liquide social responsibility code that its enterprises &ldquo;commit to encouraging and respecting social dialogue&rdquo; and the &ldquo;respect for human rights and enforce respect for the dignity of their employees.&rdquo; Review the <a href="/wp-content/migration/icem/7.ICEM.Air%20Liquide.Thailand.pdf">full letter</a> here. 
 
The ICEM will continue to monitor the negotiations at Linde, as well as work to rectify Air Liquide&rsquo;s harmful social conduct in eastern Thailand.

Thai Union at Odds with Linde in Talks; Dispute Air Liquide’s Sackings

Spring sunshine shone on March 2, 2011 as an unprecedented crowd, estimated by organisers at 70, 000 people, gathered in the central Inonu Square in the old part of Nicosia and at the nearby Kyrenia Gate at the north of the circular city wall. This was by far the largest of a number of recent demonstrations organised by the trade union movement in the north of this divided island. It was also largely peaceful with the police and military taking a low profile in comparison to earlier demonstrations. (See prior ICEM reports <a href="/en/78-ICEM-InBrief/4211-Northern-Cyprus-Resists-Ankara’s-Reforms-">here</a> and <a href="/en/78-ICEM-InBrief/3946-ICEM-Urges-Northern-Cyprus-Administration-End-Trade-Union-Repression">here</a>.) 
 
Unprecedented numbers? Well 70, 000 people is a truly incredible figure when you consider that the entire population of Turkish Cypriots is said to be 260,000. 
 
The protest was organised by a &ldquo;Trade Union Platform&rdquo; which brings together the entire trade union movement in the North of Cyprus and ICEM affiliate, EL-SEN, the Turkish Electricity Authority of Cyprus Workers Trade Union was at the forefront of the demonstration with almost all of their membership present, together with family members. The demonstration was called principally to fight privatisation, threatened as part of a series of austerity measures by the government, that would both attack trade union rights and enforce privatisation of the electric power company, the airport and even universities. All the trade union movement was present as were all of the opposition political parties, the latter at the rear of a demonstration that was clearly trade union organised and led.

Workers resent deep private and state sector salary cuts, which were announced last year, following negotiations between the Turkish Cypriot leadership and the government in Turkey, which bankrolls this area with about US$600 million a year. Turkish Cypriot trade unions have vowed to fight the austerity package, which includes rolling back entry level salaries by 40 per cent, taxing pensions and cutting the taxable income threshold from 17 to 10 per cent. The package also foresees selling off state enterprises to private Turkish business interests and such a massive privatisation is deeply unpopular, not only with effected trade unions and workers , but with the wider population. 
 
ICEM Energy Officer, Jim Catterson, joined our affiliate EL-SEN on the protest march and at the demonstration. The day began outside the trade union office by the head office of the electric power company where El-Sen members gathered in the morning, together with union President, Tuluy Kalyoncu and other leadership of the union. The atmosphere was both lively and friendly with many families present as well as a number of retired members &ndash; still eager to show their support for their union. Similar meetings of other unions were clearly taking place across the city.

After a series of short speeches, where ICEM solidarity on this and previous occasions were applauded, the EL-SEN contingent set out to march to the square and demonstration. Traffic was brought to a standstill but most motorists sounded their horns in support of the marchers. Gradually a whole series of marches coalesced into one and marched into the square, dominated by a massive stage, where in between speeches music was played to entertain the massive crowd. 
 
Despite this massive demonstration the government has so far refused to change policy. Indeed while the demonstration took place the government announced that the council of ministers will send the privatization proposed law to the parliament this week. 
 
The struggle continues. After the demonstration and after the government statement, the Trade Union Platform took a decision to take the next demonstration directly to the government. Unless these policies are changed, March 25 will see the next demonstration both in front of and inside the parliament building. 
 
Still facing the privatization of their employer our affiliate, EL-SEN has decided to call an indefinite strike to begin no later than 25 March, 2011. 
 
ICEM will continue to offer all support and solidarity to the brave struggle of our affiliated trade union.

