The worst forms of trade union repression are being conducted by the authorities and business leaders of Bahrain, punishing workers for protesting and carrying out a general strike on 13-22 March 2011. The general strike led by the national trade union centre, General Federation of Bahrain Trade Unions (GFBTU), was called in support of pro-democracy protests in the Persian Gulf island-state. 
 
The crackdown was immediate, with a campaign of mass sackings, intimidation, and violence against all workers involved, although the agreement to end the strike included a promise to GFBTU, an affiliate of the International Trade Union Confederation (ITUC), by authorities that strikers would not suffer repercussions. 
 
As trade unionists around the world condemned the violent repression, the worst estimates then were that over 1,000 workers would be sacked for strike activity, including staff at Alba Aluminum Bahrain BSC, Bahrain Telecommunications Company, Gulf Air, Bahrain Airport Services, and APM Terminals Bahrain at the Khalifa Sea Port.

Now, more than 2,600 workers have been sacked for their involvement in the uprising, including over 100 government workers in recent weeks, including health, education, and municipal workers. Reacting to international pressure, the Bahraini authorities have promised the reinstatement those illegally sacked. However, GFBTU reports that only 134 workers have been reinstated, with many only brought back in return for promises never again to join political activities &ndash; or a trade union. 
 
Jailed trade unionists and others are being passed through tribunal hearings in which they are not given an opportunity to mount a defense. 
 
The global union federation for teachers, Education International (EI), has issued a new appeal to Bahraini authorities to release Jalila al-Salman and Mahdi 'Issa Mahdi Abu Dheeb, Vice-President and President of the Bahraini Teachers Association (BTA), who face trial by a military tribunal. Six members of the GFBTU Executive Board remain dismissed, as well as 44 executive board members of GFBTU-affiliated unions.

Kingdom of Bahrain’s Trade Union Repression Continues

The ruling National Party in New Zealand took a correct industrial safety decision two weeks ago when the conservative government of Prime Minister John Key authorised NZ$1.5 million annually from an existing account to create a high hazards unit in the mining, and oil and gas industries. The decision comes in the wake of the tragic Pike River coal mine deaths nine months ago, a damning indictment on National&rsquo;s business-friendly agenda of the 1990s, but the decision also comes with strong voice that more must come regarding regulations and stringent deterrents to protect all workers on the job in New Zealand. 
 
New Zealand&rsquo;s Labour Party also said more must be done, stating check inspectors must be re-established on company payrolls to ensure monitoring and compliance. The Nationals eliminated mandatory worksite safety specialists in 1992 in deregulatory measures pushed by business. 
 
The ICEM states the hazards unit is a positive step coming just after first-phase hearings of the Pike River Royal Commission finished, and commends the New Zealand government for improving industrial safety in the country. The ICEM also encourages New Zealand through the Royal Commission to examine the safety structure at Pike River, compare it with best-practice standards of the world, and then begin a process to ratify and implement the tenets inside <a href="/en/209-ILO ">ILO Convention 176</a>.

Establishment of the high hazards unit also comes a year after a government review of health and safety and environmental issues in the offshore petroleum industry. The review recommended an increase in the number of safety inspectors. 
 
The high hazards unit will have three inspectors, plus a chief inspector each in the mines and energy sector, and a support and research staff of three. In comparison, New Zealand has only two mine inspectors &ndash; one position now being vacant &ndash; and it has only a single oil and gas inspector to cover upstream production over a wide expanse. 
 
The NZ$1.5 million will be funded from a special levy that the government has collected over the years in a Health and Safety in Employment Memorandum Account. 
 
Ged O&rsquo;Connell, Assistant National Secretary of the Engineering, Printing, and Manufacturing Union (EPMU), said it was a breakthrough for the government, &ldquo;but more still needs to be done. There is the need for decent regulations and reinstatement of the check inspector role to provide the full check and balance required.&rdquo; 
 
New Zealand Council of Trade Unions (NZCTU) President Helen Kelly said first-phase Pike River testimony before the Royal Commission made it clear that stronger mine safety regulations are critical. &ldquo;We can&rsquo;t wait and risk another disaster when we already know that other measures are also necessary,&rdquo; said Kelly. 
 
Phase one of the Royal Commission&rsquo;s inquiry into the deadly string of Pike River Coal Mine explosions that took 29 lives ended on 22 July 2011. Phase two hearings will start on 5 September in Greymouth, near the Pike River mine on the South Island, and run until 23 September. Phase two will centre on time and circumstance of death for the 29, safety and rescue efforts, and site effectiveness in the horrid weeks after the 19 November 2010 initial explosion.