The civil strike calling for control of the water supply away from the polluting company escalated into violent clashes with local police on 29 May and the police shooting at protestors, killing two.Activist leaders are now demanding justice for the police brutality and the release from jail of 24 arrested protestors. Right-wing Prime Minister Oscar Valdes has declared a 30 day state of emergency in the Espinar Province, part of the Cusco Region, thereby cutting off the right of assembly and free movement.The Tintaya copper mine, owned by Xstrata is accused of numerous community level abuses, with local people now demanding an investigation into environmental damage, and a ten-fold increase of royalties from the mine to the local authority. Locals&rsquo; blood is contaminated with mercury, arsenic and cadmium from Xstrata&rsquo;s contamination of the Salado and Cañipía rivers.Police today arrested the mayor of Espinar, Oscar Mollohuanca for his role in leading the protests against Xstrata, with national riot police storming the local municipal building in a show of brutal force by national President Hullanta Humala. Humala is growing impatient with widespread protests throughout the country as Peruvians demand a semblance of justice as mineral resources are plundered without leaving a share of the wealth.Cusco is a traditional stronghold of Humala, the protesters have accused him of abandoning his leftist roots and selling out to foreign investors.Xstrata plans a US$1.5 billion expansion of the Tintaya operations at neighbouring Antapaccay mine in August and a separate US$4.2 billion Las Bambas project in southern Peru, to mine copper concentrate and gold, silver, and molybdenum by-products.

Police Shoot Peruvian Mineworkers and Environmental Protestors

	Members of the Swiss trade union UNIA are fighting against the proposed site closure in Geneva of pharmaceuticals giant Merck Serono which threatens 1,500 jobs. Today the workers took their protest to the company headquarters in Darmstadt, Germany, and conveyed the message to management that their threat of strike action is only postponed and can be activated if the consultation period that ends 4 June fails to reach real settlement. The clear expectation is for the multinational to admit the economic viability of the Geneva site and maintain the jobs through negotiating on the proposals submitted by the union.

	The fight against closure of the Geneva site will determine the future of 2,500 jobs in Germany, and 450 in France, as the group plans massive relocation of its operations abroad. The widespread international anger at the company proposals are compounded by the excellent profit margins posted and the recent 20% increase in dividend payments to shareholders. The Merck group announced on 15 May profits of &euro;152 million in the first quarter of 2012. The ICEM strongly supports UNIA&rsquo;s calls for Merck to put &ldquo;Workers before Shareholders!&rdquo;

	Today in Darmstadt, UNIA militants rallied together with 1,000 members of the German IGBCE at the Merck Serono site, in loud demonstrations with whistles and cowbells and dressed in white overalls. With protests continuing outside the Geneva UNIA delegation of Alessandro Pelizzari and Hubert Godinot, IGBCE representative and European Works Council vice-president Iris G&uuml;rtler met with Dietmar Eidens and Kai Beckmann of the general management, and the chairman of the board Fran&ccedil;ois Naef. Continued disappointing attitude of management now makes renewed conflict after 4 June a real possibility, as the Geneva workforce is even prepared to make concessions on conditions and pay the company looks likely to ignore them.&nbsp;

	A key proposal of Geneva Regional Secretary of UNIA, Alessandro Pelizzari, and the members, is for a centre for biotechnology research is maintained by the company in the region, protecting at least 300 of the jobs threatened with relocation abroad.&nbsp;<a href="http://lolitaoutfits.com/Lolita-Skirts_l95">goth skirt </a>&nbsp;

Workers Across Europe Unite to Save Jobs at Merck Serono

USW Local 9700, one of the first unions to respond at the time of the 30 December lockout and representing Alcoa ABI workers at B&eacute;cancour, Qu&eacute;bec, voted unanimously to draw C$25-per-week from their paychecks, donating C$25,000 weekly to Local 9490.<img alt="" src="" style="width: 140px;height: 68px" width="390" />

	Locked-out members of Syndicat des M&eacute;tallos &nbsp;d&rsquo;Alma Local 9490, the United Steelworkers (USW), took their fight against Rio Tinto Alcan to Qu&eacute;bec&rsquo;s largest city, last Friday, 17 February, where Alcan CEO Jacynth C&ocirc;t&eacute; was part of a spurious forum on youth in employment, sponsored by the Board of Trade Metropolitan Montr&eacute;al.