New Zealand Updates Energy, Mine Safety Regime

The one-million-strong metalworker federation represents 50% of all Brazilian metalworkers, and is now pushing for deserved pay increases in collective agreements across the sector.</div>

<div>Some regions have made good gains, while negotiations continue elsewhere, ahead of a 1 September deadline.</div>
The campaign in S&atilde;o Paulo State was kick-started on 21 July when 2,000 unionists of 14 trade unions manifesting in front of Industry Federation of S&atilde;o Paulo (FIESP). CNM/CUT President Paulo Cayres addressed the gathering, along with the presidents of the 14 unions, representing 250,000 workers in the state.

<div>Included in the demands is the extension of maternity leave from 120 days to 180. Other demands include: automatic increase of salary in line with inflation, increased wages, improved minimum wage, freedom of organisation in all workplaces, reduction of work week to 40 hours with no reduction in wages.</div>
Demands were delivered to the Industry Federation of the Minas Gerais region on 29 July.
Metalworkers of Sapiranga, Southern Brazil, settled on an 8% salary increase and 10% hike in the minimum wage, as well as solid improvements to social allowances, including education, child care, and pensions.

ABC regional workers in S&atilde;o Bernardo rejected an offer last Tuesday from management and issued a strike warning.
Metalworkers of Itu, Porto Feliz, Boituva, and Cabre&uacute;va, 100 kilometres west of S&atilde;o Paulo, were organising united fronts at plants from 3-10 August, ahead of difficult bargaining with management.
United in the struggle for a fair wage increase, workers in the southern city of S&atilde;o Leopoldo halted production at two large companies in the area last week. Unionists linked arms at the gates of Rossi and Taurus 05, paralysing the sites for four hours on Thursday morning, 11 August. Similar scenes occurred in neighbouring Inpel on Wednesday 10 August, where a large mobilisation caused a one-and-a-half hour work stoppage.

CNM/CUT in Brazil Mobilises Campaign for Salary Gains

The ICEM joins the wide condemnation of the Malawi government&rsquo;s vicious crackdown on human and trade union rights. A raft of recent legislative changes has systematically curtailed civil liberties, freedom of the press, and increased impunity of government agencies and officials. 
 
In the African nation, Section 46 of the Penal Code was amended, allowing the Minister of Information to ban publications which are deemed to be contrary to the public interest. The Civil Procedure Bill was also amended, denying plaintiffs the right to instant relief when their rights are under threat by a government agency or officer. This latter amendment also allows police to search any house without a search warrant.</div>

<div>Civil society groups have given President Mutharika until 17 August to respond to their grievances. &quot;If nothing happens, the nation will hear from us,&quot; stated Robert Mkwezalamba, General Secretary of the Malawi Congress of Trade Unions (MCTU), referring to a petition of grievances submitted to the President. 
 
Nationwide popular protests on 20 July were brutally repressed by shocking police violence, leaving 19 people dead including a 13-year-old boy. The violence used by the Malawi government has been widely condemned, and attention is now on Mutharika&rsquo;s regime to peacefully reach agreement with protest groups, and reverse the country&rsquo;s archaic legislation.

Campaign to Halt the Bloody Repression of Malawi Trade Unionists

Swiss trade union UNIA has achieved significant steps in the campaign to save the jobs of 470 workers at Swissmetal, a company on the verge of bankruptcy. The first victory was ensuring all staff received salary payments for the month of July. This was achieved through pressure on Switzerland&rsquo;s Secretary of State for the Economy, and on the cantonal governments of Soleure and Berne.
The federal, cantonal governments and UNIA provided the CHF 2 million to meet July&rsquo;s payroll. Swissmetal no longer has the liquidity to pay wages. UNIA provided the majority of the payment, approximately 70%.
<div>This payment means that the possibility still exists that the two Swiss operations of the company still might be purchased by French-based Le Bronze Industriel SA, a manufacturer of bronze and copper electrodes.</div>

Another major step UNIA in trying to save Swissmetal jobs came when the Swiss national union succeeded in pressuring bank BNP Paribas &ndash; a creditor of Swissmetal that is owed CHF 20 million &ndash; to release the company&rsquo;s metal inventories, which the bank blocked at the two sites.
<div>On 8 August, UNIA and workers at the main facility in Dornach held a symbolic manifestation at the Basle branch of BNP Paribas, urging the bank to lift the blockade of raw metal stock. Hundreds of workers rallied under the slogan, &ldquo;You occupy our warehouse, we occupy your bank!&rdquo; The occupation of the bank proved successful.</div>