	Some 200 of 780 metalworkers from Alcan&rsquo;s Alma aluminium smelter in the Saguenay-lac-Saint-Jean region, Qu&eacute;bec, boarded buses and travelled 460 kilometres to Montr&eacute;al for a noisy protest at this business luncheon, their first manifestation away from the 488,000-tonne-per-year smelter. They were joined by another 100 steelworkers from Montr&eacute;al, and some 100 college students who joined the USW rally in mocking protest to a future&nbsp;youth theme that now sees business teaming with the Liberal provincial government of Qu&eacute;bec to raise their university tuition fees.

	17 February Manifestation, Montr&eacute;al

	This &ldquo;Hot Issues@Lunch&rdquo; theme was billed to &ldquo;foster the success of the next generation of Qu&eacute;becers.&rdquo; &nbsp;&nbsp;The Syndicat des M&eacute;tallos d&rsquo;Alma found deep irony in Jacynth C&ocirc;t&eacute; participating, since Alcan in Alma is using a lock-out to replace C$36-an-hour permanent jobs with outsourced and presumably younger workers at C$16-an-hour.

	C&ocirc;t&eacute; was not expected to address the lockout at the hot-plate lunch, but when pressed by reporters on the sidelines, she called the dispute a &ldquo;regional issue&rdquo; and &ldquo;it will be settled in Saguenay-lac-Saint-Jean&rdquo; by managers who &ldquo;have my full confidence.&rdquo;

	Earlier last week, when the lockout entered week seven and with the remote mining and manufacturing region starting to feel the economic effects of a lost wage base, one such manager told Reuters he &ldquo;wouldn&rsquo;t put a timeline to (talks restarting) right now because nothing is scheduled.&rdquo;

	With aluminium prices hovering now at very low, the Alma lockout serves as a convenient strategy to restrict supply to lift prices. It also fits Rio Tinto&rsquo;s strategy of divesting and devaluing Alcan by C$8.9 billion in view of its US$39 billion purchase of the Canadian company in 2007, although the modern and high-tech tooled Alma smelter, with its low-cost hydroelectric supply, will not likely be jettisoned.

	Perhaps this should have been a more apt business theme to the Board of Trade elite last week, and it certainly best explains the anger of metalworkers and students alike gathered on the other side of the barricades. In this vein &ndash; with Rio Tinto&rsquo;s share price dropping &ndash; it is worth mentioning that C&ocirc;t&eacute; herself exhibited a timely corporate mentality last week by shedding 3,671 shares of Rio Tinto to pocket US$213,500, money not likely to find its way to Saguenay-lac-Saint-Jean.

	USW District Five Director Daniel Roy addressed the disparity between full-time, family-supporting jobs in the region to the sub-contract and lower-wage jobs that Rio Tinto is trying create with the. &ldquo;Accepting this would cause a dramatic downward spiral not only for the workers but for members of the community, which would see income, local business sales and tax revenues drop precipitously.&rdquo;

	USW Local 9490 President Marc Maltais added, &ldquo;By using subcontractors to do the work of union members, we are asked to concede on behalf of future generations. This is an attack on our children and grandchildren.&rdquo;

	The buses departed Montr&eacute;al late on Friday afternoon for the return trip to Alma, but first stopped at a plant-gate demonstration in Sorel, Qu&eacute;bec, where workers and members of ICEM-affiliated FIM-CSN (Conf&eacute;d&eacute;ration des Syndicats Nationaux) at a Rio Tinto Iron and Titanium metal powders plant lent their support. This stop again depicts the long-erected barriers between Canadian trade unions that Local 9490 is erasing inside this lockout.