<div>While work did re-start at the other plant, in Reconvilier, on 8 August, all attention today is on the Dornach site, where production must restart immediately. This depends on Swissmetal agreeing to operate and deal with pending orders before buyers look elsewhere. Reopening of operations in the immediate term would ensure Swissmetal&rsquo;s ability to pay wages for August.</div>

<div>As sale negotiations continue, redundancies are not necessary at this stage, and will be bitterly opposed.</div>

<div>UNIA underlines the vital importance that the cantonal governments of Soleure and Bern have. They have a duty to prevent the massive dismantling of operations and stop closure of the factories.</div>

Uncertainty Continues for Swissmetal Workers

The 55-week lockout by US manufacturing and technology company Honeywell Inc. on 228 unionised workers appears to be over. United Steelworkers (USW) Local 7-669 in Metropolis, Illinois, and the US company came to tentative terms for a new three-year contract on 20 July, which likely sets in motion a return to work for USW members beginning on 15 August if union members ratify the tentative accord next week. 
 
The workers convert yellow-cake uranium into uranium hexafluoride (UF6), which is used in nuclear fuel enrichment. USW Local 7-669 members have been locked off their jobs since 28 June 2010 and in the weeks following, Honeywell inexplicably re-started operations at a worksite utilising dangerous chemicals with inexperienced replacement workers. 
 
Local 7-669 President Darrell Lillie said the union is currently in the process of sorting out job re-classifications; Honeywell has created 21 new jobs and with the union retaining its seniority provisions in the tentative new agreement, job scheduling and job bidding must take place for returning workers.

Lillie said that should be complete today and the union will conduct an explanation meeting of the new contract early next week, with voting on the tentative agreement expected to occur by mid-week. 
 
&ldquo;Overall, we&rsquo;re not entirely happy with the proposed contract but we are glad that several of the key issues that the company was trying to take from us will remain in place,&rdquo; said Lillie. &ldquo;We preserved most provisions that are at the heart of what trade unionists value.&rdquo; 
 
Those provisions include the seniority provisions, which allow senior-most workers to accept more favourable jobs when they become open; retention of a defined benefit pension plan for existing workers; retiree medical care under that same pension scheme; and retention of overtime pay for time work after eight and 12 hours per day. Honeywell workers in Metropolis work both eight- and 12-hour work shifts. 
 
Another important provision kept by workers was time-and-a-half pay on the sixth consecutive day in a week worked, and double-time for the seventh. (See <a href="/en/78-ICEM-InBrief/4538-Honeywell-Threatens-Safety-by-Extending-Lockout-of-USW-Members-">ICEM news piece</a> from earlier this month.) 
 
Regarding wages, the proposal contains no increase for the first year of the contract, 1% effective 15 August 2012, and 2% due on 15 August 2013. It should be noted that at the outset of the lockout, Local 7-669 proposed a freeze on wages and continuation of all terms and conditions from a previous three-year contract, but the company was set on gutting many benefits and union-protection provisions. 
 
In the proposed agreement, new hires will fall into an equity fund scheme rather than the defined-benefit AlliedSignal Pension Benefit Thrift Fund, and workers on leave under the US Family and Medical Leave Act must take vacation time concurrently. A handful of janitorial and laundry jobs will be contracted out, and more worrisome in such a dangerous worksite, a single safety operator job will be outsourced. That position is responsible for maintaining all safety equipment throughout the plant, such as fire extinguishers, emergency breathing devices and other safety equipment. 
 
Lillie said 150 workers will return to training and re-orientation as mandated by the US Nuclear Regulatory Commission on 15 August, 40 workers two weeks later, and the remainder two weeks after that. The unionised workforce will number about 220 workers when the experienced and qualified USW members are&nbsp;fully back to work.&nbsp; 
 
&ldquo;Local 7-669 is highly appreciative of the tremendous support we have received from trade unions, those in the community and others throughout this long lockout,&rdquo; said Lillie. &ldquo;The donations, the international support, and the recognition by many here and abroad on what we were up against will never be forgotten.&rdquo;

USW Union at Honeywell Reaches Tentative Labour Agreement

Some 10,000 workers and citizens from every part of Korea participated across the night of 9-10 July in the &quot;Hope Bus&quot; march to the Hanjin shipyards in Korea to protest against dismissals in breach of contract and precarious work, and to make a solidarity visit to hunger-striking protester Kim Jinsuk. After a culture festival at Busan, the participants started a candlelight march to the shipyards. One kilometre from the yard riot police blocked the road and opened fire on marchers with water cannons and liquid tear gas. 
 