	With Canada currently undergoing an unprecedented rash of corporate hostility, it is notable to witness trade unions and other groups galvanising behind victimised union workers.

	Last week, members of Canadian Auto Workers (CAW) Local 2301 at a Rio Tinto Alcan aluminium smelter in Kitimat, British Colombia, voted to take C$1-an-hour of their pay and donate it to &nbsp;Syndicat des M&eacute;tallos&nbsp; d&rsquo;Alma Local 9490. That represents C$60,000 per month.

	On 8 February, the Communications, Energy, Paperworkers (CEP) Union of Canada contributed C$25,000 to the Alma metalworkers, and a day later the Canadian Union of Public Employees (CUPE) contributed C$10,000. USW Local 9700, one of the first unions to respond at the time of the 30 December lockout and representing Alcoa ABI workers at B&eacute;cancour, Qu&eacute;bec, voted unanimously to draw C$25-per-week from their paychecks, donating C$25,000 weekly to Local 9490.

	Syndicat des M&eacute;tallos&nbsp; d&rsquo;Alma&rsquo;s&nbsp; journey to Montr&eacute;al to confront Rio Tinto Alcan CEO Jacynth C&ocirc;t&eacute; is just the first sally outward. This week Local 9490 leaders will visit Rio Tinto&rsquo;s borax miners in California, where members of ICEM affiliate International Longshore &amp; Warehouse Union (ILWU) Local 30 defended themselves courageously in a Rio Tinto-imposed lockout. And they&rsquo;ll follow that solidarity visit with to Australia to meet with unions represented Rio Tinto there.

	On March 31, a day after the ICEM North American region meets in Alma, a manifestation will occur there with scores of global trade union leaders attending. And on 1 April, a workshop will occur in Alma to verse an exact fightback strategy against Rio Tinto on the global level.&nbsp;

Locked-out Alcan Workers Take Dispute to Canadian Business Doorstep

	Job security and job creation was the foundation behind a new two-year national labour agreement between social partners in Denmark. That came together in marathon bargaining over the weekend, 11-12 February, in framework talks for 240,000 Danish manufacturing workers and 6,000 enterprises, the latter represented by Dansk Industri.

	The trade unions, led by the eight making up Co-Industri, including 3F, Dansk Metal and HK/Pivat, in concert with the Danish Confederation of Trade Unions (LO), set an agenda of wage moderation, instead focusing on winning excellent and precedent-setting job preservation protections such as training, seniority, and reduced work hours at full pay for both old and young workers.

	This industrial social accord now establishes the parameters for other work sectors. The agreement will run from 1 March 2012 to 1 March 2014. The national industrial agreement did establish minimum wage guideposts, but exact wage increases will now be negotiated at local levels and inside company agreements.

	The framework agreement grants training at full pay with business downturns and when reductions in work time occur, and it also allows older workers to reduce their working time within five years of retirement by continuing their income levels through salaries and partial pension benefits. Workers will also have the option to tap into current pension plans as a supplement to salaries.

	A key element in the new agreement is an additional &euro;.05-per-hour worked will be added to the national Industrial Training fund.

	Employee discretion in taking training options increases from two weeks to six weeks, in some cases, and full seniority is granted to workers when they are called back from lay-offs within nine months. Previously, it was six months. As well, paid sick leave occurs after six months on a job rather than the previous nine months.

	The new pact is also kinder to lower-income earners and gives better pay-outs when such workers are laid off. Parental leave was made more flexible and added pension accrual was put in place for weekend, holiday or extra work performed.

	The recommended minimum wage increase is &euro;.18-per-hour effective 1 March, and the same amount again on 1 March 2013. A pay supplement of 1.4% each year is available for performing difficult work, and apprentices, trainees and interns will get a 2.25% pay hike in each year.

	The bargaining, which began in early January, nearly reached dispute when HK/Privat , the Commercial and Clerical Workers&rsquo; Union, sought to drop the 50% benchmark regarding number of staff needed before a collective agreement takes effect. A compromise was struck that gives employers the opportunity to sign labour agreements without the 50% threshold and HK/Privat coverage also was expanded to include administrative staff working as trainees and college students.

	The agreement was widely praised in Denmark as the necessary building block to restore some 80,000 industrial and manufacturing jobs that have been lost in the country since the onset of the financial crisis.

Enlightened Industrial Labour Pact Set in Place in Denmark for 240,000 Workers

	The ICEM &ndash; along with the European Mine, Chemical, Energy, Federation (EMCEF) &ndash; will march in Rotterdam, the Netherlands, tomorrow, 16 November, in support of 5,200 British workers who are seriously threatened by Unilever with closure of a final salary pension scheme. The ICEM and EMCEF will join European workers of the world&rsquo;s third largest consumer goods company in protest at the company&rsquo;s Rotterdam headquarters.

	The message &ndash; Unilever, Don&rsquo;t Make Workers Pay for Your Profits &ndash; will specifically target Unilever CEO Paul Polman for his 2010-11 salary and bonus pay-out of &euro;8 million. Unilever is out to slash between 20-40% of pension earnings to UK workers represented by trade unions Unite the Union, GMB and the Union of Shop, Distributive and Allied Workers&rsquo; (USDAW).

	&ldquo;Executive greed and compensation must be challenged,&rdquo; stated United National Officer Jennie Formby. Polman saw a 50% increase in his total earnings from 2010 to 2011, some 285 times that of the average Unilever worker.

	The Rotterdam manifestation comes just days two weeks after Unilever posted a strong set of financial numbers in its latest results and three weeks after UK workers from several Unilever sites descended on Davos, Switzerland, where Polman served as one of the co-chairs at the World Economic Forum.

	The three British unions have engaged in two rounds of industrial actions against Unilever at 11 plants, the latest coming with 11 days of rolling strike actions that ended on 28 January. Unilever UK management did finally agree to meet with the unions on 9 February with the assistance of UK&rsquo;s Advisory, Conciliation and Mediation Services (ACAS), but the company is still adamant on closing the final salary pension scheme effective 1 July 2012.

	Unilever instead intends to implement a pension scheme based on career average earnings. Formby said Polman&rsquo;s vision of doubling Unilever&rsquo;s revenue stream over the next ten years and creating &ldquo;sustainable living&rdquo; is disingenuous in view of cutting workers&rsquo; pensions.

	Tomorrow&rsquo;s manifestation will begin at 12h00 at Unilever&rsquo;s offices at Weena 455, Rotterdam. The ICEM also will raise concerns over the 5 February closure due to a labour dispute at Unilever&rsquo;s Basamadi, Nepal, factory. The dispute at that facility, which produces Lux and Lifebuoy soaps and Pepsodent and Close-Up toothpastes, is close to a resolve this week after intervention from the Nepalese government.

Unilever Rotterdam Protest Pits Corporate Compensation vs. Workers’ Pension Cuts

Trade unionists are encouraged to apply for the Global Labour University&rsquo;s (GLU) two upcoming Masters programmes, one at the Tata Institute of Social Sciences, Mumbai, India, the other in Germany at the University of Kassel and Berlin School of Economics. Both programs begin on 1 July 2012, and have 1 March deadlines for applying. 
 
The India programme is entitled Globalisation of Labour, while the German curriculum is titled Labour Policies and Globalisation. Both are 14-week semesters of course offerings followed by an internship placement with trade unions or labour research institutes, thus offering the chance to engage inside the labour movement in different countries and at the international level. 
 
In Germany, the Hans Boeckler Foundation has extended its grant programme for Labour Policies and Globalisation programme, which grants scholarships to colleagues from EU Member States. The GLO, part of the ILO, has trained 214 trade unionists in economics and social sciences since 2004, giving young national and local trade union activists the opportunity to learn specific curriculums tailored to improve their skills at home. 
 
Course offerings are in English, and the GLU awards a limited number of scholarships to participants from developing and transition countries. Applicants must have the endorsement of a trade union to apply for a scholarship.&nbsp;