Kim Jinsuk has been denied access to medical treatment since 5 July, when her doctor was physically prevented from seeing her. The company has also stopped her from getting necessities and a recharged mobile phone.

The president of a national trade union centre, the Korean Confederation of Trade Unions (KCTU), planned on taking part in the hunger strike on 13 July to call on the Hanjin Corporation to bargain in good faith. 
 
The Korean Metal Workers' Union (KMWU) will hold a press conference on 14 July to announce protest letters to the Korean president Lee Myung-bak to the press. 
 
The International Metalworkers&rsquo; Federation (IMF) sent a letter to the Korean president on 4 July, calling for the Korean government to stop all violence against the workers at Hanjin Heavy Industries shipyard and Yuseong Piston Ring factories, to push the companies to start collective bargaining and lift the lock-out, stop the persecution of union officials, members and sympathizers, and to respect the ILO Conventions on freedom of association and the right to collective bargaining.

Korean Metal Workers’ Continue Struggle at Hanjin Shipyards

ICEM Belgian affiliate Centrale G&eacute;n&eacute;rale-FGTB and the chemicals company Clariant made temporary peace over the weekend in a pitched industrial strike by blue-collar workers in Louvain-la-Neuve. In weekend talks between the union and Clariant Benelux, the blue-collar workforce accepted reinstatement of one of two discharged shop stewards and resumption of social dialogue based on trade union rights and safeguards of freedoms, said the FGTB. 
 
Mohamed Loukili and Kemal Bennaceur were sacked by Clariant on 27 July for faithfully carrying out union responsibilities inside the workplace. This weekend&rsquo;s negotiations won reinstatement for Loukili, while Bennaceur decided earlier to accept a pay-out package from Clariant and depart the company.

A 17 August strike manifestation at Clariant plant gates in Louvain-la-Neuve saw 200 workers and supporters call on Clariant to reverse the anti-social sackings. Three days before the annual summer shut-down, managers announced dismissal of the two union representatives. That caused a strike by the entire 45-worker blue-collar unit, a strike that threatened the safety of some 100 white-collar staff when work resumed last week. 
 
The ICEM congratulates the FGTB on winning this important union rights test, and notes it is the second time in a month that Belgium&rsquo;s Socialist Union has won reinstatement rights for sacked job leaders. It happened at Belgian Refining Corp. (BRC), near the Port of Antwerp, when two union delegates were reinstated through dialogue on 15 July between FGTB-ABVV and BRC managers. Union Rep at Clariant in Belgium Reinstated

Jack Layton, the soul of a progressive Canada and leader of the NDP, passed away Monday, 22 August, of cancer. For the past decade and more, Layton has led a populist surge in Canada that has given NDP, the party of fairness and justice, the official opposition stamp &ndash; since May 2011 &ndash; to the ruling neo-liberal Tories. Layton was 61. 
 
Layton had recently been diagnosed with his second bout against cancer. He died at 4h45 on 22 August in his home and surrounded by his family. 
 
Layton&rsquo;s energy and conviction inspired ordinary Canadians and statements on his passing testified to that. Statements by North American unions said Layton&rsquo;s inspiration, ideas, and vision must push faster forward. 
 
In a statement to Canadian unions, the ICEM said, &ldquo;What happens in Canada has global significance&rdquo; (see full <a href="/wp-content/migration/icem/100.ICEM.Jack%20Layton.Canada.23August.pdf">ICEM letter</a>). The ICEM remembers Layton as a courageous fighter for social justice, depicted best in his own words on the labour strife brought by Vale, the Brazilian mining giant, or to the Mexican government on its union smashing. 
 
In Sudbury at the beginning of a bitter year-long strike Vale provoked against Canadian living standards, Layton stood among thousands of miners, and emphatically said, &ldquo;They cannot take away what working people have built over generations in this country, or this town.&rdquo;

Toronto: Tributes to Jack Layton
In 2009, Layton was part a global labour mission to Mexico sponsored by the ICEM and International Metalworkers&rsquo; Federation (IMF). He accurately summarised the full trade union climate in Mexico: &ldquo;We made it clear that the government&rsquo;s interference in union governance, it&rsquo;s jailing of union leaders and freezing union bank accounts, declaring strikes illegal and failing to prosecute the killers of union leaders, are serious and unacceptable violations of basic human rights.&rdquo; 
Dave Coles, President of the Communications, Energy, Paperworkers (CEP) of Canada said: &ldquo;I knew Jack Layton as a principled social democrat who was utterly committed to social justice and peace. Thousands of our members knew Jack by his first name, as a leader who had reached out to them in their workplaces and communities. Jack Layton paid attention to our members&rsquo; deepest concerns and gave them unqualified support in their struggles.&rdquo; 
Ken Neumann, Canadian National Director of the Untied Steelworkers (USW), said: &ldquo;Jack reawakened Canadians to the reality that government can &ndash; and must &ndash; play a positive role in ensuring the economic and social wellbeing of its citizens. Steelworkers will help lead the way in honouring Jack&rsquo;s legacy by carrying on his fight to build a better Canada and a better world.&rdquo; 
Ken Lewenza, President of the Canadian Auto Workers (CAW) said in a message to the NDP: &ldquo;At Jack&rsquo;s passing, your voice of conscience is needed more than ever. Your efforts can and will make a difference in the direction of our country.&rdquo; The CAW also said in mourning, progressive Canada must reflect on Jack&rsquo;s vision for Canada &ldquo;and how we can endeavour to make some of his cherished ideas a reality.&rdquo; 
 
Jack Layton was born in Hudson, Quebec, into a political family. He entered public service in 1982 as a member of the Toronto City Council after leaving academia. His years on the city council of Canada&rsquo;s largest city were marked by many accomplishments concerning poverty, homelessness, public transport, and environmental stewardship. In 2004, Layton won election to the federal Parliament as NDP leader, and the NDP has grown steadily to where it now is the logical political choice for a social Canada, and beyond. The ICEM letter said Jack stood always for workers, the poor, the disenfranchised. 
 
Jack is survived by his wife, Olivia, his dedicated political partner; and a son, Mike, a member of the Toronto City Council, and daughter, Sarah, who works for the Stephen Lewis Foundation.

ICEM Mourns Passing of Canadian Stalwart Jack Layton

A two-year campaign by the Building &amp; Wood Workers&rsquo; International (BWI), it&rsquo;s North American affiliate, the International Association of Machinists (IAM), and BWI affiliate GS of Sweden paid off on 27 July when union representation was won at IKEA&rsquo;s only Swedwood manufacturing plant in the US. 
 
Workers at the three-year-old plant in Danville, Virginia, voted by an astonishing 76% affirmation, 221-69, to have IAM represent them in a US government-supervised election. The vote brings relief to an agonising and frustrating period for BWI, IAM and GS, which sought to make IKEA live up to commitments in a Global Framework Agreement (GFA) that calls for voluntary recognition and good faith-dialogue when workers indicate a desire for a union. 
 
Swedwood is 100% owned by IKEA and exclusively provides home furnishings to the retailer. The Danville factory provides many of the furnishings to IKEA&rsquo;s 37 US stores.

Senior managers at IKEA rebuffed BWI at several junctures in the Global union Federation&rsquo;s efforts to get the company to acknowledge and correct anti-social practices at Swedwood in Danville. That included health and safety deficiencies, mandatory overtime at risk of punishment &ndash; something that is contrary to IKEA&rsquo;s written code of conduct &ndash; and failure to allow shop-flow freedom of association as outlined in the GFA. The only choice left was the government-mandated union certification process through the US National Labor Relations Board. 
 
Swedwood workers at Danville, to their credit, responded resoundingly last week. 
 
&ldquo;Despite the &lsquo;persuasive&rsquo; tactics and intervention strategies that the Swedwood management installed throughout the entire union election process, and to be frank, prior to that, the workers at Swedwood have emphatically said yes to the union,&rdquo; stated BWI General Secretary Ambet Yuson.

Swedwood must now reach a first collective labour agreement in Danville, one that must come without stalling and through honest negotiating that meets the social needs of workers. 
 
The Director of IAM&rsquo;s Woodworking Department, Bill Street, said it best: &ldquo;IKEA, you have a choice to make. You can recognise what we&rsquo;ve been saying over the past is in fact true and then begin bargaining with us in good faith, or you can continue this fight.&rdquo;
